said Notice") on the Parbhani Municipal Corporation (hereinafter referred to as "the said Municipal The Maharashtra Regional & Town Planning Corporation") and the said Appropriate Authority:

And whereas, as per the 7/12 extract of the land No. TPS-3120/266/C.R.71/2020/UD-30:-

whereas, the Development Plan of Parabhani City (Revised + Extended-Area), Dist- Parabhani has been partly sanctioned by the Government under section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS-3199/130/C.R.33/99/UD-30, dated 30/9/1999 and has come into force with effect from dt.16/12/1999. And whereas, the Development Plan for the Excluded part (Revised + Extended Area) has been sanctioned by the Government vide Notification No. TPS-3199 /130/C.R.111-A/2001/UD-30, dated 24/08/ 2001 and has come into force with effect from dt.16/ 10/2001. (Hereinafter referred to as "the said Development plan");

And whereas, in the said Development Plan, out of the land bearing Survey No.53 of Mouje Parbhani, Taluka and Dist. Parbhani, having total area of 12.01 Ha., area admeasuring 9.69 Ha., as per the 7/12 extract, (hereinafter referred to as "the said Land"), is affected by reservation of "Site No.4/08-Agricultural Produce Market Committee" (hereinafter referred to as "the said Reservation");

And whereas "Agricultural Produce Market Committee" is the Appropriate Authority for the said Reservation (hereinafter referred to as "the said Appropriate Authority");

bearing Survey No.53 of Mouje Parbhani, Taluka and Dist. Parbhani, there are three co-owners of the said Land and one of co-owner, Shri. Anant Narayanrao Phutane having area admeasuring 5.66 Ha. As per 12 extract has served the said Notice, on the said Municipal Corporation and the said Appropriate Authority. And even after service of the said Notice under section 127(1) of the said Act by the land owner as aforesaid, the said Lund has neither been scquired within prescribed time period, nor the Notification of land acquisition required under Section 126(4) of the said Act read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Appropriate Authority, within prescribed time period from the date of the service of said Notice under sub-section (1) of section 127 of the said Act;

And whereas, the Hon'ble High Court, Aurangabad Bench, in Writ Petition No.6997/2019 filed by one of the co-owner Shri. Anant Narayanrao Phutane, vide its order dated 31/01/2020, has held that, the said Reservation on the said Land stands lapsed and directed the State of Maharashtra to notify the lapsing of the said Reservation on the said Land;

And whereas, out three co-owners of the said Land, only Shri. Anant Narayanrao Phutane served the said Notice vide his letter dated 12.01.2016 as quoted above, on the said Municipal Corporation and the said Appropriate५०२ द्धन्रु]क्ष् रू न्, ाप्म्न् दाम्न्, द्ध १८-२४, २०२३ : म्/रु, २८-३, ॅ १९४५ १ -ान्म््र Authority, and as, Shri. Anant Narayanrao Phutane is the sole Petitioner in Writ Petition No.6997/2019, the Government was of the opinion that, the said Reservation on area admeasuring 5.66 Ha. Bearing Survey No.53 of Mouje Parbhani, stands lapsed;

And whereas, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra vide its Notification No.TPS-3120/266/ CR-71/2020/UD-30, dated 28/12/2020, has notified that, the said Reservation i.e. "Agricultural Produce Market Committee" on the said Land admeasuring 5.66 Ha.

Bearing Survey No.53 of MoujeParbhani, stands lapsed and the land so released, is made available to the Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan:

And whereas, the Hon'ble High Court, Aurangabad Bench, in Contempt Petition No.304/2020 in Writ Petition No.6997/2019, filed by Shri. Anant Narayanrao Phutane, vide its order dated 16/12/2021, has directed the Government to issue an order notifying the lapsing of the said Reservation on the said Land (12.01 Ha.);

And whereas, after considering the report of the said Municipal Corporation dated 10/02/2022, it is observed that, as per the proposals of the said Development Plan, out of 12.01 Ha, area of Survey No.53, only 9.69 Ha, is affected by "Site No.4/08- Agricultural Produce Market Committee", out of which 5.66 Ha. Area has been lapsed from the said Notice, nor Notification of a land acquisition required under Section 126 (4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within the prescribed time limit by the said Appropriate Authority. And, in consequence thereof, the Government of Maharashtra is of opinion that, the said reservation on the said Land bearing Survey No.53 stands lapsed to the extent of aren 4.03 Ha., as per the provisions of section 127 (1) of the said Act:

