क्रमांक नावि/प्र.ा.स./प्रा.यो. नाशिक/कलम २० (३)/मौजे उभाडे, तालुका इगतपुरी/ गट नंबर १३३ पै. व इतर/५९५/२०२३.--- ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे ज्यास "उक्त अधिनियम" असे संबोधले आहे) मधील तरतुदींनुसार नाशिक जिल्ह्याची सुधारित प्रादेशिक योजना (यात यापुढे ज्यास "उक्त प्रादेशिक योजना" असे संबोधले आहे) शासनाने दिनांक २१ जून २०१३ रोजी मंजूर केली असून ती दिनांक १६ सप्टेंबर २०१३ पासून अंमलात आलेली आहे;

आणि ज्याअर्थी, उक्त प्रादेशिक योजनेनुसार मौजे उभाडे, तालुका इगतपुरी, जिल्हा नाशिक येथील गट नंबर १३३ पै., १३६ पै., १३६/१/३ पै., १४२ पै., १४३ पै., १४७, १४८, १५३/१ पै., १५३/२, १५४, १५५, १५७ पै., १५८-अ पै., १५८-ब पै., १६१ पै., १६३, १६८, १६९ पै., १७०, १७१/२, १७३, १७४ पै. व १७५ पै. मधील एकूण २२.५४१० हेक्टर क्षेत्र (यात यापुढे ज्यास "उक्त जमिनी" असे संबोधले आहे) "शेती विभागात" समाविष्ट आहे ;

आणि ज्याअर्थी, राज्यात मंजूर असलेल्या प्रादेशिक योजनांमध्ये उक्त अधिनियमाचे कलम २० अन्वये वेळोवेळी कराव्या लागणाया जमीन वापराच्या ेरबदलासंदर्भाने करावयाच्या कार्यपद्धतीबाबत उक्त अधिनियमाचे कलम १५४ अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५/प्र.क्र.४९/ १५/नवि-१३, दिनांक ६ मे २०१५ व दिनांक ४ जानेवारी २०१६ अन्वये शासनाने निर्देश दिलेले आहेत (यापुढे ज्यास 'उक्त शासन निर्णय' असे संबोधले आहे) व त्या अनुषंगाने शासनाने प्रस्ताव ाननी समिती गठीत केली आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाचे कलम २०, पोट-कलम (२) मधील तरतुदीनुसार उक्त जमिनी शेती विभागातून वगळून खालील अटींच्या अधीन राहून रहिवास विभागात समाविष्ट करण्याचे प्रस्तावित असून त्या अनुषंगाने उक्त प्रादेशिक योजना सुधारित करणे आवश्यक आहे (यापुढे ज्यास 'उक्त ेरबदल' असे संबोधले आहे) असे उक्त शासन निर्णयान्वये गठीत प्रस्ताव ाननी समितीचे मत झाले आहे.

भाग १ (नाविपु) ११

(१)२ महाराष्ट्र शासन राजपत्र, भाग एक -------- नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, एप्रिल २० - २६, २०२३ / चैत्र ३० ते वैशाख ६, शके १९४५ (१) शासनाच्या दिनांक ४ जानेवारी २०१६ च्या निर्णयात नमूद तरतुदींनुसार अधिमूल्य रक्कम भरणे बंधनकारक राहील.

(२) उक्त शासन निर्णयात व त्यासोबतच्या सहपत्रात नमूद केलेल्या मार्गदर्शक सूचनांनुसार, सदर जमिनींचा विकास करणे बंधनकारक राहील.

(३) विषयाधीन जमिनींचे विकसन करताना १५ टक्के क्षेत्र "सार्वजनिक सुविधांसाठी" प्रस्तावित करणे आवश्यक आहे.

(४) विषयाधीन जमिनींचे विकसन करताना व विकासपश्चात तेथील पाणीपुरवठा, सांडपाणी व्यवस्था, घनकचरा विल्हेवाट / व्यवस्थापन यांकरिता योग्य ती स्वयंपूर्ण व्यवस्था अर्जदार यांनी करणे आवश्यक राहील.

(५) अयावत , , (पाण्याचा पुनर्वापर) व अशा स्वरूपाच्या संकल्पना सदर जमिनींचे विकसन करताना अंमलात आणणे व विकसित करणे आवश्यक राहील.

(६) विषयाधीन जमिनींवर अर्जदार / विकसनकत यांनी विकसन करताना प्रती हेक्टरी २५० वृक्ष लावणे बंधनकारक राहील. तसेच विकसित रेखांकनातील भूखंडधारकाने भूखंडात ५ वृक्ष लावणे बंधनकारक राहील. सदरची बाब विकसनास अंतिम मंजुरी देताना पडताळणी करण्यात यावी.

(७) सदरची परवानगी म्हणजे मालकीहक्काबाबत प्रमाणीकरण नाही. ेरबदल प्रस्तावाखालील जमिनींच्या मालकीहक्काबाबत सर्वस्वी अर्जदार यांची जबाबदारी राहील.

(८) विषयांकित जमिनींमध्ये विकसन करण्यापूर्वी सदर जमिनी वनसोंमध्ये येत नाहीत, याबाबत वन विभागाकडून 'ना-हरकत दाखला' घेणे आवश्यक राहील.

(९) सार्वजनिक बांधकाम प्रादेशिक विभाग, नाशिक यांचे पत्र क्रमांक ४००, दिनांक २५ जानेवारी २०२३ रोजीच्या पत्रात नमूद बाबींची पूर्तता अर्जदार यांनी करणे व उक्त पत्रातील अटी बंधनकारक राहतील.

(१०) सदर जमिनींवरील अभिन्यासातील भूखंड / सदनिका यांची विक्री खालील तक्त्यानुसार करणे बंधनकारक राहील.

तक्ता

अभिन्यासातील भूखंड / सदनिका यांची सुविधांच्या विकसनाशी सांगड

(अ) अभिन्यास अंतिमत: मंजूर झाल्यावर

.. एकूण २५ टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(ब) सुमारे ४० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ५० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(क) सुमारे ६० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ७५ टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(ड) सुमारे ८० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ९० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(इ) सुमारे १०० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण १०० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(११) जर अभिन्यासात समूह गृहबांधणी योजना विकसित करावयाची असेल, तर जागेत सर्व मूलभूत सुविधा विकसित झाल्याशिवाय भोगवटा प्रमाणपत्र देण्यात येणार नाही.

(१२) जास्त तीव्र उताराखालील (१ : ५ पेक्षा जास्त उताराखालील) व बांधकामयोग्य नसलेल्या क्षेत्रामध्ये कोणत्याही स्वरूपाचे विकसन अनुोय होणार नाही. तसेच प्रस्तावासोबत सादर केलेल्या कंटुर नकाशावरील तीव्र उताराच्या क्षेत्रात केवळ खुल्या स्वरूपाचे वापर अनुोय राहतील व या क्षेत्रात वृक्षारोपण करणे बंधनकारक राहील. त्याचप्रमाणे प्रस्तावाखालील जागेचे विकसन करताना क्षेत्रांतर्गत जागेची नैसर्गिक भूपृष्ठीय रचना, कंटूर या बाबी विचारात घेऊ न अभिन्यासाची व त्या अंंतर्गत रस्त्यांची आखणी नियोजित करणे आवश्यक असून नैसर्गिक पाण्याचे प्रवाहांना कोणत्याही स्वरूपाची बाधा निर्माण होणार नाही, याची दक्षता घेणे आवश्यक राहील.

