क्रमांक विडी/िे-५/एलएक्यु- एसआर-६० ि ६१/२०२२.– ज्याअर्थी, भूवमसंपादन, पुनि्वसन ि पुनर्र्ा्वपना करताना िाजिी भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क अविवन्यम, २०१३ (२०१३ चा ३०) (ज्याचा उल्लेख प्र्तुत अविसुचनेत ्यापुढे 'उक्त अविवन्यम ' असा करण्यात आला आहे) च्या कलम ३ च्या खंड (इ) च्या द्ारे प्रदान करण्यात आलेल्या अविकारांचा िापर करून काढण्यात आलेली अविसूचना, महसूल ि िन विभाग क्र. संकीि्व ११/२०१४/प्र.क्र.७७(भाग)/अ-२, वदनांक ११ सप्िेंबर, २०१५ (्यात ्यापुढे वजचा वनददेर् 'उक्त अविसूचना ' असा करण्यात आला आहे) ्याद्ारे असे अविसूवचत केले आहे की, उक्त अविवन्यमाच्या कलम ३ च्या खंड (झेड अ) मध्ये व्याख्या केलेल्या एखाद्ा साि्वजवनक प्र्योजनासाठी, एखाद्या वजल्ह्ातील १०,००० हेक्िरपेक्ा अविक नसेल इतक्या क्ेत्ाकररता जमीन संपादन करण्याच्या संबंिात, अर्ा वजल्ह्ाचा वजल्हाविकारी हा उक्त अविवन्यमाच्या प्र्योजनासाठी समूवचत र्ासन असल्याचे मानण्यात ्येईल ;
आवि ज्याअर्थी, उक्त अविसूचनेनुसार समूवचत र्ासन असलेल्या, ठािे वजल्ह्ाच्या वजल्हाविकाऱ्यास ्यासोबत जोडलेल्या अनुसूची एक मध्ये दर्विलेली जमीन (्यापुढे वजचा वनददेर् 'उक्त जमीन ' असा करण्यात आला आहे.) आिश्यक आहे असे िािते (ज्याच्या र्िरुपाचे विरि ्यासोबत जोडलेल्या अनुसूची दोन मध्ये वदलेले आहे) आवि म्हिून उक्त अविवन्यमाच्या कलम ११ च्या पोि-कलम (१) च्या तरतुदीन्ि्ये ्याद्ारे असे अविसूवचत करण्यात ्येते की, उक्त जवमनीची का्य्वकारी अवभ्यंता, ठािे खाडी पूल विभाग क्र.१, कोकि भिन, निी मु ंबई ्यांचे समवप्वत माल िाहतूक मावग्वका प्रकल्पांतग्वत राष्ट्ी्य महामाग्व क्र.४ ते बाले उत्तर वर्ि रर्ता तळोजा पंचानन ते वनळजे वक.मी.५२/८०० ्येर्े रेल्िे क्ररॉवसंग क्र.६ ई, रेल्िे ई.पी.नं.५२/१३-१४ रेल्िे उड्डािपुलाचे बांिकाम करिे ्या साि्वजवनक प्र्योजनासाठी मौजे-बामाळी ि मौजे- वनघु, ता.वज.ठािे, ्येर्ील अनुसूची एक मध्ये दर्विलेल्या जवमनीची आिश्यकता आहे ;
आवि ज्याअर्थी, महाराष्ट्र शासन राजपत्र असािारि भाग क्र. चार-अ, क्रमांक एसआ्यए-२०२३/प्र.क्र.५६/अ-२, वदनांक २४ मे, २०२३ ि महाराष्ट्र शासन राजपत्र असािारि भाग क्र. चार-अ, क्रमांक एसआ्यए-२०२३/प्र.क्र.८१/अ-२, वदनांक २४ मे, २०२३ अन्ि्ये लोकवहतार्ति उक्त अविवन्यमाच्या प्रकरि दोनच्या आवि प्रकरि तीनच्या तरतूदी लागू करण्यापासून उक्त प्रकल्पाला सूि देण्यात आली असल्यामुळे ्या प्रकल्पासाठी सामावजक प्रभाि वनिा्वरि करण्याची आिश्यकता उरलेली नाही.