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby notifies that, the said Reservation i.e. "Site.No.4/08-Agricultural Produce Market Committee" on the said Land admeasuring 4.03 Ha., bearing Survey No.53 of Mouje Parbhani, Taluka and Dist- Parbhani, stands lapsed to the extent of area 4.03 Ha as shown on plan, and the land so released, will be available to the Owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

A copy of the Part Plan, showing the area of the said Reservation which has been lapsed vide this Order, is available in the office of the Municipal Commissioner, Parbhani City Municipal Corporation, Dist. Parbhani, during office hours on all working days for inspection of public for the period of one month.

This Order shall also be published on the Govt. Website www.maharashtra.gov.in (Acts/Rules).

And whereas, as per the said sanctioned Development Plan, the lands bearing S.No. 192(part), 193(part), 194(part) of Mouje Tuljapur, Tal. Tuljapur, Dist. Osmanabad is affected by 18 m. wide East-West Development Plan Road (hereinaf- ter referred to as "the said Development Plan Road") which connects existing Naldurg-Tuljapur State Highway and 54 m. wide proposed Development Plan Road and the Appropriate Authority for acquisition and development of the said De- velopment Plan Road is Municipal Council, Tuljapur (herein- after referred to as "the said Appropriate Authority");

And whereas, the Land under the said Development Plan Road has not been acquired by the said Appropriate Author- ity within 10 (ten) years from the date on which the said sanctioned, Development Plan came into force;

And whereas, the concerned land owners (hereinafter re- ferred to as "the said Land Owners") of the land bearing S.No. 192/7 (part). C.TS. No. 3909/2 of Mouje Tuljapur admeasuring 1300 sq.m. (hereinafter referred to as "the said Land") had served a notice for the said Development Plan Road in respect of the said Land as per the provisions of section 127(1) of the said Act dated 11/12/2020 (hereinafter referred to as "the said Notice") on the said Appropriate Authority which was received by the said Appropriate Authority on 11/12/2020;

And whereas, the said Land under the said Development Plan Road is not acquired or no steps as required as per the provisions of section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period of 24 months after receipt of the said Notice;

And whereas, the Chief Officer Municipal Council, Tuljapur vide letter No. 35 dt. 05/01/2023 has stated that, after receipt of the said Notice, the Municipal Council, Tuljapur, till date, has not submitted the land acquisition proposal of After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :-

And whereas, after considering the above facts in respect of, the said Development Plan Road in respect of the said Land in the said sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Development Plan Road in respect of the said Land;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813/3211/CR-508/UD-13, dated 01.12.2016 has delegated the powers exercisable by it as per the provisions of section 127(2) of the said Act in respect of Development Plans of all Municipal Councils/Nagar Panchayat/ Zilla Parishad as a Planning Authority to the Director of Town Planning, Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune by this order and as mentioned in the Schedule hereinafter hereby notifies the lapsing of the said Development Plan Road in respect of the said Land as per the provisions of section 127(2) of the said Act and for 1) The said Land so released from the said Development Plan Road shall become available to the said Land Owners for the purpose of development as otherwise permissible in the case of adjacent land under the said sanctioned Develop- ment Plan.

2) The partial area of the said Land released from the said Development Plan Road, breaks continuity of the said Devel- opment Plan Road. Therefore, from transportation & connec- tivity point of view, it is necessary to retain the said Land under the said Development Plan Road as proposed in the said sanctioned Development Plan. In this regard, the Chief Officer, Municipal Council, Tuljapur, as the Planning Author- ity, should take appropriate action in the framework of law by offering any other alternatives to the said Land Owner with his consent.

3) A copy of the part plan of the said sanctioned Devel- opment Plan showing the area of the said Land which is lapsed from the said Development Plan Road, is available in the office of the Chief Officer, Municipal Council, Tuljapur, Tuljapur, Dist. Osmanabad during office hours on all working days for inspection to public up to one month.