(१३) संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचे पत्र क्रमांक १६४५, दिनांक ११ एप्रिल २०२३ रोजीच्या पत्रात नमूद बाबींची पूर्तता अर्जदार यांनी करणे व उक्त पत्रातील अटी यांना बंधनकारक राहतील.

(१४) सदर जागेचे विकसन करताना एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावलीमध्ये नमूद केलेल्या सर्व तरतुदींचा विचार करणे आवश्यक राहील.

(१५) ाननी समितीने वापर विभागात बदल केल्याच्या प्रस्तावास अधिमूल्य भरणा करणे सापेक्ष तत्वत: मान्यता दिल्याच्या दिनांकापासून एक वर्षाचे कालावधीत संबंधितांनी अधिमूल्य जमा न केल्यास सदर ेरबदलाचा प्रस्ताव नामंजूर करण्याचे अधिकार प्रस्ताव ाननी समितीस राहतील.

(१६) प्रस्तावाखालील जमिनींपैकी काही जमिनीच्या ७/१२ उतायावरील इतर अधिकारात कलम ३६ व ३६ (अ) बाबतची नोंद विचारात घेता, सदर जागेच्या हस्तांतरणास शासनाची पूर्वमंजुरी घेणे बंधनकारक राहील.

(१७) प्रस्तावाखालील जमिनींचा विकास करताना प्रस्तावाखालील जमिनींपैकी मुंबई-मनमाड पाईपलाईन वापरासाठी भारत पेट्रोलियमकरिता संपादित असलेल्या जमिनी व त्यापासून सोडावयाच्या अंतराबाबत संबंधितांचा ना-हरकत दाखला प्राप्त करूण घेणे आवश्यक राहील.

(१८) प्रस्तावाखालील काही क्षेत्र हे नागपूर-मुंबई समृद्धी महामार्गालगत स्थित असल्याने या अनुषंगाने प्रत्यक्ष विकसनाच्या वेळी सोडावयाच्या अंतरासह अशा विकसनासंदर्भाने संबंधित प्राधिकरणाचा ना-हरकत दाखला घेणे आवश्यक राहील.

(१९) प्रस्तावाखालील जमिनीमधून जाणाया उच्च दाबाच्या विुतवाहिनी या विकासापूर्वी स्थलांतरित करून घेणे आवश्यक आहे. तसेच त्यापासून आवश्यक अंतरानंतर विकास अनुोय राहील.

(२०) प्रस्तावाखालील जागेस असलेल्या घोटी-सिन्नर हा रस्ता हा नवीन राष्ट्रीय महामार्ग क्रमांक १६०-अ म्हणून दर्जोन्नत झालेला असून भविष्यात सदर रस्ता रुंदीकरणासाठी विषयांकित गट नंबर मधील रस्त्यालगतची जागा आवश्यकता भासल्यास शासनास विना अटी व विना मोबदला ावी लागेल. ह्यासाठी बांधकामाची परवानगी घेतेवेळी रुपये १०० च्या मुांकावर हमी पत्र देणे बंधनकारक राहील.

(२१) प्रस्तावाखालील क्षेत्राच्या हद्दीबाबत अर्जदार यांनी प्रतिाापत्र सादर केलेले असून प्रस्तावासोबत सादर मो.र.क्र. १६६/२०२१ च मो.र.क्र. १७२/२०२१ यावरील अर्जदार यांचे दर्शविलेले क्षेत्राच्या हद्दीकरताच प्रस्तुत ेरबदल प्रस्ताव सादर करण्यात आलेला असून सदर क्षेत्रात किंवा हद्दीत तावत आल्यास त्यास अर्जदार स्वत: जबाबदार राहतील.

आणि ज्याअर्थी, शासनाने उक्त अधिनियमाचे कलम १५१, पोट-कलम (१) अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५/प्र. क्र. ४९/१५/ नवि-१३, दिनांक ११ जून २०१५ नुसार कलम २० (२), २० (३) व २० (४) खालील अधिकार विभागीय सहसंचालक, नगररचना यांना प्रदान केलेले आहेत ;

आणि त्याअर्थी, याबाबतीत शासनाने प्रदान केलेल्या अधिकारांनुसार उक्त अधिनियमाच्या कलम २० चे पोट-कलम (३) अन्वये सहसंचालक, नगररचना, नाशिक विभाग, नाशिक उक्त प्रादेशिक योजनेत उक्त ेरबदल करण्याचा हेतू या सूचनेद्वारे घोषित करीत आहे आणि त्याकरिता उक्त प्रस्तावित ेरबदलांच्या अनुषंगाने नागरिकांकडून हरकती व सूचना, ही सूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या तारखेपासून ३० दिवसांच्या मुदतीत लेखी स्वरूपात मागविण्यात येत आहेत.

हरकती / सूचना सहायक संचालक, नगररचना, नाशिक शाखा, दुसरा मजला, जिल्हा कृषी औोगिक सहकारी संघ लिमिटेड, नाशिक, एन. डी. सी. सी. बकेच्या शेजारी, द्वारका चौक, नाशिक यांच्या कार्यालयाकडे पाठवाव्यात. उक्त प्रस्तावित ेरबदल दर्शविणारा नकाशा नागरिकांच्या अवलोकनार्थ त्यांचे कार्यालयात कार्यालयीन वेळेत उपलब्ध आहे. प्रस्तुत ेरबदलाबाबत विहित मुदतीत प्राप्त होणाया सूचना/ हरकतींवर सुनावणी देण्यासाठी व त्यावरील अहवाल सादर करण्यासाठी सहायक संचालक, नगररचना, नाशिक शाखा, नाशिक यांना "अधिकारी " म्हणून प्राधिकृत करण्यात येत आहे. "अधिकारी " यांनी वैधानिक कार्यवाही पूर्ण करून त्यांचा अहवाल सदस्य-सचिव यांचेकडे सादर करावा.

