क्रमांक न्या्यस्था-१२२१/६०१/प्र.क्र.१४९/का्या्गसन-११.—महाराष्ट्र ददवाणी न्या्याल्य अदिदन्यम (१८६९ चा १४) ्याच्या कलम १४ व १९ ्यांद्ारे प्रदान केलेल्या अदिकारांचा, आदण ्याबाबतीत त्यास सम्थ्ग करणाऱ्या इतर सव्ग अदिकारांचा वापर करून, आदण त्याबाबतीत ्यापूववी काढलेल्या इतर सव्ग अदिसूचना, जे्थवर त्या सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांशी संबंदित असतील ते्थवर, त्यांमध्ये अंशतः फेरबदल करून, महाराष्ट्र शासन, ्याद्ारे असे दनदेश देत आहे की, ददनांक १४ जानेवारी, २०२३ पासून,—
(क) सातारा महसुली दजल्ह्ातील वाई ्ये्थे एक न्या्याल्य असेल आदण अदतररक्त दजल्हा न्या्यािीश हे, उक्त न्या्याल्याचे पीठासीन अदिकारी असतील;
(ख) उक्त न्या्याल्याच्या सव्गसािारण अदिकाररतेच्या स्थादनक सीमा, सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांमध्ये समादवष्ट्ट असलेल्या क्ेत्ांशी समव्यापी असतील आदण त्या स्थादनक सीमांमध्ये त्या महसुली तालुक्यांना दमळून बनलेल्या क्ेत्ांचा समावेश असेल; आदण

भाग चार-अ-५–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जानेवारी १२, २०२३/पौर् २२, शके १९४४ (ग) उक्त अदिदन्यमाच्या कलम ९ अन्व्ये प्रिान दजल्हा न्या्यािीश ्यांच्याकडे दनदहत असलेल्या अदिकारांखेरीज, आदण त्यास ्योग्य वा्टतील अशी प्रकरणे, अदतररक्त दजल्हा न्या्यािीश, वाई, ्यांच्याकडे सोपदवण्याच्या दकंवा स्वतःहून दनकाली काढण्याच्या दकंवा सक्म अदिकाररतेच्या इतर न्या्याल्याकडे सोपदवण्याच्या त्याच्या अदिकारांखेरीज, सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांच्या बाबतीत, प्रिान दजल्हा न्या्यािीश, सातारा ्यांचे सव्ग अदिकार वाई ्ये्थील उक्त अदतररक्त दजल्हा न्या्यािीशाकडे दनदहत असतील.

Maharashtra Civil Courts aCt.
No. Nyayastha 1221/601/C.R.149/DESK-11.—In exercise of the powers conferred by sections 14 and 19 of the Maharashtra Civil Courts Act (XIV of 1869), and of all other powers enabling it in this behalf, and in partial modification of all the other earlier notifications issued in that behalf, in so far as they relate to the revenue Tehsils of Wai, Khandala and Mahabaleshwar in Satara District, the Government of Maharashtra, hereby directs that, with effect from 14th January, 2023,—
(a) there shall be a Court at Wai, in the revenue District of Satara and the said Court shall be presided over by the Additional District Judge;
(b) the local limits of the ordinary jurisdiction of the said Court shall be co-extensive with and cover the areas comprising the revenue Tehsils of Wai, Khandala and Mahabaleshwar in Satara District; and
(c) all the powers of the Principal District Judge, Satara in respect of the revenue Tehsils of Wai, Khandala and Mahabaleshwar in Satara District shall vest in the said Additional District Judge, Wai, except those vested in the Principal District Judge under section 9 of the said Act and except his power to assign to the Additional District Judge, at Wai or withdraw unto himself or to assign to another Court of competent jurisdiction, such matters as he thinks fit.

(ख) ददवाणी न्या्यािीश, वररष्टठ स्तर हे उक्त न्या्याल्याचे पीठासीन अदिकारी असतील आदण ते वाई ्ये्थे त्यांचे न्या्याल्य भरवतील; आदण
(ग) ददवाणी न्या्यािीश, वररष्टठ स्तर, वाई ्यांच्या सव्गसािारण अदिकाररतेच्या स्थादनक सीमांमध्ये, सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांचा समावेश असेल आदण जे तालुके ्यापूववी ददवाणी न्या्यािीश, वररष्टठ स्तर, सातारा ्यांच्या सव्गसािारण अदिकाररतेच्या स्थादनक सीमांमध्ये समादवष्ट्ट होते ते तालुके त्यामिून वगळण्यात ्येतील.

