क्रमांक-रावनआ/रापनों-२०२२/प्र.क्र.६३/का.११.—ज्याअर्थी भारती्य संविधानाच्या अनुच्छछेद २४३-के ि २४३-झेड ए अन्ि्ये तसेच राज्यातील स्र्ावनक स्िराज्य संस्र्ांच्या संबंवधत का्यद्ातील तरतुदींन्ि्ये अशा स्र्ावनक स्िराज्य संस्र्ांच्या सि्ग वनिडणुकांचे अवधक्षण, संचालन ि वन्यंत्रण ्याबाबतचे अवधकार राज्य वनिडणूक आ्योगास प्राप्त झाले आहेत ;
आवण ज्याअर्थी, स्र्ावनक स्िराज्य संस्र्ांच्या वनिडणुकांचे पावित्र्य राखणे ि अशा वनिडणुका मुक्त, वन:पक्षपातीपणे, प्रभािीपणे ि का्य्गक्षमतेने पार पाडण्याच्या दृष्टीने राजकी्य पक्षांची नोंदणी ि संबंवधत बाबींची तरतूद त्यात करणे गरजेचे आवण आिश्यक असल्याने राज्य वनिडणूक आ्योगाद्ारे क्र. एसईसी/एमसी २००९/सी आर-४९/डी.११, वद. ३१ माच्ग, २००९, च्या अवधसूचनेद्ारे, राजकी्य पक्षांची नोंदणी आदेश, २००९ आवण महाराष्ट्र वनिडणूक वचन्ह (आरक्षण ि िा्टप) आदेश, २००९ काढण्यात आला आहे ;
आवण ज्याअर्थी, उक्त आदेशातील भाग दोन ३. (१०) (अ) मधील तरतुदींमध्ये राजकी्य पक्षाचे नोंदणी आदेश, २००९ (पुन:सुधाररत २०२२) वद. १५ फेब्ुिारी २०२२ अन्ि्ये सुधारणा करण्यात आलेली असून राजकी्य पक्षाचे नाि बदलण्याबाबत वनकष वनश्श्चत करण्यात आलेला आहे ;
आवण ज्याअर्थी, ्या आदेशातील तरतुदींनुसार श्ी. ्यश सुधाकर गौरखडछे,्यांच्या अध्यक्षतेखाली बदलाि आिाज पा्टथी, वज.नागपूर ्या राजकी्य पक्षाची नोंदणी अमान्यताप्राप्त पक्ष म्हणून क्रमांक:रावनआ/रापनों-२०२२/प्र.क्र.६३/का-११, वद.२५ सप्टेंबर,२०२२ च्या पत्रान्ि्ये करण्यात आलेली आहे ;
आवण ज्याअर्थी, श्ी. ्यश सुधाकर गौरखेडठे, अध्यक्ष, बदलाि आिाज पा्टथी, रा. एच.एन. १४३५, पांढराबोडी, पोलीस चौकी, बुध्द विहारजिळ, रामनगर, वज. नागपूर,महाराष्ट्र ४४० ०३२ ्यांनी पक्षाच्या का्य्गकारणीच्या वद.१३ नोव्हेंबर २०२२ च्या सि्गसाधारण

भाग एक-अ (म.उ.वि.)-२१–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ–मध्य उप-विभाग, मार्ष २९, २०२३/र्ैत्र ८, शके १९४५ बैठकीत पाररत झालेल्या ठरािानुसार वद. ४ नोव्हेंबर २०२२ रोजीच्या पत्राद्ारे राज्य वनिडणूक आ्योगास उक्त आदेशातील भाग दोन ३. (१०) (अ) नुसार सदर पक्षाचे नाि "बदलाि आिाज पार्टी" ऐिजी "जन बदलाि पार्टी" असे बदलण्याबाबत विनंती केली आहे ;
आवण ज्याअर्थी, ्या पक्षाचा नािातील बदल करण्यापूिथी महाराष्ट्र शासन राजपत्रात पक्षाचे प्रस्तावित बदल केल्यानंतरचे नाि आवण पत्ा, त्याचे अध्यक्ष ्यांचा अंतभा्गि असलेली सूचना प्रवसध्द करून सि्गसाधारण जनतेकडून अशा नाि बदलाबाबत हरकती मागविणे आिश्यक आहे ;
आवण ज्याअर्थी, महाराष्ट्र शासन राजपत्रात उपरोक्तप्रमाणे अवधसूचना प्रवसध्द केलेल्या वदनांकापासून ३० वदिसांच्या आत कोणतीही हरकत प्राप्त न झाल्यास राज्य वनिडणूक आ्योग अवधसूचनेत प्रस्तावित केल्याप्रमाणे सदर राजकी्य पक्षाच्या नािामध्ये बदल करण्याकररता सक्षम राहील ;
आवण ज्याअर्थी, उक्त आदेशाप्रमाणे कोणतीही हरकत प्राप्त झाली, तर वतचा राज्य वनिडणूक आ्योग विचार करेल ि ती क्षुल्लक आढळल्यास, फे्टाळण्यात ्येईल ि ्या राजकी्य पक्षाचे नाि बदलण्यास मान्यता देईल. त्याचप्रमाणे राज्य वनिडणूक आ्योगास अशा हरकतीत प्र्मदश्गनी सत्य िा्टले, तर ती संबंवधत पक्ष प्रवतवनधीस कळविण्यात ्येईल आवण त्यािर त्याचे अवभप्रा्य मागविण्यात ्येतील आवण अवभप्रा्य प्राप्त झाल्यािर, आ्योग उपलब्ध अवभलेखाच्या आधारे गुणित्ेिर वनण्ग्य घेईल वकंिा,संबंवधत पक्षांचे म्हणणे ऐकून त्यानंतर वनण्ग्य घेईल ि राज्य वनिडणूक आ्योगाचा असा वनण्ग्य अंवतम राहील ;
आवण ज्याअर्थी, श्ी. ्यश सुधाकर गौरखेडठे, "बदलाि आिाज पार्टी" का्या्षल्यीन पत्ा:- रा. एर्.एन. १४३५, पांढराबोडी, पोलीस र्ौकी, बुध्द विहारजिळ, रामनगर, वज. नागपूर,महाराष्ट्र ४४० ०३२ ्यांच्या विनंतीनुसार सदर पक्षाचे नाि "बदलाि आिाज पार्टी" ऐिजी "जन बदलाि पार्टी" असे बदलण्याबाबत राज्य वनिडणूक आ्योगाकडछे अज्ग केला आहे ;
आवण ज्याअर्थी, उक्त आदेशातील भाग दोन ३. (१०) (अ) मधील तरतुदींमध्ये राजकी्य पक्षाचे नोंदणी आदेश, २००९ (पुन:सुधाररत २०२२) वद. १५ फेब्ुिारी २०२२ अन्ि्ये करण्यात आलेल्या सुधारणेनुसार राज्य वनिडणूक आ्योगाने उपरोक्त पक्षाचे नाि बदलण्यापूिथी सदर बदलाबाबत सि्गसाधारण जनतेकडून हरकती मागविणे आिश्यक आहे ;
आता त्याअर्थी, राज्य वनिडणूक आ्योग, महाराष्ट्र सदर अवधसूचना महाराष्ट्र शासन राजपत्रात प्वसध्द झाल्याच्या वदनांकापासून ३० वदिसांच्या आत उक्त पक्षाच्या नािातील प्स्तावित बदलाबाबत सि्षसाधारण जनतेकडून कोणतीही हरकत असल्यास, ती परस्पर आ्योगाच्या का्या्षल्याकडठे दाखल करािी, असे जाहीर करीत आहे.

