Whereas, Revised Development Plan of Nagpur City has been sanctioned partly by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January 2000 and finally sanctioned the Government vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated the 10th September, 2001 and has come into force with effect from the 1st March 2000 and 21st September 2001 (hereinafter referred to as "the said Development Plan") under Sction 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");

And whereas, in the said Development Plan, 30.00 Mt. wide Development Plan road is proposed in village Sitabardi between Patani Automobile to L.I.C. Chowk on Kamathi Road (hereinafter referred to as "the said Road") ;

And whereas, the Nagpur Municipal Corporation, Nagpur (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 363, Dated 05 March 2019 has resolved to widen the said road from 30.00 Mt. to 33.00 Mt. considering the proposed Flyover and Metro Viaduct Structure Construction on the said road, as per the provisions of sub-section (1) of Section 37 of the said Act, after following the legal procedure laid down under the said Act, (hereinafter referred to as "the Proposed Modification") the Planning Authority has submitted the said proposal of modification to the Government for sanction vide its letter dated 25 January 2022 ;

And whereas, the joint measurement of the land under the proposed modification has been carried out and as per the report of the joint measurement area under proposed road widening as per acquisition proposal is 2370.62 Sq. Mt. ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Modification proposal and for that purpose amends the said Development Plan Notification as follows;

In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry—

"The width of the 30.00 Mt. wide Development Plan road in village Sitabardi between Patani Automobile to L.I.C. Chowk on Kamathi Road is increased to 33.00 Mt. as shown on the Plan—

A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.

NOTIFICATION

Whereas, Development Plan of Bhivapur (N.M.C.) has been sanctioned by the Government vide Notification No.TPS-2484-C.R.112-362-UD-9, dated 14 August 1984 and came into force with effect from 15th October 1984 (here- inafter referred to as "the said Development Plan") under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") ;

And whereas, in the said Development Plan, land bearing Survey No. 349 & Survey No. 357 of Mouje Bhivapur (hereinafter referred to as "the said land") are included in "Agriculture Zone" (hereinafter referred to as "the said Zone");

And whereas, the Chief Officer, Nagar Panchayat, Bhivapur, Distt. Nagpur being the Planning Authority (hereinafter referred to as 'the said Planning Authority"), vide its General Body Resolution No. 13, dated 16th January 2020 has resolved to delete the area admeasuring 0.40 ha. of Survey No. 349 and area admeasuring 0.81 hectare of survey no 357 total admeasuring 1.21 hectare of the said Land and include the same in Residential Zone and accordingly submit- ted a modification proposal to the Government, for its sanction as per the provisions of sub-section (1) of Section 37 of the said Act, vide its letter dated 17th May 2020 (hereinafter referred to as "the Proposed Modification") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned with certain conditions;

And whereas, the said Lands Owners have deposited Rs. 39,325/- towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 25 November 2022 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 39,325/- payable to the Planning Authority has been deposited with the Chief Officer, Nagar Panchayat, Bhivapur, Dist. Nagpur on 17th November 2022 ;

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of the Maharashtra hereby, sanctions the Proposed Modification with certain conditions, and for that purpose amends the aforesaid Notification dated 14th August 1984 as follows ;

in the Schedule of Modifications appended to the Notification dated 14th August 1984 sanctioning the said Development Plan the following new entry shall be added after the last entry.—

ENTRY

The land totally ameasuring 1.21 hectare bearing Survey No. 349 (area 0.40 hectare) and Survey No. 357 (area 0.81 hectare) of Mouje Bhivapur Distt. Nagpur are deleted from Agriculture Zone and are included in Residential Zone as shown on the plan, subject to following conditions.—

Condition No. 1 : In the layout of the said Land, in addition to 10% compulsory open space as per the prevailing Development Control Regulations for Bhivapur city, it will be compulsory to provide an additional 10% amenity space.

Condition No. 2 : It is necessary to construct compound wall around the open space.

Condition No. 3 : It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage and drainage etc.

Condition No. 4 : If the above said infrastructure amenities are proposed to the developed by stages, then sale of plots shall be monitored by the Chief Officer, Nagar Panchayat, Bhivapur, Dist. Nagpur in relation to expected development of civic facilities as per the stages given below.—.

(a) After final approval of layout Sale of 25% of the total Plots shall be permissible.

(b) After completion of 40% basic Sale of 50% of the total Plots shall be permissible.

(c) After completion of 60% of Sale of 75% of the total Plots shall be permissible.

(d) After completion of 80% of Sale of 90% of the total Plots shall be permissible.

In case of violation of the above, the layout and Non - Agriculture permission will be eligible for revocation.

If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given unless all the basic amenities are fully developed.

PUBLICATION OF DRAFT DEVELOPMENT PLAN OF JIWATI UNDER SECTION 26 (1) OF MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Jiwati Nagar Panchayat, (hereinafter referred to as "the said Planning Authority.") vide Resolution No.1, dated 14th June 2021 had declared its intention to prepare a Draft Development Plan of Jiwati Town (hereinafter referred to as the "said Draft Development Plan") for the area under its jurisdiction. (hereinafter referred to as the said "area") as per the provision of Section 23(1) read with Section 21(2) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the "said Act") and notice to that effect is published in Maharashtra Government Gazette Division, Nagpur Supplement Part on 1 A, dated 14th November 2021.

And whereas, as per the provision in Section 24 of the said Act, the Nagar Panchayat vide Order No. 28, dated 11th January 2022 Planning, Town Planner, has appointed Assistant Director, Town Branch, Chandrapur as "Town Planning Officer" to prepare the said Draft Development Plan for the said area :

And whereas, the Town Planning Officer and Assistant Director, Town Planning / Town Planner Chandrapur Branch after having prepared Existing Land Use Map as per Section 25 of the said Act, has prepared the said Draft Develop- ment Plan of the said area and has handed it over to the said Planning Authority on 9th December 2022 for publication under Section 26(1) of the said Act:

And whereas, the said Planning Authority has passed Resolution No. dated 28th December 2022 to publish the said Draft Development Plan under Section 26(1) of the said Act, for inviting suggestions/objections from the public;

Therefore, Nagar Panchayat Jiwati hereby publishes the said Draft Development Plan along with the Report under Section 26(1) of the said Act for inviting suggestions/objections from the public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

2. Assistant Director, Town Planning/ Town Planner, Chandrapur Branch, Chandrapur.

The suggestions/ objections if any, in writing from the public in this regard with reasons, shall be submitted to the Chief Officer, Jiwati Nagar Panchayat within the period of 30 days from the date of publication of the Notice in Maharashtra Govt. Gazette. Suggestions/objections received by the Nagar Panchayat within the period of the 30 days from the date of publication of this Notice in Maharashtra Government Gazette shall only be considered. The copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the office of the Nagar Panchayat.
