आिण (cid:249)याअथ(cid:559), क(cid:269)याण ड(cid:635)िबवली शहरातील से(cid:242)टर ३ ते ७ करीताची सुधारीत िवकास योजना शासनाने उ(cid:242)त अिधिनयमाचे कलम ३१(१) नुसार शासन िनण(cid:593)य (cid:312). िटपीएस-१२०८/२८८४/सी.आर.-१३९/०९/पाट(cid:595)-२/निव-१२, िदनांक ४ एि(cid:332)ल २०१२ अ(cid:261)वये मंजूर क(cid:577)ली असून िदनांक १० ऑ(cid:242)टोबर २०१२ पासुन अंमलात आली. तसेच से(cid:242)टर ३ ते ७ करीता(cid:247)या सुधारीत िवकास योजनेतील वगळलेले (cid:550)े(cid:327) (Excluded Part EP) शासन िनण(cid:593)य (cid:312). िटपीएस-१२१२/४५८/सी.आर. १४८/१२/निव-१२ िदनांक ४ ऑग(cid:274)ट २०१६ अ(cid:261)वये शासनाने उ(cid:242)त अिधिनयमानुसार मंजुर क(cid:577)ले असुन, िदनांक १ ऑ(cid:242)टोबर २०१६ पासुन अंमलात आली आहे.

आिण (cid:249)याअथ(cid:559), ठाणे िज(cid:269)(cid:481)ातील क(cid:269)याण व अंबरनाथ तालु(cid:242)यामधील क(cid:269)याण ड(cid:635) िबवली महानगरपािलका (cid:550)े(cid:327)ात न(cid:271)याने समािव(cid:273)ट झाले(cid:269)या २७ गावांकरीताची िवकास योजना शासनाने उ(cid:242)त अिधिनयमाचे कलम ३१(१) नुसार शासन िनण(cid:593)य (cid:312). िटपीएस- १२१२/१६१७/सी.आर.-१०१/निव-१२ िदनांक ११ माच(cid:593) २०१५ अ(cid:261)वये मंजुर क(cid:577)ली असुन िदनांक १० ऑ(cid:242)टोबर पासुन अंमलात आली. तसेच २७ गावांकरीता(cid:247)या िवकास योजनेतील वगळलेले (cid:550)े(cid:327) (Excluded Part EP) शासन िनण(cid:593)य (cid:312). िटपीएस-१२१६/ सी.आर.-२४०/१६/निव-१२ िदनांक ९ मे २०१७ अ(cid:261)वये शासनाने उ(cid:242)त अिधिनयमानुसार मंजुर क(cid:577)ले असुन, िदनांक १ ऑ(cid:242)टोबर पासुन अंमलात आली आहे.

भाग दोन-२२–१२ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग दोन, फ(cid:577)(cid:334)ुवारी २८, २०२३/फा(cid:269)गुन ९, शक(cid:577) १९४४ आिण, (cid:249)याअथ(cid:559) शासनाने उ(cid:242)त अिधिनयमा(cid:247)या कलम ३७ (१)(क)(क)(ग) व कलम २०(४) नुसार शासन िनण(cid:593)य (cid:312). िटपीएस-१८१८/सी.आर.-२३६/१८/िवयो व (cid:332)ा.यो/ कलम ३७(१)(क)(क)(ग) व कलम २०(४)/निव-१३ िदनांक - २ िडस(cid:606)बर २०२० अ(cid:261)वये मंजुर क(cid:577)लेली आहे व िद. ३ िडस(cid:606)बर २०२० पासुन अंमलात आली असुन सदर िनयमावली क(cid:269)याण ड(cid:635)िबवली महानगरपािलक(cid:577)स लागु आहे. (यापुढ(cid:578) "उ(cid:242)त िनयमावली" असा उ(cid:269)लेख क(cid:577)ला आहे.)

आिण (cid:249)याअथ(cid:559) शहरातील मो(cid:450)ा (cid:332)माणावर असले(cid:269)या जु(cid:261)या मोडकळीस आले(cid:269)या आिण अनािधक(cid:565)त इमारत(cid:558)चे िनयोजनब(cid:460) व सुिनयोिजत पुनिव(cid:593)कास हो(cid:256)याकरीता रा(cid:249)याकरीता(cid:247)या एकि(cid:327)क(cid:565)त िवकास िनयं(cid:327)ण व (cid:332)ो(cid:257)साहन िनयमावलीतील िविनयम (cid:312). १४.८ अ(cid:261)वये नागरी पुन(cid:543)(cid:258)थान योजनेची तरतुद क(cid:577)लेली आहे.

