क्रमांक ओिीपी-०९२२/प्र.क्र.५७/अविवनयम.— ज्याअर्थी, महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार पररषद अविवनयम, २००२ (यात यापुढे ज्याचा वनददेश "उक्त अविवनयम" असा करण्यात आला आहे) च्या कलम ३ (३) अन्वये काढण्यात आलेल्या शासकीय अविसूचना, वैद्यकीय वशक्ष्ण व औषिी द्रव्ये ववभाग क्र. एमसीओिी ०३१२/प्र.क्र.९३/अविवनयम, वदनांक ९ नोव्हेंबर २०१७ (यात यापुढे जीचा वनददेश "उक्त अविसूचना" असा करण्यात आला आहे) द्ारे महाराष्ट्र शासनाने, महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार पररषद (यात यापुढे ज्याचा वनददेश "पररषद" असा करण्यात आला आहे) या पररषदेची स्र्ापना केलेली आहे ;
आव्ण ज्याअर्थी, पररषदेच्या सदस्यांचा कालाविी वदनांक ८ नोव्हेंबर २०२२ रोजी संपुष्टिात आला आहे ;
आव्ण ज्याअर्थी, केंद्र शासनाचा "The National Commission for Allied and Healthcare Professions (NCAHP) Act, २०२१" हा वदनांक २५ मे २०२१ पासून अंमलात आला आहे. या अविवनयमातील कलम २२ पोि-कलम (१) खालील तरतुदीनुसार राज्यात State Allied and Healthcare Council ची स्र्ापना कर्णे आवश्यक आहे आव्ण उक्त अविवनयम पू्ण्गप्णे परत (REPEAL BACK) घ्यावा लागेल ;
आव्ण ज्याअर्थी, उक्त अविवनयम परत घेतल्यानंतर महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार पररषद परर्णामक्षम अस्णार नाही. यास्तव पररषदेची नव्याने वनवड्णूक घे्णे सुयोग्य ठर्णार नाही ;
आव्ण ज्याअर्थी, या संपू्ण्ग प्रवक्रयेला काही कालाविी लाग्णार असल्याने पररषदेचे कामकाज त्या कालाविीसाठी सुरू ठेव्णे आवश्यक आहे. आव्ण म्ह्णून पररषदेचा पाच वषांचा कालाविी संपुष्टिात आल्यानंतर उक्त पररषद पुढे चालू ठेवावी हे शासनाला इष्टि वाित नाही व राज्यात State Allied and Healthcare Council ची स्र्ापना होईपयांत शासनास उक्त पररषदेवर प्रशासकाची वनयुक्ती करावी असे वािते ;

भाग चार-ब-२३–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जानेवारी ३१, २०२३/माघ ११, शके १९४४ आव्ण ज्याअर्थी, उक्त पररषदेचे कामकाज अंतररम कालाविीसाठी सुरळीत चालावे यासाठी शासनाने डॉ. संवदप भागवत, सदस्य, ंबई यांची उक्त पररषदेचे सव्ग अविकार व कत्गव्य पार पाडण्यासाठी प्रशासक महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार पररषद, मु म्ह्णून वनयुक्त करण्याचे ठरववले आहे.
त्याअर्थी, आता महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार पररषद अविवनयम, २००२ च्या कलम ३७ (२) (ख) याद्ारे प्रदान करण्यात आलेल्या अविकाराचा वापर करून महाराष्ट्र शासन डॉ. संवदप भागवत, सदस्य, महाराष्ट्र राज्य व्यवसायोपचार व भौवतकोपचार ंबई यांची उक्त पररषदेचे सव्ग अविकार व कत्गव्य पार पाडण्यासाठी एक वषा्गच्या कालाविीसाठी वकंवा State Allied and पररषद, मु Healthcare Council गवठत होईपयांत, यापैकी जे अगोदर घडेल तोपयांत प्रशासक म्ह्णून वनयुक्ती करीत आहे.

NOTIFICATION
Maharashtra state CounCil for oCCupational therapy and physiotherapy aCt, 2002.
No.OTP-0922/P.No.57/Act.— Whereas by Notification, Medical Education and Drugs Department No. MCOT 0312/P.No.93/Act, dated the 9th November 2017 the Maharashtra State Council for Occupational therapy and Physiotherapy (hereinafter referred to as "the said Council") has been constituted under sub-section (3) of section 3 of the Maharashtra State Council for Occupational therapy and Physiotherapy Act, 2002 (hereinafter referred to as "the said Act") ;
And whereas, the term of the members of the Council has expired on 8th November 2022 ;
And whereas, the Central Government's " The National Commission for Allied and Healthcare Professions (NCAHP) Act, 2021" has come into force from 25th May 2021. According to the following provision of Sub-section (1) of Section 22 of this Act, it is necessary to establish State Allied and Healthcare Council in the State and the said Act has to be completely REPEAL BACK ;
And whereas, the Maharashtra State Council of Occupational Therapy and Physiotherapy shall not be effective after the repeal of the said Act. Therefore, it will not be appropriate to hold a fresh election of the Council ;
And whereas, as this whole process will take some period, it is necessary for the Council to continue for that period. And therefore the Government does not think it is desirable to continue the said Council after the expiry of its five year term and the Government feels that an Administrator should be appointed on the said Council, till the State Allied and Healthcare Council is established in the State ;
And whereas, the Government of Maharashtra has decided to appoint Dr. Sandeep Bhagwat, Member, Maharashtra State Council of Occupational Therapy and Physiotherapy, Mumbai as Administrator to exercise all the powers and perform all the duties of the said Council during the interim period for the smooth working.
Now, therefore, in exercise of the powers conferred by section 37(2)(b) of the Maharashtra State Council for Occupational Therapy and Physiotherapy Act, 2002, and all other powers enabling it in that behalf, the Government of Maharashtra hereby appoints Dr. Sandeep Bhagwat, Member, Maharashtra State Allied and Healthcare Council, Mumbai to be person as Administrator to exercise all the powers and perform all the duties of the said Council for a period of one year or till the formation of State Allied and Healthcare Council, whichever is earlier.
