(cid:312)मांक.औसुवआ-०३१३/(cid:332).(cid:312).३१/कामगार-१.— भारतीय संिवधाना(cid:247)या अनु(cid:247)छ(cid:578)द ३०९ (cid:247)या परंतुका(cid:271)दारे (cid:332)दान कर(cid:256)यात आले(cid:269)या श(cid:242)त(cid:558)चा वापर क(cid:544)न आिण या बाबतीत क(cid:577)लेले सव(cid:593) िव(cid:464)मान िनयम, आदेश िक(cid:573)वा संलेख यांचे अिध(cid:312)मण क(cid:544)न महारा(cid:273)(cid:322)ाचे रा(cid:249)यपाल या(cid:271)दारे महारा(cid:273)(cid:322) शासना(cid:247)या उ(cid:464)ोग, ऊजा(cid:593) व कामगार िवभागा(cid:247)या िनयं(cid:327)णाखालील औ(cid:464)ोिगक सुर(cid:550)ा व आरो(cid:244)य संचालनालया(cid:247)या आ(cid:274)थापनेवरील व(cid:555)र(cid:273)ठ रसायन शा(cid:274)(cid:327)(cid:551), (cid:332)योगशाळा तं(cid:327)(cid:551), (cid:332)योगशाळा सहायक या गट-क (cid:247)या पदां(cid:247)या सेवा(cid:332)वेशाचे िविनयमन करणारे पुढील िनयम करीत आहेत :—
१. (१) या िनयमांना, औ(cid:464)ोिगक सुर(cid:550)ा व आरो(cid:244)य संचालनालयातील व(cid:555)र(cid:273)ठ रसायन शा(cid:274)(cid:327)(cid:551), (cid:332)योगशाळा तं(cid:327)(cid:551), (cid:332)योगशाळा सहायक, गट-क यांचे सेवा(cid:332)वेश िनयम-२०२३ असे संबोध(cid:256)यात यावे.
(२) सदर िनयम शासन राजप(cid:327) (cid:332)िस(cid:460) झा(cid:269)या(cid:247)या िदनांकापासून अंमलात येतील.
२. या िनयमांम(cid:260)ये संदभा(cid:593)नुसार दुसरा अथ(cid:593) अिभ(cid:332)ेत नसेल तर—
क) "पदवी" याचा अथ(cid:593), कोण(cid:257)याही सांिविधक िव(cid:464)ापीठाची पदवी, असा आहे ;
ख) "िवभाग" याचा अथ(cid:593), भारतीय संिवधाना(cid:247)या अनु(cid:247)छ(cid:578)द १६६ अ(cid:261)वये बनिवले(cid:269)या महारा(cid:273)(cid:322) शासन काय(cid:593)िनयमावली(cid:247)या पिह(cid:269)या अनुसूिचम(cid:260)ये िविनिद(cid:593)(cid:273)ट क(cid:577)लेला, "उ(cid:464)ोग, ऊजा(cid:593) व कामगार िवभाग", असा आहे ;
(१)
भाग चार-अ-३९–१२ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, फ(cid:577)(cid:334)ुवारी १३, २०२३/माघ २४, शक(cid:577) १९४४ (ग) "संचालनालय" याचा अथ(cid:593), महारा(cid:273)(cid:322) शासना(cid:247)या उ(cid:464)ोग, ऊजा(cid:593) व कामगार िवभागा(cid:247)या अिधप(cid:257)याखालील "औ(cid:464)ोिगक सुर(cid:550)ा व आरो(cid:244)य संचालनालय, महारा(cid:273)(cid:322) रा(cid:249)य", असा आहे ;
(घ) "शासन" याचा अथ(cid:593), "महारा(cid:273)(cid:322) शासन" असा आहे ;
(च) "िनवड सिमती" याचा अथ(cid:593), संचालक, औ(cid:464)ोिगक सुर(cid:550)ा व आरो(cid:244)य संचालनालय, महारा(cid:273)(cid:322) रा(cid:249)य या काया(cid:593)लयासाठी दु(cid:267)यम सेवेतील गट-क (cid:247)या पदांवरील उमेदवारांची िनवड कर(cid:256)याक(cid:555)रता शासना(cid:247)या मा(cid:261)यतेने गिठत क(cid:577)लेली िनवड सिमती, असा आहे.
