क्रमांक ठामपा/शलवलव/क्िस्टरसेि/अलिसूचना/१४.— ज्याअर्थी, ठाणे शहराची सुिारीत लवकास ्योजना शासनाने महाराष्ट्र प्ादेलशक लन्योजन व नगररचना अलिलन्यम, १९६६ चे किम ३१ (१) नुसार (्यापुढे ्याचा उल्िेख "उक्त अलिलन्यम" असा केिा आहे.) शासन लनण्ण्य क्र. ल्टपीएस-१२९७/१३१९/सीआर-१४८/९७/नलव-१२, लदनांक ४ ऑक्टोबर, १९९९ अन्व्ये मंजूर केिी असून, ती लदनांक २२ नोव्हेंबर १९९९ पासून अंमिात आहे. तसेच सुिारीत लवकास ्योजनेतीि वगळिेल्या क्ेत्ाची (Excluded portion) लवकास ्योजना शासन लनण्ण्य क्र. ल्टपीएस-१२०१/२७४/सीआर-२८/२००१/नलव-१२, लद. ३ एलप्ि, २००३ अन्व्ये शासनाने उक्त अलिलन्यमानुसार मंजूर केिी असून ती लदनांक १४ मे, २००३ पासून अंमिात आहे. (्यापूढे " उक्त मंजूर लवकास ्योजना " असा उल्िेख केिा आहे.) ;
आलण ज्याअर्थी, ठाणे महानगरपालिका प्ारुप लवकास लन्यंत्ण लन्यमाविीत काही बदि करून शासनाने लनण्ण्य क्र. ल्टपीएस १२९४/१२५९/सीआर-२२२/९४/नलव-१२, लदनांक २८ एलप्ि १९९५ अन्व्ये उक्त अलिलन्यमाचे किम ३१(१) अन्व्ये लवकास लन्यंत्ण लन्यमाविी मंजुर केिी होती व सदर लन्यमाविी लदनांक १ जून १९९५ पासून अंमिात आिी होती ;
आलण ज्याअर्थी, तत्कािीन मंजुर लवकास लन्यंत्ण लन्यमाविीतीि तरतुदीनुसार ठाणे महानगरपालिका हद्ीमध्ये ४४ नागरी पुनरुत्र्ान आराखडे (्यु.आर.पी.) लदनांक ५ मे २०१८ रोजीच्या शासन राजपत्रामध्ये अलिसूलचत करण्यात आिे आहेत ;
आलण ज्याअर्थी, शासन लनण्ण्य क्र. ल्टपीएस १८१८/प्.क्र. २३६/१८/किम ३७ (१क क) (ग) व किम २०(४)/नलव-१३, लदनांक २ लडसेंबर २०२० अन्व्ये शासनाने एकलत्कृत लवकास लन्यंत्ण व प्ोत्साहनपर लन्यमाविी, मंजुर केिी आहे आलण उक्त लवकास लन्यंत्ण लन्यमाविी लदनांक ३ लडसेंबर २०२० पासून अंमिात आिी असून सदर लन्यमाविी ठाणे महानगरपालिकेस िागू आहे. (्यापुढे "उक्त लन्यमाविी" असा उल्िेख केिा आहे) ;

भाग दोन-४८–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मे १५, २०२३/वैशाख २५, शके १९४५ आलण ज्याअर्थी, मौजे पाचपाखाडी ्येर्ीि अंलतम भूखंड क्र. १८६ व १८७ क्ेत् १२४९७.६९ चौ.मी. हे बृहन्मु ंबई महानगरपालिकेच्या मािकीचे आहेत ;
आलण ज्याअर्थी, नागरी पुनरुत्र्ान ्योजना क्र.१२, लकसन नगर ्येर्ीि नागरी पुनरुत्र्ान प्कल्पासाठी बृहन्मु ंबई महानगरपालिकेच्या ंबई महानगरपालिकेकडून लदनांक २३ माच्ण २०२३ मािकीचे अंलतम भूखंड क्र. १८६ व १८७ मिीि क्ेत् ठाणे महानगरपालिकेस देणेबाबत बृहन्मु रोजी तत्वत: मंजूरी प्ाप्त झािेिी आहे ;
