क्रमांक लवाद/नरयो -३/नैना/अंतिम/तनवाडा/२०२३/८९८.— ज्याअर्थी, प्ारुप नगररचना पररयोजना नैना क्र.३, (तचपळे, कोप्ोली, तवतिघर, नेरे, नेरेपाडा, मोिो) िी उपाध्यक्ष व व्यवस्र्ापकीय संचालक, तसडको, यांनी नगरतवकास तवभाग, अतिसूचना क्र. टीपीएस/१८१७/९७३/प्.क्र.१०३/ १७/नतव-१३, तदनांक १३ सप्टेंबर २०१७ अन्वये, त्यांना प्ाप्ि झालेल्या अतिकाराचा वापर करून मिाराष्ट्र प्ादेतिक तनयोजन व नगररचना अतितनयम, १९६६ च्या कलम ६८ चे पोट- कलम (२) अन्वये त्यांची अतिसूचना क्र. तसडको/नैना/ तटपीएस-३/प्ा.यो./ २०१९/१२९९/SAP/११४४, तदनांक १ नोव्िेंबर २०१९ प्माणे मंजुरी केली आिे. उक्ि अतिसूचना िी महाराष्ट्र शासन राजपत्रात असािारण, भाग-१ मिील पृष्ट्ठ १ िे ७ वर तदनांक १ नोव्िेंबर २०१९ रोजी प्तसद्ध झालेली आिे ;

आतण ज्याअर्थी, उक्ि अतितनयमांच्या कलम ७२ च्या पोट-कलम (१) अन्वये राज्य िासनाच्या नगरतवकास तवभागाने तनवृत्त उपसंचालक, नगररचना श्ी. सु. व. सुववे यांची तदनांक ३० नोव्िेंबर २०१९ च्या अतिसूचना क्र. टीपीएस-१२१९/१५२४/प्.क्र.६४/१९/ नतव-१२,अन्वये वर उल्लेखलेल्या मंजूर प्ारुप परीयोजनेसा्ठी लवाद म्िणून नेमणूक केलेली आिे ;

आतण ज्याअर्थी, मिाराष्ट्र नगररचना पररयोजना तनयम क्र. १९७४ च्या तनयम क्र. १३(१) अन्वये महाराष्ट्र शासन राजपत्र असािारण, भाग-२ मध्ये तदनांक ८ जानेवारी २०२० रोजी सूचना लवाद यांनी प्तसद्ध करून प्ारुप नगररचना पररयोजना, नैना क्र.३, (तचपळे, कोप्ोली, तवतिघर, नेरे, नेरेपाडा, मोिो) करीिा लवाद म्िणून कि्तव्ये पार पाडण्याचे काम तदनांक ८ जानेवारी २०२० पासून सुरु करण्याि आले आिे ;

आतण ज्याअर्थी, तविीि केलेल्या नमुना क्रमांक ४ मिील तविेष सूचना उक्ि नगररचना पररयोजनेमध्ये समातवष्टट झालेल्या सव्त जमीन मालकांना देण्याि आलेल्या असून त्यांची या संदभा्तिील सुनावणी पुण्त करून त्याबाबिची तटपणे नोंदतवण्याि आलेली आिेि ;

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, जून ६, २०२३/ज्ययेष्ट्ठ १६, शके १९४५ आतण ज्याअर्थी, उक्ि अतितनयमांच्या कलम ७२ च्या पोट-कलम (३) अन्वये नगररचना परीयोजना, नैना क्र.३ , (तचपळे, कोप्ोली, तवतिघर, नेरे, नेरेपाडा, मोिो) ची सदर लवाद यांनी त्यांच्या तदनांक ११ फेब्ुवारी २०२२ च्या लवाद, नरयो-३/उपतवभागणी/२०२२/५६९ च्या सूचनेप्माणे प्ारंतभक परीयोजना व अंतिम परीयोजना अिी तवभागणी तदनांक ११ फेब्ुवारी २०२२ रोजी केलेली आिे ;

आतण ज्याअर्थी, उक्ि तनयमांमिील तनयम क्र. १३ प्माणे सव्त काय्तवािी पूण्त करून उक्ि अतितनयमांच्या कलम ७२ च्या पोट-कलम (४) व (६) मिील कि्तव्ये पार पाडण्याि आलेली आिेि ;

आतण ज्याअर्थी, त्यानंिर लवाद यांनी प्ारंतभक नगररचना पररयोजना नैना क्र. ३ ियार करून िासनास तविीि मुदिीि सादर केली िोिी व उक्ि प्ारंतभक नगररचना पररयोजना िासनाने तदनांक २९ नोव्िेंबर २०२२ च्या अतिसूचना क्रमांक टीपीएस-१२२२/२१८६/ प्.क्र.१५१/२२/न.तव-१२ अन्वये उक्ि अतितनयमांच्या कलम ८६(१) अन्वये मंजूर केली आिे.