३. संचालनालया(cid:247)या आ(cid:274)थापनेवरील "व(cid:555)र(cid:273)ठ रसायन शा(cid:274)(cid:327)(cid:551), गट-क" या पदावरील िनयु(cid:242)ती पुढील मागा(cid:593)ने करता येईल :—
(क) संचालनालया(cid:247)या आ(cid:274)थापनेवरील (cid:332)योगशाळा तं(cid:327)(cid:551), गट-क हे पद धारण करणा(cid:311)या तसेच सदर पदावर िकमान तीन वषा(cid:593)हून कमी नसेल इतकी िनयिमत सेवा झाले(cid:269)या तसेच या िनयमा(cid:247)या पोटिनयम (ख)(दोन) नुसार शै(cid:550)िणक अह(cid:593)ता धारण करणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून (cid:249)ये(cid:273)ठता अधीन पा(cid:327)ता या िनकषावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल.
िक(cid:573)वा
(ख) सदर पद पदो(cid:261)नतीने भर(cid:256)यासाठी पा(cid:327) (cid:271)य(cid:242)ती उपल(cid:264)ध नस(cid:269)यास, िनवड सिमतीकड(cid:564)न घे(cid:256)यात येणा(cid:311)या (cid:274)पधा(cid:593)(cid:257)मक परी(cid:550)े(cid:247)या िनकाला(cid:247)या आधारे िशफारस कर(cid:256)यात आले(cid:269)या, खाली नमूद अटी पूण(cid:593) करणा(cid:311)या उमेदवारांमधून नामिनद(cid:616)शना(cid:465)ारे, जे—
(एक) ३८ वषा(cid:597)पे(cid:550)ा जा(cid:274)त वयाचे नाहीत:
परंतु, आरि(cid:550)त (cid:332)वगा(cid:593)तील उमेदवारां(cid:247)या बाबतीत वयोमया(cid:593)दा पाच वषा(cid:597)पय(cid:597)त िशिथल क(cid:577)ली जाईल ;
(दोन) सांिविधक िव(cid:464)ापीठाची िव(cid:551)ान शाखेतील अॅनािलिटकल क(cid:577)िम(cid:274)(cid:322)ी िक(cid:573)वा एन(cid:271)हायर(cid:261)म(cid:606)टल साय(cid:261)स या िवषयासह पद(cid:271)यु(cid:427)र पदवी धारण करतात ;
आिण
(तीन) कोण(cid:257)याही उ(cid:464)ोगामधील/ शासकीय खा(cid:257)यामधील/ शासनाने (cid:274)थािपत क(cid:577)ले(cid:269)या औ(cid:464)ोिगक उप(cid:312)मामधील/ (cid:274)थािनक (cid:332)ािधकरणामधील/ महामंडळामधील, रासायिनक िक(cid:573)वा (cid:332)दूषणिवषयक (cid:332)योगशाळ(cid:578)तील िकमान ३ वष(cid:616) इतका (cid:332)(cid:257)य(cid:550) कामाचा अनुभव धारण करतात.
४. संचालनालया(cid:247)या आ(cid:274)थापनेवरील "(cid:332)योगशाळा तं(cid:327)(cid:551), गट-क" या पदावरील िनयु(cid:242)ती, (cid:332)योगशाळा सहायक या पदावर िकमान तीन वष(cid:626) िनयिमत सेवा पूण(cid:593) क(cid:577)ले(cid:269)या (cid:271)य(cid:242)त(cid:558)मधून (cid:249)ये(cid:273)ठता अधीन पा(cid:327)ता या िनकषावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल.
