Bill No. I of 2023), introduced in the Maharashtra Legislative Assembly on the 27th February 2023, is hereby published under the authority of the Governor.

further to amend the Mumbai Municipal Corporation Act and the
Maharashtra Municipal Corporations Act.

LIX of 1949.
WHEREAS it is expedient further to amend the Mumbai Municipal Corporation Act and the Maharashtra Municipal Corporations Act, for the purposes hereinafter appearing ; it is hereby enacted in the Seventy-fourth Year of the Republic of India, as follows :—
CHAPTER I
PRELIMINARY
Short title.
1. This Act may be called the Mumbai Municipal Corporation and Maharashtra Municipal Corporations (Amendment) Act, 2023.

CHAPTER II
AMENDMENT TO THE MUMBAI MUNICIPAL CORPORATION ACT.
III of 1888.
Amendment of section 5 of III of 1888.
2. In section 5 of the Mumbai Municipal Corporation Act, in sub-section (1), in clause (b), for the words " five nominated councillors " the words "ten nominated councillors" shall be substituted.
CHAPTER III
AMENDMENT TO THE MAHARASHTRA MUNICIPAL CORPORATIONS ACT.
LIX of 1949.
Amendment of section 5 of LIX of 1949.
3. In section 5 of the Maharashtra Municipal Corporations Act, in sub-section (2), in clause (b), for the words "not exceeding five" the words " not exceeding ten per cent. of the total number of elected Councillors or ten, whichever is less " shall be substituted.

Clause (b) of sub-section (1) of section 5 of the Mumbai Municipal Corporation Act (III of 1888) provides that the Corporation shall consist of five nominated councillors having special knowledge or experience in the Municipal Administration and clause (b) of sub-section (2) of section 5 of the Maharashtra Municipal Corporations Act (LIX of 1949) provides that each Corporation shall consist of such number of nominated councillors not exceeding five having special knowledge or experience in the Municipal Administration.
2. A person having knowledge and experience in the Municipal Administration is nominated as a councillor for more effective administration of municipal corporations in the State. With a view to qualitatively improve the functioning of the corporations by utilizing the knowledge and experience of the members so nominated, the Government considers it expedient to increase the number of nominated members from five to ten, in the Municipal Corporation of Brihan Mumbai; and from not exceeding five to not exceeding ten per cent. of the total number of elected Councillors or ten, whichever is less in the other Municipal Corporations in the State. It is, therefore, proposed to amend section 5 (1)(b) of the Mumbai Municipal Corporation Act and section 5 (2)(b) of the Maharashtra Municipal Corporations Act, suitably.
3. The Bill seeks to achieve the above objectives.
