आवि ज्याअर्थी, जी/ उत्तर प्रभागातील 'िारािी' नािाने ओळखले जािारे क्ेत् हे अविकवसत असल्याने सिर क्ेत्ाचा सि्वसमािेशक वनयोजन पद्धतीने विकास करिे आिश्यक असल्याची बाब विचारात घेऊन त्यानुसार याबाबतीत तातडीने उपाययोजना कराियाच्या हेतुने शासन नगरविकास विभागाने अविसूचना क्र. टीपीबी-४३८७/ १७९८/प्र.क्र. ३१७/ ८७/नवि-५, विनांक १६ जून १९८७ अन्िये महाराष्ट्र गृहवनमा्वि ि क्ेत् विकास प्राविकरि यांची सिरहु अविसूचनेमध्ये वनिा्वररत केलेल्या िारािी क्ेत्ासाठी विशेष वनयोजन प्राविकरि म्हिून नेमिूक केली होती ;

आवि ज्याअर्थी, शासन गृहवनमा्वि ि विशेष सहाय्य विभागाने अविसूचना क्र. एसआरपी-१०९५/प्र.क्र. ३७/गृहवनमा्वि कक्, वि. १६ वडसेंबर १९९५ अन्िये "झोपडपट्ी पुनवि्वकास प्राविकरि" यांची झोपडपट्ी पुनि्वसन अविवनयम, १९७१ चे कलम ३अ नुसार झोपडपट्ी पुनवि्वकासासाठी नेमिूक केली आहे ;

आवि ज्याअर्थी, महाराष्ट्र गृहवनमा्वि ि क्ेत् विकास प्राविकरि ने ठराि क्र. ५३८२, वि. १४ वडसेंबर १९९८ अन्िये िारािी क्ेत्ासाठी म्हाडाची विशेष वनयोजन प्राविकरि म्हिून केलेली नेमिूक रद्द करण्याबाबत शासनास विनंती केली होती;

आवि ज्याअर्थी, शासनाने गृहवनमा्वि विभागाकडील शासन वनि्वय क्र. झोपयो २००३/ प्र.क्र. १८९ /झोपसु-१अ, विनांक ४ फेब्ुिारी २००४ अन्िये िारािी विकास कृती योजना राबविण्याचा तसेच िारािी क्ेत्ासाठी झोपडपट्ी पुनि्वसन प्राविकरिाची विशेष वनयोजन प्राविकरि म्हिून नेमिूक करण्याचा वनि्वय घेतला आहे ;

भाग एक (को.वि.पु)-१५–१

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, फेब्ुिारी १४, २०२३/माघ २५, शके १९४४ आवि ज्याअर्थी, शासन नगरविकास विभागाने अविसूचना क्र. टीपीबी-४३०३/३२२/प्र.क्र.५६/०४/नवि-११, विनांक ९ माच्व २००५ अन्िये सिरहू अविसूचनेच्या पररवशष्टटामध्ये नमूि केल्यानुसार िारािी क्ेत्ातील सेक्टर-१ ते ४ चे वनयोजन ि विकास करण्यासाठी झोपडपट्ी पुनवि्वकास प्राविकरिाची उक्त अविवनयमाच्या कलम ४०(१बी) अन्िये विशेष वनयोजन प्राविकरि म्हिून नेमिूक केली आहे ;

आवि ज्याअर्थी, शासन नगरविकास विभागाने अविसूचना क्र. टीपीबी-४३०८/३४९९/प्र.क्र.८३/०९/नवि-११, विनांक २५ जून २००९ अन्िये सिरहू अविसूचनेच्या पररवशष्टटामध्ये नमूि केल्यानुसार िारािी क्ेत्ातील सेक्टर-५ चे वनयोजन ि विकास करण्यासाठी झोपडपट्ी पुनवि्वकास प्राविकरिाची उक्त अविवनयमाच्या कलम ४०(१बी) अन्िये विशेष वनयोजन प्राविकरि म्हिून नेमिूक केली आहे;

