(cid:312)मांक से(cid:332)िन-१२२०/(cid:332).(cid:312).१४०/ना.पु.-१५.—भारता(cid:247)या संिवधाना(cid:247)या अनु(cid:247)छ(cid:578)द ३०९ (cid:247)या परंतुका(cid:261)वये (cid:332)दान क(cid:577)ले(cid:269)या अिधकारांचा वापर क(cid:544)न आिण याबाबतीत काढलेले सव(cid:593) िव(cid:464)मान िनयम, आदेश िक(cid:573)वा संलेख यांचे अिध(cid:312)मण क(cid:544)न, महारा(cid:273)(cid:322)ाचे रा(cid:249)यपाल, या(cid:465)ारे, महारा(cid:273)(cid:322) शासना(cid:247)या अ(cid:261)न, नागरी पुरवठा व (cid:314)ाहक संर(cid:550)ण िवभागा(cid:247)या (cid:332)शासकीय िनयं(cid:327)णा अधीन असले(cid:269)या उप आयु(cid:242)त (पुरवठा), िज(cid:269)हा पुरवठा अिधकारी व अ(cid:261)नधा(cid:261)य िवतरण अिधकारी, गट-अ, सहा(cid:267)यक िज(cid:269)हा पुरवठा अिधकारी, तांि(cid:327)क अिधकारी आिण िनरी(cid:550)ण अिधकारी (पुरवठा), गट-ब (राजपि(cid:327)त) या पदां(cid:247)या सेवा(cid:332)वेशाचे िविनयमन करणारे पुढील िनयम करीत आहेत :—

१. संि(cid:550)(cid:262)त नाव.— या िनयमांस, उप आयु(cid:242)त (पुरवठा), िज(cid:269)हा पुरवठा अिधकारी व अ(cid:261)नधा(cid:261)य िवतरण अिधकारी गट-अ, सहायक िज(cid:269)हा पुरवठा अिधकारी, तांि(cid:327)क अिधकारी आिण िनरी(cid:550)ण अिधकारी (पुरवठा) गट - ब (राजपि(cid:327)त) (सेवा(cid:332)वेश) िनयम, २०२३ असे (cid:266)हणावे.

२. (cid:271)या(cid:243)या.— या िनयमांत, संदभा(cid:593)नुसार दुसरा अथ(cid:593) आव(cid:272)यक नसेल तर,—

(क) "आयोग" याचा अथ(cid:593), महारा(cid:273)(cid:322) लोकसेवा आयोग, असा आहे;

(ख) "पदवी" याचा अथ(cid:593), सांिविधक िव(cid:464)ापीठाची कोण(cid:257)याही शाखेतील पदवी िक(cid:573)वा ित(cid:247)याशी समतु(cid:269)य अस(cid:269)याचे शासनाने घोिषत क(cid:577)लेली इतर कोणतीही अह(cid:593)ता, असा आहे;

(ग) "िवभाग" याचा अथ(cid:593), शासनाचा अ(cid:261)न, नागरी पुरवठा व (cid:314)ाहक संर(cid:550)ण िवभाग, असा आहे;

(घ) "पदो(cid:261)नतीसाठी पा(cid:327)ता" याचा अथ(cid:593), शासना(cid:247)या सामा(cid:261)य (cid:332)शासन िवभागा(cid:465)ारे वेळोवेळी काढलेले िनयम, शासन िनण(cid:593)य िक(cid:573)वा आदेश यांम(cid:260)ये पदो(cid:261)नतीसाठी िविनिद(cid:593)(cid:273)ट क(cid:577)ले(cid:269)या अटी व शत(cid:559)नुसार, पदो(cid:261)नतीसाठी पा(cid:327), असा आहे;

(१)

भाग चार-अ-७५–१महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, माच(cid:593) २७, २०२३/चै(cid:327) ६, शक(cid:577) १९४५ (ङ) "समतु(cid:269)य पद" याचा अथ(cid:593), अ(cid:261)न, नागरी पुरवठा व (cid:314)ाहक संर(cid:550)ण िवभागा(cid:247)या अधीन असणा(cid:311)या संबंिधत पदाची समान वेतन(cid:342)ेणी व समान दजा(cid:593), कत(cid:593)(cid:271)ये व जबाबदा(cid:311)या असणारे शासना(cid:247)या अ(cid:261)य िवभागा(cid:247)या कोण(cid:257)याही काया(cid:593)लयातील पद, असा आहे;

(च) "शासन" याचा अथ(cid:593), महारा(cid:273)(cid:322) शासन, असा आहे;

(छ) "अनुसूची" याचा अथ(cid:593), या िनयमांस जोडलेली अनुसूची, असा आहे.