आलण ज्याअर्थी, बृहन्मु ंबई महानगरपालिकेकडून लदनांक २३ माच्ण २०२३ रोजी प्ाप्त तत्वत: मंजूरीस अनुसरुन ठाणे महानगरपालिकेच्या मा. प्शासकी्य ठराव क्र. २०५, लद. २७/०३/२०२३ अन्व्ये ठाणे महानगरपालिकेच्या नागरी पुनरुत्र्ान ्योजना क्र. १२, लकसन नगर ्येर्ीि नागरी पुनरुत्र्ान प्कल्पासाठी बृहन्मु ंबई महानगरपालिकेच्या मािकीचे अंलतम भूखंड क्र. १८६ व १८७ ्यांचे एकलत्त क्ेत्ापैकी ंबई महानगरपालिकेस आवश्यक असिेिे क्ेत् वगळता उव्णररत क्ेत् ठाणे महानगरपालिकेकडे हस्तांतरीत करणेबाबतच्या प्स्तावास बृहन्मु मान्यता देण्यात आिेिी आहे ;
आलण ज्याअर्थी, बृहन्मु ंबई महानगरपालिकेचे अंलतम भूखंड क्र. १८६ व १८७ मिीि तत्वत: मंजूरीनुसारचे क्ेत् व नगररचना ्योजनेतीि ्या भूखंडािगत असिेल्या ट्ररॉिी रस्त्याचे क्ेत् देखीि ्योजना क्ेत्ाशी सिग्न होणार असल्याने समूह लवकास आराखड्ात समालवष्ट्ट करता ्येणे शक्य आहे ;
आलण ज्याअर्थी, उक्त क्ेत् हे पूवथी अलिसूचीत केिेल्या ्यु.आर.पी. क्र. १२ लकसननगर च्या हद्ीिगत असल्याने सदरचे क्ेत् ्यु.आर.पी. क्र. १२ लकसननगर मध्ये समालवष्ट्ट करण्याचे प्स्तालवत आहे (्यापुढे प्स्तावालिन क्ेत् असा उल्िेख केिा आहे) ;
आलण ज्याअर्थी, उक्त लन्यमाविीतीि लवलन्यम क्र. १४.८.१(ii) (b) च्या तरतुदीनुसार नागरी पुनरुत्र्ान आराखडा त्यार करणेचे, अलिसूलचत करण्याचे आलण जेव्हा आवश्यक असेि तेव्हा सुिारीत करण्याचे अलिकार आ्युक्त ्यांना असल्याचे नमुद आहे. तसेच उक्त लवकास लन्यंत्ण लन्यमाविीतीि लवलन्यम क्र. १४.८.१ (i) च्या तरतूदीनुसार ्योजना क्ेत्ास सिग्न असिेल्या जागा महानगरपालिका आ्युक्त ्योजना क्ेत्ात समालवष्ट्ट करु शकतात ;
आलण त्याअर्थी, उक्त लन्यमाविीमिीि लवलन्यम क्र. १४.८.१ (ii) (बी) अन्व्ये मिा प्दान अलिकारान्व्ये, ठाणे शहराच्या ्णत करून सुिारीत हद्ीचा हद्ीतीि ्यु.आर.पी. क्र. १२ लकसननगरच्या ्यापुवथीच्या अलिसूलचत हद्ीमध्ये प्स्तावालिन क्ेत् नव्याने अंतभु आराखडा यु.आर.पी. क्र. १२ ककसननगर (सुधारीत क्ेत्र अंदाज १४२.३२८ हेक्टर) म्हणून अलिसूलचत करीत आहे.
सदर अलिसूलचत आराखड्ाची सुिारीत हद् दश्णलवणारा नकाशा जनतेच्या अविोकनार्ण खािीि लठकाणी, पुढीि तीस लदवसांकररता ठेवण्यात ्येत आहे.
