ज्याअथीर्, महानगरपािलक(cid:577)चे पिरपतर्क कर्. बीएमसी / एडीएमएन / ३, िदनांक ७ एिपर्ल २०२२ नुसार अ(cid:464)ावत सुधािरत मु ंबई महानगरपािलका अिधिनयम, १८८८ च्या कलम ६ क (१) अन्वये महानगरपािलका आिण महानगरपािलक(cid:577)च्या इतर पर्ािधकरणांचे सवर् अिधकार आता पर्शासकांकड(cid:578) िनिहत आहेत.

त्याअथीर्, पर्शासक (महानगरपािलका) यांचा ठराव कर्. ५०, िद. िडस(cid:606)बर २०२२ च्या आदेशान्वये 'ई' िवभागातील िड(cid:271)हीजन माझगांव येथील भू. कर्. ५९० वरील महारा(cid:273)टर् पर्ादेिशक व नगररचना अिधिनयम, १९६६ कलम ३१(१) नुसार मंजूर िवकास आराखडा, २०३४ मध्ये फ(cid:577)रबदल करण्याच्या पर्(cid:274)तावाची कायर्वाही सुरू करण्याबाबत आिण महारा(cid:273)टर् पर्ादेिशक िनयोजन व नगररचना अिधिनयम, १९६६ च्या कलम ३७ (२) नुसार फ(cid:577)रबदल पर्(cid:274)तावास महारा(cid:273)टर् शासनाची अंितम मंजुरी घेण्याकिरता नगर िवकास िवभाग खात्याशी संपक(cid:594) साधण्याची मंजुरी िदली आहे ;

ज्याअथीर्, महारा(cid:273)टर् पर्ादेिशक व नगररचना अिधिनयम, १९६६ (यापुढ(cid:578) " उक्त अिधिनयम " असा उ(cid:269)लेख करणेत आलेला आहे) चे कलम ३१, पोट-कलम (१) अन्वये पर्ा(cid:262)त अिधकारांचा वापर करून राज्य शासनाने अिधसूचना कर्. टीपीबी ४३१७/६२९/पर्. कर्.११८/२०१७/िव.यो./निव-११, िदनांक ८ मे २०१८ (यापुढ(cid:578) "उक्त अिधसूचना" असा उ(cid:269)लेख करणेत आलेला आहे) (cid:465)ारे बृहन्मु ंबई पर्ारूप िवकास योजना - २०३४ (यापुढ(cid:578) " उक्त िवकास योजना" असा उ(cid:269)लेख करणेत आलेला आहे) सह िवकास िनयंतर्ण व पर्ोत्साहन िनयमावली - २०३४ ला उक्त अिधसूचनेसोबतचे पिरिश(cid:273)ट-ब मध्ये दशर्िवलेले सारभूत (cid:274)वरुपाचे फ(cid:577)रबदल (ई.पी.) वगळ(cid:564)न उक्त अिधसूचनेसोबतचे पिरिश(cid:273)ट-अ मध्ये दशर्िवले(cid:269)या सुधारणेसह मंजुरी िदली आहे ;

आिण ज्याअथीर्, त्यानंतर शासनाने उक्त अिधसूचनेस समकर्मांकाचे शुि(cid:460)पतर्क व पुरकपतर् िदनांक २९ जून २०१८ रोजी पािरत क(cid:577)ले असून सदर शुि(cid:460)पतर्क व पुरकपतर् महारा(cid:273)टर् शासनाच्या राजपतर्ात िदनांक ३० जून २०१८ रोजी पर्िस(cid:460) करण्यात आले आहे ;

आिण ज्याअथीर्, शासनाने उक्त अिधसूचनेस समकर्मांकाचे शुि(cid:460)पतर्क िदनांक २२ जून २०१८ रोजी िनगर्िमत क(cid:577)ले असून त्यानुसार उक्त िवकास योजना िदनांक १ स(cid:262)ट(cid:608)बर २०१८ पासून अंमलात आली आहे ;