३. िवभागांतग(cid:593)त असले(cid:269)या उप आयु(cid:242)त (पुरवठा) गट-अ, या पदावरील िनयु(cid:242)ती, एकतर,—

(क) पदो(cid:261)नतीसाठी पा(cid:327) असणा(cid:311)या, अनुसूची(cid:247)या भाग-एक म(cid:260)ये नमूद क(cid:577)लेली गट-अ ची कोणतीही पदे धारण करणा(cid:311)या आिण (cid:257)या पदांवरील तीन वषा(cid:597)पे(cid:550)ा कमी नसेल इतकी िनयिमत आिण अखंड सेवा असणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून सेवा(cid:249)ये(cid:273)ठते(cid:247)या आधारावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल; िक(cid:573)वा

(ख) जर पदो(cid:261)नतीसाठी पा(cid:327) उमेदवार उपल(cid:264)ध झाला नाही तरच क(cid:577)वळ समतु(cid:269)य पद धारण करणा(cid:311)या यो(cid:244)य अिधका(cid:311)या(cid:247)या (cid:332)ितिनयु(cid:242)तीने कर(cid:256)यात येईल. (cid:332)ितिनयु(cid:242)ती(cid:465)ारे िनयु(cid:242)ती ही, सामा(cid:261)य (cid:332)शासन िवभागा(cid:247)या (cid:332)ितिनयु(cid:242)ती(cid:247)या धोरणा(cid:247)या सव(cid:593) अटी व शत(cid:559)नुसार कर(cid:256)यात येईल. मंजूर पदां(cid:247)या पंधरा ट(cid:242)क(cid:577) पे(cid:550)ा अिधक पदांची (cid:332)ितिनयु(cid:242)तीने िनयु(cid:242)ती कर(cid:256)याची परवानगी असणार नाही.

४. िवभागांतग(cid:593)त िज(cid:269)हा पुरवठा अिधकारी िक(cid:573)वा अ(cid:261)नधा(cid:261)य िवतरण अिधकारी, गट-अ, या पदावरील िनयु(cid:242)ती एकतर,—

(क) पदो(cid:261)नतीसाठी पा(cid:327) असणा(cid:311)या, अनुसूची(cid:247)या भाग-दोन म(cid:260)ये नमूद क(cid:577)लेली गट-ब (राजपि(cid:327)त) ची कोणतीही पदे धारण करणा(cid:311)या आिण (cid:257)या पदांवरील तीन वषा(cid:597)पे(cid:550)ा कमी नसेल इतकी िनयिमत व अखंड सेवा असणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून संयु(cid:242)त सेवाजे(cid:273)ठते(cid:247)या आधारावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल; िक(cid:573)वा

(ख) िनयं(cid:327)क, िशधावाटप व संचालक नागरी पुरवठा, मु ंबई या(cid:247)या अधीन असले(cid:269)या उप िनयं(cid:327)क, िशधावाटप पद धारण करणा(cid:311)या यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या िनयु(cid:242)तीने कर(cid:256)यात येईल; िक(cid:573)वा

(ग) जर पदो(cid:261)नतीसाठी पा(cid:327) उमेदवार उपल(cid:264)ध झाला नाही तरच क(cid:577)वळ समतु(cid:269)य पद धारण करणा(cid:311)या यो(cid:244)य अिधका(cid:311)या(cid:247)या (cid:332)ितिनयु(cid:242)तीने कर(cid:256)यात येईल. (cid:332)ितिनयु(cid:242)ती(cid:465)ारे िनयु(cid:242)ती ही, सामा(cid:261)य (cid:332)शासन िवभागा(cid:247)या (cid:332)ितिनयु(cid:242)ती(cid:247)या धोरणा(cid:247)या सव(cid:593) अटी व शत(cid:559)नुसार कर(cid:256)यात येईल. मंजूर पदा(cid:247)या पंधरा ट(cid:242)क(cid:577) पे(cid:550)ा अिधक पदांची (cid:332)ितिनयु(cid:242)तीने िनयु(cid:242)ती कर(cid:256)यास परवानगी असणार नाही.