The Maharashtra Regional Planning and Town Planning Act, 1966

NOTIFICATION

No. NKDN/P.S.C./R.P. Nashik/Section 20 (3)/Mouje Ubhade, taluka Igatpuri/Gat No. 133 (Pt.) and others/595/2023.– Whereas, the Government has sanctioned the Revised Regional Plan for Nashik district on 21st June 2013 (hereinafter referred to as "the said Regional Plan") under the provisions of Maharashtra Regional Planning and Town Planning Act, 1966 (hereinafter referred to as "the said Act") and has came into force with effect from 16th September 2013 ;

and whereas, in the said Regional Plan, the land admeasuring about 22.5410 Hectares bearing Gat Nos. 133 (Pt.), 136/1 (Pt.), 136/1/3 (Pt.), 142, 143 (Pt.), 147, 148, 153/1 (Pt.), 153/2, 154, 155, 157 (Pt.), 158-A (Pt.), 158-B (Pt.), 161 (Pt.), 163, 168, 169 (Pt.), 170, 171/2, 173, 174 (Pt.) and 175 (Pt.). of Mouze Ubhade, taluka Igatpuri, district Nashik (hereinafter referred to as "the said Lands") are included in "Agriculture Zone";

and whereas, the Government vide Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May 2015 and dated 4th January 2016 (hereinafter referred to as "the said Government Resolution") has issued the directives under Section 154 of the said Act, regarding the procedure to be followed under Section 20 of the said Act, for making changes in the use of land in the areas of sanctioned Regional Plans and for that purpose constituted "Proposal Scrutiny Committee;"

and whereas, the "Proposal Scrutiny Committee" constituted under the said Government Resolution, is of the opinion that, the said land shall be deleted from "Agriculture Zone" and proposed to be included in "Residential Zone," and accordingly it is necessary to modify the said Regional Plan (hereinafter referred to as "the said Modification") in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject to the following conditions.–

(1) It shall be binding to deposit the premium amount as mentioned in Government Resolution, dated 4th January 2016.

(2) It shall be binding to develop the said lands as per the guidelines mentioned in the said Government Resolution and Annexure with it.

(3) While developing the said lands it shall be binding to provide 15 per cent Amenity Space.

(4) Applicant / Developer shall make necessary self-contained arrangements to provide Water Supply, Waste Water Treatment, Solid Waste Disposal / Management while developing the said land and after development of the said lands at his own cost.

(5) It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and Solar Energy while developing the said lands.

(6) It shall be binding on Applicant / Developer to plant 250 trees per hectare, while developing the lands and Plot holder of sanctioned layout to plant 5 trees per plot. This shall be verified at the time of final sanction to development.

(7) This permission does not confirm ownership of the said lands. The Applicant will be completely responsible regarding any issue about ownership of the said lands.

(8) It shall be binding to get "No-Objection Certificate" from the Forest Department prior to development of the said lands.

(9) Conditions mentioned in the letter No. 400, dated 25th January 2023 of Public Works Department are bindning to the Applicant.

(10) It shall be binding to sale layout plot of the said lands as per table given below.

Corelation of layout Plots / Flats with development of basic infrastructure

(A) After final approval of layout .. 25 per cent of the total Plots shall be

permitted to sale.

(B) After completion of 40 per cent of .. 50 per cent of the total Plots shall be Civic Amenities. permitted to sale.

(D) After completion of 80 per cent of .. 90 per cent of the total Plots shall be Civic Amenities. permitted to sale.

(E) After completion of 100 per cent of .. 100 per cent of the total Plots shall be Civic Amenities. permitted to sale.

(11) If the Group Housing Scheme is proposed in the layout then, Occupancy Certificate shall not be issued unless all the basic amenities are fully developed in the said lands.

(12) No development will be permissible in the land having steep slope more than 1:5 and in land which is not suitable for construction. The lands having steep slope and shown on the contour map submitted with the proposal shall be utilized for open use only and plantation shall be necessary. The development of land regarding the internal roads is to be done according to natural topography of the land, contour etc. the land shall be so develop, as not to affect adversely, the natural water source/ streams passing through it.

(13) Conditions mentioned in the letter No.1645, dated 11th April 2023 of Director of Town Planning, Maharashtra State, Pune are binding to the Applicant.

(14) All provisions mentioned in the UDCPR are binding while developing this land.

(15) Payment of Premium to the proposal of Zone Change by the Scrutiny Committee in principle, if the Applicant does not pay the premium within a period of one Year from the date of approval, the Proposal Scrutiny Committee shall retain the right to reject the said Modification Proposal.

(16) Prior approval from the Government will be necessary for the lands under Section 36 and 36-A of M.L.R. Code, 1966.

(17) While obtaining the development permission, the lands acquired by Bharat Petroleum for Mumbai-Manmad Petroleum Pipeline, the necessary N.O.C. should be obtained for maintaining the safe distances from the pipeline alignment.

(18) As, some lands included in the proposal is situated near the Nagpur-Mumbai Expressway (Samrudhi Mahamarg), N.O.C from the Concern Authority shall be obtained before the development of the land.

(19) High Tension Power Line passing through the said land under the proposal should be shifted before the Development. Also Development shall be pennissible after the necessary distance there from.

(20) Ghoti-Sinnar Road has been upgraded as New National Highway No.160-A. In future if land is needed for road widening, it should be handed over to the Authority without any condition, free of cost. An affidavit on stamp paper of Rs. 100 to be submitted while obtaining building permission.

(21) The Applicant has submitted the affidavit for the boundary of the lands as per the Measurement Plan No.166/2021 and 172/2021 under the Change of Zone. If some discrepancy found in near future, then sole responsibility lies with the Applicant.

and whereas, as per the provision of sub-section (1) of Section 151 of the said Act, Government vide Notification No. TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning.

Now, therefore, in exercise of the powers delegated by the Government in this regard, as per Section 20 (3) of the said Act, the Joint Director of Town Planning, Nashik Division, Nashik by this Notice declares intention to make the said modification in the said Regional Plan and for the proposed said Modification invites suggestions / objections from the public in writing within 30 days from the date of Publication of this Notice in the Maharashtra Government Gazette.

The suggestions / objections shall be addressed to the Assistant Director of Town Planning, Nashik Branch, 2nd Floor, Zilla Krushi Audyogik Sahakari Sangh Ltd., Nashik, near NDCC Bank, Dwarka Chowk, Nashik. The Plan showing the proposed said Modification is kept open for inspection to the public during the Office hours in their Office. Regarding the proposed said Modification, Assistant Director of Town Planning, Nashik Branch, Nashik is appointed as the "Officer" to hear the suggestions / objections received within the stipulated period and after following legal procedure, the "Officer" shall submit the Report thereon to the Member Secretary.