आवि ज्याअर्थी, उप प्रमुख अवभयंता, िारािी पुनि्वसन प्रकल्प झोपडपट्ी पुनि्वसन प्राविकरि (यापुढे ज्याचा उल्लेख "उक्त प्राविकरि" असा करण्यात आलेला आहे.) यांनी वि. २१ जानेिारी २०२० रोजीच्या पत्ाद्ारे सिर पत्ात नमूि केल्यानुसार रेल्िेच्या जवमनीचा (अंिाजे १३.९८ हेक्टर) िारािी अविसूवचत क्ेत्ामध्ये समाविष्टट करण्याबाबत तसेच सिर रेल्िेच्या क्ेत्ासाठी झोपडपट्ी पुनवि्वकास प्राविकरिाची विशेष वनयोजन प्राविकरि म्हिून नेमिूक करिेबाबत उक्त अविवनयमाच्या कलम ४०(१बी) अन्िये अविसूचना वनग्ववमत करण्याबाबत शासन नगरविकास विभागास विनंती केली आहे. आवि ज्याअर्थी, सिर पत्ात नमूि आहे की, िारािी क्ेत्ालगत असलेल्या रेल्िे जवमनीचा िारािी अविसूवचत क्ेत्ामध्ये समािेश करण्याबाबत उक्त प्राविकरि ि रेल्िे जमीन विकास प्राविकरि (आरएलडीए ) यांचेमध्ये वि. ३ माच्व २०१९ रोजी सामंजस्य करार झाला आहे ;

आवि ज्याअर्थी, शासन गृहवनमा्वि विभागाकडील शासन वनि्वय क्र. िापुप्र-२०२२/प्र.क्र.८७/झोपसु, विनांक २८ सप्टेंबर २०२२ (यापुढे ज्याचा उल्लेख "सिर शासन वनि्वय" असा करण्यात आलेला आहे.) अन्िये सिरहू सामंजस्य करारास मान्यता विली असून सिर शासन वनि्वयासोबतच्या पररवशष्टट क्र. १ मध्ये नमूि केल्यानुसार िारािी अविसूवचत क्ेत्ांतग्वत असलेल्या रेल्िेच्या अंिाजे ६.२३ हेक्टर क्ेत् जवमनीचा िारािी पुनवि्वकास प्रकल्पामध्ये समािेश करण्यास तसेच सिर शासन वनि्वयासोबतच्या पररवशष्टट क्र. २ मध्ये नमूि केल्यानुसार िारािी अविसूवचत क्ेत्ालगतच्या रेल्िेच्या अंिाजे १२.९१ हेक्टर क्ेत् असलेल्या जवमनीचा िारािी पुनवि्वकास प्रकल्प िारािी अविसूवचत क्ेत्ामध्ये समािेश करण्यास (यापुढे नव्याने समािेश करण्यात आलेल्या ६.२६ हे. + १२.९१ हे. या जवमनीचा उल्लेख "उक्त क्ेत्" असा करण्यात आलेला आहे.) सिर शासन वनि्वयाद्ारे मान्यता विली आहे. आवि ज्याअर्थी मुख्य काय्वकारी अविकारी, िारािी पुनवि्वकास प्रकल्प यांनी वि. १२ जानेिारी २०२३ रोजीचे पत्ान्िये शासन नगरविकास विभागास कळविले आहे की, रेल्िे लँड डेव्हलपमेंट ऑर्ोरीटी (आरएलडीए) आवि उक्त प्राविकरि यांचे मध्ये वि. १८ ऑक्टोबर २०२२ रोजी अंवतम करारनामा वनष्टपावित करण्यात आलेला आहे. त्याअनुषंगाने शासन नगरविकास विभागाने वि. २८ सप्टेंबर २००२ चे शासन वनि्वयानुसार त्याबाबतची अविसूचना वनग्ववमत करून उक्त क्ेत्ासाठी झोपडपट्ी पुनि्वसन प्राविकरिाची विशेष वनयोजन प्राविकरि म्हिून नेमिूक करण्याबाबत काय्विाही करािी अशी विनंती केली आहे ;

आवि ज्याअर्थी, शासन गृहवनमा्वि विभागाकडील वि. २८ सप्टेंबर २०२२ रोजीचा शासन वनि्वय, मुख्य काय्वकारी अविकारी, िारािी पुनवि्वकास प्रकल्प यांची विनंती ि उपरोक्त िस्तुस्स्र्ती विचारात घेता, त्याअनुषंगाने अविसूचना वनग्ववमत करिे आिश्यक असल्याची शासनाची खात्ी झाली आहे.