५. िवभागांतग(cid:593)त असले(cid:269)या सहायक िज(cid:269)हा पुरवठा अिधकारी, गट-ब, (राजपि(cid:327)त) या पदावरील िनयु(cid:242)ती, पदो(cid:261)नतीसाठी पा(cid:327) असणा(cid:311)या, अनुसूची(cid:247)या भाग-तीन म(cid:260)ये नमूद क(cid:577)लेली गट-ब (राजपि(cid:327)त) ची कोणतीही पदे धारण करणा(cid:311)या आिण (cid:257)या पदांवरील तीन वषा(cid:597)पे(cid:550)ा कमी नसेल इतकी िनयिमत व अखंड सेवा असणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून संयु(cid:242)त सेवा(cid:249)ये(cid:273)ठते(cid:247)या आधारावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल.

६. िवभागांतग(cid:593)त तांि(cid:327)क अिधकारी, गट-ब (राजपि(cid:327)त) पदावरील िनयु(cid:242)ती, पदो(cid:261)नतीसाठी पा(cid:327) असणा(cid:311)या अनुसूची(cid:247)या भाग-तीन म(cid:260)ये नमूद क(cid:577)लेली गट-ब (राजपि(cid:327)त) ची कोणतीही पदे धारण करणा(cid:311)या आिण (cid:257)या पदांवरील तीन वषा(cid:597)पे(cid:550)ा कमी नसेल इतकी िनयिमत आिण अखंड सेवा असणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून संयु(cid:242)त सेवा(cid:249)ये(cid:273)ठते(cid:247)या आधारावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल:

परंतु, वै(cid:551)ािनक प(cid:460)तीने अ(cid:261)नधा(cid:261)य याची साठवण, संशोधन व तपासणी या िवषयावरील भारत सरकार(cid:247)या भारतीय अ(cid:261)न साठवण, (cid:271)यव(cid:274)थापन व संशोधन सं(cid:274)थेने आयोिजत क(cid:577)लेला दीघ(cid:593) मुदतीचा (cid:332)िश(cid:550)ण पा(cid:450)(cid:312)म उ(cid:427)ीण(cid:593) क(cid:577)(cid:269)याखेरीज आिण उ(cid:242)त सं(cid:274)थेने आयोिजत क(cid:577)लेली अंितम लेखी परी(cid:550)ा उ(cid:427)ीण(cid:593) क(cid:577)(cid:269)याखेरीज सु(cid:460)ा तांि(cid:327)क अिधका(cid:311)या(cid:247)या पदावर कोण(cid:257)याही (cid:271)य(cid:242)तीची िनयु(cid:242)ती कर(cid:256)यात येणार नाही.

७. िवभागांतग(cid:593)त िनरी(cid:550)ण अिधकारी (पुरवठा), गट-ब (राजपि(cid:327)त) या पदावरील िनयु(cid:242)ती एकतर,—

(क) पदो(cid:261)नतीसाठी पा(cid:327) असणा(cid:311)या अनुसूची(cid:247)या भाग-चार म(cid:260)ये नमूद क(cid:577)लेली गट-क ची कोणतीही पदे धारण करणा(cid:311)या आिण (cid:257)या पदांवरील तीन वषा(cid:597)पे(cid:550)ा कमी नसेल इतकी िनयिमत आिण अखंड सेवा असणा(cid:311)या (cid:271)य(cid:242)त(cid:558)मधून संयु(cid:242)त सेवा(cid:249)ये(cid:273)ठते(cid:247)या आधारावर यो(cid:244)य (cid:271)य(cid:242)ती(cid:247)या पदो(cid:261)नतीने कर(cid:256)यात येईल; िक(cid:573)वामहारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, माच(cid:593) २७, २०२३/चै(cid:327) ६, शक(cid:577) १९४५ (ख) जे उमेदवार पुढील िनकषांची पूत(cid:593)ता करतात अशा, (cid:257)यासाठी घेतले(cid:269)या (cid:274)पधा(cid:593) परी(cid:550)े(cid:247)या िनकाला(cid:247)या आधारे आयोगाने िशफारस क(cid:577)ले(cid:269)या उमेदवारांमधून नामिनद(cid:616)शना(cid:465)ारे कर(cid:256)यात येईल :—

(एक) वयोमया(cid:593)दा.—

(क) िकमान वयोमया(cid:593)दा.— (cid:257)या पदा(cid:247)या भरती(cid:247)या जािहरातीनुसार अज(cid:593) (cid:274)वीक(cid:565)ती(cid:247)या अंितम िदनांकास अठरा वष(cid:616) वय पूण(cid:593) क(cid:577)लेले.