शासन अिधसुचना िदनांक ८ मे २०१८ नुसार न.भू.कर्. ५९० हा सारभुत (cid:274)वरूपाचे पर्(cid:274)तािवत फ(cid:577)रबदल ( EP - E42) मध्ये समािव(cid:273)ट करण्यात आला होता. तसेच सदर भूभागावर, सदर अिधसूचनेपर्माणे उ(cid:464)ान / बगीचा (EOS1.5) + पर्ाणीसंगर्हालय (EOS2.3) हे नामिनद(cid:616)शन दशर्िवण्यात आले होते व सदर अिधसूचनेसोबत पर्िस(cid:460) करण्यात आले(cid:269)या नकाशानुसार सदर भूभागावर उ(cid:464)ान / बगीचा (ROS1.5) + पर्ाणीसंगर्हालय (ROS2.3) चे आरक्षण दशर्िवण्यात आले होते.

तद्नंतर, सारभूत (cid:274)वरुपाचे फ(cid:577)रबदल कर्. EP-E42, शासन नगर िवकास िवभागाकडील अिधसुचना कर्. टीपीबी- ४३२०/पर्. कर्.१३५/२०२० /निव-११, िदनांक १२ स(cid:262)ट(cid:608)बर २०२२ अन्वये मंजूर करण्यात आला होता. तसेच, सदर अिधसूचनेपर्माणे फ(cid:577)रबदल कर्. EP-E42 मधून न.भू.कर्. ५९० वगळण्यात आला होता. या(cid:274)तव, सदर भूभागावर अिधसुचना िदनांक ८ मे २०१८ पर्माणे नमूद क(cid:577)लेले नामिनद(cid:616)शन व सदर अिधसूचनेबरोबर पर्िस(cid:460) करण्यात आले(cid:269)या िवकास आराख(cid:454)ापर्माणे दशर्िवण्यात आलेले आरक्षण पुना(cid:274)थिपर्त करण्यात आले आहे ;

ज्याअथीर्, अवर सिचव, नगर िवकास िवभाग, महारा(cid:273)टर् शासन यांनी पतर् कर्. टीपीबी- ४३२०/ पर्.कर्.१३५/२०२२/िवयो फ(cid:577)र /निव- ११, िदनांक १६ नो(cid:271)ह(cid:606)बर २०२२ अन्वये न.भू.कर्. ५९०, माझगांव िड(cid:271)हीजन या भूभागाचे संपादन न क(cid:577)(cid:269)याचे व सदर भूभागावर वीरमाता ंबई िवकास योजना २०३४ मध्ये सदर भूभागावर दशर्िवण्यात िजजाबाई भोसले उ(cid:464)ान व पर्ाणीसंगर्हालय हे अि(cid:274)तत्वात नस(cid:269)यामुळ(cid:578), बृहन्मुमहारा(cid:273)टर् शासन राजपतर्, भाग दोन-संकीणर् सूचना व जािहराती, ५ गुरुवार ते बुधवार, जानेवारी १९-२५, २०२३/पौष २९-माघ ५, शक(cid:577) १९४४ आलेले उ(cid:464)ान / बगीचा (EOS1.5) + पर्ाणीसंगर्हालय (DOS2.3 ) चे नामिनद(cid:616)शन र(cid:459) करून सदर भूखंड रिहवास वापरात समािव(cid:273)ट करण्याबाबत, िवकास योजनेमध्ये फ(cid:577)रबदल करण्यासाठी, बृहन्मु ंबई महानगरपािलक(cid:577)ने महारा(cid:273)टर् पर्ादेिशक व नगररचना अिधिनयम, १९६६ चे कलम ३७ (१) अन्वये फ(cid:577)रबदलाची वैधािनक कायर्वाही करून फ(cid:577)रबदलाचा पर्(cid:274)ताव शासनास मंजुरीसाठी सादर करावा असे कळिवले आहे. सदर भूभागाचा तपशील खालीलपर्माणे आहे :—