५. संचालनालया(cid:247)या आ(cid:274)थापनेवरील "(cid:332)योगशाळा सहायक,गट-क", या पदावरील िनयु(cid:242)ती, िनवड सिमतीकड(cid:564)न घे(cid:256)यात येणा(cid:311)या (cid:274)पधा(cid:593)(cid:257)मक परी(cid:550)े(cid:247)या िनकाला(cid:247)या आधारे िशफारस कर(cid:256)यात आले(cid:269)या, खाली नमूद अटी पूण(cid:593) करणा(cid:311)या उमेदवारांमधून नामिनद(cid:616)शना(cid:465)ारे कर(cid:256)यात येईल, जे—
(एक) ३८ वषा(cid:597)पे(cid:550)ा जा(cid:274)त वयाचे नाहीत:
परंतु, आरि(cid:550)त (cid:332)वगा(cid:593)तील उमेदवारां(cid:247)या बाबतीत वयोमया(cid:593)दा पाच वषा(cid:597)पय(cid:597)त िशिथल क(cid:577)ली जाईल ;
(दोन) सांिविधक िव(cid:464)ापीठाची िव(cid:551)ान शाखेतील माय(cid:312)ोबायोलॉजी िक(cid:573)वा बायोक(cid:577)िम(cid:274)(cid:322)ी िक(cid:573)वा बायोलॉजी (बॉटनी िक(cid:573)वा झूऑलॉजी) िक(cid:573)वा क(cid:577)िम(cid:274)(cid:322)ी या िवषयासह पदवी धारण करतात ;
महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, फ(cid:577)(cid:334)ुवारी १३, २०२३/माघ २४, शक(cid:577) १९४४ ३(तीन) शासन मा(cid:261)यता (cid:332)ा(cid:262)त सं(cid:274)थेची वै(cid:464)कीय (cid:332)योगशाळा तं(cid:327)(cid:551)ान पदिवका (िड(cid:262)लोमा इन मेिडकल लेबोरेटरी ट(cid:578)(cid:242)नॉलॉजी) धारण करतात ;
आिण
(चार) कोण(cid:257)याही रासायिनक िक(cid:573)वा रोगिनदान िवषयक (cid:332)योगशाळ(cid:578)तील िकमान २ वष(cid:626) इतका कामाचा (cid:332)(cid:257)य(cid:550) अनुभव धारण करतात ;
६. (एक) िनयम ३ आिण ४ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदांवर पदो(cid:261)नतीने िनयु(cid:242)त क(cid:577)ले(cid:269)या (cid:271)य(cid:242)तीने, सदर पदांवर पदो(cid:261)नती हो(cid:256)यापूव(cid:559), शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमांनुसार मराठी आिण िहंदी भाषा परी(cid:550)ा जर तो आधीच उ(cid:427)ीण(cid:593) झाला नसेल तर, उ(cid:427)ीण(cid:593) क(cid:577)लेली असणे अथवा उ(cid:427)ीण(cid:593) हो(cid:256)यापासून सूट िमळिवलेली असणे आव(cid:272)यक राहील.
(दोन) िनयम ३ आिण ५ म(cid:260)ये नामिनद(cid:616)शना(cid:465)ारे नमूद क(cid:577)ले(cid:269)या पदांवर िनयु(cid:242)त क(cid:577)ले(cid:269)या (cid:271)य(cid:242)तीने, शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमांनुसार मराठी आिण िहंदी भाषा परी(cid:550)ा जर तो आधीच उ(cid:427)ीण(cid:593) झाला नसेल तर, िविहत कालमया(cid:593)देत उ(cid:427)ीण(cid:593) होणे अथवा उ(cid:427)ीण(cid:593) हो(cid:256)यापासून सूट िमळिवणे आव(cid:272)यक राहील. जोपय(cid:597)त तो (cid:257)या परी(cid:550)ा उ(cid:427)ीण(cid:593) होत नाही तोपय(cid:597)त तो वािष(cid:593)क वेतनवाढीसाठी िक(cid:573)वा पुढील पदो(cid:261)नती(cid:247)या पदावर पदो(cid:261)नतीसाठी पा(cid:327) असणार नाही.
७. (एक) िनयम ३ आिण ४ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदांवर पदो(cid:261)नतीने िनयु(cid:242)त क(cid:577)ले(cid:269)या (cid:271)य(cid:242)तीने, सदर पदांवर पदो(cid:261)नती हो(cid:256)यापूव(cid:559), शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमांनुसार संगणक हाताळणीबाबतचे (cid:551)ान असणे अथवा (cid:257)यापासून सूट िमळिवलेली असणे आव(cid:272)यक राहील.
(दोन) िनयम ३ आिण ५ म(cid:260)ये नामिनद(cid:616)शना(cid:465)ारे नमूद क(cid:577)ले(cid:269)या पदांवर िनयु(cid:242)त क(cid:577)ले(cid:269)या (cid:271)य(cid:242)तीने, शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमांनुसार संगणक हाताळणीबाबतचे (cid:332)माणप(cid:327) (cid:332)ा(cid:262)त क(cid:577)लेले नसेल तर, िविहत कालमया(cid:593)देत सदर (cid:332)माणप(cid:327) धारण करणे अथवा ते सादर कर(cid:256)यापासून सूट िमळिवणे आव(cid:272)यक राहील. जोपय(cid:597)त तो सदर (cid:332)माणप(cid:327) धारण करत नाही तोपय(cid:597)त तो वािष(cid:593)क वेतनवाढीसाठी िक(cid:573)वा पुढील पदो(cid:261)नती(cid:247)या पदावर पदो(cid:261)नतीसाठी पा(cid:327) असणार नाही.
