No. 3/4/ ID 2023/SDR/VOL.I.— Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the Clectors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote ; and

Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Elector Photo Identity Card (EPIC) to all electors, according to a time bound programme; and 6. Whereas, Elector Photo Identity Card have been issued to approximate 100% electors in the States of Meghalaya, Nagaland, Tripura, Arunachal Pradesh, Jharkhand, Tamil Nadu, West Bengal & Maharashtra; and

7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for the current General Election to the Legislative Assembly of Tripura notified on 21st January 2023, General Election to the Legislative Assemblies of Meghalaya & Nagaland and bye elections to 01-Lumla(ST) Assembly Constituency of Arunachal Pradesh, 23-Ramgarh Assembly Constituency of Jharkhand, 98-Erode(East) Assembly Constituency of Tamil Nadu, 60-Sagardighi Assembly Constituency of West Bengal and 215-Kasba Peth & 205-Chinchwad Assembly Constituencies of Maharashtra notified on 31st January 2023, all electors who have been issued EPIC shall produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity :—

(i) Aadhaar Card,

(ii) MNREGA Job Card,

(iii) Passbooks with photograph issued by Bank/Post Office,

(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour, (v) Driving License,

(vi) PAN Card,

(vii) Smart Card issued by RGI under NPR,

(viii) Indian Passport,

(ix) Pension document with photograph,

(x) Service Identity Cards with photograph issued to employees by Central/State Govt./ PSUs/Public Limited Companies,

(xi) Official identity cards issued to MPs/MLAs/MLCs, and

(xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India.

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

सं. 3/4/आईडली/2023/एसडलीआर/खण्ड-I.— यतः ्लोक प्रनतनिनित्र् अनिनियम, 1951 कली िारा 61 में यह उपबंनित है नक निर्ावाचकों के प्रनतरुपण का निर्ारण करिे कली दृष्टटि से, तानक उक्त अनिनियम कली िारा 62 के अिलीि र्ास्तनर्क निर्ावाचकों का उिके मत देिे के अनिकार को और अनिक प्रभार्ली बिाया जा सके, मतदाि के समय निर्ावाचकों कली पहचाि सुनिष्चचत करिे के साि के रूप में निर्ावाचकों के न्लए निर्ावाचक फोटिो पहचाि पत्र के उपयोग हेतु नियमों के द्ारा उपबंि नकए जा सकते हैं ; तथा

2. यतः निर्ावाचकों का रनजष्स्रिकरण नियम, 1960 का नियम 28 निर्ावाचि आयोग को, इस दृष्टटि से नक निर्ावाचकों के प्रनतरुपण का निर्ारण हो सके तथा मतदाि के समय उिकली पहचाि को सर्ल बिाया जा सके, निर्ावाचको को राज्य कली ्लागत पर फोटिोयुक्त निर्ावाचक फोटिो-पहचाि पत्र जारली करिे के न्लए निदेश देिे कली शष्क्त प्रदाि करता है; तथा

3. यतः, निर्ावाचिों का संचा्लि नियम, 1961 के नियम 49 ज(3) और 49 टि (2) (ख) में यह उपबंनित है नक जहाँ नकसली निर्ावाचि क्ेत्र के निर्ावाचकों को निर्ावाचक रनजष्स्रिकरण नियम, 1960 के नियम 28 के उक्त उपबंिों के अिलीि निर्ावाचक फोटिो पहचाि- पत्र नदए गए हैं, र्हां निर्ावाचकों को मतदाि केन्द्र में अपिा निर्ावाचक फोटिो पहचाि-पत्र नदखािा होगा तथा उिकली ओर से उि निर्ावाचक फोटिो पहचाि पत्रों को िहीं नदखाए जािे या नदखािे में असमथवा होिे पर उन्दहें मत डा्लिे कली अिुमनत देिे से इन्दकार नकया जा सकता है; तथा 4. यतः, उक्त अनिनियम, और नियमों के उपयु वाक्त उपबंिों को नम्लाकर एर्ं सामंजस्यपूणवा ढंग से उिके अध्ययि से यह स्प्टटि होता है नक यद्यनप मत देिे का अनिकार निर्ावाचक िामार्ली में िाम के होिे से हली होता हैं, यह निर्ावाचि आयोग द्ारा राज्य कली ्लागत पर, मतदाि के समय उिकली पहचाि सुनिष्चचत करिे के साि के रूप में प्रदाि करर्ाए गए निर्ावाचक फोटिो पहचाि पत्र के प्रयोग पर भली निभवार करता है, तथा दोिों का एक साथ प्रयोग करिा होता है; तथा

5. यतः, निर्ावाचि आयोग िे एक समयबद्ध कायवाक्रम के अिुसार सभली निर्ावाचकों को निर्ावाचक फोटिो पहचाि-पत्र ई०पली०आई०सली० जारली करिे का निदेश देते हुए 28 अगस्त, 1993 को एक आदेश जारली नकया है; तथा