आिण त्याअथीर्, उपरोक्त पिरि(cid:274)थती आिण व(cid:274)तुि(cid:274)थती िवचारात घेता आिण उक्त अिधिनयमाच्या कलम ३७ (१) अन्वये पर्ा(cid:262)त अिधकार आिण त्या संदभार्तील सवर् शक्तींचा वापर करून, बृहन्मु ंबई महानगरपािलक(cid:577)(cid:465)ारे पर्(cid:274)तािवत फ(cid:577)रबदलािवषयी उक्त अिधिनयमाच्या कलम ३७ (१) नुसार कोणत्याही (cid:271)यक्तीकड(cid:564)न हरकती / सूचना मागिवण्यासाठी तसेच संभा(cid:271)य बािधत होणा(cid:311)या (cid:271)यक्तींच्या मािहतीसाठी सदर सूचना पर्िस(cid:460) करीत आहे. मनपाकड(cid:564)न असेही कळिवण्यात येत आहे की, खालील पिरिश(cid:273)टात नमूद पर्(cid:274)तािवत फ(cid:577)रबदलािवषयी कोणत्याही हरकती / सूचना सदर सूचना पर्िस(cid:460) झा(cid:269)याच्या िदनांकापासून एक मिहन्याच्या आत लेखी (cid:274)वरुपात पर्मुख अिभयंता ( िवकास िनयोजन), बृहन्मु ंबई महानगरपािलका यांचेकड(cid:578) महानगरपािलका मुख्यालय, ५ वा मजला, िव(cid:274)तािरत इमारत, महापािलका मागर्, फोट(cid:595), मु ंबई ४०० ००१, या कायार्लयाच्या प(cid:346)यावर पाठिवण्यात या(cid:271)यात. सदरच्या कालावधीत पर्ा(cid:262)त होणा(cid:311)या हरकती / सूचना यावर उक्त अिधिनयमाच्या कलम ३७ (१) अन्वये कायर्वाही करण्यात येईल ;

पर्(cid:274)तािवत फ(cid:577)रबदल दशर्िवणारा नकाशा जनतेच्या अवलोकनासाठी खालील िठकाणी ठ(cid:578)वण्यात आला आहे :—

NOTIFICATION

No. Che. (D.P.) / City/25462, Dated 12th January 2023.

Whereas, in exercise of the powers conferred by sub section (1) and (2) of section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " MR & TP Act, 1966"), the Planning Authority may, or when so directed by the State Government shall within one month from date of such directions publish a notice inviting suggestions/ objections from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction ;

And whereas, as per circular u/No. BMC/ADMN/3, dated 7th April 2022 under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as " MMC Act, 1888") all the powers of the Corporation are now vested with the Administrator ;

And whereas, Administrator (Corporation) has accorded sanction to the proposal vide resolution No. 50, dated December, 2022, to take further action to modify the plot bearing CS No. 590 of Mazgaon Division in Sanctioned DP, 2034 to invite suggestions/ objections from general public u/s. 37(1) of MRTP Act, 1966 and approach State Govt. in Urban Development Dept. for final sanction u/s. 37(2) of MRTP Act, 1966 for modification in Sanctioned DP 2034 ;

And whereas, as per the powers conferred by sub section (1) of section 31 of the MR and TP Act, 1966, State Government has accorded sanction to the Draft Development Plan 2034 of Greater Mumbai (hereinafter referred to as " the said Development Plan") vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations, 2034 for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification ;

And whereas, thereafter Government has issued a Corrigendum and Addendum dated 29th June 2018 to the said Notification, which is published in the Government Gazette dated 30th June 2018 ;

And whereas, Government has issued a corrigendum dated 22nd June 2018 to the said Notification, as per which, the said Development Plan has came into force from 1st September 2018;

And whereas, the plot bearing CS No. 590 of Mazgaon Division was included in Excluded part (EP-E42), the Designation of Garden (EOS 1.5) + Zoo (EOS 2.3) was shown on the said plot in the said Notification dated 8th May 2018 and reservation of Garden/ Park (ROS 1.5) + Zoo (ROS 2.3) was shown on the DP plan published along with the said Notification ;

Further, said modification EP-E42 is approved by the Urban Development Department, Government of Maharashtra vide No. TPB-4320/CR-1J5/2020/UD-11, dated 12th September 2022.

