ORDER
No. D.T.P-D.P.Mul Sec.-127(2)-Order-TPV-II-1106-2023.—
Whereas, the Development Plan of Mul Municipal Council has been partly sanctioned as per the provisions of section 31 (1) of Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS-2298/CR-102/ 98/443/2005/UD-9, dated 25th October, 2001 (hereinafter referred to as "the said Notification") & has come into force with effect from 15th December, 2001, (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan, the Land bearing S. Nos. 143 (part), 144 (part) & 145 (part) of Mouza Mul, area admeasuring approx. 3.0 H.A. has been affected by the Reservation Site No.38, "Garden" (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the acquisition and development of the said Reservation is Municipal Council, Mul (hereinafter referred to as "the said Appropriate Authority");
And whereas, the Land under said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force;
And whereas, the concerned Land Owner (hereinafter referred to as "the said Land Owner") of the land bearing S.No. 145, area 1.55 H.A. of Mouza Mul for an area affected by the said Reservation, (hereinafter referred to as "the said Land") had served a notice as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 19th December, 2017;
And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127 (1) of the said Act has been taken by the Appropriate Authority within the stipulated period from the date of service of the said notice by the said Land Owner as per the provisions of Section 127 of the said Act;
And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the judgement dated 13th June, 2022 in Writ Petition No. 865/2020 (hereinafter referred to as "the said Writ Petition") has passed an order that, area admeasuring 0.60 H.A. of the said Reservation of the said Land owner has lapsed as per the provisions of Section 127 of the said Act and directed to notify the lapsing of the said Reservation in accordance with law;
And whereas, Municipal Council, Mul vide letter No. 355/2022, dated 9th November, 2022 has submitted report stating that, as Municipal Council has passed a Resolution for lapsing of the said Reservation on the said Land, Special Leave Petition against the order passed by the Hon'ble High Court in said writ petition is not filed and no steps have been taken regarding the acquisition of the said Land;
And whereas, the Joint Director of Town Planning, Nagpur Division, Nagpur vide letter No.1469, dated 21st December, 2022 has submitted report stating that, in respect of the said Land under the said Reservation, acquisition procedure has not been completed and as per the order issued by the Hon'ble High Court, Mumbai, Nagpur Bench in the said Writ Petition, it is necessary to issue an order as per the provisions of Section 127(2), of the said Act regarding lapsing of 0.95 H.A. of the said Reservation on the said Land;
And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservation on the said Land;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No. TPS-1813/3211/CR- 508/UD-13, dated 1st December, 2016, has delegated the powers exercisable by it as per the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

(2) A copy of the part plan of the said sanctioned Development Plan showing the area of the said Land which is lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Mul, District Chandrapur during office hours on all working days for inspection to public upto one month.

ORDER
No. D.T.P-D.P.Katol(R+AA) Sec-127(2)/Order TPV-II 107-2023.—
Whereas, the Development Plan of Katol Municipal Council (Revised +A.A.) has been Partly Sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS-2406-3123-CR-133(A)-07-UD-9, dated 4th November, 2008 (hereinafter referred to as "the said Notification") & has come into force with effect from dated 15th December, 2008, (hereinafter referred to as "the said Sanctioned Development Plan") ;
And whereas, as per the said Sanctioned Development Plan, the Land bearing S.No. 684 (Part) of Mouza Katol, area admeasuring 7750.00 sq.m. is affected by the Reservation Site No. 88, "Play Ground" and area admea- suring 3500.00 sq.m. is affected by the Reservation Site No. 89, "Primary School", (hereinafter referred to as "the said Reservations") and the Appropriate Authority for the acquisition and development of the said Reservstions is Municipal Council, Katol (hereinafter referred to as "the said Appropriate Authority") ;
And whereas, the Land under said Reservations has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force ;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the Land bearing S.No. 684/4 of Mouza Katol, Dist. Nagpur affected by the said Reservations (hereinafter referred to as "the said Land") had served a notice as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 17th January, 2019 ;
And whereas, the said Land under the said Reservations are not acquired or no steps as required as per the provisions Section 127 (1) of the said Act has been taken by the Appropriate Authority within the stipulated period from the date of service of the said notice by the said Land owner as per the provisions of Section 127 of the said Act ;
And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the judgement dated 08th April, 2022 in Writ Petition No.1212/2021 (hereinafter referred to as "the said Writ Petition") has passed an order that, the said Reservations on the said Land have lapsed as the provision of section 127 of the said Act, ;
And whereas, Municipal Council, Katol vide Marathi letter No. ॅ-न्ह्यम्-104-2022-557, dated 21st June, 2022 has communicated that, Municipal Council, Katol has passed a Resolution on 7th June, 2019 to acquire the said land but the Land acquisition proposal of the said Land under the said Reservations have not submitted to the Collector, Nagpur and also Special Leave Petition is not filed in Hon'ble Supreme Court by Municipal Council, Katol ;
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध २३-२९, २०२३/ २-८, ॅ १९४५ ७And whereas the Joint Director of Town Planning, Nagpur Division, Nagpur, vide letter No. 1267, dated 14th November, 2022 has communicated that, said Reservations on the said land have lapsed as per the order passed by the Hon'ble High Court and there is no objection to issue the Notification regarding lapsing of the said Reserva- tions as per the provisions of Section 127 (2) ;
And whereas, after considering the above facts in respect of the said Reservations on the said Land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservation the said Lands ;
And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it as per the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by ZillaParishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservations in respect of the said Land as per the provi- sions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows :-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :-

(2) A copy of the part plan of the said sanctioned Development Plan showing the area of the said Land which are lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Katol, District Nagpur during office hours on all working days for inspection to public upto one month.

Modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966
NOTIFICATION

The Development Plan of Gondia (Second Revised) has been sanctioned by Government in Urban Development Department vide notification No.TPS-2311-2187-CR-249(B)-2011-UD-9, dated 4th April, 2012 and came into force with effect form 15th May, 2012.
Now, the Administrator & Chief Officer of Gondia Municipal Council has passed the Resolutions dated 22nd February 2023 as mentioned below to make modifications to sanctioned Development plan under Section 37(1) of Maharasthtra Regional and Town Planning Act, 1966.

It is hereby notified that any person having any objection or suggestions regarding the proposed modifications may communicate in writing to the Municipal Council within a period of 30 (Thirty) days from date of publication of this notice in Maharashtra Govt.Gazzette.
The objections or suggestions received from the public shall be considered by the Municipal Council, Gondia before submitting the proposal of Modifications to the Government for sanction.