क्रमांक न.प./३८/सन २०२३.---- ज्याअर्थी, शेंदुर्णी नगरपंचायतीने नियोजन प्राधिकरण म्हणून महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यानंतर 'उक्त अधिनियम' असे संबोधिलेले) चे कलम २६ (१) नुसार प्रारूप विकास योजना, शेंदुर्णी (यानंतर 'उक्त विकास योजना' असे संबोधिलेले) सर्वसाधारण सभेच्या दिनांक ३० सप्टेंबर २०२२ रोजीचे ठराव क्रमांक २ अन्वये नागरिकांच्या सूचना / हरकती मागविण्यासाठी प्रसिद्ध केली आहे. याबाबतची सूचना महाराष्ट्र शासन राजपत्र, नाशिक विभागीय पुरवणी, भाग एकमध्ये, पृष्ठ ३० व ३१ वर दिनांक १३ ऑक्टोबर २०२२ रोजी प्रसिद्ध झाली आहे ;

आणि ज्याअर्थी, उक्त योजनेवर विहित मुदतीत प्राप्त सूचना व हरकतींचा विचार करून उक्त अधिनियमाच्या कलम २८ (२) नुसार गठीत झालेल्या नियोजन समितीने तिचा अहवाल उक्त नियोजन प्राधिकरणाकडे दिनांक ७ ेब्रुवारी २०२३ रोजी सादर केला आहे ;

आणि ज्याअर्थी, नियोजन समितीने सादर केलेल्या अहवालावर विचारांती उक्त नियोजन प्राधिकरणाने काही बदल सूचवून तो मान्य केलेला आहे. उक्त योजनेत ेरबदल / बदल करण्यासाठी व ती उक्त अधिनियमाच्या कलम ३० नुसार शासनाकडे मंजुरीसाठी सादर करण्यासाठी सर्वसाधारण सभेचा ठराव क्रमांक २, दिनांक ३१ मार्च २०२३ पारित केलेला आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाचे कलम २८ (४) खालील तरतुदींनुसार उक्त योजनेच्या मसुात केलेले ेरबदल / बदल नागरिकांच्या अवलोकनार्थ प्रसिद्ध करणे आवश्यक आहे ;

आणि त्याअर्थी, उक्त प्रारूप विकास योजनेच्या मसुात नियोजन प्राधिकरणाने उक्त अधिनियमाचे कलम २८ (४) नुसार केलेल्या ेरबदलांची / बदलांची सूची परिशिष्ट 'अ' मध्ये नमूद केल्याप्रमाणे नागरिकांच्या माहितीसाठी प्रसिद्ध करण्यात येत आहे. सदर ेरबदल /महाराष्ट्र शासन राजपत्र, भाग एक -------- नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, एप्रिल २० - २६, २०२३ / चैत्र ३० ते वैशाख ६, शके १९४५ ७ बदल दर्शविणारा उक्त प्रारूप विकास योजनेचा नकाशा व अहवाल पुढील नमूद केलेल्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत ३० दिवसांच्या कालावधीकरिता नागरिकांच्या अवलोकनार्थ ठेवण्यात आला आहे.

एम-४ गट नंबर ५१० (भाग) मधील आरक्षण क्रमांक १९ मधील पाकग () चे आरक्षण वगळण्यात यावे व तो भाग 'रहिवास' विभागात समाविष्ट करण्यात यावा व पाकगचे क्षेत्र (१ एकर) ते गट नंबर ६१८ मध्ये स्थलांतरित करण्यात यावे.

एम-५ गट नंबर ६०४ (भाग) व ६०५ (भाग) मधील आरक्षण क्रमांक २१ मधील बगीचा () चे आरक्षण वगळण्यात यावे व तो भाग 'रहिवास' विभागात समाविष्ट करण्यात यावा.

एम-७ गट नंबर ६४८ (भाग), ६४७ (भाग) व १०६२ (भाग)मधील आरक्षण क्रमांक २५ मधील , चे आरक्षण वगळण्यात यावे व तो भाग 'रहिवास' विभागात समाविष्ट करण्यात यावा व , चे क्षेत्र ते गट नंबर ६१८ मध्ये स्थलांतरित करण्यात यावे. तसेच गट नंबर ६१८ मधील आरक्षणाकरिता नकाशावर दर्शविल्यानुसार १२.०० मीटर रुंद विकास योजना रस्ता प्रस्ताविक करण्यात यावा.

एम-८ गट नंबर ७३५ (भाग), ७३६ (भाग) व ७४२ (भाग) मधील आरक्षण क्रमांक २७ मधील बगीचा () चे आरक्षण वगळण्यात यावे व तो भाग 'रहिवास' विभागात समाविष्ट करण्यात यावा.

एम-९ गट नंबर ११०४ (भाग) व ११०६ (भाग) या गटास तात्पुरती अभिन्यास परवानगी प्राप्त झाली. तसेच मा. सहायक जिल्हा अधिकारी, जळगाव यांनी दिनांक १२ जुलै २०१७ रोजी बिनशेती आदेश असल्याने सदरचे आरक्षण वगळण्यात यावे व ते 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-११ गट नंबर १०४९ (भाग) व ११५६ (भाग) मधील आरक्षण क्रमांक ३१ मधील कत्तलखाना ( ) चे आरक्षण शेंदुर्णी शहराला कत्तलखान्याची आवश्यकता नसल्याने ते वगळण्यात यावे व त्याचे आरक्षण परत टाकण्यात येऊ नये व तो भाग 'शेती' विभागात समाविष्ट करण्यात यावा.

एम-१३ गट नंबर ११२४ (भाग), १०९६ (भाग) व ११२५ (भाग) मधील आरक्षण क्रमांक ३५ मधील चे आरक्षण वगळण्यात यावे व ते 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१४ गट नंबर ११५० (भाग), ११५४ (भाग) व ११५२ (भाग) मधील आरक्षण क्रमांक ३६ मधील चे आरक्षण वगळण्यात यावे व ते 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१५ हरकत अर्ज क्रमांक ८ अन्वये गट नंबर ६६४ चा काही भाग हा रहिवास क्षेत्रात आहे. उर्वरित क्षेत्र शेती विभागात आहे. तरी पूर्ण भाग हा 'रहिवास' विभागात समाविष्ट करावा.

एम-१६ संपूर्ण गट नंबर ६१८ मध्ये शासकीय विश्रामगृह (१ एकर) इतर शासकीय कार्यालयाच्या प्रशासकीय इमारत क्षेत्र (२.५ एकर) साठी आरक्षित करण्यात यावा.

एम-१७ हरकत अर्ज क्रमांक १९ अन्वये गट नंबर ७४८ चा काही भाग हा रहिवास क्षेत्रात आहे. उर्वरित क्षेत्र शेती विभागात आहे. तरी पूर्ण भाग हा 'रहिवास' विभागात समाविष्ट करावा.

एम-१८ हरकत अर्ज क्रमांक ३४ अन्वये गट नंबर ७८२ चा काही भाग हा रहिवास क्षेत्रात आहे. उर्वरित क्षेत्र शेती विभागात आहे. तरी पूर्ण भाग हा 'रहिवास' विभागात समाविष्ट करावा.

एम-१९ हरकत अर्ज क्रमांक ३७ अन्वये गट नंबर ७८२ चा काही भाग हा रहिवास क्षेत्रात आहे. उर्वरित क्षेत्र शेती विभागात आहे. तरी पूर्ण भाग हा 'रहिवास' विभागात समाविष्ट करावा.

एम-२० आरक्षण क्रमांक २३ बस स्टॅण्ड दक्षिणेकडील पेट्रोलपंपाच्या शेजारी स्थलांतरित करण्यात यावे.

