महाराष्ट्र ्ठठेवीदारांच्या (प्वत्ीय संस्थांमधील) प्हतसंबंधाचे संरक्षण अप्धप्नयम, १९९९.
क्र. एमपीआयडी-०६२२/प्र.क्र.४२/पोल-१५.— ज्याअर्थी ऑसम अवर अपॉर्यु ्गदनटी प्रा.दल., पुणे (यापुढे उक्त दवत्ीय संस्र्ा असा उल्लेख करण्यात आला आहे) या दवत्ीय संस्र्ेने ठेवीदारांना मुदतीअंती लाभासह ठेवी परत करण्याचे आश्वादसत करून ठेवीदारांकडून ठेवी स्वीकारल्या होत्या;
आदण ज्याअर्थी, उक्त दवत्ीय संस्र्ा आदण सदर संस्र्ेचे प्रवत्गक, संचालक, भागीदार आदण इतर यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपूतथीनंतर ठेवीदारांना परत करण्यास कसूर केला असल्याने त्यांचेदवरुध्द जेलरोड पोलीस ठाणे, दज.सोलापूर येर्े गु.र.नं. ५४/२०२१ नुसार भारतीय दंड संदहता (१८६० चा ४५) कलम ४२०, ४०६, १२० (ब) व ३४ सह महाराष्ट्र ठेवीदारांर्या (दवत्ीय संस्र्ांमधील) दहतसंबंधाचे संरक्षण अदधदनयम, १९९९ (सन २००० चा महाराष्ट्र १६) कलम ३ व ४ अन्वये गुन्हा दाखल करण्यात आला आहे;
आदण ज्याअर्थी, महाराष्ट्र शासनाची अशी खात्ी झाली आहे की, उक्त दवत्ीय संस्र्ा आदण सदर संस्र्ेचे प्रवत्गक, संचालक, भागीदार आदण इतर हे ठेवीदारांर्या मागणीनुसार ठेवी परत करण्यात अपयशी ठरले असून उक्त दवत्ीय संस्र्ेद्ारे ठेवीदारांना ठेवी परत करण्याची शक्यता ददसून येत नाही;
आदण ज्याअर्थी, महाराष्ट्र शासनाला, उक्त दवत्ीय संस्र्ा आदण त्यांचे प्रवत्गक, संचालक, भागीदार आदण इतर दकंवा कोणतीही अन्य व्यक्ती यांनी गोळा केलेल्या ठेवींमधून त्यांर्या स्वत:र्या अर्वा अन्य कोणत्याही व्यक्तीर्या नावे रक्कम व अन्य मालमत्ा संपाददत केली असल्याचे अदभकदर्त असल्याने, उक्त दवत्ीय संस्र्ांमधील ठेवीदारांर्या दहताचे संरक्षण करण्याकररता अशी रक्कम व अन्य मालमत्ा जप्त करण्याचे आदण अशी जप्त रक्कम व अन्य मालमत्ा यावर दनयंत्ण ठेवण्याकररता उप दवभागीय अदधकारी, सेालापूर-१, सोलापूर यांची सक्षम प्रादधकारी म्हणून दनयुक्ती करणे आवश्यक वाटते.
२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल ५, २०२३/चैत्र १५, शके १९४५त्याअर्थी आता, महाराष्ट्र ठेवीदारांर्या (दवत्ीय संस्र्ांमधील) दहतसंबंधाचे संरक्षण अदधदनयम, १९९९ (सन २००० चा महाराष्ट्र १६) र्या कलम ४ व कलम ५ चे पोट-कलम (१) याद्ारे प्रदान करण्यात आलेल्या अदधकारांचा वापर करून महाराष्ट्र शासन याद्ारे, - (अ) ऑसम अवर अपॉचु ्गदनटी प्रा.दल.पुणे या संस्र्ेची आदण सदर संस्र्ेचे प्रवत्गक, संचालक, भागीदार आदण इतर दकंवा कोणतीही अन्य व्यक्ती यांर्या नावे असलेल्या सोबतर्या अनुसूचीत दवदनदद्गष्टट केल्याप्रमाणे रक्कम व अन्य मालमत्ा जप्त करीत आहे, आदण (ब) सदर जप्त रक्कम व अन्य मालमत्ा यावर दनयंत्ण ठेवण्यासाठी उप दवभागीय अदधकारी, सोलापूर-१, दज.सोलापूर यांची सक्षम प्रादधकारी म्हणून दनयुक्ती करीत आहे.

Order
Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.
No.MPID-0622/C.R.No.42/Pol-15.— Whereas, Ossum Our Opportunity Pvt. Ltd., Pune (hereinafter referred to as "the said Financial Establishment") has received deposits from depositors under the scheme to repay the deposits on maturity alongwith benefits promised thereof to the depositors;
And whereas, an offence has been registered against the said Financial Establishment and its Promoters, Directors, Partners and Others at Jail Road Police Station, Dist. Solapur vide Complaint Register No.54/2021 under sections 420, 406, 120B and 34 of the Indian Penal Code (45 of 1860) and section 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits after maturity;
And whereas, the Government of Maharashtra is satisfied that the said Financial Establishment and its Promoters, Directors, Partners and Others or any other person have failed to return the deposits on demand by the depositors and the said Financial Establishment is not likely to return the deposits to the depositors;
And whereas, the Government of Maharashtra considers it expedient to attach the money or other property believed to have been acquired by the said Financial Establishment and its Promoters, Directors, Partners and Others or any other person, either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishment in order to protect the interest of the depositors of the said Financial Establishment and to appoint Sub-Divisional Officer, Solapur No.1 District Solapur as the Competent Authority to exercise control over the monies and other properties attached;
Now therefore, in exercise of the powers conferred by sub-section (1) of sections 4 and 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,—
(a) attaches the monies and other properties of Ossum Our Opportunity Pvt. Ltd. Company, Pune and its Promoters, Directors, Partners and Others or any other person as specified in the Schedule appended hereto; and
(b) appoints the Sub-Divisional Officer, Solapur-1, District Solapur to be the Competent Authority to exercise control over the monies and other properties attached.