6. यतः, मेघा्लय, िागा्लैंड, नत्रपुरा, अरुणाच्ल प्रदेश, झारखण्ड, तनम्लिाडू, पष्चचम बंगा्ल एर्ं महारा्टरि राज्यों के निर्ावाचकों को 100% निर्ावाचक फोटिो पहचाि पत्र जारली नकए जा चुके हैं ; तथा

7. अतः, अब, सभली संबद्ध कारकों तथा नर्निक एर्ं तथ्यात्मक ष्स्थनतयों को ध्याि में रखते हुए, निर्ावाचि आयोग, एतद् द्ारा यह निदेश देता है नक कदनांक 21 जनवरी 2023 को अकधसूकचत कत्रपरुरा कवधानसभा के चालू साधारण कनवा्षचन, कदनांक 31 जनवरी 2023 को अकधसूकचत मेघालय और नागालैंड़ की कवधानसभाओं के साधारण कनवा्षचन और अरुणाचल प्देश के 01 - लरुम्ला (अ.ज.जा) कवधानसभा कनवा्षचन क्ेत्र, झारखण्ड के 23 - रामगढ़ कवधानसभा कनवा्षचन क्ेत्र, तकमलनाडू के 98 - इरोड (पूव्ष) कवधानसभा कनवा्षचन क्ेत्र, पश्चचम बंगाल के 60 - सागरदीघी कवधानसभा कनवा्षचन क्ेत्र और महाराष्ट्र के 215-कसबा पे्ठ और 205 - कचंचवड कवधानसभा कनवा्षचन क्ेत्ररों के उपचरुनावरों के कलए, सभली निर्ावाचक नजन्दहें निर्ावाचक फोटिो पहचाि पत्र जारली नकए गए हैं, मतदाि स्थ्ल पर अपिा मत डा्लिे से पह्ले अपिली पहचाि सुनिष्चचत करिे हेतु अपिा निर्ावाचक फोटिो पहचाि पत्र नदखाएंगे। ऐसे निर्ावाचक जो अपिा निर्ावाचक फोटिो पहचाि पत्र प्रस्तुत िहीं कर पाते हैं, उन्दहें अपिली पहचाि स्थानपत करिे के न्लए निम्िन्लनखत र्ैकष्ल्पक फोटिो पहचाि दस्तार्ेजों में से कोई एक प्रस्तुत करिा होगा :—

i आिार काड्ड,

ii मिरेगा जॉब काड्ड,

vii. एिपलीआर के अंतगवात आरजलीआई द्ारा जारली नकए गए स्माटि्ड काड्ड,

xii. यूनिक नडसएनबन्लटिली आईडली (यूडलीआईडली) काड्ड, सामानजक न्दयाय एर्ं अनिकाररता मंत्रा्लय, भारत सरकार । 8. एनपक के संबंि में, ्लेखि अशुनद्ध, र्तवािली कली अशुनद्ध इत्यानद को िजरअंदाज कर देिा चानहए बशततें निर्ावाचक कली पहचाि ईपलीआईसली से सुनिष्चचत कली जा सके। यनद कोई निर्ावाचक फोटिो पहचाि पत्र प्रदनशवात करता है, जो नक नकसली अन्दय सभा निर्ावाचि क्ेत्र के निर्ावाचक रनजस्रिलीकरण अनिकारली द्ारा जारली नकया गया हैं, ऐसे एनपक भली पहचाि स्थानपत करिे हेतू स्र्लीकृत नकए जाएंगे बशततें उस निर्ावाचक का िाम जहां र्ह मतदाि करिे आया है उस मतदाि केंद्र से संबंनित निर्ावाचक िामार्ली में उप्ल्लि हो। यनद फोटिोग्ाफ इत्यानद वाक्त पैरा 7 में र्नणवात नकसली एक र्ैकष्ल्पक के बेमे्ल होिे के कारण निर्ावाचक कली पहचाि सुनिष्चचत करिा संभर् ि हो तब निर्ावाचक को उपयु फोटिो दस्तार्ेज को प्रस्तुत करिा होगा।

9. उक्त पैरा 7 में नकसली बात के होते हुए भली, प्र्ासली निर्ावाचकों को जो अपिे पासपोटि्ड में नर्र्रणों के आिार पर ्लोक प्रनतनिनित्र् अनिनियम, 1950 कली िारा 20क के अिलीि निर्ावाचक िामार्न्लयों में पंजलीकृत हैं, मतदाि केन्द्र में केर्ल उिके मू्ल पासपोटि्ड (तथा कोई अन्दय पहचाि दस्तार्ेज िहीं) के आिार पर हली पहचािा जाएगा।