Notice

No. NP/TPD/38/2023.– Whereas, Shendurni Nagarpanchayat being Planning Authority has published the Draft Development Plan of Shendurni Nagarpanchayat (hereinafter referred to as the "said Development Plan") under Section 26 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (hereinafter referred to as "the said Act") vide it's General Body Resolution No. 2, dated 30th September 2022 for inviting suggestions / objections from public. The said Notice has been published in the Maharashtra Government Gazette, Nashik Divisional Supplement, Part 1, dated 13th October 2022 on page No. 30 and 31 ;

and whereas, after considering the suggestions / objections to the said Plan received within stipulated period the Planning Committee constituted under Section 28 (2) of the said Act has submitted it's report to the said Planning Authority on dated 7th February 2023 ;

and whereas, the said Planning Authority after considering the report submitted by Planning Committee accepted it and suggested some changes in it and passed General Body Resolution No. 2, dated 31st March 2023 to make Modifications / Changes to the said Development Plan and to submit the said Plan for sanction to the Government under Section 30 of the said Act ;

and whereas, it is necessary to publish the said Modifications / Changes made in the said Plan for information of the public as per Section 28 (4) of the said Act ;

Now, therefore, the list of Modifications / Changes made under Section 28 (4) of the said Act by the said Planning Authority is hereby published as Appendix-A as per the provisions of the said Act for information of the public. The said Draft Development Plan showing the Modifications / Changes is kept open for the inspection of the public in the following offices on working days during the office hours for a period of 30 days.

क्रमांक नि.न.प./बांध./कार्या-७२६/सन २०२३.---- ज्याअर्थी, निाड नगरपंचायतीने नियोजन प्राधिकरण म्हणून महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ चे कलम २६ (१) नुसार प्रारूप विकास योजना, निाड दिनांक ११ ऑक्टोबर २०२२ चे सूचनेद्वारे नागरिकांच्या सूचना / हरकती मागविण्यासाठी प्रसिद्ध केली आहे. सदरची सूचना महाराष्ट्र शासन राजपत्र, नाशिक विभागीय पुरवणी, भाग एकमध्ये, दिनांक १३ ते १९ ऑक्टोबर २०२२ रोजी प्रसिद्ध झाली आहे ;

आणि ज्याअर्थी, उक्त योजनेवर विहित मुदतीत प्राप्त सूचना व हरकतींचा विचार करून उक्त अधिनियमाच्या कलम २८ (४) नुसार स्थापन झालेल्या नियोजन समितीने तिचा अहवाल उक्त नियोजन प्राधिकरणाकडे दिनांक २८ डिसेंबर २०२२ रोजी सादर केला ;

आणि ज्याअर्थी, नियोजन समितीने सादर केलेल्या अहवालावर विचारांती उक्त नियोजन प्राधिकरणाने तो अंशत: मान्य करून नव्याने बदल सूचवून उक्त योजनेत ेरबदल / बदल करण्यासाठी व ती उक्त अधिनियमाच्या कलम ३० नुसार शासनाकडे मंजुरीसाठी सादर करण्यासाठी ठराव क्रमांक २८६, दिनांक २८ ेब्रुवारी २०२३ रोजी पारित केलेला आहे ;

आणि त्याअर्थी, उक्त प्रारूप विकास योजनेच्या मसुात नियोजन प्राधिकरणाने उक्त अधिनियमाचे कलम २८ (४) नुसार केलेल्या ेरबदलांची / बदलांची सूची परिशिष्ट 'अ' मध्ये नमूद केल्याप्रमाणे नागरिकांच्या माहितीसाठी प्रसिद्ध करण्यात येत आहे. सदर ेरबदल / बदल दर्शविणारा उक्त प्रारूप विकास योजनेचा नकाशा खालील नमूद केलेल्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत ३० दिवसांच्या कालावधीकरिता नागरिकांच्या अवलोकनार्थ ठेवण्यात आला आहे.

एम-४ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक १३ वगळून वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-४ नकाशावर दर्शविल्याप्रमाणे १५ मीटर रुंद विकास योजना रस्त्याची लांबी उत्तर बाजूस गट नंबर १२३ व १२४ मधून प्रस्तावित करून १५ मीटर पूर्व-पश्चिम विकास योजना रस्त्यापयत (एम ३ नुसार) वाढविण्यात यावी.

एम-६ नकाशावर दर्शविल्याप्रमाणे १५ मीटर रुंद विकास योजना रस्त्याची संरचना गट नंबर २६८, २६५, २६७, २६६ च्या सामाईक हद्दीवरून भागश: स्थलांतरित करून स्थलांतरणाखालील क्षेत्र 'शेती' विभागात समाविष्ट करण्यात यावे.

एम-७ नकाशावर दर्शविलेप्रमाणे गट नंबर ३३० चे भागश: क्षेत्र 'शेती' विभागातून वगळून 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-८ नकाशावर दर्शविलेप्रमाणे गट नंबर १८ मीटर रुंद विकास योजना रस्त्याची (यापूर्वीचा १८ मीटर प्रादेशिक विकास योजना रस्ता) आखणी वगळून वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-८ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २० ची संरचना बदलावी व वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-९ गाव नकाशानुसार गट क्रमांक दुरुस्ती करण्यात यावी.

एम-१० नकाशावर दर्शविलेप्रमाणे गट नंबर ६७८ ते गट नंबर ७३५ पयतच्या उत्तर-दक्षिण १२ मीटर रुंद विकास योजना रस्त्याची आखणी गट नंबर ६७८, ६७७, ७२३, ७२४, ७२९, ७२५, ७२८, ७२७, ७३६, ७३७ व ७३५ च्या समाईक हद्दीवरून स्थलांतरित करण्यात यावी व स्थलांतरित केलेल्या रस्त्यापयतचे क्षेत्र 'शेती' विभागातून वगळून 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-११ नकाशावर दर्शविलेप्रमाणे गट नंबर ६९८ ते ७२८ मधील पूर्व-पश्चिम १५ मीटर रुंद विकास योजना रस्ता १२ मीटर रुंद करण्यात यावा व रस्त्याखालील वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१२ नकाशावर दर्शविलेप्रमाणे गट नंबर ७०५, ६९९, ४०७, ४०८, ४०६ ंमधून जाणारा १२ मीटर रुंद विकास योजना रस्त्याची आखणी वगळून वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१३ नकाशावर दर्शविलेप्रमाणे १२ मीटर रुंद विकास योजना रस्त्याची आखणी भागश: स्थलांतरित करून गट नंबर ७५४ च्या पश्चिम बाजूने जाणाया अस्तित्वातील रस्त्यानुसार करण्यात यावी व स्थलांतरणाखालील रस्त्याचे क्षेत्र 'शेती' विभागात समाविष्ट करण्यात यावे.

एम-१४ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २१ 'म्युनिसिपल पर्पज'चे क्षेत्र वगळून 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१५ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २२ चे क्षेत्र १२ मीटर रुंद विकास योजना रस्त्याच्या पश्चिम बाजूस गट नंबर ८११ व ८१२ मध्ये स्थलांतरित करण्यात यावे व स्थलांतरणाखालील क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१६ नकाशावर दर्शविलेप्रमाणे पूर्व-पश्चिम १२ मीटर रुंद विकास योजना रस्ता दक्षिण बाजूस स्थलांतरित करून गट नंबर ८२१, ८०८ ते गट नंबर ८९९ च्या सामाईक हद्दीवरून स्थलांतरित करून वगळलेल्या रस्त्याखालील क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१६ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २४ ची संरचना भागश: बदलून वगळलेले क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१७ नकाशावर दर्शविलेप्रमाणे अनुल्लेखीत गट नंबर ८२७ व ८२८ च्या हद्दी दर्शविण्यात याव्यात.

