महाराष्ट्र कृर्ी उत्पन्न पणन (कवकास व कवकनयमन) अकधकनयम, १९६३.

क्रमांक कृबास-०४२२/प्र.क्र.१९४/२१-स.—महाराष्ट्र कृषी उत्पन्न ्पणन (दवकास व दवदनयमन) अदिदनयम, १९६३ (१९६४ चा महा. २०) याच्या कलम ६० च्या ्पोट-कलम (१) व ्पोट-कलम (२) च्या खंड (ड) व (यु) यांद्ारे प्रदान केलेल्या अदिकारांचा आदण त्याबाबतीत त्यास समर्ग करणाऱ्या इतर सव्ग अदिकारांचा वा्पर करून, महाराष्ट्र कृषी उत्पन्न बाजार सदमत्या (सदमतीची दनवडणूक) दनयम, २०१७ यामध्ये आणखी सुिारणा करण्यासाठी, महाराष्ट्र शासनाने सुिारणा करण्याचे प्रस्तादवत केलेल्या दनयमांचे ्पुढील प्रारू्प, त्यामुळे बािा ्पोहचण्याचा संभव असलेल्या सव्ग व्यक्तींच्या मादहतीकररता, उक्त अदिदनयमाच्या कलम ६० च्या ्पोट-कलम (३) द्ारे आवश्यक असल्याप्रमाणे, याद्ारे, प्रदसद्ध करण्यात येत आहे; आदण याद्ारे अशी नोटीस देण्यात येत आहे की, उक्त प्रारू्प, महाराष्ट्र शासनाकडून ददनांक ३१ जानेवारी २०२३ रोजी दकंवा त्यानंतर दवचारात घेण्यात येईल.

२. उ्परोक्त ददनांकास दकंवा त्या्पूववी, उक्त प्रारू्पाच्या बाबतीत, कोणत्याही व्यक्तीकडून संचालक (्पणन), ्पणन संचालनालय, महाराष्ट्र राज्य, नवीन मध्यवतवी इमारत, ३रा मजला, ्पुणे-४११ ००१ यांच्याकडे ज्या कोणत्याही हरकती दकंवा सूचना प्राप्त होतील त्या शासनाकडून दवचारात घेण्यात येतील.

प्ारुप कनयम

क्रमांक कृबास-०४२२/प्र.क्र.१९४/२१-स.- महाराष्ट्र कृषी उत्पन्न ्पणन (दवकास व दवदनयमन) अदिदनयम, १९६३ (१९६४ चा महा. २०) याच्या कलम ६० च्या ्पोट-कलम (१) व ्पोट-कलम (२) च्या खंड (ड) व (यु) यांद्ारे प्रदान केलेल्या अदिकारांचा आदण त्याबाबतीत त्यास समर्ग करणाऱ्या इतर सव्ग अदिकारांचा वा्पर करून, महाराष्ट्र शासन, याद्ारे महाराष्ट्र कृषी उत्पन्न बाजार सदमत्या (सदमतीची दनवडणूक) दनयम, २०१७ यामध्ये सुिारणा करीत आहे :-

१. या दनयमांस, महाराष्ट्र कृषी उत्पन्न बाजार सदमत्या (सदमतीची दनवडणूक) (्पदहली सुिारणा) दनयम, २०२३, असे म्हणावे.

(१)

भाग चार-ब-१२–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जानेवारी १६, २०२३/पौर् २६, शके १९४४ २. मुख्य दनयमाच्या दनयम ७ मध्ये, ्पोट-दनयम (४) नंतर, ्पुढील ्पोट-दनयम (५) समादवष्टट करण्यात येईल:-

"(५) कृषी ्पतसंस्र्ा, बहुउद्ेशीय सहकारी संस्र्ा व ग्ाम्पंचायती यांच्या नव्याने दनवडून आलेल्या सदमतीच्या बाबतीत दकंवा जेव्हा कृषी ्पतसंस्र्ा, बहुउद्ेशीय सहकारी संस्र्ा व ग्ाम्पंचायती यांनी व्यवस्र्ा्पन सदमतीचे सदस्य स्वीकृत केले असेल त्याबाबतीत, ्पोट-दनयम (३) अन्वये प्रदसद्ध केलेल्या मतदारांच्या अंदतम यादीमध्ये ज्या व्यक्तीचे नाव समादवष्टट नाही अशा कोणत्याही व्यक्तीस, कोणत्याही वेळी ्परंतु, नामदनददेशन करण्याच्या शेवटच्या ददनांका्पूववी ्पाच कामकाजाच्या ददवसांच्या आत, दजल्हा दनवडणूक अदिकाऱ्याकडे अज्ग करता येईल; आदण दजल्हा दनवडणूक अदिकारी दकंवा त्याने प्रादिकृत केलेली व्यक्ती, चौकशी करील, जर दजल्हा दनवडणूक अदिकाऱ्याने प्रादिकृत केलेल्या व्यक्तीने चौकशी केली असेल त्याबाबतीत, ती व्यक्ती, चौकशीचा अहवाल दजल्हा दनवडणूक अदिकाऱ्यास सादर करील. त्यानंतर, दजल्हा दनवडणूक अदिकारी, अंदतम मतदार यादीमध्ये त्यास योग्य वाटेल असे आवश्यक ते बदल करील.".

NOTIFICATION

Maharashtra agricultural Produce Marketing (develoPMent and regulation) act, 1963.

No. KBS-0422/C.R.194/21-C.—The following draft of rules further to amend the Maharashtra Agricultural Produce Market Committee (Election to Committee) Rules, 2017, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-section (1) and clauses (d) and (u) of sub-section (2) of section 60 of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963 (Mah. XX of 1964), and of all other powers enabling it in that behalf, is hereby published, as required by sub-section (3) of section 60 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after 31st January 2023.

2. Any objections or suggestions, which may be received by the Director (Marketing), Directorate of Marketing, Maharashtra State, New Central Building, 3rd Floor, Pune 411 001, from any person with respect to the said draft on or before the aforesaid date, will be considered by the Government.

DRAFT RULES

No. KBS0422/C.R.194/21-C.—In exercise of the powers conferred by sub-section (1) and clauses (d) and (u) of sub-section (2) of section 60 of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963. (Mah. XX of 1964), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby amends the Maharashtra Agricultural Produce Market Committee (Election to Committee ) Rules, 2017 namely :—

1. These rules may be called the Maharashtra Agricultural Produce Market Committee (Election to Committee) (First Amendment) Rules, 2023.

2. In rule 7 of the principal rules, after sub-rule (4), the following sub-rule (5) shall be inserted, namely :—

"(5) In case of newly elected committee of the Agricultural Credit Societies, Multi- purpose Co-operative Societies and Village Panchayats or where due to co-option of members of the Managing Committee by the Agricultural Credit Societies, Multi- purpose Co-operative Societies and Village Panchayats, any person whose name is not entered in the final list of voters as published under sub-rule (3), may at any time but not later than five working days before the last date of making nominations, apply to the District Election Officer; and the District Election Officer or the person authorized by him, shall conduct an inquiry, in case the inquiry conduct by the person authorized by the District Election Officer in this behalf, he shall submit the report of inquiry to the District Election Officer. Thereafter, the District Election Officer, as he deems fit, may make necessary changes in the final voter list."
