क्रमांक भाख्रिवि-२०२१/१०४२/प्र.क्र. ४५५/कु.क.----- भारतीय ख्रिश्चन विवाह अधिनियम, १८७२ (कायदा क्रमांक १५/१८७२) च्या कलम ६ व ९ मधील तरतुदीनुसार श्री. लिव्िंहगस्टन जखरिया, १/अ/३, सदनवाडी पोलीस स्टेशनसमोर, लेक रोड, भांडूप (प.), मुंबई ४०० ०७८ यांना '' द लिव्िंहग वे मिनिस्ट्रीज अॅण्ड चॅरिटेबल ट्रस्ट, १४/१, सुनिता इस्टेट, व्हिलेज रोड, भांडूप (प.), मुंबई ४०० ०७८ '' या नोंदणीकृत चर्चमध्ये भारतीय ख्रिश्चन विवाह योग्य त्या विधीसह लावण्याचा परवाना ख्रिश्चन विवाह परवाना क्रमांक ०५/२०२३ तसेच सदर विवाहाचे प्रमाणपत्र देण्याचा अधिकार शासन प्रदान करीत आहे.

श्री. लिव्िंहगस्टन जखरिया, यांनी विवाह विधी पार पाडताना उक्त अधिनियमातील तरतुदींचे काटेकोरपणे पालन करावे.

No. SPP. 2023/U.O.R. 39/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. 2 of 1974), and Section under 8 (1) of Maharashtra Control of Organized Crime Act, 1999 (30 of 1999) the Government of Maharashtra hereby appoints Adv. Ajay Suhas Misar as '' Special Public Prosecutor '' for conducting the case/s pending before MCOCA Court, Thane which is /are arising out of C.R.No. 403/2022 registered Shivajinagar Police Station, Thane City.

2. The fees of Advocate Ajay Suhas Misar as '' Special Public Prosecutor '' shall be paid by Home Department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

क्रमांक वि-४/न्यु पंचगंगा हौ.सो./विभाजन मसुदा आदेश/२०२३.----- ज्याअर्थी, न्यु पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक, म्हाडा बिल्डींग, पाथर्डी शिवार, पाथर्डी गाव, ता. जि. नाशिक ही संस्था (जिचा उल्लेख यापुढे ' संस्था ' असा केला आहे) महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व त्याखालील नियम, १९६१ अन्वये नोंदविण्यात आलेली सहकारी संस्था असून, या संस्थेचा नोंदणी क्रमांक एनएसके/ एसएसके/एचएसजी/(टीसी)/६१४७/२०२२, दिनांक २२ डिसेंबर २०२२ असा आहे आणि संस्थेचे कार्यक्षेत्र गांव मौजे पाथर्डी शिवारातील गट नं. ३०९/४अ, ३०९/४ब, ३०९/४क यासी एकत्रित क्षेत्र ७३३२.०० चौ.मी. असून संस्थेचे मुख्य वर्गीकरण ' गृहनिमार्ण संस्था ' व उप वर्गीकरण ' भाडेकरू सहभागीदारी गृहनिर्माण संस्था ' असे आहे नमुद संस्था वैधानिक कामकाजाचे दृष्टीने या कार्यालयाच्या अधिकारकक्षेत येते.

ज्याअर्थी, नमुद संस्थेच्या मिळकतीचा विकास नाशिक गृहनिर्माण व क्षेत्रविकास मंडळ, नाशिक (म्हाडाचा विभागीय घटक) यांनी केलेला असुन, नमुद मिळकतीवर अ, ब, क, ड व ई अशा ५ विंगचे बांधकाम करण्यात आलेले आहे. सदर ०५ विंग पैकी काही प्रवर्तकांनी बी-विंग साठी नियोजित संस्थेचे नांव राखून ठेवणेस व बँक खाते उघडणेस परवानगी मागितलेली होती तर काही प्रवर्तकांनी ई-विंग साठी नियोजित संस्थेचे नाव राखून ठेवणेस व बँक खाते उघडणेस परवानगी मागितलेली होती तसेच सर्व ०५ विंग साठी एकत्रित संस्था स्थापन करणेसाठी काही प्रवर्तकांनी नियोजित पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक या संस्थेचा प्रस्ताव सादर केलेला होता. एकाच मिळकतीवर नियोजित संस्था स्थापन करणेसाठी ०३ वेगवेगळे प्रस्ताव प्राप्त झालेले असल्याने या कार्यालयाने क्षेत्रीय अधिकारी यांना स्थळनिरिक्षण करुन अहवाल सादर करण्यास सूचित केलेले होते. त्यांचेकडून प्राप्त स्थळनिरिक्षण अहवाल, प्रस्तावातील कागदपत्राचे अवलोकन करता असे निदर्शनास आले होते की, शासनाने परिपत्रकीय सूचनाद्वारे निश्चित करुन दिलेले निकष बी-विंग व ई-विंग या नियोजित संस्थांच्या बाबतीत पुर्ण होत नसल्याने या कार्यालयाने बी-विंग व ई-विंग यांचे नियोजित संस्थेचे नांव राखुन ठेवणे व बँकेत खाते उघडणेस परवानगी मिळणेबाबतचा प्रस्ताव नाकारुन न्यू पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक या संस्थेची नोंदणी नमुद मिळकतीवर अ, ब, क ड व ई अशा ०५ विंगसाठी केलेली आहे.