आिण (cid:249)याअथ(cid:559), उ(cid:242)त िनयमावलीतील िविनयम (cid:312). १४.८.१(ii)(b) (cid:247)या तरतुदीनुसार क(cid:269)याण ड(cid:635)िबवली महानगरपािलका ह(cid:459)ीम(cid:260)ये ४१ नागरी पुन(cid:543)(cid:258)थान आराखड(cid:578) िद. १२.०९.२०२२ रोजी(cid:247)या शासन राजप(cid:327)ाम(cid:260)ये अिधसुिचत कर(cid:256)यात आले आहेत.

आिण (cid:249)याअथ(cid:559), (cid:274)थािनक (cid:332)ितिनधी, नागरीक यां(cid:247)या मागणीनुसार गु ंजाळ चौक यु.आर.पी. (cid:312). ११ व यु.आर.पी. (cid:312). ३५ कोळसेवाडी मधील उव(cid:593)रीत (cid:550)े(cid:327) यु.आर.पी. (cid:312). ३५ कोळसेवाडी (cid:550)े(cid:327)ात समािव(cid:273)ट कर(cid:256)यास सुिचत क(cid:577)ले आहे.

आिण (cid:249)याअथ(cid:559), उ(cid:242)त (cid:550)े(cid:327) हे यु.आर.पी. (cid:312). ३५ कोळसेवाडी (cid:247)या ह(cid:459)ीलगत अस(cid:269)याने सदरचे (cid:550)े(cid:327) यु.आर.पी. (cid:312). ३५ कोळसेवाडी म(cid:260)ये समािव(cid:273)ट कर(cid:256)याचे (cid:332)(cid:274)तािवत आहे (यापुढ(cid:578) (cid:332)(cid:274)तािवत (cid:550)े(cid:327) असा उ(cid:269)लेख क(cid:577)ला आहे) .

(cid:249)याअथ(cid:559), उ(cid:242)त िनयमावलीतील िविनयम (cid:312). १४.८.१ (ii)(b) (cid:247)या तरतुदीनुसार नागरी पुन(cid:543)(cid:257)थान आराखडा तयार करणेचे, अिधसुिचत कर(cid:256)याचे आिण जे(cid:271)हा आव(cid:272)यक असेल ते(cid:271)हा सुधारीत कर(cid:256)याचे अिधकार आयु(cid:242)त यांना अस(cid:269)याचे नमुद आहे. तथािप, उ(cid:242)त िवकास िनयं(cid:327)ण िनयमावलीतील िविनयम (cid:312). १४.८.१ (i) (cid:247)या प(cid:555)र(cid:247)छ(cid:578)त २ नुसार नागरी पु(cid:543)(cid:274)थान योजने(cid:247)या ह(cid:459)ी, र(cid:274)ता, नाला िक(cid:573)वा रे(cid:269)वे लाईन अशा भौितक ह(cid:459)(cid:558)नी वेढले(cid:269)या नस(cid:269)यास, उ(cid:247)चािधकारी सिमतीशी स(cid:269)लामसलत क(cid:543)न, समुहा(cid:247)या ह(cid:459)ी मा. महापािलका आयु(cid:242)त िन(cid:556)(cid:272)चत क(cid:543) शकतात.

आिण (cid:249)याअथ(cid:559), उ(cid:242)त िनयमावलीमधील िविनयम (cid:312). १४.८.१ (ii)(b) अ(cid:261)वये मला (cid:332)दान अिधकारा(cid:261)वये, शहरा(cid:247)या ह(cid:459)ीतील यु.आर.पी. (cid:312). ३५, कोळसेवाडी यापुव(cid:559)(cid:247)या अिधसुिचत ह(cid:459)ीम(cid:260)ये बदल क(cid:543)न सुधारीत ह(cid:459)ीचा आराखडा यु.आर.पी. (cid:312). ३५, कोळसेवाडी (सुधारीत (cid:550)े(cid:327) अंदाज ६०.०० हे(cid:242)टर) (cid:266)हणुन अिधसुिचत करीत आहे.

