महाराष्ट्र ्ठठेवीदारांच्या (प्वत्ीय संस्थांमधील) प्हतसंबंधाचे संरक्षण अप्धप्नयम, १९९९.

क्र. एमपीआयडी-०६२२/रि.क्र.४५/पोल-१५.–ज्याअर्थी पलाश हेल्र् केअर दिस्टीम रिा.दल.व िीड मॅनेजमें्ट िर्वह्गिेि रिा.दल., पुणे (यापुढे 'उक्त दवत्ीय िंस्र्ा' अिा उल्लेख करण्यात आला आहे) या दवत्ीय िंस्र्ांनी ठेवीदारांना मुदतीअंती लाभािह ठेवी परत करण्याचे आश्वादित करून ठेवी स्वीकारल्या होत्या;

आदण ज्याअर्थी, उक्त दवत्ीय िंस्र्ा आदण िदर िंस्र्ांचे रिवत्गक, िंचालक, भागीदार, िदस्य आदण इतर यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपूतथीनंतर ठेवीदारांना परत करण्याि किूर केला अिल्याने त्यांचेदवरुध्द डेक्कन पोलीि ठाणे येर्े गु.र.क्र. ३३/२०२० भारतीय दंड िंदहता (१८६० चा ४५) कलम ४२०, ४०९, १२० (ब), ३४ िह महाराष्ट्र ठेवीदारांच्या (दवत्ीय िंस्र्ामधील) दहतिंबंधाचे िंरक्षण अदधदनयम, १९९९ (२००० चा महाराष्ट्र १६) कलम ३ व ४ अन्वये गुन्हा दाखल करण्यात आला आहे;

आदण ज्याअर्थी, महाराष्ट्र शािनाची अशी खात्ी झाली आहे की, उक्त दवत्ीय िंस्र्ा आदण िदर िंस्र्ांचे रिवत्गक, िंचालक, भागीदार, िदस्य आदण अन्य ्वयक्ती हे ठेवीदारांच्या मागणीनुिार ठेवी परत करण्याि अपयशी ठरले अिून उक्त दवत्ीय िंस्र्ाद्ारे ठेवीदारांना ठेवी परत करण्याची शक्यता ददिून येत नाही;

आदण ज्याअर्थी, महाराष्ट्र शािनाला, उक्त दवत्ीय िंस्र्ा आदण िंस्र्ांचे रिवत्गक, िंचालक, भागीदार, िदस्य आदण इतर यांनी जमा केलेल्या ठेवींमधून त्यांच्या स्वत:च्या अर्वा अन्य कोणत्याही ्वयक्तीच्या नावे रक्कम व अन्य मालमत्ा िंपाददत करण्यात आली अिल्याचे अदभकदर्त अिल्याने, उक्त दवत्ीय िंस्र्ांमधील ठेवीदारांच्या दहताचे िंरक्षण करण्याकररता अशी रक्कम व अन्य मालमत्ा जप्त करण्याचे आदण अशा जप्त रक्कम व अन्य मालमत्ा यावर दनयंत्ण ठेवण्याकररता उप दवभागीय अदधकारी, पुणे उप दवभाग, दज. पुणे यांची िक्षम रिादधकारी म्हणून दनयुक्ती करणे आवश्यक वा्टते.

भाग चार-ब-१३७–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल २५, २०२३/वैशाख ५, शके १९४५ त्याअर्थी आता, महाराष्ट्र ठेवीदारांच्या (दवत्ीय िंस्र्ांमधील) दहतिंबंधाचे िंरक्षण अदधदनयम, १९९९ (२००० चा महाराष्ट्र १६) च्या कलम ४ व कलम ५ चे पो्ट कलम (१) याद्ारे रिदान करण्यात आलेल्या अदधकारांचा वापर करून महाराष्ट्र शािन याद्ारे,– (अ) पलाश हेल्र् केअर दिस्टीम रिा.दल.व िीड मॅनेजमें्ट िर्वह्गिेि रिा.दल., पुणे आदण िदर दवत्ीय िंस्र्ांचे रिवत्गक, िंचालक, भागीदार, िदस्य आदण इतर दकंवा कोणतीही अन्य ्वयक्ती यांच्या नावे अिलेली, िोबतच्या अनुिूचीत दवदनदद्गष्ट्ट केल्यारिमाणे, रक्कम व अन्य मालमत्ा जप्त करीत आहे, आदण

(ब) िदर जप्त रक्कम व अन्य मालमत्ा यावर दनयंत्ण ठेवण्यािाठी उप दवभागीय अदधकारी, पुणे उप दवभाग, दज. पुणे यांची िक्षम रिादधकारी म्हणून दनयुक्ती करीत आहे.

उक्त दवत्ीय िंस्र्ा आदण िदर दवत्ीय िंस्र्ांचे रिवत्गक, िंचालक, भागीदार, िदस्य आदण इतर दकंवा कोणतीही अन्य ्वयक्ती यांच्या जप्त करावयाच्या रक्कम व अन्य मालमत्ेची िूची खालीलरिमाणे आहे :–

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No.MPID-0622/C.R.No.45/Pol-15.– Whereas, Palash Health Care System Pvt. Ltd. and Seed Management Services Pvt. Ltd., Pune (hereinafter referred to as "the said Financial Establishment") have received deposits from depositors under the scheme to repay the deposits on maturity alongwith benefits promised thereof to the depositors;

And whereas, offence has been registered against the said Financial Establishments and their Promoters, Directors, Partners and others at Deccan Police station, vide Complaint Register No.33/2020 under sections 420, 409, 120B and 34 of the Indian Penal Code (45 of 1860) and sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed to repay the deposits after maturity;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishments and their Promoters, Director, Partners and others have failed to return the deposits on demand by the depositors and the said Financial Establishment are not likely to return the deposits to the depositors;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by the said Financial Establishments and their Promoters, Directors, Partners and others or any other person, either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishment, in order to protect the interest of the depositors of the said Financial Establishments and to appoint Sub-Divisional Officer, Sub-Division, Pune, District Pune as the Competent Authority to exercise control over the monies and other properties attached.

Now therefore, in exercise of the powers conferred by sub-section (1) of sections 4 and 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,–

(a) attaches the monies and other properties of Palash Health Care System Pvt. Ltd. and Seed Management Services Pvt. Ltd., Pune and their Promoters Directors, Partners and others or any other person as specified in the Schedule appended hereto: and

(b) appoints the Sub-Divisional Officer, Sub-Division, Pune, District-Pune to be the Competent Authority to exercise control over the monies and other properties attached.
