भाग चार-ब-१२६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल १९, २०२३/चैत्र २९, शके १९४५ आदण ज्याअर्थी, या सयोबत जयोडललेल्या अनुसूचीतील जदमनीचा (यापुढे दजचा उल्ललेि "उक्त जमीन" असा करण्यात यलेईल) ताबा राज्य शासन दकंिा त्याच्या ितीनले घलेण्यात आललेला नाही आदण उक्त जमीन उक्त कायद्ाच्या रिययोजनासा्ठी आिश्यक नाही असले राज्य शासनाचले मत झालले आहले.

त्याअर्थी आता, उक्त अदिदनयमाच्या कलम ३२ च्या पयोट-कलम (४) मिील परंतुक ि इतर अदिकारांचा िापर करून राज्य शासन उक्त जमीन संपादनातून काढून घलेत आहले आदण असले घयोदित करीत आहले की, ही सूचना महाराष्ट्र शासन राजपत्रात रिदसध्द झाल्यानंतर कलम ३२ च्या पयोट-कलम (१) नुसार नयोटीस रिदसध्द हयोण्याच्या लगतपूिथी उक्त जमीन दजच्याकडे दनदहत हयोती त्या व्यक्क्तकडे ती त्यािलेळी अक्ततत्िात असतील असले भारांना अदिन राहून पूि्गलक्ी रिभािासह पुनदन्गदहत हयोईल.

NOTIFICATION

Maharashtra IndustrIal developMent act, 1961.

No. IDC. 2016/(C.R.64)/IND-14.—Whereas, by Government Notification, Industries, Energy and Labour Department, No.IDC. 2007/(334)/IND-14, dated the 12th February, 2009 issued under sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of 1962) (hereinafter referred to as ''the said Act "), the Government of Maharashtra has appointed the 12th February, 2009, also Corrigendum has been issued as per notification No. IDC. 2019 /(C.R.662)/ Udyog-14, dated 19th March 2020 for the area mentioned in the said schedule to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas in village Kumbharte, Taluka Mangaon, District Raigad mentioned in the Schedule appended to the said notification and declared the said area as an industrial area under clause (g) of section 2 of the said Act;

And whereas, Sub Divisional Officer, Mangaon Division, Mangaon, District Raigad has by issuing notice क्रमांक उविअमा-भूसं/काम-2/एसआर-58/2011, dated 26th March, 2015 published in the Maharashtra Government Gazette, Part I Supplementary, Kokan Divisional Supplement, Ordinary 26th March- 1st April, 2015, on page No. 5, उविअमा-भूमं/कात-2/एसआर/2012, dated 5th March, 2020, published in the Maharashtra Government Gazette, Part I Supplementary, Kokan Divisional Supplement, Ordinary dated 5th March, 2020, on pages 1 to 6, and क्रमांक उविअमा-भूसं/कात-2/एसआर-59/2011, dated 22nd October, 2020 published in the Maharashtra Government Gazette, Part I Supplementary, Kokan Divisional Supplement, Ordinary dated 22nd October, 2020 , on pages 1 to 4, under sub-section (1) of section 32 of the said Act , acquired the lands in the said industrial area, and as such, the lands mentioned in the said notice have vested absolutely in the State Government free from all encumbrances under sub-section (4) of said section 32;

And whereas, the actual possession of the lands mentioned in the Schedule appended hereto (thereinafter referred to as " the said lands") was not taken by or on behalf of the State Government and it appears to the State Government that the said lands is no more required for the purpose of the said Act.

Now, therefore in exercise of the powers conferred by the proviso to sub-section (4) of section 32 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby withdraws the said land from acquisition and declares that, on the publication of this Notice in the Maharashtra Government Gazette, the said land shall re-vest with retrospective effect in the person in whom it was vesting immediately before the publication of the notice under sub-section (1) of said section 32, subject to such encumbrances, if any, as may be subsisting at that time.