सदर आराख(cid:454)ाची ह(cid:459) दश(cid:593)िवणारे नकाशे जनते(cid:247)या अवलोकनाथ(cid:593) खालील िठकाणी पुढील तीस िदवसांकरीता ठ(cid:578)व(cid:256)यात येत आहेत.

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Revised Draft Development Plan of Sector 1 and 2 of the city of Kalyan- Dombivali has been sanctioned by the Government in the Urban Development Department, under section 31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as "the said Act") vide Notification No.TPS-1299/1910/CR34/2000/UD-12 dated 3rd September 2005 which has come into force with effect from 10th October, 2005, and the Excluded Parts(EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS/1207/604/C.R. 494/08/UD-12 dated 14th September,2009 which has come into force with effect from the 1st October,2009.

And whereas, the Revised Draft Development Plan of Sector 3-7 of the city of Kalyan- Dombivali has been sanctioned by the Government in the Urban Development Department, under section31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as "the said Act") vide Notification No.TPS-1208/2884/C.R.139/09/(Part-2)/UD-12 dated 4th April, 2012 which has come into force with effect from 10th October,2012, and the Excluded Parts(EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS/1212/458/C.R. 148/12/UD-12 dated 4th August, 2016 which has come into force with effect from the 1st October,2016.

And whereas, the Draft Development Plan of 27 villages of Kalyan and Ambarnath Talukas from Thane district has been sanctioned by the Government in the Urban Development Department, under section31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as the said Act") vide Notification No.TPS-1212/1697/C.R.101/13/UD-12 dated 11th March, 2015 which has come into force with effect from 10th October,2015, and the Excluded Parts(EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS/1216/C.R. 240/16/UD-12 dated 9th May, 2017 which has come into force with effect from the 1st October,2017.

And whereas, the Unified Development Control & Promotion Regulations (hereinafter referred to as "the said Regulation") has been sanctioned by the State Government under Section 37 (1AA) (c) and section 20(4) of the said Act vide Notification No. TPS-1818/C. R-236/18/DP & RP/Sec.37(1AA) (c) and section 20(4)/UD-13 dated 2nd December 2020 which has come into force with effect from the 3rd December 2020.

And whereas, the Government to have planned and controlled redevelopment of large number of old, dilapidated and unauthorized buildings in the state has introduced special regulation provisions in respect of "Urban Renewal Schemes" under the Regulation No.14.8 of UDCPR.

And whereas, as mentioned in the regulation No.14.8.1(ii) (b) of the said regulations 41 Urban Renewal Plans are notified by Commissioner in Government Gazette Dated 12.09.2022 within the Limit of Kalyan Dombivli Municipal Corporation;

And whereas as per the Demand from Local Public and Representative the area between Gunjal Chowk URP No. 11 and URP No. 35 Kolasewadi proposed to be include in the URP No. 35 Kolshewadi;

And whereas, since the said area is adjacent to boundaries of earlier Notified URP No. 35 Kolshewadi , this area is proposed to be merged in URP No. 35 Kolshewadi ( herein after referred as 'the area under proposal');

And whereas, as mentioned in the Regulation No. 14.8.1(i) (b) of the said Regulations, that commissioner can prepare and notify Urban Renewal Plan and revise the same, as and when required. But, as mentioned in the para -2 of Regulation No. 14.8.1(i) of the said Regulations, if URS is not bounded by physical boundaries such as roads, nallahs and railway lines, then the boundary of the cluster can be decided / finalized by Municipal Commissioner, in consultation with High Power Committee (HPC).

Now therefore, as per powers conferred to me vide regulation No.14.8.1(ii) (b) of the said Regulations the notified boundaries of URP No. 35 Kolshewadi are changed and revised boundary of URP No. 35 Kolshewadi (Revised area approx. 60.00 Ha.) is hereby notified.

The Plans showing the boundaries of Urban Renewal Plans area is Kept for inspection by public at following places for next Thirty Days:—

1. Office of the Assistant Director of Town Planning, Town Planning Department, Kalyan- Dombivali Municipal Corporation.

2. Offices of the Assistant Municipal Commissioners of the respective wards of KDMC.

This notification and notified plans are also available on official website www.kdmc.gov.in.