(ख) कमाल वयोमया(cid:593)दा.— (cid:257)या पदा(cid:247)या भरती(cid:247)या जािहरातीनुसार अज(cid:593) (cid:274)वीक(cid:565)ती(cid:247)या अंितम िदनांकास राखीव (cid:332)वगा(cid:593)तील नसले(cid:269)या (cid:271)य(cid:242)तीसाठी अडतीस वष(cid:616) वय पूण(cid:593) क(cid:577)लेले आिण राखीव (cid:332)वगा(cid:593)तील असले(cid:269)या (cid:271)य(cid:242)त(cid:558)साठी (cid:327)ेचाळीस वष(cid:616) वय पूण(cid:593) क(cid:577)लेले.

(दोन) िकमान शै(cid:550)िणक अह(cid:593)ता.— कोण(cid:257)याही सांिविधक िव(cid:464)ापीठामधून कोण(cid:257)याही िव(cid:464)ा शाखेतील पदवी िक(cid:573)वा शासनाने ितला समतु(cid:269)य अस(cid:269)याचे घोिषत क(cid:577)लेली अ(cid:261)य कोणतीही शै(cid:550)िणक अह(cid:593)ता धारण क(cid:577)लेले.

८. िनरी(cid:550)ण अिधकारी (पुरवठा) गट-ब (राजपि(cid:327)त) या पदावरील िनयु(cid:242)ती, पदो(cid:261)नती व नामिनद(cid:616)शना(cid:465)ारे ८०:२० या (cid:332)माणात कर(cid:256)यात येईल.

९. िनरी(cid:550)ण अिधकारी (पुरवठा), गट-ब (राजपि(cid:327)त) या पदावर नामिनद(cid:616)शनाने िनयु(cid:242)त क(cid:577)लेली (cid:271)य(cid:242)ती, दोन वषा(cid:593)(cid:247)या कालावधीसाठी प(cid:555)रवी(cid:550)ाधीन असेल. प(cid:555)रवी(cid:550)ा कालावधी स(cid:550)म (cid:332)ािधका(cid:311)या(cid:247)या (cid:274)वे(cid:247)छािनण(cid:593)यानुसार कमाल एक वषा(cid:593)पय(cid:597)त वाढवता येईल. सदर पदावर िनयु(cid:242)त होणा(cid:311)या (cid:271)य(cid:242)तीने प(cid:555)रवी(cid:550)ा कालावधी (वाढीव कालावधीसह) शासना(cid:247)या प(cid:555)रवी(cid:550)ा धोरणानुसार समाधानकारकरी(cid:257)या पूण(cid:593) करणे, कोणतीही अस(cid:269)यास, िविहत क(cid:577)लेली िवभागीय परी(cid:550)ा उ(cid:427)ीण(cid:593) करणे, आिण अस(cid:269)यास, कोणतेही िविहत क(cid:577)लेले (cid:332)िश(cid:550)ण पूण(cid:593) करणे अिनवाय(cid:593) असेल. जर ितने शासना(cid:247)या प(cid:555)रवी(cid:550)ा धोरणानुसार (वाढीव कालावधीसह) प(cid:555)रवी(cid:550)ा कालावधी समाधानकारकरी(cid:257)या िक(cid:573)वा प(cid:555)रवी(cid:550)ा कालावधीतील कोणतीही अस(cid:269)यास, िविहत क(cid:577)लेली परी(cid:550)ा उ(cid:427)ीण(cid:593) क(cid:577)ली नसेल िक(cid:573)वा कोणतेही अस(cid:269)यास, िविहत क(cid:577)लेले (cid:332)िश(cid:550)ण पूण(cid:593) क(cid:577)ले नसेल तर , ती ितची सेवा समा(cid:262)त क(cid:577)ली जा(cid:256)यास पा(cid:327) असेल.