८. (एक) िनयम ३ आिण िनयम ५ येथे नमूद क(cid:577)ले(cid:269)या पदावर नामिनद(cid:616)शना(cid:465)ारे िनयु(cid:242)त होणा(cid:311)या (cid:271)य(cid:242)तीने, महारा(cid:273)(cid:322) नागरी (cid:574)बाचे (cid:332)ित(cid:551)ापन) िनयम, २००५ मधील तरतुदीनुसार व (cid:257)याबाबत वेळोवेळी कर(cid:256)यात येणा(cid:311)या (cid:574)बाचे (cid:332)ित(cid:551)ापन सादर करणे आव(cid:272)यक राहील. अ(cid:261)यथा, ती (cid:271)य(cid:242)ती सेवा (लहान क(cid:561)ट(cid:562) िनयमांनुसार, िनयु(cid:242)ती(cid:247)या वेळी लहान क(cid:561)ट(cid:562) सदर पदावर िनयु(cid:242)तीसाठी पा(cid:327) ठरणार नाही.
(दोन) लहान क(cid:561)ट(cid:562) (cid:574)बाचे (cid:332)ित(cid:551)ापन सादर करताना (cid:257)याम(cid:260)ये दोन पे(cid:550)ा अिधक अप(cid:257)ये िनयु(cid:242)ती(cid:247)या वेळ(cid:578)स हयात अस(cid:269)यास संबंिधत उमेदवार शासकीय िनयु(cid:242)तीसाठी अपा(cid:327) राहील.
(तीन) एखादी (cid:271)य(cid:242)ती शासन सेवेत िनयु(cid:242)त झा(cid:269)यानंतर (cid:257)या (cid:271)य(cid:242)तीस दोन पे(cid:550)ा अिधक अप(cid:257)ये अस(cid:269)याचे िस(cid:460) झाले तर ती (cid:271)य(cid:242)ती शासकीय सेवेतील सदर पदावरील िनयु(cid:242)तीसाठी अपा(cid:327) राहील.
९. व(cid:555)र(cid:273)ठ रसायन शा(cid:274)(cid:327)(cid:551), (cid:332)योगशाळा तं(cid:327)(cid:551), (cid:332)योगशाळा सहायक ही पदे संचालनालया(cid:247)या आ(cid:274)थापनेवर अ(cid:556)(cid:274)त(cid:257)वात ंबई अस(cid:269)याने, िनयम ३, ४ आिण ५ येथे नमूद क(cid:577)ले(cid:269)या पदांवर िनयु(cid:242)त होणा(cid:311)या (cid:271)य(cid:242)ती संचालनालया(cid:247)या मु काया(cid:593)लयातच काय(cid:593)रत राहतील.
१०. शासकीय सेवेतील िनयु(cid:242)तीसाठी या िनयमां(cid:465)ारे िविहत कर(cid:256)यात आले(cid:269)या अटी व शत(cid:560)ची पूत(cid:593)ता करणे आव(cid:272)यक आहे. सदर िनयमांनुसार शासकीय सेवेत िनयु(cid:242)ती झा(cid:269)यानंतर, संबंिधत शासकीय कम(cid:593)चा(cid:311)यास, शासकीय सेवे(cid:247)या कालावधीत, महारा(cid:273)(cid:322) नागरी सेवा िनयम, तसेच सेवािवषयक बाब(cid:558)संदभा(cid:593)त रा(cid:249)य शासनाने वेळोवेळी अिधिनयम/ अिधसूचना/ शासन िनण(cid:593)य/ शासन आदेशा(cid:465)ारे िनग(cid:593)िमत क(cid:577)लेले अ(cid:261)य िनयम लागू राहतील.

NOTIFICATION
CONSTITUTION OF INDIA.
No.DISH-0313/CR-31/Lab-1.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all existing rules, orders, instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Senior Chemist, Laboratory Technician, Laboratory Assistant, Group-C on the establishment of the Directorate of Industrial Safety and Health under the Industries, Energy and Labour Department of the Government of Maharashtra namely :—
1. (1) These rules may be called "the Senior Chemist, Laboratory Technician, Laboratory Assistant, Group-C in the Directorate of Industrial Safety & Health (Recruitment) Rules, 2023.
(2) These rules shall come into force on the date of publication of these rules in the Government Gazette.
