NOTIFICATION

Whereas, Development Plan of Additional area of Chandrapur City has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-2294-1315-CR-253-96-UD-9, dated the 2nd June, 1997 and has come into force with effect from the 15th August, 1997 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Survey No. 16, 17, 43, 44, 45, 46, 48, 49, 50, 52, 53, 55 of Mouje Wadgaon, land bearing Survey Nos. 20, 22, 23, 34/1, 30, 32, 31, 41/1, 46, 45, 47, 76, 82, 83, 90/1, 91, 92, 79, 78, 69, 68/3, 69/3, 107/1Chh, 107/1Ch, 107/1J, 107/46, 107/45, 107/44, 107/43, 107/42 of Mouje Dewai Govindpur raiyyatwari & land bearing Survey Nos. 14, 15, 16, 17 of Mouje Dewai Govindpur Tukum is reserved for Mul-Chandrapur-Nagpur 60.00 Mt. wide and 5.00 K.Mt. long Development Plan road (hereinafter referred to as "the said Development Plan Proposal");
And whereas, the Chandrapur Municipal Corporation being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No.68, dated 29th December, 2018 has resolved to modify the said Development Plan proposal by deleting the Development Plan road of 60.00 m. width and about 5.00 km. long and to include the land in the Residential Zone deleted from the said road and accordingly submitted to the Government, for its final sanction, a modification proposal as per the provisions of sub section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed modification under the said proposal should be sanctioned as detailed below with some modifications;

And whereas, in the above sanctioned modification only land owner of Survey No. 107/43/3 of Mouje Dewai Govindpur, Raiyyatwari admeasuring area of 2706.096 Sq. Mt. out of the total land area 0.41 HA. under the modifi- cation have deposited Rs.4,66,126/- towards the 50% Government share of 5% premium amount as per the value of the land as prescribed in the Annual Statement of Rates (ASR) for the year 2022-2023 in the Government Treasury on 10th November 2022 through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध ४-१०, २०२३/म् १४-२०, ॅ १९४५ remaining 50% of the 5% premium amount Rs.4,66,126/- payable to the Planning Authority has been deposited with the Commissioner, the Chandrapur Municipal Corporation on 9th December, 2022;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated 2nd June, 1997 as follows;
In the Schedule of Modifications appended to the Notification dated 2nd June, 1997 sanctioning the said Devel- opment Plan, the following new entry shall be added after the last entry:–

"Development Plan road under land bearing No. 107/43/3 of Mouje Dewai Govindpur, Raiyyatwari is kept 18.00 Mt. from North side instead of 60.00 Mt. in Development Plan of Chandrapur Town (Extended area) as shown on the plan and area of land owner admeasuring 2706.096 Sq. Mt. under the Development Plan road out of total area 0.41 HA. is included in Residential Zone."
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Commissioner, the Chandrapur Municipal Corpora- tion, Dist. Chandrapur during office hours on all working days for a period of one month.

Government of Maharashtra Urban Development Department vide there Notification No. TPS-2298-443-CR- 102-98-UD-09, dated 25th October, 2001 sanctioned, part of the Development Plan of Mul, has come into force from dated 15th December, 2001 and Excluded parts of the said Development Plan sanctioned vide Government Notifica- tion No. TPS 2414-99-CR-58-2014-UD-09, dated 10 March, 2015.
The Municipal Council, Mul proposed to make minor modification in the aforesaid sanctioned Development Plan under Section 37 (1) of the Maharashtra Regional And Town Planning Act, 1966. The details about Proposed minor modification are as below.—

Now, in pursuance of Section 37 (1) of the Maharashtra Regional And Town Planning Act, 1966, It is hereby notified that any suggestion or objection to the proposed modification as details above shall communicate the same in writing to the Chief Officer, Municipal Council, Mul within period of the month (30 days) from the date of notification published in the Gazette Government of Maharashtra.
The objection or suggestion if any received within above period will be considered before submitting to the proposal to the Government for Sanction.