भाग एक (को.वि.पु)-५६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, जून ७, २०२३/ज्ययेष्ट्ठ १७, शके १९४५ त्याअर्थी, आता, असे घोवित करण्यात ्येते की, उक्त अविवन्यमाच्या कलम ११ च्या पोि कलम ४ अनुसार कोितीही व्यक्ती, ही अविसूचना प्रवसद्ध झाल्याच्या वदनांकापासून ते उक्त अविवन्यमाच्या प्रकरि चार खालील का्य्विाही पूि्व होईल त्या कालािीप्ययंत उक्त जवमनीचा अर्िा वतच्या भागाचा कोिताही व्यिहार करिार नाही वकंिा उक्त जवमनीिर कोिताही भार वनमा्वि करिार नाही :
परंतु,उक्त जवमनीच्या अर्िा वतच्या भागाच्या मालकाने अज्व केल्यािर, वजल्हाविकाऱ्यास विर्ेि पररस्र्र्तीत, लेखी कारिे नमूद करून अर्ा मालकास उपरोक्त तरतुदीच्या प्रि्वतनातून सूि देता ्येईल ;
परंतु आिखी असे की, जर कोित्याही व्यक्तीने ्या तरतुदीचे जािीिपूि्वक उल्लंघन केल्यामुळे वतला झालेल्या कोित्याही हानीची वकंिा क्तीची वजल्हाविकाऱ्याकडून भरपाई वदली जािार नाही.
तसेच, उक्त अविवन्यमाच्या कलम ११ च्या पोि कलम (५) अनुसार, उप विभागी्य अविकारी, ठािे उप विभाग, ठािे हे भूवमसंपादन, पुनि्वसन ि पुनर्र्ा्वपना करताना उवचत भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क (महाराष्ट्) वन्यम, २०१४ (्यात ्यापुढे त्यांचा वनददेर् 'उक्त वन्यम' असा करण्यात आला आहे) उक्त वन्यम १०च्या उपवन्यम ३ द्ारे विवहत केल्याप्रमािे भूवम अवभलेखाच्या अद्ाितीकरिाचे काम हाती घेिार असल्याचे ि पूि्व करिार असल्याचे देखील घोवित करीत आहे ;
तसेच उक्त अविवन्यमाच्या कलम ३ च्या खंड (छ) अन्ि्य े, समुवचत र्ासन असलेले वजल्हाविकारी, ठािे ्यांनी उक्त अविवन्यमाखालील वजल्हाविकाऱ्यांची का्यदे पार पाडण्यासाठी उपविभागी्य अविकारी ठािे, उपविभाग ठािे ्यांस पदवनददेवर्त केले आहे.