त्याअर्थी, तनन्मस्वाक्षरीकार या योजनेचे लवाद म्िणून उक्ि अतितनयमांच्या कलम ७२ च्या पोट-कलम (७) प्माणे िसेच उक्ि तनयमांच्या तनयम क्र. १३(९) प्माणे असे जािीर करीि आिेि की, आिा अंतिम नगररचना पररयोजना नैना क्र.३, ( तचपळे, कोप्ोली, तवतिघर, नेरे, नेरेपाडा, मोिो) िी ३१ मे २०२३ रोजी तविीि मुदिीि ियार करण्याि आली आिे.

िी अंतिम पररयोजना तनन्मस्वाक्षरीकार लवाद यांच्याकडून ियार करण्याि आल्यानंिर जनिेच्या िसेच या पररयोजनेमध्ये समातवष्टट झालेल्या जतमनींच्या मालकांच्या अवलोकनार्त लवादांच्या व नैनाच्या काया्तलयाि कामकाजाच्या वेळेि नैना काया्तलय, टॉवर नं. १०, ंबई ४०० ६१४ येर्े प्तसद्ध करण्याि आली आिे. िसेच या ियार करण्याि सािवा मजला, बेलापूर रेल्वे स्टेिन, सीबीडी-बेलापूर, नवी मु

आलेल्या अंतिम नगररचना परीयोजनेिील िपिील सव्त जमीन मालकांना योग्य वेळी नमुना क्र. ५ प्माणे कळतवण्याि येणार आिे.

PUBLIC NOTICE

[Under Section 72(7) of the Maharashtra Regional and Town Planning Act, 1966]

[read with Rule 13(9) of the Maharashtra Town Planning Schemes Rules, 1974]

No. TPS-ARB/TPS-3/NAINA/Final/Award/2023/898.— Whereas, the Draft Town Planning Scheme, NAINA No. 3 (Chipale, Koproli, Vihighar, Nere, Nerepada, Moho) (hereinafter referred to as "the said Draft Scheme") has been sanctioned by the Vice Chairman and Managing Director, CIDCO under sub-section (2) of section 68 of the Maharashtra Regional & Town Planning Act, 1966 (hereinafter, referred to as the 'said Act') vide Notification No. CIDCO/NAINA/TPS-3/Draft Scheme/2019/1299/SAP/1144, dated 1st November, 2019, in exercise of the powers delegated to him by the Urban Development Department vide Notification No.TPS-1817/973/CR-103/17/UD-13, dated 13th September, 2017. The said Notification is published in Maharashtra Government Gazette, Extraordinary, Part-II, dated 3rd May 2019 ;

And whereas, the Government in Urban Development Department has appointed Shri S. V. Surve, Retired Deputy Director of Town Planning as the Arbitrator for the said sanctioned Draft Scheme vide Notification No. TPS-1219/1524/ CR-64/19/UD-12, dated 30th November 2019 under sub-section (1) of section 72 of the said Act ;

And whereas, the Arbitrator, in accordance with Rule No.13 (1) of Maharashtra Town Planning Schemes Rules, 1974 (hereinafter referred to as the 'said Rules'), has declared under his notice dated 8th January, 2020 that, he has commenced the duties as Arbitrator in respect of the Town Planning Scheme, NAINA No. 3 (Chipale, Koproli, Vihighar, Nere, Nerepada, Moho) with effect from 8th January, 2020 ;

And whereas, the special notices in prescribed Form No. 4 have been served to each and every owner of the lands included in the said scheme & the hearings in this regard have been completed ;

And whereas, the Town Planning Scheme, NAINA No.3 (Chipale, Koproli, Vihighar, Nere, Nerepada, Moho) has been sub-divided by the Arbitrator under his notice bearing No. Arbitrator/ TPS-3/Sub-division/2022/569, dated 11th February, 2022 into Preliminary Scheme & Final Scheme on 11th February 2022 as provided under sub-section (3) of section 72 of the said Act ;

And whereas, the Arbitrator has now followed the procedure prescribed in Rule No. 13 of the said Rules, and has carried out the duties laid down in sub-sections (4) & (6) of section 72 of the said Act ;

And whereas, thereafter, the Arbitrator has prepared the Preliminary Town Planning Scheme, NAINA No. 3 and submitted the said scheme to the Government within the prescribed time limit and the said Preliminary Town Planning Scheme has been sanctioned vide Notification dated 29th November, 2022 bearing No. TPS-1222/2186/CR-151/22/UD- 12 under section 86(1) of the said Act. Now, therefore, the undersigned as Arbitrator hereby declares that the Final Town Planning Scheme, NAINA No. 3 (Chipale, Koproli, Vihighar, Nere, Nerepada, Moho) has been drawn up by him on 31st May, 2023 as provided under sub-section (7) of section 72 of the said Act read with rule 13 (9) of the said Rules within the prescribed time limit.

The Final Scheme so drawn up by the undersigned has been published and copies thereof have been kept open for the inspection of the land owners and of the public during office hours at the office of the Arbitrator and of the Special Planning Authority, NAINA, at 7th Floor, Tower No. 10, Belapur Railway Station Complex, CBD, Belapur, Navi Mumbai. The details of the said Final Town Planning Scheme would be communicated to all the land owners in Form No. 5 in due course.