एम-१८ नकाशावर दर्शविलेप्रमाणे दक्षिण-उत्तर १२ मीटर रुंद विकास योजना रस्त्याची आखणी बदलून पूर्व बाजूने गट नंबर ८५० व ८५२ च्या सामाईक हद्दीवर स्थलांतरित करण्यात यावे व स्थलांतरित रस्त्यापयतचे क्षेत्र 'शेती' विभागातून वगळून 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-१९ नकाशावर दर्शविलेप्रमाणे १२ मीटर रुंद रस्त्याची आखणी भागश: स्थलांतरित करून विमान जमीन वापर नकाशावर दर्शविलेल्या विमान रस्त्यानुसार करण्यात येऊ न वगळलेले क्षेत्र 'शेती' विभागात समाविष्ट करण्यात यावे.

एम-२० नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २६ चे दक्षिणेकडील ३० मीटर रुंदीचे क्षेत्र वगळून वगळलेले क्षेत्र 'ग्रीन बेल्ट' मध्ये समाविष्ट करण्यात यावे.

एम-२१ नकाशावर दर्शविलेप्रमाणे नंबर १०७० ते १०८१ पयतचा दक्षिण-उत्तर १२ मीटर रुंद विकास योजना रस्ता भागश:

वगळण्यात यावा. नव्याने प्रस्तावित १२ मीटर रुंद विकास योजना रस्ता, गट नंबर १०७० मधील मंजूर अभिन्यासातील पूर्व-पश्चिम ९ मीटर रस्त्याचे रुंदीकरण करून प्रस्तावित करण्यात यावा. तदनंतर सदर रस्ता दक्षिणेकडे वळवून गट नंबर १०७० व गट नंबर १०८२ च्या सामाईक हद्दीवरून आरक्षण क्रमांक २६ पयत प्रस्तावित करण्यात यावा.

तसेच सुधारित रस्त्याच्या आखणीपयतचे व गट नंबर १०७५ पयतचे क्षेत्र 'रहिवास' विभागात व उर्वरित गट नंबर १०७७, १०७८, १०७९ चे क्षेत्र 'शेती' विभागात समाविष्ट करण्यात यावे.

एम-२२ नकाशावर दर्शविलेप्रमाणे १२ मीटर रुंद विकास योजना रस्त्याची आखणी पूर्व बाजूने मंजूर अभिन्यासातील रस्त्यानुसार भागश: स्थलांतरित करून वगळलेल्या रस्त्याखालील क्षेत्र 'रहिवास' विभागात समाविष्ट करण्यात यावे.

एम-२३ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २३ ची संरचना बदलण्यात यावी.

एम-२४ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक ४ चे नामाभिधान 'वाहनतळ' ऐवजी 'म्युनिसिपल पर्पज' असे करण्यात यावे.

एम-२५ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक ५ चे नामाभिधान 'वाहनतळ' ऐवजी 'म्युनिसिपल पर्पज' असे करण्यात यावे.

एम-२६ नकाशावर दर्शविलेप्रमाणे आरक्षण क्रमांक २ चे नामाभिधान 'वाहनतळ' ऐवजी 'दुकान कें' असे करण्यात यावे.

एम-२७ नकाशावर दर्शविलेप्रमाणे सी.टी.एस. क्रमांक ९३१, ९३२ ते सी.टी.एस. क्रमांक ४१, ४२ पयतची अस्तित्वातील रस्त्याच्या आखणीची मध्यरेषा विचारात घेऊ न ९ मीटर रुंद विकास योजना रस्त्याची ७.५ मीटर रुंद करण्यात यावा.

एम-२८ नकाशावर दर्शविल्याप्रमाणे ७.५ मीटर रुंद विकास योजना रस्त्याची आखणी (एम-२७ नुसार) सी.टी.एस. क्रमांक ९३०, ९३२ व ९४० च्या उत्तर बाजूस स्थलांतरित करण्यात यावी.

एम-२९ नकाशावर दर्शविल्याप्रमाणे ७.५ मीटर रुंद विकास योजना रस्ता (एम-२७ नुसार) विभाजीत करून सी.टी.एस. क्रमांक १०३ च्या दक्षिण बाजूने अस्तित्वातील रस्त्यानुसार साधारणत: ६.० मीटर कायम ठेवून उर्वरित दीड मीटर रुंद रस्ता उत्तर बाजूने स्थलांतरित करण्यात यावा.

एम-३० नकाशावर दर्शविल्याप्रमाणे विनिता व कादवा नदीच्या पुररेषा वगळण्यात याव्यात.

Publication of list of Modification / Changes in Draft Development Plan of Niphad under Section 28 (4)

of the Maharashtra Regional Planning and Town Planning Act, 1966.

Notice

क्रमांक नि.न.प./बांध./कार्या-७२६/सन २०२३.---- Whereas, Niphad Nagarpanchayat being Planning Authority has published the Draft Development Plan of Niphad under Section 26 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 vide Notice dated 11th October 2022 for inviting suggestions/ objections from public. The said Notice is published in Maharashtra Government Gazette of Nashik Divisional, Supplement, Part-1, dated 13-19 October 2022 ;

and whereas, after considering the suggestions/objections to the said Plan received within stipulated period, the Planning Committee constituted under Section 28 (4) of the said Act, has submitted it's report to the said Planning Authority on 28th December 2022.

and whereas, the said Planning Authority after considering the report submitted by the Planning Committee, partly accepted it / suggested changes in it and passed Resolution No. 286, dated 28th February 2023 to make modifications / changes to the said Plan and submit the said Plan for sanction to the Government under Section 30 of the said Act;

and whereas, it is necessary to publish the said modifications / changes made in the said Plan for inspection of the public as per Section 28 (4) of the said Act;

Now, therefore, the list of modifications / changes made under Section 28 (4) of the said Act, by the said Planning Authority is hereby published as Appendix-A as per the provisions of the said Act for information of the public. The said Draft Development Plan showing the modifications / changes is kept open for the inspection of the public in the following offices, on all working days, during the office hours for a period of 30 days.

M-4-ii 15.0 meters wide D. P. Road is extended towards Northern side passing through Gat Nos. 123 and 124 upto 15.0 meters wide East-West D. P. Road (Modified by M-3) as shown on Plan.

M-5 Part Area of the Land bearing Gat No. 224 is deleted from "Residential Zone" and land thus released is reserved as New Site No. 27 "M.S.E.B" as shown on Plan.

M-6 The Alignment of 15.0 meters wide D.P. Road is partly realigned, passing from the common boundary of Gat Nos. 268, 265, 267, 266 as shown on Plan and land thus released is included in "Agriculture Zone".

