वैधमापन शास्त्र अप्धप्नयम, २००९.

क्रमांक वैमाशा-२०२२/रि.क्र.४०/ ग्ासं-३.—वैधमापन शास्त् अदधदनयम, २००९ (२०१० चा क्र.१) च्या कलम ५३ च्या पोट-कलम (१) व (२) याद्ारे रिदान करण्यात आलेल्या अदधकारांचा आदि या संबंधात महाराष्ट्र शासनास समर्ग करिाऱ्या इतर सव्ग अदधकारांचा वापर करून उक्त अदधदनयमातील कलम ५३ च्या पोट-कलम (१) मधील तरतुदीनुसार केंद्रशासनाची पूव्गदवचारदवदनमय केल्यानंतर याद्ारे महाराष्ट्र वैधमापन शास्त् (अंमलबजाविी) दनयम, २०११ मध्ये खालीलरिमािे सुधारिा करीत आहे :—

१. संप्क्षप्त नाव :- या दनयमांना "महाराष्ट्र वैधमापन शास्त् (अंमलबजाविी) (पदहली सुधारिा), २०२३" असे म्हिण्यात येईल.

२. महाराष्ट्र वैधमापन शास्त् (अंमलबजाविी) दनयम, २०११ (यापुढे "मूळ दनयम"असे संबोधण्यात येईल) च्या दनयम ६ मधील,—

(ग) पोट-दनयम -१ मधील, दतसरा परंतुक वगळण्यात येत आहे ;

(घ) पोट-दनयम -७ वगळण्यात येत आहे.

३. मूळ दनयमातील दनयम ७ च्या पोट-दनयम (१) मधील,—

(१)

भाग चार-अ-८८–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, एप्रिल २४, २०२३/वैशाख ४, शके १९४५ ४. मूळ दनयमातील दनयम ८ च्या पोट-दनयम (१) मधील,—

(क) खंड "ग" वगळण्यात येत आहे ;

(ख) खंड "च" वगळण्यात येत आहे.

५. मूळ दनयमातील दनयम ९ च्या पोट-दनयम (१) मधील,—

(क) खंड "ग" वगळण्यात येत आहे ;

(ख) खंड "च" वगळण्यात येत आहे.

६. मूळ दनयमातील दनयम १० चा पोट-दनयम (४) वगळण्यात येत आहे.

७. मूळ दनयमातील दनयम १४ चा पोट-दनयम (५) वगळण्यात येत आहे.

८. मूळ दनयमातील दनयम १५ च्या पोट-दनयम (३) मधील दुसऱ्या परंतुकानंतर खालील परंतुक समादवष्टट करण्यात येत आहे :—

परंतु आिखी असे की, काम बंद दकंवा दनलंबन, पोट्टल दकंवा सर्ह्गरच्या कोित्याही समस्तयेमुळे, नैसदग्गक आपत्ी दकंवा अटळ पररस्स्तर्तीमुळे दशक्क्याची दवधीग्ाह्यता समाप्त होण्यापूववी वजन वा माप यांच्या फेरपडताळिीचे काम होऊ शकले नाही तर, अशा रिमािात व अशा क्ेत्ात दनयंत्क दवशेष आदेशाद्ारे अदतररक्त शुल्कामध्ये सवलत देण्याबाबत दनददेदशत करतील.

९. मूळ दनयमातील दनयम १६ साठी खालील दनयम समादवष्टठ करण्यात येत आहे :—

"१६ फी वसूल करिे व कोषागारात जमा करिे,—

(१) पडताळिीचे काम सुरू करण्यापूववी, वैधमापन शास्त् अदधकारी, दनयंत्क यांनी मान्यता ददलेल्या नमुन्यात शुल्क स्तवीकारतील व पावती देतील,"

(२) वैधमापन शास्त् अदधकारी यांचेकडून या दनयमांतग्गत स्तवीकारण्यात येिारे इतर सव्ग शुल्क हे दनयंत्क यांनी मान्यता ददलेल्या नमुन्यात स्तवीकारतील व पावती देतील."

१०. मूळ दनयमातील दनयम २१ चा पोट-दनयम (३) वगळण्यात येत आहे.

११. मूळ दनयमातील दनयम २२ साठी खालील दनयम समादवष्टठ करण्यात येत आहे :—

" २२- पडताळिी रिमािपत् रिददश्गत करिे-ज्या र्यक्तीला पडताळिी रिमािपत् देण्यात आले आहे ते वजन वा माप वापरात असलेल्या दठकािी भौदतक दकंवा डीजीटल स्तवरूपात ठेवावे".

१२. मूळ दनयमांशी जोडलेली अनुसूची-६ वगळण्यात येत आहे.

LegaL MetroLogy act, 2009.

No. LM-2022/CR-40/ CP-3.—The following rules further to amend the Maharashtra Legal Metrology (Enforcement) Rules, 2011, which the Government of Maharashtra propose to make in exercise the powers conferred by sub-sections (1) and (2) of section 53 of the Legal Metrology Act, 2009 ( 1 of 2010), and of all other powers enabling it in that behalf and after consultation with the Central Government as required by sub-section (1) of section 53 of the said Act, namely :—

1. These rules may be called the Maharashtra Legal Metrology (Enforcement) (First Amendment) Rules, 2023.

2. In rule 6 of the Maharashtra Legal Metrology (Enforcement) Rules, 2011 (hereinafter referred to as " the principal Rules"),—

(i) in sub-rule (1), the third proviso shall be deleted;

(ii) sub-rule (7) shall be deleted.

3. In rule 7 of the principal Rules, in sub-rule (1),—

(i) clause (c) shall be deleted;

(ii) clause (e) shall be deleted.

4. In rule 8 of the principle Rules, in sub-rule (1),—

(i) clause (c) shall be deleted;

(ii) clause (e) shall be deleted.

5. In rule 9 of the Principle Rules, in sub-rule (1),—

(i) clause (c) shall be deleted;

(ii) clause (e) shall be deleted.

6. In rule 10 of the Principle Rules, sub-rule (4) shall be deleted;

7. In rule 14 of the Principle Rules, sub-rule (5) shall be deleted;

8. In rule 15 of the Principle Rules, sub-rule (3), after second proviso, the following proviso shall be added, namely :—

" Provided also that, if the re-verification of weight or measure work could not be undertaken before expiry of the validity of stamp due to closure or suspension of works, any server or portal issue, natural calamities or other unavoidable circumstance, the Controller may relax such additional fees to such extent in such areas as he may be special order directs."

9. For rule 16 of the principle Rules, the following rule shall be substituted namely :—

" 16 Collection of fees and deposit into Treasury :-

(1) Before commencing the work of the verification, the Legal Metrology Officer shall receive the fee and issue a receipt, in the form approved by the Controller.

(2) All other payments received by the Legal Metrology Officer under these rules shall receive the same and issue a receipt, in the form approved by the Controller." 10. In rule 21 of the principal Rules, sub-rule (3) shall be deleted.

" 22. Certificate of verification to be kept.— The person to whom the certificate of verification is issued shall be kept the same in physical or digital form, where such weight or measure are being used."

12. Schedule VI appended to the principle Rules shall be deleted ;
