क्रमांक जामपा-२०२२/प्र.क्र.३३१(१)/नवि-१७.—महाराष्ट्र महानगरपावलका अविवनयमाच्या (१९४९ चा ५९) (यात यापुढे ज्याचा उल्लेख "उक्त अविवनयम" असा करण्यात आला आहे.) कलम ३ च्या पोट-कलमे (२) आवि (२A) अन्िये असलेल्या अविकाराचा िापर करून महाराष्ट्र शासनाने खालील प्रारुप अविसूचनेचा मसूदा उक्त अविवनयमाच्या कलम ३ च्या पोट-कलम (४) अन्िये आिश्यक असल्याप्रमािे वनग्गवमत करण्याचे प्रस्तावित केले असून याव्दारे पररिाम होण्याचा संभि असलेल्या सि्ग व्यक्तींच्या मावहतीसाठी प्रवसद्ध करण्यात येत आहे; आवि याद्ारे अशी नोटीस देण्यात येत आहे की, वदनांक ८ जून २०२३ रोजी वकंिा त्यानंतर उक्त प्रारुप महाराष्ट्र शासनाकडून विचारात घेण्यात येईल ;
२. उक्त मसुद्ाच्या संदभा्गत उक्त कालािीपूिवी वजल्हाविकारी, जालना यांच्याकडे कोित्याही व्यक्तींकडून प्राप्त होिाऱ्या सूचना आवि हरकतींिर शासनाकडून विचार करण्यात येईल.

क्रमांक मनपा-२०२२/प्र.क्र.३३१(१)/नवि-१७.—ज्याअर्वी, महाराष्ट्र महानगरपावलका अविवनयमातील (१९४९ चा ५९) (यात यापुढे ज्याचा उल्लेख "उक्त अविवनयम" असा करण्यात आला आहे.) कलम ३ च्या पोट-कलम (४) अन्िये महाराष्ट्र शासनाने शासन अविसूचना, नगरविकास विभाग, क्र. मनपा-२०२२/प्र.क्र.३३१(१)/नवि-१७, वदनांक ९ मे २०२३, महाराष्ट्र शासनाच्या राजपत्रात वदनांक ९ मे २०२३ रोजी प्रवसद्ध केल्यानुसार अविवनयमाच्या कलम ३ च्या पोट-कलमे २ आवि (२A) अन्िये वदलेल्या अविकारांचा (१) २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ–मध्य उप-विभाग, मे ९, २०२३/िैशाख १९, शके १९४५ िापर करून जालना वजल्ह्ातील जालना नगरपररषदेचे संपूि्ग क्ेत् एक मोठे नागरी क्ेत् म्हिून "जालना शहर महानगरपावलका" या नािाने ओळखले जािारे महानगरपावलकेचे मोठे नागरी क्ेत् होण्यासाठी उक्त अविवनयमाच्या तरतदीनुसार अविसूचना वनग्गवमत करण्यासाठी सूचना आवि हरकती मागविल्या होत्या ;
आवि ज्याअर्वी, उक्त अविसूचनेच्या संदभा्गत उक्त कालािीमध्ये वजल्हाविकारी, जालना यांच्याकडे प्राप्त झालेल्या हरकती आवि सूचनांचा शासनाने विचार केला आहे ;
आवि ज्याअर्वी, भारतीय राज्यघटनेच्या कलम २४३-Q च्या खंड (२) मध्ये नमूद केलेल्या घटकांचा विचार करून, उक्त अविवनयमाच्या कलम ३ च्या पोट-कलम (२) अंतग्गत जालना वजल्ह्ातील जालना नगरपररषदेचे संपूि्ग स्र्ावनक क्ेत् हे मोठे नागरी क्ेत् घोवषत करिे महाराष्ट्र शासनास इष्टट िाटते.
त्याअर्वी, आता, उक्त अविवनयमाच्या कलम-३ चे पोट-कलम (२) आवि पोट-कलम (२A) याद्ारे प्रदान करण्यात आलेल्या अविकारांचा तसेच त्याबाबतीत समर्ग करिाऱ्या इतर सि्ग अविकारांचा िापर करून महाराष्ट्र शासन याद्ारे जालना वजल्ह्ातील जालना नगरपररषदेचे संपूि्ग क्ेत् हे उक्त अविवनयमाच्या उद्ेशाने अविक मोठे नागरी क्ेत्, असेल आवि या अविक मोठ्ा नागरी क्ेत्ासाठी उक्त अविवनयमाच्या उद्ेशाने "जालना शहर महानगरपावलका" या नािाने ओळखले जािारी महानगरपावलका असेल, असे विवनवद्गष्टट करीत आहे.

