NOTIFICATION

No. SPP.2023/UOR No. 04/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974) the Government of Maharashtra hereby appoints Adv. Kaushik M. Mhatre as " Special Public Prosecutor " for conducting the case/s in Hon'ble Sessions Court, Mumbai, which is/are arising out of C.R. No. 777/ 2022 registered at Tilaknagar Police Station, Mumbai.

2. The fees of Adv. Kaushik M. Mhatre, Special Public Prosecutor, shall be paid by Home Department as per the fee proposal agreed by Home Department and approved by this Department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

क्रमांक जिउनि-यवत/वि-२/राजराजेश्वर पत./कलम १५६/३७२/२०२३.----- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, नानासाहेब चव्हाण, जिल्हा उप निबंधक, सहकारी संस्था, यवतमाळ या आदेशान्वये अध्यक्ष श्री. राजराजेश्वर नागरी सहकारी पतसंस्था मर्या., पुसद, र.न. ६७४, ता. पुसद, जि. यवतमाळ या संस्थेच्या संचालक मंडळ यांची सभा दिनांक १७ ऑगस्ट २०२२ रोजीचे ठरावामध्ये नमुद कर्मचारी / अधिकारी यांना त्यांच्या नावासमोर दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्जवसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) व नियम, १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०२३ या कालावधीकरिता प्रदान करीत आहे :-----

अ.क्र. अधिकार प्रदान केलेल्या अधिकार प्रदान केलेल्या शक्तीची व्याप्ती कार्यक्षेत्र अधिकायांचे नाव अधिकायाचा हुद्दा

(१) (२) (३) (४) (५) १ सौ. मंजुषा शुक्लकुमार वाकडे वसुली अधिकारी विशेष वसुली अधिकारी तालुका वरीलप्रमाणे वाचा क्रमांक ५ नुसार संस्थेच्या वसुली अधिकायांना याबाबत सुचीत करण्यात येते की, त्यांनी जप्त केलेल्या मालमत्तेचा कर्जदाराकडील ताबा. जोपयर्ंत अशी मालमत्ता सार्वजनिक लिलावात विकली जाणार नाही तोपयर्ंत घेऊ नये.

वरीलप्रमाणे अधिकार खाली नमूद केलेल्या अटी व शतर्ींस अधिन राहून प्रदान करण्यात आलेले आहेत.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्जवसुलीची कार्यवाही करावी. कर्जवसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१, ९८ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दरमहा सोबत जोडलेल्या विहित नमुन्यात " अ-३ ", " अ-४ ", व " ब " कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनीदेखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी वसूल केलेल्या संपुर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलानाने शासकीय कोषागारात करावा. वसूली अधिकारी यांनी वसुल केलेला सरचार्ज, त्यांच्या शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वंतत्र नोंदवही ठेवण्यात यावी. त्याबाबत नमुना " अ-१ ", " अ-२ ", व " अ-४ ", सोबत जोडलेला आहे.

(६) " मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्र. १९४२/२०१३ दि बेसन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५, रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करतांना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधनकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निर्दशनास आल्यास प्रदान केलेले अधिकार काढुन घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०५/प्र.क्र. २३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायांस त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा ""सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे कलम १०७ अन्वये)"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी ........................... सहकारी बँक/ पतसंस्था ........................... "" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जमिनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जमिनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास थकबाकीदारांकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व सरर्चाज रक्कम याशिवाय इतर कोणतीही रक्कम वसुल करता येणार नाही.

(१३) सहकार आयुक्त कार्यालयाचे आदेश / परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकायांनी करावयांची कार्यवाही यामधील मार्गदर्शक सुचनाचे पालन करावे, बँकेचे/पतसंस्थेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायाचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१४) वसुली अधिकारी यांनी निर्गमीत करावयाच्या नोटीस / आदेश / घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

क्रमांक संकीर्ण-२०२३/प्र.क्र. ५०/सेवा-३.----- सार्वजनिक बांधकाम विभागातील श्री. नरेश यादव मानकर, कनिष्ठ अभियंता, सार्वजनिक बांधकाम विभाग, अंबाजोगाई यांचे दिनांक ३१ डिसेंबर २०२२ रोजी निधन झाले असल्याने, दिनांक ३१ डिसेंबर २०२२ पासून त्यांची शासन सेवा समाप्त झालेली आहे.

क्रमांक ४३३२/क-१.----- उपरोक्त संदर्भ क्र. २ वरील ज्ञापनान्वये एस-२३: ६७,७००---२,०८,७०० या वेतनस्तरातील अवर सचिव (विधि) हे पद एस-२५: ७८८००---२०९२०० या वेतनस्तरातील उप सचिव (विधि) या पदामध्ये उन्नत करण्यात आले असून या पदावर या सचिवालयातील श्रीमती सायली सु. कांबळी, अवर सचिव यांची कायम बदलीने तात्काल स्थान्नापन्न नियुक्ती करण्यात आली आहे.