| प्रकल्पाचे ि्वन | सदर प्रकल्पाचा माग्व जे.एन.पी.िी ते दादरी असा असून त्यापैकी १८० वक.मी. ची लांबी महाराष्ट् राज्यातुन जाते. महाराष्ट्ामध्ये जे.एन.पी.िी ते घोलिड ्या दरम्यान डेडीकेिेड फ्ेि करॉररडर करॉपपोरेर्न ऑफ इंवड्या वलवमिेड ्या रेल्िे मंत्ाल्याच्या अखत्यारीतील संर्र्ेकडून संपूि्व प्रकल्पाचे काम पावहले जाते. जे.एन.पी.िी ते घोलिड ्या मागथीकेमध्ये एकूि ४० लेव्हल क्ररॉवसंग गेि आहेत. त्यापैकी एकूि १६ आर.ओ.बी हे साि्वजवनक बांिकाम विभागाच्या अखत्यारीत ्येतात एकूि १६ आर.ओ.बी पैकी १० आर.ओ.बी हे मुख्य अवभ्यंता, सा.बां.प्रादेवर्क विभाग, कोंकि ्यांच्यामाफ्फत ि उि्वरीत ६ आर.ओ.बी हे मुख्य अवभ्यंता, सा.बां.प्रादेवर्क विभाग, मु ंबई ्यांच्यामाफ्फत का्या्वन्िीत करण्याचे वनस्श्चत करण्यात आले आहे. ्या सि्व प्रकल्पांचा आढािा ि संवन्यंत्ि मुख्य अवभ्यंता, सा.बां. प्रादेवर्क विभाग, मू ंबई ह्ा का्या्वल्यामाफ्फत घेण्यात ्येतो. मुख्य अवभ्यंता, सा.बां.प्रादेवर्क विभाग, मू ंबई ्यांच्या अखत्यारीत असलेले ६ आर.ओ.बी पैकी ४ आर.ओ.बी (LC-२, LC-३, LC९C, LC६E) ची कामे का्य्वकारी अवभ्यंता, ठािे खाडी पूल विभाग क्र.१, कोंकि भिन, निी मु ंबई ्या विभागाकडे िग्व करण्यात आलेली आहे. त्यापैकी राष्ट्ी्य महामाग्व क्र. ४ ते बाले उत्तर वर्ि रर्ता तळोजा पंचानन ते वनळजे वक.मी. ५२/८०० ्येर्े रेल्िे क्ररॉवसंग क्र.६ ई रेल्िे ई.पी.नं. ५२/१३-१४ रेल्िे उड् डािपुलाचे बांिकाम करण्यासाठीचे भूसंपादनाचे काम वजल्हाविकारी, ठािे ्यांचेतफफे उप विभागी्य अविकारी, ठािे उप विभाग, ठािे ्यांचेमाफ्फत प्रगतीत आहे. |
| समाजाला वमळिारे लाभ | राष्ट्ी्य महामाग्व क्र. ४ ते बाले उत्तर वर्ि रर्ता तळोजा पंचानन ते वनळजे वक.मी. ५२/८०० ्येर्े रेल्िे क्ररॉवसंग क्र.६ ई रेल्िे ई.पी.नं. ५२/१३-१४ रेल्िे उड् डािपुलाचे बांिकाम ्या प्रकल्पामुळे जलदगती रेल्िेप्रकल्प बांिकाम करिे, त्याचा िापर करिे ि देखभाल करिे ्याकामी रोजगाराच्या संिी उपलब्ि होिार आहेत. र्र्ावनक लोकांना त्यांचे कौर्ल्य आवि अनुभि ्यानुसार त्या जागेतील प्रचवलत वन्यमानुसार रोजगाराच्या संिी वमळतील. तसेच त्या प्रकल्पामुळे प्रिासी िाहतुकीत िाढ, सुरवक्त आवि जलद प्रिास, भौगोवलक आवि सामावजक दृष्िीने सि्वकि विकास, मोठ्ा प्रमािात रोजगार वनवम्वती प्या्विरि स्र्र्रता ह्ा बाबी अवभप्रेत आहेत. |

र्ासन, महसूल ि िन विभाग, मंत्ाल्य, मु ंबई-३२ ्यांनी त्यांचेकडील अविसूचना वदनांक २६ एवप्रल २०१८ व्दारे भूमीसंपादन, पुनि्वसन ि पुनर्र्ा्वपना करताना िाजिी भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क अविवन्यम, २०१३ (२०१३ चा ३०) ्यामध्ये कलम १० (क) समाविष्ि केले असून, त्यामध्ये अर्ी तरतुद केली आहे की, समुवचत र्ासनाला जनवहताच्या दृष्िीने अविसुचनेव्दारे, उक्त अविवन्यमाच्या प्रकरि दोन ि प्रकरि तीन ्यांच्या तरतुदी लागू करण्यापासून सूि देता ्येते. त्यानुसार महाराष्ट्र शासन राजपत्र असािारि भाग क्र. चार-अ, क्रमांक एसआ्यए-२०२३/प्र.क्र.५६/अ-२, वदनांक २४ मे, २०२३ ि महाराष्ट्र शासन राजपत्र असािारि भाग क्र. चार-अ, क्रमांक एसआ्यए-२०२३/प्र.क्र.८१/अ-२, वदनांक २४ मे, २०२३ नुसार उक्त फरक प्रकल्पाला जनवहताच्या दृष्िीने लोकवहतकारी प्रकल्प असल्याकारिाने प्रकरि दोन आवि प्रकरि तीन च्या तरतुदी लागू करण्यापासून उक्त प्रकल्पाला सूि देण्यात आली आहे.
