क्रमांक टिपीएस-१२९९/१४९९/प्र.क्र.१५३/९९/नवि-१२.— ज्याअर्थी, केंद्र शासनाच्या वन व पर्यावरण विभागाने दिनांक २० जून १९९१ रोजीच्या अधिसूचनेन्वये डहाणू तालुका पर्यावरण दृष्टया संवेदनशील असल्याचे घोषित करून, राज्य शासनाने डहाणू तालुक्याचा मास्टर प्लॅन/ रिजनल प्लॅन तयार करून त्यास केंद्र सरकारच्या पर्यावरण व वन मंत्रालयाची मान्यता घेणेचे सूचित केले आहे ;
आणि ज्याअर्थी, राज्य शासनाने डहाणू नगरपरिषदेची विकास योजना, केंद्र शासनाच्या वन व पर्यावरण विभागाच्या मंजूरीसापेक्ष (यापुढे जिचा उल्लेख " उक्त विकास योजना " असा करण्यात आला आहे), महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे जिचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे) चे कलम ३१(१) अन्वये शासन नगरविकास विभागाची अधिसूचना क्रमांक टिपीएस-१२९९/१४९९/ प्र.क्र.१५३/९९/नवि-१२, दिनांक ४ एप्रिल २०१२ (यापुढे जिचा उल्लेख " उक्त अधिसूचना क्र.१ " असा करण्यात आला आहे) अन्वये मंजूर केली असून, सदर विकास योजना अंमलात येण्यासंबंधी खालील निर्णय नमूद करण्यात आला आहे ;
d) After the approval of the Government of India in Ministry of Environment & Forest Department, the notification regarding the implementation of Development Plan alongwith it's Development Control Regulations (excluding the said Excluded Parts of Draft Development Plan as mentioned in the Schedule – II) will be issued separately under the provisions of Section 31(4) of Maharashtra Regional and Town Planning Act, 1966.
आणि ज्याअर्थी, तद्नंतर राज्य शासनाने उक्त विकास योजनेच्या वगळलेल्या भागाची विकास योजना देखील केंद्र शासनाच्या वन व पर्यावरण विभागाच्या मंजूरीसापेक्ष, उक्त अधिनियमाचे कलम ३१(१) अन्वये शासन नगरविकास विभागाची अधिसूचना क्रमांक टिपीएस-१२१५/८४२/ प्र.क्र.११५/१५/नवि-१२, दिनांक २१ जानेवारी २०१६ (यापुढे जिचा उल्लेख " उक्त अधिसूचना क्र.२ " असा करण्यात आला आहे) अन्वये मंजूर केली असून, सदर विकास योजना अंमलात येण्यासंबंधी खालील निर्णय नमूद करण्यात आला आहे ;
d) After the approval of the Government of India in Ministry of Environment & Forest Department, the notification regarding the implementation of Excluded Part of the said Development Plan will be issued separately under the provisions of Section 31(4) of Maharashtra Regional and Town Planning Act, 1966.

भाग एक (को.वि.पु.)--२३-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक----कोकण विभागीय पुरवणी, मार्च १३, २०२३/फाल्गुन २२, शके १९४४ आणि ज्याअर्थी, केंद्र शासनाच्या पर्यावरण व वन विभागाने दिनांक २० जून १९९१ रोजी पारीत केलेल्या अधिसूचनेमधील तरतूदीनुसार, उक्त विकास योजना ही राज्य शासनाने दिनांक ५ जानेवारी २०१७ रोजीच्या पत्रान्वये केंद्र शासनाकडे मंजूरीसाठी सादर केली होती ;
आणि ज्याअर्थी, केंद्र शासनाच्या पर्यावरण व वन विभागाने यापुर्वी दिनांक २० जून १९९१ रोजी निर्गमित केलेल्या अधिसूचनेमध्ये सुधारणा केली असून, त्यामधील " get the plan approved by the Ministry of Environment & Forest" या वाक्यांशा ऐवजी "get the plan approved by the Competent Authority in the State Government for its effective implementation" हा वाक्यांश दिनांक २२ फेब्रुवारी २०२१ रोजी निर्गमित केलेल्या अधिसूचनेनुसार अंतभर्ूत केला आहे ;
आणि ज्याअर्थी, सदस्य सचिव, डहाणू तालुका पर्यावरण संरक्षण प्राधिकरण यांनी दिनांक ३ डिसेंबर २०२१ रोजीच्या पत्रान्वये, डहाणू तालुका पर्यावरण संरक्षण प्राधिकरणाच्या दिनांक १४ ऑक्टोबर २०२१ रोजीच्या तिसया बैठकीमध्ये संमत केलेल्या ठराव क्र. ३ नुसार, केंद्र शासनाच्या पर्यावरण व वन विभागाच्या दिनांक २२ फेब्रुवारी २०२१ रोजीच्या अधिसूचनेमध्ये करण्यात आलेली सुधारणा विचारात घेता, राज्य शासनाच्या नगरविकास विभागाने डहाणू नगरपरिषदेची विकास योजना मंजूर करण्याच्या अनुषंगाने पुढील निर्णय घेणे योग्य राहील, असे शासनास सूचित केले आहे ;
आणि ज्याअर्थी, वर नमुद वस्तुस्थिती विचारात घेऊन, डहाणू नगर परिषद क्षेत्राची उक्त विकास योजना व विकास योजनेच्या वगळलेल्या भागाच्या विकास योजनेबाबत उक्त अधिनियमाच्या कलम ३१(१) अन्वये शासन नगरविकास विभागाने निर्गमित केलेल्या अनुक्रमे दिनांक ४ एप्रिल २०१२ व दिनांक २१ जानेवारी २०१६ रोजीच्या उक्त अधिसूचना क्र. १ व २, ह्य उक्त अधिनियमाच्या कलम ३१(४) अन्वये उक्त विकास योजना अंमलात आणण्याविषयीची अधिसूचना निर्गत करणे आवश्यक आहे, असे शासनाचे मत झाले आहे.