M-7 Part Area of the Land bearing Gat No. 330 is deleted from "Agriculture Zone" and land thus released is included in "Residential Zone" as shown on Plan.

M-8-i 18.0 meters wide D.P. Road (previously designated as 18.0 meters wide R.P. Road) is deleted and land thus released is included in " Residential Zone" as shown on Plan.

M-8-ii The Site No 20 is rearranged and land thus released is included in "Residential Zone" as shown on Plan.

M-9 Correction of Gat Numbers as per TLR Map.

M-10 The alignment of 12.0 meters wide North-South D.P Road starting from Gat No. 678 upto Gat No. 735 is shifted to the common boundary of Gat Nos. 678, 677, 723, 724, 729, 725, 728, 727, 736, 737 and 735 land up to the modified alignment is released from"Agriculture Zone" and included in "Residential Zone" as shown on Plan.

M-11 The Width of East-West 15.0 meters wide D.P. Road, passing through Gat Nos.

698 to 728, is reduced to 12.0 meters and land thus released is included in "Residential Zone" as shown on Plan.

M-12 The East - West 12.0 meters D.P Road passing through Gat Nos. 705, 699, 407, 408, 406 is deleted and land thus released is included in " Residential Zone" as shown on Plan.

M-13 The Alignment of 12.0 meters wide D.P. Road is partly shifted towards to the existing road on the western side of Gat No. 754 and land thus released is included in "Agriculture Zone" as shown on Plan.

M-14 Site No. 21 "MPL Purpose" is deleted and land thus released is included in "Residential Zone" as shown on Plan.

M-15 Site No. 22 is shifted to western side of 12.0 meters D.P. Road in Gat Nos. 811 and 812 and land thus released is included in "Residential Zone" as shown on Plan.

M-16-i The East-West 12.0 meters wide D.P. Road is shifted towards Southern side passing from common boundary of Gat Nos. 821, 808 etc., upto Gat No. 899 and the land thus released is included in "Residential Zone" as shown on Plan.

M-16-ii The Site No. 24 is partly rearranged and the land thus released is included in "Residential Zone" as shown on Plan.

M-18 The North - South 12.0 meters wide D.P. Road is slightly shifted towards Eastern side passing from common boundary of Gat Nos. 850 and 852 and land upto the modified alignment is released from"Agriculture Zone" and included in "Residential Zone" as shown on Plan.

M-19 The Alignment of 12.0 meters wide D.P. Road is partly shifted as per the existing road alignment shown on ELU Plan and land thus released is included in "Agriculture Zone" as shown on Plan.

M-20 30.0 meters wide strip from Southern Side of Site No. 26 is deleted and land thus released is included in " Green Belt" as shown on Plan.

M-21 The North-South 12.0 meters wide D.P. Road is partly deleted from Gat No. 1070 to Gat No. 1081. New alignment of 12.0 meter wide D.P. Road is proposed by widening the 9.0 meters wide East-West Sanctioned Layout Road in Gat No. 1070 turning towards south on the common boundary of Gat Nos. 1070 and 1082 up to Site No. 26 and land thus released is included in "Residential Zone" upto 1075 and rest of the land in Gat Nos. 1077, 1078, 1079 is included in "Agriculture Zone" as shown on Plan.

M-22 Alignment of 12.0 meters wide D.P. Road is partly realigned towards Eastern side as per the Sanctioned Layout Road and land thus released is included in "Residential Zone" as shown on Plan.

M-23 Site No. 23 is rearranged as shown on Plan.

M-24 The Site No. 4 "Parking" is redesignated as "MPL Purpose" as shown on Plan.

M-25 The Site No. 5 "Parking" is redesignated as "MPL Purpose" as shown on Plan.

M-26 The Site No. 2 "Parking" is redesignated as "Shopping Center" as shown on Plan.

M-27 The width of 9.0 meters wide D.P Road is reduced to 7.5 meters and the same is realigned by considering centre of existing road's alignment, passing through CTS Nos. 931, 932 etc., upto 41, 42 as shown on Plan.

M-28 The modified 7.5 meters wide D.P. Road (As per M-27) is realigned towards Northern side of the CTS Nos. 931, 932 and 940 as shown on Plan.

M-29 7.5 meters wide D.P Road (As per M-27) is partly bifurcated by keeping existing average 6.0 meters wide road towards Southern side of CTS No. 103 and the remaining road widening 1.5 meters relocated towards Northern side of the said CTS as shown on Plan.

M-30 Flood Lines of Vinetha and Kadava river are deleted as shown on Plan.

क्रमांक डीसी/कार्या ९-ब-१/७६८/२०२३.---- ज्याअर्थी, पोलीस अधीक्षक, अहमदनगर यांचेकडील पत्र क्रमांक जिविशा / प्रतिबंधात्मक आदेश / ४४९१/२०२३/अहमदनगर, दिनांक २५ मार्च २०२३ रोजीन्वये अहमदनगर जिल्ह्यात शहरी व ग्रामीण भागात दिनांक २९ मार्च २०२३ ते दिनांक ११ एप्रिल २०२३ या कालावधीत पत्रात नमूद केलेपैकी अनुचित प्रकार घडण्याची शक्यता नाकारता येत नाही. तसेच सण, उत्सव, जयंती, पुण्यतिथी साजरे होणार आहेत, अहमदनगर जिल्हा पोलीस आस्थापना यांचेकडून दिनांक २ एप्रिल २०२३ रोजी पोलीस भरती पेपरच्या अनुषंगाने विविध भागातून मोठा प्रमाणावर उमेदवार पोलीस भरतीसाठी येणार आहेत. तसेच सभा, महासभा, आंदोलने इत्यादींमुळे सार्वजनिक शांतता बिघडण्याची दाट शक्यता नाकारता येत नाही.

त्यासाठी जिल्ह्यात सार्वजनिक शांतता आणि सार्वजनिक सुरक्षितता राखण्यासाठी संपूर्ण अहमदनगर जिल्हा महसूल स्थळसीमेच्या हद्दीत महाराष्ट्र पोलीस अधिनियमाचे कलम ३७ (१) चे प्रतिबंधात्मक आदेश जारी करणेबाबत विनंती केली आहे.

त्याअर्थी, पोलीस अधीक्षक, अहमदनगर यांचे अहवालाचे अवलोकन करता जिल्ह्यात सार्वजनिक शांतता आणि सार्वजनिक सुरक्षितता राखण्यासाठी अहमदनगर जिल्हा महसूल स्थळसीमेच्या हद्दीत कलम ३७ (१) चे प्रतिबंधात्मक आदेश जारी करणे आवश्यक असल्याची माझी खात्री झाल्याने मी, सिद्धाराम सालीमठ, जिल्हादंडाधिकारी, किंवा ेकावयाची उपकरणे अथवा साधने जवळ बाळगणे, जमा करणे किंवा तयार करणे;

(घ) व्यक्तींचे अथवा मृतदेहांचे किंवा त्यांच्या आकृत्या किंवा प्रतिमा यांचे प्रदर्शन करणे;

(च) ज्यामुळे सभ्यता अगर नीतिमत्ता यास धक्का पोहोचेल अशी व सुरक्षितता धोक्यात येईल किंवा ज्यामध्ये मानहानी करण्याची प्रवृत्ती दिसून येत असेल अशी कृती व आवेशपूर्ण भाषणे करणे, अंगविक्षेप करणे किंवा विडंबन करणे आणि अशी चित्रे, चिन्हे, लक किंवा इतर कोणताही जिन्नस किंवा वस्तू तयार करणे, त्यांचे प्रदर्शन करणे किंवा त्यांचा प्रसार करणेे.