(१) उपसंचािक, नगररचना, क्िस्टर सेि, ्यांचे का्या्णि्य, माजीवाडा, ठाणे.
(२) शहर लवकास लवभाग, चौर्ा मजिा, ठाणे महानगरपालिका, ठाणे.
(३) वागळे प्भाग सलमती का्या्णि्य.

NOTIFICATION
Maharashtra regional and town Planning act, 1966.
No. TMC/TDO/Cluster Cell/Notification/14.—Whereas, the Revised Development Plan of the Thane City has been sanctioned by the Government under section 31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as "the said Act") vide Notification No.TPS-1297/1319/CR-148/97/UD-12, dated 4th October 1999, which has come into force with effect from 22nd November 1999, and the Excluded Part (EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No.TPS/1201/274/CR-28/2001/UD-12, dated 3rd April 2003 which has come into force with effect from the 14th May 2003; (hereinafter referred to as "the said sanctioned Development Plan") ;
And whereas, the Development Control Regulations of Thane Municipal Corporation has been sanctioned by the Government after making some modifications in draft Development Control Regulations of Thane City vide Urban Development Department, vide Notification No. TPS 1294/1259/ CR-222/94/UD-12, date 28th April 1995 under section 31(1) of the said Act which had come into force with effect from the 1st June 1995 ;
And whereas, in pursuant to the provisions of erstwhile sanctioned Development Control Regulations, 44 Urban Renewal Plans are notified in Government Gazette dated 05/05/2018 within the limits of Thane Municipal Corporation ;
And whereas, the Government has sanctioned Unified Development Control and Promotion Regulations vide resolution No.TPS-1818/CR236/18/DP&RP/ sec.37(1AA)(c) and sec. 20(4)/UD-13, dated 2nd December 2020 (hereinafter referred to as "the said Regulations") and the said Regulation are in force from dated 3rd December 2020 and are applicable to Thane Municipal Corporation ;
And whereas, final plot No. 186 and 187 of village Panchpakhadi is owned by Municipal Corporation of Greater Mumbai admeasuring 12497.69 sq.mt. ;
And whereas, Municipal Corporation of Greater Mumbai vide letter dated 23rd March 2023 has conveyed it's in-principal approval for handing over of part portion of final plot No. 186 and 187 to the Thane Municipal Corporation for the implementation Urban Renewal Scheme ;
And whereas, Thane Municipal Corporation vide administrative resolution No. 205, dated 27th March 2023 has accorded its sanction for the handing over part portion of final plot No. 186 and 187 to the Thane Municipal Corporation while retaining the portion of the land required for maintenance of Tansa pipelines to Municipal Corporation of Greater Mumbai as mentioned in letter dated 23rd March 2023 ;
And whereas, land under trolley road adjacent to final plot No. 186 and 187 as shown in Town Planning Scheme No. 1 is also to be included in notified boundary of Urban Renewal Plan No. 12 ;
And whereas, final plot No. 186 and 187 being adjacent to the notified boundary of Urban Renewal Plan No.12 is proposed to be included in the Urban Renewal Plan No.12 (hereinafter referred as 'the area under proposal') ;
And whereas, as mentioned in the Regulation No. 14.8.1 (ii) (b) of the said Regulations, that Commissioner can prepare and notify Urban Renewal Plan and revise the same, as and when required. Also as mentioned in the said Regulation No. 14.8.1 clause (i) if proposed inclusion is contiguous to Urban Renewal Scheme boundary then the proposed inclusion can be decided / finalized by the Municipal Commissioner ;
Now therefore, as per powers conferred to me vide Regulation No. 14.8.1 (ii) (b) of the said Regulations, the notified boundaries of URP No. 12 Kisan Nagar are changed and revised boundary of URP No. 12 Kisan Nagar (Revised area approx. 142.328 hect.) is hereby notified.

(1) Office of the Deputy Director of Town Planning, Cluster Cell, Majiwada, Thane.
(2) Town Development Department, 4th floor, Thane Municipal Corporation, Thane.
(3) Wagale Ward office.