सदर अविसुचनेव्दारे ज्या जवमनीची साि्वजवनक प्र्योजनासाठी आिश्यकता आहे वकंिा आिश्यकता भासण्याचा संभि असल्याचे का्यद्ाचे ११ चे उप कलम (१) खाली अविसूचीत करिेत आले आहे. त्या विरुद्ध आक्ेप नोंदविण्याचे असल्यास प्रारंवभक अविसूचनेच्या तारखेपासून ६० वदिसांच्या आत उप विभागी्य अविकारी, ठािे उप विभाग, ठािे ्यांचे (पत्ता:- २१७, दुसरा मजला, वजल्हाविकारी का्या्वल्य, ठािे कोि्ट नाका, ठािे (पस्श्चम) ४०० ६०१) का्या्वल्यात आक्ेप नोंदविेत ्येतील.

BY THE SUB-DIVISIONAL OFFICER, THANE SUB-DIVISION, THANE
NOTIFICATION
No. TD/T-5/LAQ-SR-60 and 61/2022.—Whereas, The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as the said Act.) has been enacted, under the powers conferred by clause (e) of section 3 of the said Act. Government notification, Revenue and Forest Department No. संकीि्व ११/२०१४/प्र.क्र.७७/(भाग) अ-२, dated 11th September 2015 (hereinafter referred to as the said notification) has been published. According to the definition comprised in clause (Z A) of Section 3 of the said Act, it is mentioned that in connection with the acquisition of land for a public purpose for an area not exceeding 10000 hectares in a district, the Collector of such district shall be deemed to be an Appropriate Government for the purpose of the said Act;
And, whereas, the Appropriate Government i.e. Dist. Collector of Thane has come to the conclusion that the land indicated in Schedule-I attached herewith are required as per the said notification (hereinafter referred to as the said land). For the public purpose the details of which are given in Schedule-II attached herewith. And hence, under sub-section (1) of Section 11 of the said Act, it is hereby notified that the said lands are required for the public purpose of the Executive Engineer, Thane Creek Bridge Div. No.1, Kokan Bhavan, Navi Mumbai to Construction of Oropsed Dedicated Freight Corridor (DFC) project of Railway Over Bridge (ROB) in lieu of LC-6E at Rly Km 52/800, in Diva-Panvel section Railway Km.52/12-14 on Bale Uttar shiv road to NH-4 road to lands of Village- Bamali & Nighu, Tal. & Dist. Thane needed for the said public purpose shown in Schedule –I.
And, whereas, Government of Maharashtra's Extraordinary Gazette No. Part Four-A, No. SIA.2023/C.R.56/A-2, dated 24th May 2023 and Government of Maharashtra's Extraordinary Gazette No. Part Four-A, No. SIA.2023/C.R.81/A-2, dated 24th May 2023, has resolved that Public – Private Partnership mentioned in Section 10A of the said Act with the said projects in which land ownership will be continued with the State Government. Since such projects were exempted from the provisions of chapter two and three of the said Act, there is no need to determine the social impact for this project;
Therefore, it is hereby declared that no person, in accordance with sub-section (4) of section 11 of the said Act, shall make any transaction of the said land or shall create any third party interest in the said land, or any part thereof from the date of publication of this notification till the completion of the proceedings under chapter IV of the said Act ; Provided that, upon application by the owner of the said land or part thereof, the Collector may, in special circumstances, exempt such owner from the effect of the above provision by mentioning reasons in writing ;
However, any loss or damage caused to any person in violation of this provision purposely made will not be compensated by the Collector.