१०. (१) िनयम ३,४,५,६ िक(cid:573)वा ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदांवर पदो(cid:261)नती(cid:465)ारे िनयु(cid:242)त क(cid:577)ली जाणारी (cid:271)य(cid:242)ती, अगोदरच मराठी भाषा व िहंदी भाषा परी(cid:550)ा उ(cid:427)ीण(cid:593) नसेल िक(cid:573)वा (cid:257)या परी(cid:550)ा उ(cid:427)ीण(cid:593) हो(cid:256)यापासून ितला सूट दे(cid:256)यात आलेली नसेल तर, उ(cid:242)त पदावर पदो(cid:261)नती दे(cid:256)यापूव(cid:559) (cid:257)याबाबतीत शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमांनुसार, (cid:257)या परी(cid:550)ा, उ(cid:427)ीण(cid:593) करील.

(२) िनयम ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदावर नामिनद(cid:616)शना(cid:465)ारे िनयु(cid:242)त क(cid:577)ली जाणारी (cid:271)य(cid:242)ती, अगोदरच मराठी भाषा व िहंदी भाषा परी(cid:550)ा उ(cid:427)ीण(cid:593) नसेल िक(cid:573)वा (cid:257)या परी(cid:550)ा उ(cid:427)ीण(cid:593) हो(cid:256)यापासून ितला सूट दे(cid:256)यात आलेली नसेल तर , (cid:257)याबाबतीत शासनाने वेळोवेळी क(cid:577)ले(cid:269)या िनयमानुसार िनयु(cid:242)तीनंतर िविहत मुदतीत, मराठी व िहंदी भाषा परी(cid:550)ा, उ(cid:427)ीण(cid:593) करील. ती (cid:271)य(cid:242)ती या परी(cid:550)ा उ(cid:427)ीण(cid:593) होईपय(cid:597)त वािष(cid:593)क वेतन वाढीसाठी व पुढील पदो(cid:261)नती(cid:247)या पदावरील पदो(cid:261)नतीसाठी पा(cid:327) असणार नाही.

११. (१) िनयम ३,४,५,६ िक(cid:573)वा ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदांवर पदो(cid:261)नतीने िनयु(cid:242)त क(cid:577)ली जाणारी (cid:271)य(cid:242)ती, ितला संगणक हाताळणी (cid:332)माणप(cid:327) धारण कर(cid:256)यापासून सूट दे(cid:256)यात आली नसेल तर, शासनाने याबाबतीत वेळोवेळी काढले(cid:269)या िनयमा(cid:465)ारे िक(cid:573)वा आदेशाने िविहत क(cid:577)लेले संगणक हाताळणी (cid:332)माणप(cid:327), उ(cid:242)त पदावर पदो(cid:261)नती िमळ(cid:256)यापूव(cid:559) धारण करील.

(२) िनयम ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदावर नामिनद(cid:616)शनाने िनयु(cid:242)त क(cid:577)ली जाणारी (cid:271)य(cid:242)ती, ितला संगणक हाताळणी (cid:332)माणप(cid:327) धारण कर(cid:256)यापासून सूट दे(cid:256)यात आली नसेल तर, शासनाने वेळोवेळी िविहत क(cid:577)लेले संगणक हाताळणी (cid:332)माणप(cid:327), िनयु(cid:242)तीनंतर िविहत मुदतीत धारण करील, अ(cid:261)यथा ती (cid:271)य(cid:242)ती, ते (cid:332)माणप(cid:327) धारण करीपय(cid:597)त, वािष(cid:593)क वेतनवाढीसाठी व पुढील पदो(cid:261)नती(cid:247)या पदावरील पदो(cid:261)नतीसाठी पा(cid:327) असणार नाही.

१२. (१) िनयम ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदावर नामिनद(cid:616)शना(cid:465)ारे िनयु(cid:242)तीसाठी िशफारस क(cid:577)लेली (cid:271)य(cid:242)ती, महारा(cid:273)(cid:322) नागरी सेवा (cid:574)बाचे (cid:332)ित(cid:551)ापन) िनयम, २००५ (cid:247)या तरतुद(cid:558)नुसार व याबाबत शासनाने वेळोवेळी िनग(cid:593)िमत क(cid:577)लेले अ(cid:261)य कोणतेही िनयम, (लहान क(cid:561)ट(cid:562) आदेश िक(cid:573)वा कोणतेही संलेख यांनुसार लहान क(cid:561)ट(cid:562) (cid:574)बाचे (cid:332)ित(cid:551)ापन सादर करील.