2. In these rules unless the context requires otherwise —
(a) "Degree" means a degree of a Statutory University;
(b) "Department" means the Department of Industries, Energy and Labour Department of the Government of Maharashtra specified in the First Schedule appended to the Maharashtra Government Rules of Business made under article 166 of the Constitution of India;
(c) "Directorate" means the Directorate of Industrial Safety & Health, Maharashtra under the control of the Industries, Energy and Labour Department of the Government of Maharashtra;
(d) "Government" means the Government of Maharashtra.
(e) "Selection Committee" means the Selection Committee constituted with the approval of the Government for selection of the candidates for Group-C posts in the office of the Director;
3. Appointment to the post of "Senior Chemist, Group C" on the establishment of Directorate shall be made either—
(a) By promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of "Laboratory Technician, Group-C" at the Establishment of the Directorate having not less than three years of regular service on that post and possesses the educational qualification mentioned in sub-clause (ii) of clause (b);
ORमहारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, फ(cid:577)(cid:334)ुवारी १३, २०२३/माघ २४, शक(cid:577) १९४४ ५ (b) If the eligible candidate is not available for promotion, then by nomination of candidates recommended by selection committee on the basis of result of competitive examination conducted by it, who fulfil the conditions mentioned below,—
(i) are not more than 38 years of age:
Provided that, the age limit shall be relaxed upto five years in case of the candidates belonging to the reserved category;
(ii) Possess a post graduate Degree of a Statutory University in Science in Analytical Chemistry or Environmental Science;
AND
(iii) have at least three years of actual work experience in Chemical or Pollution related laboratory in any Industry or Department of Government or Government established Industrial Undertaking or Local Authority or Statutory Corporation.
4. Appointment to the post of "Laboratory Technician, Group C" on the establishment of Directorate shall be made by Promotion on the basis of seniority subject to fitness from amongst the persons holding the post of Laboratory Assistant, Group C at the Establishment of the Directorate having not less than three years of regular service on that post.
5. Appointment to the post of "Laboratory Assistant, Group C" on the establishment of Directorate shall be made, By Nomination of candidates recommended by selection committee on the basis of result of competitive examination conducted by it, who fulfil the conditions mentioned below—
(i) are not more than 38 years of age:
Provided that, the age limit shall be relaxed upto five years in case of the candidates belonging to the reserved category;
(ii) Possess a Degree of Statutory University in Science in Microbiology or Biochemistry or Biology (in Botony or Zoology) or Chemistry;
(iii) has completed a Diploma in Medical Laboratory Technology (DMLT) from the Government recognized Institute.
AND
(iv) have at least two years of actual work experience in Chemical or Pathological Laboratory.
6. (1) A person appointed to the posts mentioned in rules 3 and 4 by promotion shall pass the Marathi and Hindi Languages examinations, as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said posts.
(2) A person appointed to the posts mentioned in rules 3 and 5 by nomination shall pass the Marathi and Hindi Languages examinations, as per the rules made in that behalf by the Government, from time to time, within prescribed time limit after appointment unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or for the promotion to the next promotional post, until he passes those examinations.
7. (1) A person appointed to the posts mentioned in rules 3 and 4 by promotion shall possess a knowledge of Computer Operations prescribed by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said posts.
६ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, फ(cid:577)(cid:334)ुवारी १३, २०२३/माघ २४, शक(cid:577) १९४४(2) A person appointed to the posts mentioned in rules 3 and 5 by nomination shall possess a knowledge of Computer Operations prescribed by the Government, from time to time, within prescribed time limit after appointment unless he has been exempted from possessing such certificate in knowledge of Computer Operations, otherwise, he shall not be eligible for annual increment or for the promotion to the next promotional post, until he possess such certificate.
8. (1) A person appointed to the posts mentioned in rules 3 and 5 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in this behalf, by the Government, from time to time, otherwise, he shall not be eligible for appointment to the post.
(2) A person having more than two children on the date of submission of Declaration of Small Family, shall be disqualified for the appointment in Government Service.
(3) After appointment of a person in the Government Service, if it is proved that he has more than two children, then he shall be disqualified for the appointed post in Government Service.
9. The posts of Senior Chemist, Laboratory Technician and Laboratory Assistant, Group-C are on the establishment of the Directorate. Therefore, the persons appointed to the posts mentioned in Rules 3, 4 and 5 shall be working in the Mumbai office of the Directorate, only.
10. The terms and conditions prescribed by these rules must be fulfilled for appointment to the Government Service. After being appointed in the Government service as per the said rules, Maharashtra Civil Service Rules and other rules issued by the State Government from time to time through Acts/Notifications/Government Decisions/ Government Orders shall be applicable to the concerned Government employee during the period of Government service.