आता, त्याअर्थी, उक्त अविवनयमाचे कलम ४०(१बी) अन्िये प्राप्त अविकारात आवि त्या संिभा्वतील सि्व शक्तीचा िापर करून शासन याद्ारे :

(अ) खालील पररवशष्टटामध्ये विशेषत्िाने नमूि केलेले क्ेत् हे िारािी पुनवि्वकास प्रकल्प िारािी अविसूवचत क्ेत्ामध्ये समािेश करण्यास मान्यता िेण्यात आल्याचे घोवषत करीत आहे. तसेच,

(ब) खालील पररवशष्टटामध्ये विशेषत्िाने नमूि केलेले सिरहू क्ेत्ाचे वनयोजन ि विकास करण्यासाठी "झोपडपट्ी पुनवि्वकास प्राविकरि" ची विशेष वनयोजन प्राविकरि म्हिून नेमिूक करत आहे. तसेच,

(क) सिरची अविसूचना शासकीय राजपत्रामध्ये प्रवसद्ध झालेचा विनांक हा सिर अविसूचना अंमलात आलेचा विनांक असेल.

पररवशष्ट्ट

i) शासन गृहवनमा्वि विभागाकडील शासन वनि्वय क्र. िापूप्र-२०२२/प्र.क्र.८७/झोपसु, वि. २८ सप्टेंबर २०२२ चे पररवशष्टट-१ मध्ये नमूि रेल्िेची जमीन (अंिाजे क्ेत् ६.२६ हे.) आवि ज्याच्या चतु: सीमा :-

ii) शासन गृहवनमा्वि विभागाकडील शासन वनि्वय क्र. िापूप्र-२०२२/प्र.क्र.८७/झोपसु, वि. २८ सप्टेंबर २०२२ चे पररवशष्टट-२ मध्ये नमूि रेल्िेची जमीन (अंिाजे क्ेत् १२.९१ हे.) आवि ज्याच्या चतु: वसमा :-

सिर अविसूचनेची प्रत ि नकाशा वनरीक्िाकररता पुढील एक मवहन्याच्या कालािीमध्ये खालील काया्वलयामध्ये उपलब्ि असेल :-

िारािी पुनि्वसन प्रकल्प झोपडपट्ी पुनि्वसन प्राविकरि, ५िा मजला, गृहवनमा्वि भिन, िांद्े (पूि्व), मु ंबई-५१.

उप संचालक, नगररचना, बृहन्मु ंबई, इन्सा हटमेंट, ई-ब्ललॉक, महापावलका माग्व, मु ंबई-०१.

URBAN DEVELOPMENT DEPARTMENT

NOTIFICATION

Maharashtra regional and town Planning act, 1966.

No. TPB-4323/UOR-7/CR-18/2023/UD-11.—Whereas, the Government in Urban Development Department vide Notification No. TPB-4385/40198/CR-776/85/UD-5, dated the 26th May 1987 has sanctioned a Revised Development Plan for Dharavi Area from "G" North Ward under the provisions of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act"); And whereas, the Government of Maharashtra considered that areas from 'G' North ward known as " Dharavi Area" was in undeveloped condition and need to be developed in a comprehensive manner and for this purpose, to take urgent and appropriate steps for the said development, Government of Maharashtra Urban Development Department vide Notification No. TPB-4387/1798/CR-317/87/ UD-5, dated 3rd June 1987 had appointed Maharashtra Housing and Area Development Authority as the Special Planning Authority for Planning and Development of "Dharavi Area" more specifically defined in the schedule therein ;

Whereas, for Dharavi Area, Government of Maharashtra by Notification Housing and Special Assistance Department, vide Notification No. SRP-1095/CR-37/Housing Cell, dated 16th December 1995, has appointed "Slum Rehabilitation Authority" under provision of section 3A of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 for Slum Redevelopment ;

And whereas, the Maharashtra Housing and Area Development Authority by Resolution No. 5382 of 14th December 1998, has requested the State Government to denotify Maharashtra Housing and Area Development Authority for Dharavi Area ;