The said plot is excluded from the EP-E42 as per the said notification. Hence, the Designation and Reservation shown in notification and DP plan respectively published in Government Notification dated 8th May 2018 is restored ;

And whereas, Under Secretary, Urban Development Department, Government of Maharashtra vide letter u/No. TPB-4320/135/CR 2022 / DP (Rev) UD-11 dated 16th November 2022 has directed भाग दोन (संकीणर्)–३८ महारा(cid:273)टर् शासन राजपतर्, भाग दोन-संकीणर् सूचना व जािहराती, गुरुवार ते बुधवार, जानेवारी १९-२५, २०२३/पौष २९-माघ ५, शक(cid:577) १९४४ BMC to follow due process of modification under section 37(1) of MR and TP Act, 1966 for deleting the EOS 1.5+ DOS 2.3 and include the said plot in Residential Zone after following due process of law as the plot is not included in acquisition process by BMC. Further, there is no existing Garden/ Zoo (extension of Veermata Jijabai Bhosale Udyan hereinafter referred as VJB) is found on site. The details of the plots area is as under :—

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub section (1) of section 37 of the MR and TP Act, 1966 ; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the proposed modification mentioned in the Schedule given below may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of Chief Engineer (Development Plan) Brihanmumbai Municipal Corporation, 5th floor, Municipal Head Office, Mahapalika Marg, Fort, Mumbai 400 001.

Any objections or suggestions, which may be received within the said period will be dealt with in accordance with the provisions of section 37(1) of the said Act by the Chief Engineer (Development Plan) BMC.

A part plan showing the proposed modification is kept open for the inspection of the general public at the following offices :—

(1) Office of the Chief Engineer (Development Plan), 5th Floor, Brihanmumbai Municipal Corporation, Mahapalika Marg, Mumbai 400 001.

मा. महानगरपािलका आयुक्त यांची मंजुरी कर्. एमसीपी / २५७, िद. ३० स(cid:262)ट(cid:608)बर २०२२ अन्वये तत्वतः मंजूर क(cid:577)लेली ९.१५ मी. (३० फ(cid:563)ट) र(cid:274)ता रेषा नकाशावर दशर्िवली आहे. ज्यामध्ये पर्चिलत ५.२० मी. (१७ फ(cid:563)ट) मंजूर रेषा लाल रंगात दशर्िवली आहे आिण पर्(cid:274)तािवत ९.१५ मी. Notice is hereby given pursuant to section 297(1) (b) of Mumbai Municipal Corporation Act, 1888 (as mentioned up to date) that, the undersigned proposes to apply to the Municipal Corporation at their meeting to be held after 30 days from display of this public notices or such day thereafter, as the said application can conveniently be disposed off for authority to accept proposed 9.15 m. (30(cid:2)0(cid:2)(cid:2)) wide Regular line of the Road from Walkeshwar Road to Banganga Tank Road (Marked in A to B), Malabar Hill Division, D- Ward, Mumbai.

The road from Walkeshwar Road to Banganga Tank Road is having 5.20 m. (17(cid:2)0(cid:2)(cid:2)) wide Sanctioned Regular Line and same is proposed to be widened to 9.15 m. under section 297(1)(b) of MMC Act (as mentioned upto date), as per Note-l of Regulation 19(3) of DCPR, 2034 and as per subsequent order of Hon'ble Municipal Commissioner U/No. ChE/DP/73/Gen /2019-20 directing to widen the roads of width less than 9.00 m. to 9.00 m. and above as per site condition through MR and TP Act or MMC Act, 1888.

The proposed alignment of 9.15 m. wide R.L. is as shown on plan, which in principally approved by Hon. Municipal Commissioner vide approval under No. MCP/257, dated 30th September 2022. The prevailing alignment of sanctioned R.L. of 5.20 m. (17(cid:2)00(cid:2)(cid:2)) is shown in Red Colour and proposed alignment of 9.15 m. (30(cid:2)00(cid:2)(cid:2)) R.L. to be prescribed is shown in Green Colour on plan displayed at the office of Asstt. Commissioner 'D' ward, Nanachowk, Tardeo, Mumbai 400 007 and Asstt. Engineer (Survey) City, office of the Dy.Ch.E. (Building Proposal) City, Dosti Acres, Walmiki Chowk, Vidyalankar College Marg, Wadala (E.), Mumbai 400 037.

Any person desirous making any representation to the Corporation or of bringing before the Corporation any suggestion / objection in respect of the said proposal may do so by letter addressed Dy.Ch.E. (Building Proposal) City, Dosti Acres, Walmiki Chowk, Vidyalankar College Marg, Wadala (E.), Mumbai 400 037 or Asstt.