क्रमांक स्वेसेनि-२०२२/प्र.क्र. १३/आस्थापना-१.-----श्री. मंगेश हिंदूराव बनसोडे, अवर सचिव, इतर मागास बहुजन कल्याण विभाग, मंत्रालय, मुंबई यांनी त्यांच्या दिनांक २४ जानेवारी २०२३ च्या अर्जर्ाद्वारे महाराष्ट्र नागरी सेवा (निवृत्तीवेतन) नियम १९८२ च्या नियम ६५ (२)(बी) मधील तरतुदीनुसार स्वेच्छेने सेवानिवृत्त होण्यासाठी नोटीस दिली आहे.

महाराष्ट्र नागरी सेवा (निवृत्तीवेतन) नियम १९८२ च्या नियम ६५(२)(बी) नुसार श्री. बनसोडे यांची सदर स्वेच्छा सेवानिवृत्तीची नोटीस स्वीकारण्यात येत आहे. त्यानुसार श्री. मंगेश हिंदूराव बनसोडे, अवर सचिव हे दिनांक २४ फेब्रुवारी २०२३ (म.पू.) पासून स्वेच्छेने सेवानिवृत्त होत आहेत.

क्रमांक सेनिवे-२०१७/प्र.क्र. २०८/का-१.----उपरोक्त संदर्भाधीन दिनांक ३० ऑक्टोबर २०१७ रोजीचे कार्यालयीन आदेश अधिक्रमित करण्यात येत असून श्री. प्रविण दे. परदेशी, कक्ष अधिकारी यांनी दिनांक १ ऑगस्ट २०१७ अन्वये दिलेली स्वेच्छा सेवानिवृत्ती नोटीसीच्या अनुषंगाने श्री. परदेशी यांना महाराष्ट्र नागरी सेवा (निवृत्तीवेतन) नियम, १९८२ मधील नियम ६५ व म.ना.से (रजा) नियम १९८१ नियम ६६(२) खालील टिपेनुसार तसेच वित्त विभाग शासन निर्णय दिनांक २३ ऑक्टोबर २००५ परिशिष्ट १ रकाना ३ (ब) समोरील शेरा क्रम. ६ मधील तरतुदीनुसार दिनांक २ ऑगस्ट २०१७ (म.पू.) पासून शासकीय सेवेतू स्वेच्छा सेवानिवृत्त करण्यात येत आहे.

२. सदर कार्यालयीन आदेश वित्त विभागाच्या अनौ. संदर्भ क्र. १४/२३/सेवा-६, दिनांक २३ जानेवारी २०२३ रोजीच्या सहमतीस अनुसरून निर्गमित करण्यात येत आहे.

अधिसूचना

विधि व न्याय विभाग अधिसूचना क्रमांक इएसटी-२०२१/प्र.क्र.४२/दोन, दिनांक ७ जून २०२१ अधिक्रमित करण्यात येत आहे.

क्रमांक पीईएन-२०२१/प्र.क्र.४२/दोन.----- विभागाच्या दिनांक १८ जानेवारी २०२० रोजीच्या कार्यालयीन आदेशान्वये श्री. म. चि. अंतर्ुलिकर, कक्ष अधिकारी यांच्या सेवा अधिसंख्य पदावर वर्ग करण्यात आल्या. तसेच दिनांक २० मार्च २०२०, दिनांक १८ डिसेंबर २०२० अन्वये अधिसंख्य पदांना तांत्रिक खंड न देता मुदतवाढ देण्यात आली. श्री. अंतर्ुलिकर यांच्या सेवा अधिसंख्य पदावर वर्ग करण्यात आल्या नसत्या, तर ते दिनांक ३१ मे २०२१ (म.नं.) रोजी नियत वयोमानाने सेवानिवृत्त झाले असते. सबब, श्री. म. चि. अंतर्ुलिकर, कक्ष अधिकारी यांची अधिसंख्य पदावरील सेवा दिनांक ३१ मे २०२१ (म.नं.) पासून विभागाच्या दिनांक ७ जून २०२१ रोजीच्या अधिसूचनेन्वये समाप्त करण्यात आली होती.

आता, सामान्य प्रशासन विभागाच्या दिनांक १४ डिसेंबर २०२२ रोजीच्या शासन निर्णयातील तरतुदीनुसार अनुसूचित जमातीचे जात प्रमाणपत्र अवैध ठरल्यामुळे ज्या शासकीय अधिकारी/कर्मचारी यांना अधिसंख्य पदावर वर्ग केले आहे. अशा अधिसंख्य पदावरील अधिकारी व कर्मचारी यांना सेवाविषयक तसेच सेवानिवृत्तीचे लाभ देण्याबाबत सूचित करण्यात आले आहे.

त्यानुसार, श्री. म. चि. अंतर्ुलिकर, कक्ष अधिकारी यांना अधिसंख्य पदावरून दिनांक ३१ मे २०२१ (म.नं.) पासून नियत वयोमानाने शासकीय सेवेतून सेवानिवृत्त करण्यात येत आहे. सदर अधिसूचना सामान्य प्रशासन विभागाने त्यांच्या अनौपचारिक संदर्भ क्र. ०७/१६/१६ब(ब), दिनांक ६ जानेवारी २०२३ अन्वये दिलेल्या मान्यतेनुसार निर्गमित करण्यात येत आहे.