It is further declared that according to sub-section (5) of section 11 of the said Act, the Sub- Divisional Officer, Thane Sub-Division, Thane is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency Land Acquisition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said rules),
Similarly, under the provision of sub-section (g) of section 3 of the said Act, the Collector being Appropriate Goverment is empowerd to designate Sub-Divisional Officer, Thane Sub-Division, Thane to carry out the functions of the Collector.

| Description of Project Work | Construction of Proposed Dedicated Freight Corridor (DFC) project of Railway Over Bridge (ROB) in lieu of LC- 6E At Rly Km 52/800, on Diva-Panvel section Railway Km.52/13-14 on Bale Uttar shiv Road to NH-4 Road. For the proposed project oft Dedicated Freight Corridor between JNPT and Dadari about 180 km length lies in Maharashtra state. Execution work between JNPT & Gholvad is governed / Moni- tored by Railway department (DFCCIL). There are total 40 existing Level Crossing (LC) gates between JNPT to Gholvad. Out of which 16 ROB's (LC) lies under the jurisdiction of Public Works Department. Out of 16 ROB's (LC), 10 ROB's (LC) is decided to be executed by Chief Engineer, Kokan and remaining 6 ROB's (LC) is decided to be executed by Chief Engineer, Mumbai. Progress and monitoring of all these ROB's (LC) project is done by Chief Engineer, Mumbai. Out of 6 ROB's (LC) (LC-2, LC-3, LC9C, LC6E) execution of 4 ROB's (LC) is carrying out under Executive Engineer,Thane Creek Bridge Div No.1, Konkan Bhavan, Navi Mumbai. Land acquisition for the project of Railway Over Bridge (ROB) in lieu of LC- 6E At Rly Km 52/800, on Diva-Panvel section Railway Km.52/13-14 on Bale Uttar shiv Road to NH-4 road is in progress under office of Sub-Divisional Officer, Thane Sub-Division, Thane of Collector office Thane. |

Opportunities of various jobs as per the skill & experiences shall be made available to the needy person, as per the rules. Geographical & social development in all aspect of life shall be im- proved, shall result in employment generation. Environmental condi- tions shall be stable. Due to this project there will be increase in number of passengers as the fast & safe journey will be provided. |

The Government, in Revenue and Forest Department, has published a notification in Government Extraordinary Gazette dated 26/04/2018 and amended section 10 (A), of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 (30 of 2013) which provides that the appropriate government may, by notification in the public interest, be exempted from the application of the provisions of Chapter Two and Chapter Three of the said Act. Accordingly the notification by Government of Maharashtra has been published in Government of Maharashtra's Extraordinary Gazette No. Part Four-A, No. SIA.2023/C.R.56/A-2, dated 24th May 2023 and Government of Maharashtra's Extraordinary Gazette No. Part Four-A, No. SIA.2023/C.R.81/A-2, dated 24th May 2023, and the said project is exempted from the application of the provision of chapter Two and Three being a public interest project in terms of public interest.
The land which is required for public purpose or is likely to be required under sub-section (1) of section 11 of the Act has been notified by this notification If any objection is to be lodged against it, the objection will be lodged in the office of Sub-Divisional Officer, Thane Sub-Division, Thane [Address:- 217, 2nd Floor, Collector Office, Thane Court Naka, Thane (West) 400 601] within 60 days from the date of preliminary notification.