NOTIFICATION
No.SEC/RPP-2022/CR-63/D-11.—Whereas, the superintendence, direction and control of all elections to the Panchayats and Municipalities in the State are vested in the State Election Commission, Maharashtra by virtue of Article 243-K and 243-ZA of the Constitution of India, and the provisions of the relevant State law as applicable to such Panchayats and Municipalities ;
And Whereas, with a view to provide, in the interest of sanctity of elections to the local bodies, and in the interest of conduct of such elections, in a free, fair, effective and efficient manner, for the registration of political parties and for matters connected therewith; the Registration of political Parties Order, 2009 and Maharashtra Election Symbols (Reservation and Allotment) Order, 2009 has been made by the State Election Commission, Maharashtra vide the State Election Commission, Maharashtra, Notification No. SEC/MC-2009/CR-49/D-11 dated 31st March, 2009 ;
And Whereas, as per the Political Parties Registration Order, 2009 (Re-revised in 2022) published on 15th February, 2022, criteria for changing name of a Political Party has been fixed by amending Part Two 3. (10) (A) of the above said Order ;
And Whereas, as per the provisions of the said Order, a political party bearing the name as Badlaav Aawaaz Party, and having Mr.Yash Sudhakar Gourkhede, as its President has been registered as an unrecognised Political Party wide letter No. SEC/RPP-2022/CR-63/D-11 Dated 11th September 2022 by the State Election Commission, Maharashtra ;
And Whereas, according to the provision under Part Two 3. (10) (A) of the above said Order, Shri Yash Sudhakar Gourkhede, President, Badlaav Aawaaz Party has requested this Commission vide its letter Dated 13th November 2022 to change the name of the said political party from "Badlaav Aawaaz Party" to " Jan Badlaav Party" as per the resolution passed by its Working Committee on 4th November 2022 ;
And Whereas before changing the name of a political party under this Order, it is necessary to publish a notice in the Maharashtra Government Gazette indicating therein, the name and address of the political party, its President and calling for objections, if any, for such change of name from the general public ;
And Whereas, as per the said Order, if no objection is received within 30 days from the date of publication of such notification in the Maharashtra Government Gazette, it shall be competent for the State Election Commission to change the name of said political party, as proposed in the notification ;
And Whereas, if any objection is so received, the State Election Commission may consider the same and in case it is found to be without substance, it may reject the same and change the name of said political party. If on the other hand, the State Election Commission considers that the objection is prima facie genuine, then the same shall be communicated to the concerned office bearer of the said party and his remarks shall be called for. After receipt of the remarks, the Commission may either decide the matter on merits on the basis of the records available or it may give personal hearing to the parties concerned and take a decision thereafter. The decision of the State Election Commission shall be final ;
And Whereas, Shri Yash Sudhakar Gourkhede, President "Badlaav Aawaaz Party", having main office address : House No.1435, Pandharabodi Police Chowki, Near Buddha Vihar, Ramnagar Dist. Nagpur, Maharashtra 440 033 has applied to the State Election Commission for the change of name from "Badlaav Aawaaz Party" to "Jan Badlaav Party", as a political party ;

(10) (A) of the above said Order vide Notification published on 15th February 2022 [ Political Parties Registration Order, 2009 (Re-revised in 2022) ] it is necessary for the State Election Commission to call for objections, if any, from the general public with respect to the change in the name of above said political party ;
Now, therefore, the State Election Commission, Maharashtra, hereby calls for objections, if any, for such change in the name of said political party from the general public which are to be submitted directly to the Commission within 30 days from the date of publication of this notification in Maharashtra Government Gazette.