And whereas, the Government of Maharashtra vide Government Resolution of Housing Department No. झोपयो-२००३/प्र.क्र. १८९/झोपसु-१-अ, dated 4th February 2004 had resolved to implement Dharavi Development Action Plan and to declare "Slum Rehabilitation Authority" as Special Planning Authority for the said Area;

And whereas, the State Government in Urban Development Department vide Notification No. TPB-4303/322/CR-56/4/UD-11, dated 9th March 2005 has appointed Slum Rehabilitation Authority as the Special Planning Authority for the Planning and Development of Dharavi Area namely Sector 1 to 4, more specifically defined in the Schedule therein, under sub-section (1B) of section 40 of the said ;

And whereas, the State Government in Urban Development Department vide Notification No. TPB-4308/3499/CR-83/09/UD-11, dated 25th June 2009, has appointed Slum Rehabilitation Authority as the Special Planning Authority for the Planning and Development of Dharavi Area namely area of Sector 5, more specifically defined in the Schedule therein, under sub-section (1B) of section 40 of the said Act;

And whereas, Dy. Chief Engineer, Dharavi Redevelopment Project Slum Rehabilitation Authority (hereinafter referred to as "the said Authority") vide his letter dated 21st January 2020 has requested Government in Urban Development Department to issue notification under sub- section (1B) of section 40 of said Act to include Railway land admeasuring about 13.98 Hector as specified therein, in Dharavi Notified Area and to declare Slum Rehabilitation Authority as Special Planning Authority for said railway land area. And whereas, it is stated in said letter that the Memorandum of Understanding (MoU) is signed between Railway Land Development Authority (RLDA) and the said authority regarding the transfer of Railway land adjacent to Dharavi Notified Area (DNA) on March 3, 2019 ;

And whereas, the Government in Housing Department vide GR No.िापूप्र-२०२२/प्र.क्र.८७/झोपसु, dated 28th September 2022 (hereinafter referred to as "the said G.R.") has accorded sanction to the aforesaid MoU and Further has granted permission to include the 6.23 Hector Railway land situated in DNA in Dharavi Redevelopment Project as specifically described in the schedule-1 appended to said GR, and to include the Railway land of approx. area of 12.91 Hector adjacent to DNA in Dharavi Redevelopment Project as specifically described in the schedule-2 appended to said GR. [hereinafter this newly included land (approx. 6.26 Hector + 12.91 Hector) in Dharavi Redevelopment Project along with Dharavi Notified Area is referred to as "the said Area"]. And whereas, C.E.O. Dharavi Redevelopment Project vide his letter dated 12th January 2023 has informed the Government in Urban Development Department that Definite Agreement is now executed between RLDA and the said Authority on dt. 18th October 2022 and thereby requested, Government in Urban Development Department to issue notification as per GR dated 28th September 2022 so as to appoint the said Authority as Special Planning Area for the said Area;

And whereas, after considering the Government in Housing Department's GR dated 28th September 2022, request of C.E.O. Dharavi Redevelopment Project and considering the above stated facts, Government is of the opinion that the necessary Notification is required to be issued ;

Now therefore, in exercise of the powers conferred by sub-section (1B) of section 40 of the said Act and all powers enabling it in this behalf, the Government of Maharashtra hereby :—

(A) Sanctions and declares that the said Area more specifically as described in the Schedule given below, is included in Dharavi Notified Area (DNA) and in Dharavi Redevelopment Project.

(B) Appoints "Slum Rehabilitation Authority" as the Special Planning Authority for the said area for planning and development more specifically defined in the schedule here under :—

(C) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this Notification.

Schedule

(i) Railway land having area (Approx. 6.26 Hector) as specified in Schedule-1 of Government in Housing Department G.R. No. िापूप्र-२०२२/प्र.क्र.८७/झोपसु, dated ²⁸th September ²⁰²² and bounded on :—

(ii) Railway land having area (Approx. 12.91 Hector) as specified in Schedule-2 of Government

A copy of this Notification along with plan shall be made available for inspection for a period of one month at the following offices :—

(1) Dharavi Redevelopment Project Slum Rehabilitation Authority, 5th Floor, Grihanirman Bhavan, Bandra (E.), Mumbai-51.

(2) Deputy Director of Town Planning, Greater Mumbai, ENSA Hutment, Mahapalika Marg, Mumbai.