मात्र, शासकीय सेवेतील व्यक्तींना, ज्यांना आपले वरिष्ठांचे आदेशानुसार कर्तव्यपूर्तीसाठी हत्यार जवळ बाळगणे आवश्यक आहे तसेच ज्या व्यक्तींना शारीरिक दुर्बलतेच्या कारणास्तव काठी वापरणे आवश्यक आहे, अशा व्यक्तींना सदरचा वापर अनुोय राहील.

प्रस्तुतचा आदेश अहमदनगर जिल्हा महसूल स्थळ सीमेच्या हद्दीत दिनांक २९ मार्च २०२३ ते दिनांक ११ एप्रिल २०२३ रोजीचे २४.०० वाजेपावेतोचे कालावधीत जारी राहील.

प्रस्तुतचा आदेश आज दिनांक दिनांक २८ मार्च २०२३ रोजी माझे सही व शिक्क्यानिशी दिला असे.

क्रमांक ड/कक्ष-३/एमएजी-२/कावि-४९१/२०२३.--- ज्याअर्थी, धुळे जिल्ह्यात दिनांक २२ मार्च २०२३ रोजी हिंदू नववर्ष असल्याने नववर्ष स्वागत यात्रा, मिरवणूक काढण्यात येतात. तसेच दिनांक २४ मार्च २०२३ रोजीपासून मुस्लीम बांधवांचा पारंपरिक पद्धतीने उपवास (रोजे) सुरू होणार आहेत. तसेच आता सध्या महाराष्ट्र राज्यात सुरू असलेल्या राजकीय घडामोडीच्या काळात कायदा व सुव्यवस्था अबाधित रहावी, तसेच कें सरकार यांच्या विरोधात विविध पक्ष संघटना हे वेगवेगया विषयांवरून धरणे, आंदोलने, मोर्चे करीत आहेत. तसेच वेगवेगया संघटना ह्या विविध विषयांवरून निवेदने देत असल्याने प्रतिबंधात्मक उपाययोजनांची अंमलबजावणी योग्य प्रकारे करण्यासाठी धुळे जिल्ह्यात प्रतिबंधात्मक उपाययोजना करणे आवश्यक आहे. त्या अनुषंगाने जिल्ह्यात कायदा व सुव्यवस्थेचा प्रश्न निर्माण होण्याची शक्यता नाकारता येत नाही. यास्तव, दिनांक १८ मार्च २०२३ रोजीचे ००.०१ वाजेपासून ते दिनांक १ एप्रिल २०२३ रोजीचे रात्री २३.५५ वाजेपावेतो मुंबई पोलीस कायदा, कलम ३७ (१) (३) चे प्रतिबंधात्मक आदेश जारी होऊ न प्रसिद्धी होणेस पोलीस अधीक्षक, धुळे यांनी त्यांचेकडील पत्र क्रमांक जिविशा/प्रतिबंधात्मक आदेश/ ८०९/२०२३/धुळे. दिनांक १५ मार्च २०२३ अन्वये विनंती केलेली आहे.

जिल्ह्यात कायदा व सुव्यवस्था अबाधित राखण्याकामी पोलिसांना मदत व्हावी म्हणून प्रभारी पोलीस अधीक्षक, धुळे यांनी सादर केलेला अहवाल व वरील परिस्थिती पाहता माझी खात्री झालेने संपूर्ण धुळे जिल्ह्यातील कायदा व सुव्यवस्था अबाधित राहणेसाठी व परिस्थितीवर नियंत्रण ठेवणेसाठी पोलिसांना मदत व्हावी म्हणून मी, संजय गायकवाड, अपर जिल्हादंडाधिकारी, धुळे मला मुंबई पोलीस अधिनियम, १९५१ चे कलम ३७ (१) (३) नुसार प्राप्त असलेल्या अधिकारांचा वापर करून धुळे जिल्ह्यातील कोणत्याही इसमास खालील कृत्ये करण्यास याद्वारे मनाई करीत आहे.

(इ) जाहीरपणे घोषणा करणे, गाणे म्हणणे, वाे वाजविणे ;

() कोणत्याही व्यक्तीची आकृती किंवा प्रतिमेचे प्रदर्शन करणे ;

(ग) सभा घेण्यास, मिरवणुका काढण्यास, पाच किंवा पाचापेक्षा जास्त व्यक्ती एकत्र येण्यास मनाई करीत आहे ;

(ह) संबंधित तहसीलदार तथा कार्यकारी दंडाधिकारी यांनी दिलेल्या परवानगीशिवाय काढण्यात आलेले मोच, रॅली, सभा ;

मुंबई पोलीस अधिनियम, १९५१ चे कलम ३७ (१) (३) हा आदेश ज्यांना लाठी अगर तत्सम वस्तू घेतल्याशिवाय चालता येत नाही, अशा अपंग इसमांना लागू नाही. तसेच शासनाच्या सेवेतील ज्या व्यक्तींना आपल्या वरिष्ठांचे आदेशानुसार कर्तव्यपूर्तीसाठी हत्यार बाळगणे आवश्यक आहे, त्यांना लागू होणार नाही.

तसेच, मुंबई पोलीस अधिनियम, १९५१ चे कलम ३७ (१) (३) नुसार संबंधित तहसीलदार तथा कार्यकारी दंडाधिकारी यांचे पूर्वपरवानगीशिवाय पाचपेक्षा जास्त व्यक्तींचा समावेश असलेल्या कोणत्याही मंडळींस (जमावास) किंवा मिरवणुकीस मनाई करीत आहे व सदर कालावधीत सभा, मिरवणुका, मोर्चे, मिटिंग, कार्यक्रम व रॅली इत्यादी परवानगीबाबत स्थानिक पोलीस स्टेशनच्या अधिकायांच्या सहमतीने संबंधित तहसीलदार तथा कार्यकारी दंडाधिकारी यांनी कायदा व सुव्यवस्था राखणेबाबत योग्य तो निर्णय घेऊन परवानगी ावी. अशी देण्यात आलेली परवानगी, लग्न समारंभ अगर प्रेतयात्रेच्या जमावास शासनाने वेळोवेळी दिलेले निबध लागू असतील.

सदरचा आदेश हा दिनांक १८ मार्च २०२३ रोजीचे ००.०१ वाजेपासून ते दिनांक १ एप्रिल २०२३ रोजीचे रात्री २३.५५ वाजेपावेतो संपूर्ण धुळे जिल्ह्यात अंमलात राहील.