No. Nyayastha 1221/601/C.R.149/DESK-11.—In exercise of the powers conferred by sections 21, 22A and 23 of the Maharashtra Civil Courts Act (XIV of 1869), and of all other powers enabling it in this behalf, and in partial modification of all earlier notifications issued in that behalf, in so far as they relate to the revenue Tehsils of Wai, Khandala and Mahabaleshwar in Satara District the Government of Maharashtra hereby directs that, with effect from 14th January 2023,—
(a) there shall be a Civil Court at Wai, sub-ordinate to the District Court, Satara in Satara District ;
(b) the said Court shall be presided over by the Civil Judge, Senior Division, who shall hold his Court at Wai in Satara District ; and
(c) the local limits of the ordinary jurisdiction of the Civil Judge, Senior Division, Wai, shall comprise of the local limits of the revenue Tehsils of Wai, Khandala and Mahabaleshwar in Satara District and the said Tehsils which were heretofore included within the local limits of the ordinary jurisdiction of the Civil Judge, Senior Division, Satara shall be excluded therefrom.

क्रमांक न्या्यस्था- १२२१/६०१/प्र.क्र.१४९/का्या्गसन-११.—फौजदारी प्रदक्र्या संदहता,१९७३ (१९७४ चा २) हा महाराष्ट्र राज्यास लागू असताना, त्याच्या कलम ७ च्या पो्ट-कलम (३) तसेच कलम ९ ्यांव्दारे प्रदान केलेल्या अदिकारांचा, आदण ्याबाबतीत त्यास सम्थ्ग करणाऱ्या इतर सव्ग अदिकारांचा वापर करून; आदण त्याबाबतीत, ्यापूववी काढलेल्या सव्ग अदिसूचना, जे्थवर त्या सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांशी संबंदित असतील ते्थवर, त्यांमध्ये अंशतः फेरबदल करून, महाराष्ट्र शासन, मु ंबई ्ये्थे अदिकाररता असणाऱ्या उच्च न्या्याल्याशी दवचारदवदनम्य केल्यानंतर, ्याद्ारे, १४ जानेवारी २०२३ पासून, सातारा दजल्ह्ातील वाई, खंडाळा व महाबळेश्वर ्या महसुली तालुक्यांसाठी सत् उपदवभागाची दनदम्गती करीत आहे आदण उक्त सत् दवभागाच्या सीमांतग्गत उद्भवणाऱ्या प्रकरणांची न्या्यचौकशी करण्यासाठी वाई ्ये्थे सत् न्या्याल्याची दनदम्गती करीत आहे, ज्याचे पीठासीन अदिकारी अदतररक्त सत् न्या्यािीश असतील. सत् न्या्यािीश, सातारा हे, वाई ्ये्थील सत् उपदवभागाचे देखील सत् न्या्यािीश असतील, आदण त्यास, उक्त सत् उपदवभागाकडील प्रकरणे स्वत: दनकाली काढण्याचे दकंवा सक्म अदिकाररता असलेल्या इतर कोणत्याही न्या्याल्याकडे सोपदवण्याचे, अ्थवा त्यास ्योग्य वा्टतील अशी कोणतीही प्रकरणे, वाई ्ये्थील अदतररक्त सत् न्या्यािीशाकडे सोपदवण्याचे अदिकार असतील.

Code of CriMinal ProCedure, 1973.
No. Nyayastha-1221/601/C.R.149/DESK-11.—In exercise of the powers conferred by sub-section (3) of section 7 read with section 9 of the Code of Criminal Procedure, 1973 (2 of 1974), in its application to the State of Maharashtra, and of all other powers enabling it in this behalf, and in partial modification of all earlier notifications issued in that behalf, in so far as they relate to the revenue tehsils of Wai, Khandala and Mahabaleshwar in Satara District, the Government of Maharashtra, after consultation with the High Court of Judicature at Bombay, hereby,with effect from 14th January, 2023, creates a Sessions sub-division for the revenue tehsils of Wai, Khandala and Mahabaleshwar in Satara District and establishes Court of Sessions at Wai to be presided over by the Additional Sessions Judge, for trial of cases arising within the limits of the said Sessions sub- division. The Sessions Judge, Satara, shall also be the Sessions Judge for the Sessions sub-division at Wai, and shall have the powers to withdraw unto himself or assign to any other Court of competent jurisdiction, the cases from the said Sessions sub-division, or to assign unto the Additional Sessions Judge at Wai, any such cases as he thinks fit.

No. Nyayastha-1221/601/C.R.149/ DESK-11.—In exercise of the powers conferred by clause (b) of section 3 of the Hindu Marriage Act, 1955 (25 of 1955), in its application to the State of Maharashtra, and of all other powers enabling it in this behalf and in partial modification of all the earlier notifications issued in that behalf, in so far as they relate to the revenue tehsils of Wai, Khandala and Mahabaleshwar in Satara District, the Government of Maharashtra hereby, with effect from 14th January,2023, specifies the Court of Civil Judge, Senior Division at Wai in Satara District as having jurisdiction in respect of the matters to be dealt with under the said Act, within the local limits of ordinary jurisdiction of the Court of Civil Judge, Senior Division, Wai, established under the Maharashtra Civil Courts Act (XIV of 1869).