(cid:574)बाचे (cid:332)ित(cid:551)ापन सादर कर(cid:256)या(cid:247)या िदनांकाला दोनपे(cid:550)ा अिधक अप(cid:257)ये असणारी (cid:271)य(cid:242)ती, शासकीय सेवेत (२) लहान क(cid:561)ट(cid:562) िनयु(cid:242)तीसाठी अपा(cid:327) असेल.

(३) शासकीय सेवेत (cid:271)य(cid:242)तीची िनयु(cid:242)ती झा(cid:269)यानंतर, जर ितला िनयु(cid:242)ती(cid:247)या वेळी िक(cid:573)वा (cid:257)यानंतर दोनपे(cid:550)ा अिधक अप(cid:257)ये अस(cid:269)याचे िस(cid:460) झाले तर, ती (cid:271)य(cid:242)ती, शासकीय सेवेतील उ(cid:242)त पदावर कायम राह(cid:256)यासाठी अपा(cid:327) असेल.

१३. िनयम ३,४,५,६ िक(cid:573)वा ७ म(cid:260)ये नमूद क(cid:577)ले(cid:269)या पदावर िनयु(cid:242)त क(cid:577)ली जाणारी (cid:271)य(cid:242)ती, महारा(cid:273)(cid:322) रा(cid:249)यात क(cid:561)ठ(cid:578)ही बदलीसाठी पा(cid:327) असेल.

१४. शासकीय सेवेतील िनयु(cid:242)तीसाठी या िनयमां(cid:465)ारे िविनिद(cid:593)(cid:273)ट क(cid:577)ले(cid:269)या अटी व शत(cid:560)ची पूत(cid:593)ता करणे आव(cid:272)यक आहे. सदर िनयमांनुसार शासकीय सेवेत िनयु(cid:242)ती झा(cid:269)यानंतर, संबंिधत शासकीय कम(cid:593)चा(cid:311)यास, शासकीय सेवे(cid:247)या कालावधीत, महारा(cid:273)(cid:322) नागरी सेवा िनयम, तसेच सेवािवषयक बाब(cid:558)संदभा(cid:593)त रा(cid:249)य शासनाने वेळोवेळी अिधिनयम/अिधसूचना/शासन िनण(cid:593)य/शासन आदेशा(cid:465)ारे िनग(cid:593)िमत क(cid:577)लेले अ(cid:261)य िनयम लागू राहतील.

No. SEPRANI-¹²²⁰/C.R.-¹⁴⁰/Na.Pu.-¹⁵.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of the Deputy Commissioner (Supply), District Supply Officer and Foodgrain Distribution Officer, Group-A, Assistant District Supply Officer, Technical Officer and Inspecting Officer (Supply), Group-B (Gazetted) under the administrative control of the Food, Civil Supplies and Consumer Protection Department of the Government of Maharashtra namely :—

¹. Short title.— These Rules may be called the Deputy Commissioner (Supply), District Supply Officer and Foodgrain Distribution Officer, Group-A, Assistant District Supply Officer, Technical Officer and Inspecting Officer (Supply), Group-B (Gazetted) (Recruitment) Rules, 2023.

². Definitions .— In these rules, unless the context requires otherwise,—

(a) "Commission" means the Maharashtra Public Service Commission;

(b) "Degree" means a Degree of any discipline of a statutory University or any other qualification declared by the Government to be equivalent thereto;

(c) "Department" means the Food, Civil Supplies and Consumer Protection Department of the Government;

(d) "eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time;

(e) "equivalent post" means a post in any office of other Department of the Government having same pay scale and equal rank, duties and responsibilities of that of the concerned post under the Food, Civil Supplies and Consumer Protection Department ;

(f) "Government" means the Government of Maharashtra;

(g) "Schedule" means the Schedule appended to these rules.

