महाराष्ट्र दिवाणी न्यायालय अधिनियम.
क्रम(cid:५९८)क न्यास्थाप-१११९/८५७/प्र.क्र.१८३/कार्यासन-११.— महाराष्ट्र दिवाणी न्यायालय अधिनियम (१८६९ चा १४) याच्या कलम १४ व १९ य(cid:५९८)द्वारे प्रदान के लेल्या अधिकार(cid:५९८)चा, आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकार(cid:५९८)चा वापर करून, आणि त्याबाबतीत यापूर्वी काढलेल्या इतर सर्व अधिसूचना, जेथवर त्या नाशिक जिल्ह्यातील येवला महसुली तालुक्याशी संबंधित असतील तेथवर, त्यामध्ये अंशत: फे रबदल करून, महाराष्ट्र शासन, याद्वारे असे निदेश देत आहे की, दिन(cid:५९८)क २ एप्रिल,२०२३ पासून, —
(क) नाशिक महसुली जिल्ह्यातील येवला येथे एक न्यायालय असेल आणि अतिरिक्त जिल्हा न्यायाधीश हे, उक्त न्यायालयाचे पीठासीन अधिकारी असतील;
(ख) उक्त न्यायालयाच्या सर्वसाधारण अधिकारितेच्या स्थानिक सीमा, नाशिक जिल्ह्यातील येवला या महसुली तालुक्यामध्ये समाविष्ट असलेल्या क्षेत्र(cid:५९८)शी समव्यापी व समाविष्ट असतील; आणि
(ग) येवला महसुली तालुक्याच्या बाबतीत, प्रधान जिल्हा न्यायाधीश, नाशिक य(cid:५९८)चे सर्व अधिकार, उक्त अधिनियमाच्या कलम ९ अन्वये प्रधान जिल्हा न्यायाधीश य(cid:५९८)च्याकडे निहित असलेल्या अधिकार(cid:५९८)खेरीज, आणि त्यास योग्य वाटतील अशी प्रकरणे, अतिरिक्त जिल्हा न्यायाधीश, येवला य(cid:५९८)च्याकडे सोपविण्याच्या किंवा स्वत:हून निकाली काढण्याच्या किंवा सक्षम अधिकारितेच्या इतर न्यायालयाकडे सोपवण्याच्या त्याच्या अधिकार(cid:५९८)खेरीज, नाशिक येथील उक्त अतिरिक्त जिल्हा न्यायाधीशाकडे निहित असतील.

NOTIFICATION
MAHARASHTRA CIVIL COURTS ACT.
No. NYASTHAP-1119/857/C.R.183/DESK-11.—In exercise of the powers conferred by sections 14 and 19 of the Maharashtra Civil Courts Act (XIV of 1869), and of all other powers enabling it in this behalf, and in partial modification of all the other earlier notifications issued in that behalf, in so far as they relate to the revenue tahsil of Yeola in Nashik District, the Government of Maharashtra, hereby directs that, with effect from 2nd April, 2023.
(a) there shall be a Court at Yeola, in the revenue district of Nashik and the said Court shall be presided over by the Additional District Judge;
(b) the local limits of the ordinary jurisdiction of the said Court shall be co-extensive with and cover the areas comprising the revenue tahsil of Yeola, in Nashik District; and (c) all the powers of the Principal District Judge, Nashik in respect of the revenue tahsil of Yeola in Nashik District shall vest in the said Additional District Judge, Yeola, except those vested in the Principal District Judge under section 9 of the said Act and except his power to assign to the Additional District Judge, Yeola or withdraw unto himself or to assign to another Court of competent jurisdiction, such matters as he thinks fit.

क्रम(cid:५९८)क न्यास्थाप-१११९/८५७/प्र.क्र.१८३/कार्यासन-११.—फौजदारी प्रक्रिया संहिता,१९७३ (१९७४ चा २) हा महाराष्ट्र राज्यास लागू असताना, त्याच्या कलम ७ च्या पोट-कलम (३) कलम ९ च्या पोट-कलम (१) सह वाचा, य(cid:५९८)द्वारे प्रदान के लेल्या अधिकार(cid:५९८)चा, आणि त्याबाबतीत, यापूर्वी काढलेल्या सर्व अधिसूचना, त्यास समर्थ करणाऱ्या इतर सर्व अधिकार(cid:५९८)चा वापर करून;
आणि याबाबतीत जेथवर नाशिक जिल्ह्यातील येवला महसुली तालुक्याशी संबंधित आहेत तेथवर, त्यामध्ये, अंशतः फे रबदल करून, महाराष्ट्र शासन, मु ंबई येथील उच्च न्यायालयाशी विचारविनियम करून, याद्वारे, २ एप्रिल, २०२३ पासून, नाशिक जिल्ह्यातील येवला महसुली तालुक्यासाठी सत्र उप विभागाची निर्मिती करीत आहे आणि उक्त सत्र विभागाच्या सीमा अंतर्गत उद्भवणाऱ्या प्रकरण(cid:५९८)ची न्यायचौकशी करण्यासाठी अतिरिक्त सत्र न्यायाधीश पीठासीन अधिकारी असलेल्या सत्र न्यायालयाची येवला येथे स्थापना करीत आहे. प्रधान सत्र न्यायाधीश, नाशिक हे, येवला सत्र उप विभागाचेदेखील सत्र न्यायाधीश असतील, आणि त्यास, उक्त सत्र उप विभागाकडील प्रकरणे स्वत: निकाली काढण्याचे किंवा सक्षम अधिकारिता असलेल्या इतर कोणत्याही न्यायालयाकडे सोपविण्याचे, अथवा त्यास योग्य वाटतील अशी कोणतीही प्रकरणे, येवला येथील अतिरिक्त सत्र न्यायाधीशाकडे सोपविण्याचे, अधिकार असतील.

NOTIFICATION
CODE OF CRIMINAL PROCEDURE, 1973.
No. NYASTHAP-1119/857/C.R.183/DESK-11.— In exercise of the powers conferred by sub-section (3) of section 7 read with sub-section (1) of section 9 of the Code of Criminal Procedure, 1973 (2 of 1974), in its application to the State of Maharashtra, and of all other powers enabling it in this behalf, and in partial modification of all earlier notifications issued in that behalf, in so far as they relate to the revenue tahsil of Yeola in Nashik District, the Government of Maharashtra, after consultation with the High Court of Judicature at Bombay, hereby, with effect from 2nd April, 2023 creates a Sessions sub-division for the revenue tahsil of Yeola in Nashik District and establishes a Court of Sessions at Yeola to be presided over by the Additional Sessions Judge, for trial of cases arising within the limits of the said Sessions sub-division. The Sessions Judge, Nashik, shall also be the Sessions Judge for the Sessions sub-division, Yeola, and shall have the powers to withdraw unto himself or assign to any other Court of competent jurisdiction, the cases from the said Sessions sub-division, or to assign unto the Additional Sessions Judge at Yeola, any such cases as he thinks fit.
