क्रमांक ईओएफ. १२१७/रि.क्र. ६४६ (भाग-३)/पोल-१३.—ज्याअर्थी, महाराष्ट्र ठेवीदारांच्या (दवत्ीय संस्र्ामधील) दहतसंबंधाचे संरक्षण अदधदनयम, १९९९ (२००० चा महा.१६) (यात यापुढे ज्याचा ''उक्त अदधदनयम'' असा दनददेश करण्यात आला आहे) याच्या कलम ४ चे पोट-कलम (१), कलम ५ आदण कलम ८ याद्ारे रिदान करण्यात आलेल्या अदधकारांचा वापर करून गृह दवभाग, अदधसूचना क्रमांक ईओएफ १२१७/रि.क्र.६४६/पोल-१३, ददनांक ५ मे, २०१८ (यात पुढे ''उक्त अदधसूचना'' असा दनददेश करण्यात आला आहे.) अन्वये श्ी. दीपक सखाराम कुलकणथी, श्ीमती हेमंती दीपक कुलकणथी व इतर यांच्या नावे असलेली अनुसूचीत दवदनदददिदष्टटत केलेली मालमत्ा जप्त करण्याबाबत आदेश दनगदिदमत केले आहेत ;

आदण ज्याअर्थी, महाराष्ट्र ठेवीदारांच्या (दवत्ीय संस्र्ामधील) दहतसंबंधाचे संरक्षण अदधदनयम, १९९९ अंतगदित दवशेदषत अपर सत् न्यायालय, दशवाजीनगर, पुणे यांनी एम.ए. केस क्र.६३/२०१८ मध्ये ददनांक १२ जानेवारी, २०२२ रोजी अदधसूचना क्रमांक ईओएफ. ंगी, ता. हवेली, दज. पुणे येर्ील १२१७/रि.क्र.६४६/पोल-१३, ददनांक ५ मे, २०१८ सोबतच्या अनुसूचीमधील अ.क्र.८८ येर्े नमूद "फुरसु सवदे नं. ३७/१डी क्षेत् ९१.५आर, सवदे नं.३७/१बी/१बी क्षेत् ८.५० आर व सवदे नं. ३७/१इ/२/१ क्षेत् २५ आर ही स्र्ावर मालमत्ा मुक्त करण्यात यावी." असा आदेश ददला आहे ;

आदण ज्याअर्थी, मा. अदतररक्त सत् न्यायाधीश, पुणे यांचे ददनांक १२ जानेवारी, २०२२ रोजीचे आदेश दवचारात घेता उक्त अदधसूचनेद्ारे जप्तीसाठी घोदषत केलेल्या मालमत्ेपैकी नमूद मालमत्ा मुक्त करणे शासनाच्या दवचाराधीन होते.

म्हणून आता महाराष्ट्र ठेवीदारांच्या (दवत्ीय संस्र्ामधील) दहतसंबंधाचे संरक्षण अदधदनयम, १९९९ (२००० चा महा.१६) अंतगदित कलम ४ च्या पोट-कलम (१) याद्ारे रिदान करण्यात आलेल्या अदधकारांचा वापर करून उक्त अदधसूचनेमध्ये अंशतः सुधारणा करून पुढील अनुसूचीत रकाना क्र. (४) मध्ये नमूद मालमत्ा जप्तीच्या कारवाईमधून मुक्त करण्यात येत आहे :—

Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. EOF. 1217/C.R.646 (Part 3)/Pol-13.—Whereas, the Government of Maharashtra has, vide Government Notification, Home Department, No. EOF. 1217/C.R.646/Pol-13, dated the 5th May, 2018 (hereinafter referred to as "the said Notification"), issued order in exercise of the powers conferred by sub-section (1) of section 4, sections 5 and 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), thereby attaching the properties of Shri Deepak Sakharam Kulkarni, Smt. Hemanti Deepak Kulkarni and others as specified in the Schedule appended thereto;

And whereas, the Court of Additional Sessions Judge, Pune, a Designated Court under the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999, has vide Order, dated the 12th January, 2022, in Criminal Misc. Application No. 63/2018, directed that "Land admeasuring 91.50 R in Survey No. 37/1D, Land admeasuring 8.50 R in Survey No. 37/1B/1B and Land admeasuring 25 R in Survey No. 37/1E/2/1 of properties situated at village Fursungi, Tal. Haveli, District Pune as specified in the schedule at Sr. No. 88 appended to Notification No. EOF - 1217/C.R.646/Pol-13, dated 5th May, 2018 stands released from the attachment.";

And whereas, in view of the said order, dated 12th January 2022 of the Additional Sessions Judge, Pune, the Government considers it expedient to release the property attached by the said notification.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4, of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000) and in partial modification of the said Notification, the Government of Maharashtra, hereby releases the properties specified in the schedule appended hereto to the extent of area mentioned in column (4) of the said Schedule as follows, namely :–
