BY DIRECTOR OF TOWN PLANNING

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT. 1966.—

ORDER

No.D.T.P.-D.P. Katol(R+AA)-Sec-127(2)-Order-TPV-II-2042-2023 :—

Whereas, the Development Plan of Katol Municipal Council (Revised + A.A.) has been Sanctioned Partly as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act. 1966 (Mah.

XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS- 2406-3123-CR-133(A)-07-JD-9. dt. 4th November, 2008 (hereinaf- ter referred to as "the said Notification") & has come into force with effect from dt. 15th December 2008, (hereinafter referred to as "the said Sanctioned Development Plan");

And whereas, in the said Sanctioned Development Plan, land bearing S.No. 33 of Mouza Katol is affected by the Reservation Site No. 119. "Housing for Dishoused" and 24 mt. wide Development Plan Road. (hereinafter referred to as "the said Reservation and Road") and the Appropriate Authority for the acquisition and development of the said Reservation and Road is Municipal Council, Katol (hereinafter referred to as "the said Appropriate Authority");

And whereas, the land under said Reservation and Road has not been acquired by the said Appropri- ate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force ;

And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S. No. 33 of Mouza Katol which is affected by the said Reservation and Road (hereinafter referred to as "the said Land") had served a notice as per the provisions of section 127(1) of the said Act. (herein- after referred to as "the said Notice") on the said Appropriate Authority on 4th January, 2019 ;

And whereas, the said land under the said Reservation and Road is not acquired or no steps as required as per the provisions of Section 127 (1) of the said Act has been taken by the Appropriate Authority within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of Section 127 of the said Act;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the judgement dated 22nd April, 2022 in Writ Petition No. 1211-2021 (hereinafter referred to as "the said Writ Petition") has passed an order that, the said Reservation and Road on the said land have lapsed as per the provisions of section 127 of the said Act;

And whereas, Municipal Council, Katol vide Marathi letter No. ॅ-न्ह्यम्-२०९-२०२२-८०६. dt. 11th October, 2022 has communicated that, the Land acquisition proposal of the said land under the said reservation has not submitted to the district Collector, Nagpur and also Special Leave Petition is not filed by Municipal Council, Katol against the order passed in the said Writ Petition :

And whereas, the Joint Director of Town Planning, Nagpur Division, Nagpur vide letter No.149. dt. 6th February 2023 has submitted report stating that, in consideration of the order dt. 22nd April 2022 passed by the Hon'ble High Court, Mumbai, Nagpur Bench, there is no objection to issue a notification regarding the lapsing of the said Reservation and Road on the said land as per the provisions of section 127 of the said Act;

And whereas, the Assistant Director of Town Planning, Nagpur Branch. Nagpur vide letter No. 894, dt. 3rd April 2023 has submitted measurement sheet showing the area affected by the said Reservation and Road, and according to that, Reservation No. 119 "Housing for Dishoused on the said Land admea- suring an area of 1.10 Ha. and 24 mt. vide Development Road admeasuring an area of 0.216 Ha. have been lapsed;

And whereas, after considering the above facts in respect of the said Reservation and Road on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act, regarding the lapsing of the said Reservation and Road on the said Land;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR-508-UD-13. dt.1st December 2016, has delegated the powers exercisable by it as per the provisions of Section 127 (2) of the said Act. in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans under taken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation and Road in respect of the said Land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows :—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :—

(2) Due to partial area of the land released from the said roads, it brakes contiguity of the said roads. Therefore, Transportation and Connectivity point of view, it is required to be retained the same area as proposed in the said Sanctioned Development Plan. In this regards, the Chief Officer, Municipal Council, Katol as a Planning Authority should take appropriate action in the framework of law by offering any other alternatives to the said land owners with their consent.

(3) A copy of the part plan of the said sanctioned Development Plan showing the areas of the said Lands which are lapsed from the said Reservation and Road is available in the office of the Chief Officer, Municipal Council, Katol, District Nagpur during office hours on all working days for inspection to public upto one month.

(4) This Order shall also be published on the Directorate's official website. www.dtp.maharashtra.gov.in.

Whereas, Tumsar Municipal Council has published a Revised Draft Development Plan to invite sug- gestions/objections from the citizens under section 26(1) of the said act, and the relevant notice has been published in Maharashtra Government Gazette, Nagpur, Division, Supplement Part 1-A dated 29th Septem- ber 2022.

And whereas, while publishing the said Revised Development Plan, it has inadvertently been noticed that some GIS layers in the existing land use map have not actually been printed.

Therefore, for that purpose, the Revised Draft Development Plan is being modified and republished by incorporating the GIS layers of the existing Land use Map

Modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966

Notice

Whereas, The Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31(1) has been partially sanctioned by the Government vide Urban Development Department Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January, 2000 and came into force from 1st March, 2000. Excluded part of development plan has bees sanctioned vide Govt. Notification No. TPS-2400-1628- CR-200-2000-UD-9, dated, 10th September, 2001 and came into force from dated 21st September, 2001. Also Nagpur Municipal Corporation has been declared as the " Planning Authority " for Nagpur City except the area covered under seven schemes vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, dated 27th February, 2002. However as per the Government Notificaion No. TPS-2419-1419-CR No. 154-2019-UD-9, date 27th August. 2019 under the Nagpur Improve- ment Trust Jurisdiction the planning of the seven schemes under Nagpur Municipal Corporation has also been declared by the Government but as per the Govt. Notification No. TPS-2419-1419-CR No. 154 (Bhag-1)-2019-CR-9, dated 9th April 2021 so the power has been given to implement seven project under Nagpur Municipal Corporation and Nagpur Improvement Trust.

Whereas, in the said Revised Sanctioned Development Plan, the Municipal Corporation is desirous of making some modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966 as detailed below- In the Sanctioned Development Plan of Nagpur City the land bearing Sr. Nos. 188/2, 188/3, Mouza-Narsala, Area Area 2.00 Hect. shown as agriculture land is proposed for residential use.

Whereas, as per Section 37 of the Maharashtra Regional and Town Planning Act 1966, Nagpur Municipal Corpo- ration has decided to modify Mouza-Narsala, Sr. Nos. 188/2, 188/3 Area 2.00 Hect. Nagpur Municipal Corporation has passed the resolution vide resolution No. 14 द्ध-रूॅ, dated. 7th June, 2022 to make the aforesaid modification.

The part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Department of Nagpur Municipal Corporation for inspection by public during office hours on all working days. The suggestions and objections which may be received to Municipal Corporation in respect of the said modification to the Development Plan within a period of one month from the date of publication of this notice, will be heard by the Municipal Commissioner before submiiting the said modification proposal, to the State Government for sanction.

In exercise of the powers conferred by section 5(3), Section 14 of The Maharashtra Municipal Corporation Act, (Bom. LIX of 1949) (hereinafter referred to as the 'said Act') after carefully taking into consideration the objection and suggestion received, in response to the Draft Notification No.SEC/MC-2022/CR-31/D-5, Dated 08/06/2022 fixing for the Chandrapur Mu- nicipal Corporation. The number and the extent of the wards into which the said municipal area shall be divide shown in the schedule to said Draft Notification. I, Mr. U.P.S. Madan, State Election Commissioner, Maharashtra, hereby makes the following Notification.

1. Whereas, the State Election Commissioner, Maharashtra, Mumbai as specified for Chandrapur Municipal Corpora- tion under section 5 of the Maharashtra Municipal Corporation Act the Number of Councilors to be elected is 77 2.