आता त्याअर्थी, शासन, उक्त अधिनियमाच्या कलम ३१(४) अन्वये प्राप्त अधिकारात, डहाणू नगरपरिषदेच्या विकास योजनेबाबत उक्त अधिनियमाच्या कलम ३१(१) अन्वये शासनाने निर्गमित केलेली अधिसूचना क्रमांक टिपीएस-१२९९/१४९९/प्र.क्र.१५३/९९/नवि-१२, दिनांक ४ एप्रिल २०१२ व उक्त विकास योजनेच्या वगळलेल्या भागाच्या विकास योजनेबाबत, उक्त अधिनियमाच्या कलम ३१(१) अन्वये शासनाने निर्गमित केलेली अधिसूचना क्रमांक टिपीएस-१२१५/८४२/प्र.क्र.११५/१५/नवि-१२, दिनांक २१ जानेवारी २०१६, ह्य दोन्हीं अधिसूचना, प्रस्तुतची अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसानंतर अंमलात येतील, असे अधिसूचित करीत आहे.
२. सदर अधिसूचना ही महाराष्ट्र शासनाच्या www.maharashtra.gov.in (कायदे व नियम) या वेबसाईटवर देखील प्रसिद्ध करण्यात यावी.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-1299/1499/C.R.-153/99/UD-12.—Whereas, the Ministry of Environment and Forest of Government of India has declared the Dahanu Taluka as Ecologically Fragile Area vide its Notification dated 20th June, 1991, and as per the provisions of Notification the State Government has to prepare a Master Plan or Regional Plan for the Dahanu Taluka and get the plan approved from the Ministry of Environment and Forest Department of Government of India ;
And whereas, the Development Plan for the Dahanu Municipal Council (hereinafter referred to as " the said Development Plan ") has been sanctioned partly by the Government in the Urban Development Department under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966, (hereinafter referred to as " the said Act "), vide Notification No. TPS-1299/1499/ C.R.-153/99/UD-12, dated 4th April, 2012 (hereinafter referred to as " the said Notification No.1 "), subject to the approval from the Ministry of Environment and Forest of Government of India and accordingly following decision, regarding implementation of the said Development Plan, was notified :—
d) After the approval of the Government of India in Ministry of Environment & Forest
Department, the notification regarding the implementation of Development Plan alongwith it's
Development Control Regulations (excluding the said Excluded Parts of Draft Development Plan
as mentioned in the Schedule – II) will be issued separately under the provisions of Section 31(4) of
Maharashtra Regional and Town Planning Act, 1966.
And whereas, Excluded Part (E.P.) of the said Development Plan has also been sanctioned by the Government in the Urban Development Department under section 31(1) of the said Act vide Notification No.TPS-1215/842/C.R.-115/15/UD-12, dated 21st January, 2016 (hereinafter referred to as " the said Notification No. 2 "), subject to the approval from the Ministry of Environment and Forest of Government of India and accordingly following decision, regarding implementation of the said Excluded Part (E.P.) of the said Development Plan, was notified ;
d) After the approval of the Government of India in Ministry of Environment & Forest
Department, the notification regarding the implementation of Excluded Part of the said Development
Plan will be issued separately under the provisions of Section 31(4) of Maharashtra Regional and
Town Planning Act, 1966.
And whereas, the said Development Plan was submitted by the State Government to the Ministry of Environment and Forest of Government of India, for approval, vide letter dated 5th January 2017, in compliance of the provisions of the Notification dated 20th June, 1991 ;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक----कोकण विभागीय पुरवणी, मार्च १३, २०२३/फाल्गुन २२, शके १९४४And whereas, the Ministry of Environment and Forest has amended their Notification dated 20th June 1991 vide Notification dated 22nd February, 2021 and the phrase " get the plan approved by the Ministry of Environment & Forest " is substituted by "get the plan approved by the Competent Authority in the State Government for its effective implementation" ;
And whereas, the Member Secretary, Dahanu Taluka Environment Protection Authority has informed the State Government vide letter dated 3rd December 2021 that, in the third meeting of the Authority held on 14th October 2021 it has been resolved vide Resolution No.3 that, the State Government in Urban Development Department is advised to decide further course of action regarding final approval of the Development Plan of Dahanu Municipal Council by considering the amendments made in the Notification issued by the Ministry of Environment and Forest Department of Government of India on dated 22nd February, 2021 ;
And whereas, by considering the above mentioned facts, the State Government is of the opinion that, it is necessary to issue the Notification regarding implementation of Development Plan sanctioned vide Notification No.1 and 2 under section 31(4) of the said Act ;
Now therefore, the Government, under the powers conferred under section 31 (4) of the said Act, hereby Notifies that, the Notification No.TPS-1299/1499/C.R.-153/99/UD-12, dated 4th April, 2012 sanctioning the Development Plan for Dahanu Municipal Council and the Notification No.TPS-1215/842/C.R.-115/15/UD-12, dated 21st January, 2016 sanctioning the Development Plan of Excluded Part for Dahanu Municipal Council, shall come into force with effect from the 30 days from the publication of this Notification in the Maharashtra Government Gazette ;
2. This Notification shall also be made available on the Government website www.maharashtra.gov.in (Acts/ Rules).