3. Appointment to the post of Deputy Commissioner (Supply), Group-A under the Department shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding any of Group A posts mentioned in Part I of the Schedule and having not less than three years regular and continuous service on those posts; or (b) by deputation of a suitable officer holding the equivalent post only if the eligible candidate for promotion is not available. The appointment by deputation shall be made in accordance with all the terms and conditions of the deputation policy of the General Administration Department. The appointment by deputation shall not be allowed more than fifteen per cent. of the sanctioned post.

4. Appointment to the post of District Supply Officer or Foodgrain Distribution Officer, Group-A under the Department shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of combined seniority, from amongst the persons holding any of the Group B (Gazetted) posts mentioned in Part II of the Schedule and having not less than three years regular and continuous service on those posts; orमहारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, माच(cid:593) २७, २०२३/चै(cid:327) ६, शक(cid:577) १९४५ (b) by transfer of a suitable person holding the post of Deputy Controller of Rationing under the Controller of Rationing and Director Civil Supplies, Mumbai; or

(c) by deputation of a suitable officer holding the equivalent post only if the eligible candidate for promotion is not available. The appointment by deputation shall be made in accordance with all the terms and conditions of the deputation policy of the General Administration Department. The appointment by deputation shall not be allowed more than fifteen per cent. of the sanctioned post.

5. Appointment to the post of Assistant District Supply Officer, Group-B (Gazetted) under the Department shall be made by promotion of a suitable person having eligibility for promotion on the basis of combined seniority, from amongst the persons holding any of the Group-B (Gazetted) posts mentioned in Part III of the Schedule and having not less than three years regular and continuous service on those posts.

6. Appointment to the post of Technical Officer, Group-B (Gazetted) under the Department shall be made by promotion of a suitable person having eligibility for promotion, on the basis of combined seniority, from amongst the persons holding any of the Group-B (Gazetted) posts mentioned in Part III of the Schedule and having not less than three years regular and continuous service on those posts:

Provided that, no person shall be appointed to the post of Technical Officer unless he has passed the long term training course organized by the Indian Grain Storage, Management and Research Institute of Government of India on the subject Storage, Research and Inspection of food grains by scientific method and has also passed the final written examination conducted by the said Institute.

7. Appointment to the posts of Inspecting Officer (Supply), Group-B (Gazetted) under the Department shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of combined seniority, from amongst the persons holding any of the Group-C posts mentioned in Part IV of the Schedule and having not less than three years regular and continuous service on those posts; or

(b) by nomination from amongst the candidates recommended by the Commission on the basis of result of Competitive Examination conducted therefor, who fulfills the following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit.— Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.— Thirty eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—Possesses a degree in any discipline from any statutory university or any other educational qualification declared by the Government to be equivalent thereto.

8. Appointment to the post of Inspecting Officer (Supply), Group-B (Gazetted) shall be made by promotion and nomination in the ratio of 80:20.

9. A person appointed to the post of Inspecting Officer (Supply), Group-B (Gazetted) by nomination shall be on probation for a period of two years. The probation period may be extended maximum upto one year at the discretion of the Competent Authority. Completion of the probation period (including extended period) satisfactorily as per the probation policy of the Government, passing of prescribed Departmental Examination, if any and completion of prescribed training, if any, are mandatory. In the event of failing to complete the probation period (including extended period) satisfactorily as per the probation policy of the Government or in the event of not clearing the Departmental Examination prescribed, if any, during the probation period or in the event of not completing the prescribed training, if any, his services shall be liable to be terminated.

10. (1) A person to be appointed to the post mentioned in rule 3, 4, 5, 6 or 7 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 7 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment and promotion to the next promotional post until he passes those examinations.

11. (1) A person to be appointed to the post mentioned in rule 3, 4, 5, 6 or 7 by promotion shall possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 7 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment and promotion to the next promotional post until he possess the same.

12. (1) A person recommended for appointment by nomination to the post mentioned in rule 7 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government Service.

13. A person appointed to the post mentioned in rule 3, 4, 5, 6 or 7 shall be liable for transfer anywhere in the State of Maharashtra.

14. The terms and conditions specified in these Rules shall be complied with for appointment in the Government Service. Subsequent to the appointment in Government Service, the Maharashtra Civil Service Rules and other prevailing enactments/Government Resolutions/Government Orders with regard to service matters as prescribed from time to time, shall be applicable to the concerned Government Servant.