PROCLAMATION
Maharashtra Municipal corporations act.
No. JMC-2022/C.R.No.331(1)/UD-17.—The following draft of notification which the Government of Maharashtra proposes to issue in exercise of the powers conferred by sub-sections (२) and (२A) of section 3 of the Maharashtra Municipal Corporations Act (LIX of 1949) (hereinafter referred to as "the said Act"), is hereby published, as required by sub-section (४) of section 3 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after 8th June 2023.
2. Any such objections or suggestions which may be received by the Collector of the District of Jalna, from any person with respect to the aforesaid draft, before the aforesaid date will be considered by the Government.
DRAFT NOTIFICATION
No. JMC-2022/C.R.No.331(1)/UD-17.—Whereas, by the Government Notification, Urban Development Department, No. MNC-2022/ C.R.No.331(1)/UD-17, dated the 9th May 2023, published in the Maharashtra Government Gazette, dated the 9th May 2023 issued in exercise of the powers conferred by sub-section (४) of section 3 of the Maharashtra Municipal Corporations Act (LIX of 1949) (hereinafter referred to as "the said Act"), the Government of Maharashtra has invited objections and suggestions to its proposal to issue a notification in exercise of the powers conferred by sub-sections (२) and (२A) of section 3 of the said Act, with a view to specify that the whole of local area of the Jalna Municipal Council in Jalna District shall be a larger urban area within the meaning of the said Act and there shall be a Municipal Corporation for such larger urban area to be known as "the Municipal Corporation of City of Jalna" for the purpose of the said Act ;
And whereas, the objections and suggestions so received by the Collector of the District of Jalna, pursuant to the said proclamation have been duly considered by the Government of Maharashtra ;
And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the Constitution of India, the Government of Maharashtra considered it expidient to declare under sub- section (२) of section 3 of the said Act, the said whole of the local area of Jalna Municipal Council in Jalna District to be the larger urban area.
Now, therefore, in exercise of the powers conferred by sub-sections (२) and (२A) of section 3 of the said Act, and of all other powers enabling it in that behalf, the Government of Maharashtra hereby specifies that the whole of local area of the Jalna Municipal Council in Jalna District shall be a larger urban area within the meaning of the said Act and there shall be a Municipal Corporation for such larger urban area to be known as "the Municipal Corporation of City of Jalna" for the purpose of the said Act.

क्रमांक जामपा-२०२२/प्र.क्र.३३१(२)/नवि-१७.—महाराष्ट्र नगरपररषदा, नगरपंचायती आवि औद्ोवगक नगरी अविवनयम, १९६५ (१९६५ चा महाराष्ट्र चाळीस) (यात यापुढे ज्याचा उल्लेख "उक्त अविवनयम" असा करण्यात आला आहे.) चे कलम ३, पोट-कलम (३) आवि कलम ६ यांच्या तरतुदीनुसार महाराष्ट्र शासन उक्त अविवनयमाच्या कलम ६ चे पोट-कलम (१) चे खंड (ड) अन्िये असलेल्या अविकारांचा िापर करून जालना वजल्ह्ातील जालना नगरपररषदेचे संपूि्ग स्र्ावनक क्ेत्, नगरपररषद क्ेत् म्हिून बंद करण्याच्या उद्ेशाने अविसूचना काढण्याचा उद्ेश घोवषत करीत आहे ;
२. उक्त उद्घोषिेच्या संदभा्गत ज्या कोित्याही व्यक्तींचे कोितेही आक्ेप असतील ते त्यांनी लेखी स्िरुपात त्यांच्या कारिांसह, ही उद्घोषिा राजपत्रात प्रवसद्ध झाल्याच्या तारखेपासून तीस वदिसांच्या आत वजल्हाविकारी, जालना यांच्याकडे सादर करिे आिश्यक राहील ;
३. उक्त कालािीमध्ये प्राप्त झालेल्या अशा कोित्याही आक्ेपांचा शासनाकडून विचार करण्यात येईल.

आवि ज्याअर्वी, महाराष्ट्र शासनाने उक्त अविवनयमातील कलम ६, पोट-कलम (१) मिील तरतुदींनुसार जालना नगरपररषद यांच्याशी सल्लामसलत केली आहे ;
आवि ज्याअर्वी, अविसूचनेत नमूद कालािीत वजल्हाविकारी, जालना यांच्याकडे विहीत कालािीत प्राप्त झालेल्या हरकती आवि सूचनांचा महाराष्ट्र शासनाने विचार केला आहे.
त्याअर्वी, आता, महाराष्ट्र शासन, उक्त अविवनयमाच्या कलम ६ पोट-कलम (१) खंड (ड) तसेच त्याबाबतीत समर्ग करिाऱ्या इतर सि्ग अविकारांचा िापर करून उक्त अविवनयमाच्या उद्ेशाने जालना वजल्ह्ातील जालना नगरपररषदेचे संपूि्ग स्र्ावनक क्ेत् हे नगरपावलका क्ेत् असल्याचे बंद करण्याचे याव्दारे घोवषत करीत आहे.

PROCLAMATION
Maharashtra Municipal councils, nagar panchayats and industrial townships act, 1965.
No. JMC-2022/C.R.No.331(2)/UD-17.—In pursuance of the provisions of sub-section (२) of section 6 read with sub-section (३) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965) (hereinafter referred to as "the said Act"), the Government of Maharashtra hereby announces its intention to issue a notification, in exercise of the powers conferred by clause (d) of sub-section (१) of section 6 of the said Act, with a view to declare that the whole of local area of the Jalna Municipal Council in Jalna District shall cease to be a municipal area within the meaning of the said Act ;
2. Any person who entertains any objection to the said proclamation is hereby required to submit the same in writing with the reasons therefore, to the Collector, District Jalna, within a period of thirty days from the date of publication of this proclamation in the Maharashtra Government Gazette ;
3. Any such objection which may be received during the said period will be considered by the Government.

Now, therefore, in exercise of the powers conferred by clause (d) of sub-section (१) of section 6 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby declares that the whole of local area of the Jalna Municipal Council in Jalna District, shall cease to be a municipal area within the meaning of the said Act.