ज्याअर्थी, नियोजित ज्ञानपीठ सहकारी गृहनिर्माण संस्था मर्या., विंग आणि नियोजित न्यु स्वप्नपूर्ती सहकारी गृहनिर्माण संस्था मर्या. ई-विंग या संस्थेच्या मुख्य प्रवर्तक यांनी या कार्यालयाच्या निर्णयावर नाराज होऊन मा. विभागीय सहनिबंधक, सहकारी संस्था, नाशिक विभाग, नाशिक यांचेकडे महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५४ अन्वये अनुक्रमे आर-३८/२०२२ व आर-३९/२०२२ हे पुनरिक्षण अर्ज दाखल केलेले होते. सदर पुनरिक्षण अर्जावरील आदेश वाचावे क्रं. ०२ व ०३ पारीत करताना वादी यांचे पुनरिक्षण अर्ज मान्य करुन नियोजित दोन्ही संस्थांचे नाव राखून ठेवणे व बँकेत खाते उघडणे बाबतचे प्रस्तावास मंजुरी देणे आणि सहकारी गृहनिर्माण संस्था नोंदणीबाबत कायदेशिर कारवाई कऱण्यास आदेशित केलेले असल्याने न्यू पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक या संस्थेने विभाजन करुन प्रत्येक विंगसाठी स्वंतत्र गृहनिर्माण संस्था नोंदणी करणे क्रमप्राप्त झालेले आहे.

ज्याअर्थी, उक्त वस्तुस्थिती विचारात घेऊन महाराष्ट्र सहकारी संस्था अधिनियम १९६० चे कलम १८ व महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १७ मध्ये नमुद केल्याप्रमाणे मा. विभागीय सहनिबंधक, सहकारी संस्था, नाशिक विभाग, नाशिक यांचेकडील उक्त वाचावे मध्ये नमुद आदेशास अनुुसरुन नियम १७(१) मधील तरतुदीप्रमाणे विभागणी योजनेचा मसुदा तयार करुन तो संस्थेकडे पाठवून त्याद्वार संस्थेसे, संस्थेच्या सदस्यांकडून, धनकोकडून (असल्यास) हरकती व सूचना दोन महिन्यांत मागवून त्या विचारात घेतल्यानंतर कलम १८ (१) अन्वये अंतिम आदेश देणे कायदेशीर होईल, या निर्णयाप्रत आलेलो असल्याने मी खालीलप्रमाणे मसुदा आदेश देत आहे.

मसुदा आदेश

महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १८ (१) व महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १७ अन्वये मला प्राप्त झालेल्या अधिकारानुसार मी, फयाज मुलाणी, उप निबंधक, सहकारी संस्था, नाशिक तालुका, नाशिक या आदेशाद्वारे न्यु पंचगंगा को- ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक नोंदणी क्रमांक एनएसके/एनएसके/एचएसजी/(टीसी)/६१४७/२०२२, दिनांक २२ डिसेंबर २०२२ या मुळ संस्थेची नोंदणी कायम ठेवून खालील विभाजित करुन पुढे दिलेल्या विभाजनाबाबतच्या योजनेनुसार खालीलप्रमाणे आदेश देत आहे. विभाजनाची योजना

(६) मालमत्ता व जबाबदारी :---- मुळ न्यू पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि.,नाशिक (अे, सी, डी-विंग) या संस्थेचा दिनांक ३१ मार्च २०२२ च्या ताळेबंदातील तपशिलाप्रमाणे मालमत्ता व जबाबदारी आधारभुत धरुन त्या पुढील प्रमाणे विभाजित करण्यात आलेल्या आहेत.

सदर ताळेबंदात नमुद रोख रक्कम व बँँक शिल्लक रक्कम ही विभाजीत व मुळ संस्थेचे कायम सभासद संख्येनुसार व त्या प्रमाणात वाटप करण्यात येईल व त्या त्या विभाजित व मुळे संस्थेचे ताब्यात व बँँक खात्यामध्ये जमा करण्यात येईल.

सभासद भागभांडवल, राखीव निधी, सभासद बांधकाम वर्गणी व जमीन व इमारती संदर्भाने ताळेबंदाला दर्शविण्यात आलेली एकुण किमंत ही त्या त्या संस्थेचे धारण क्षेत्राचे प्रमाणात विभागण्यात येईल व त्या त्या संस्थेच्या ताळेबंदाला नमुद करण्यात येईल.

तसेच इतर पायाभुत सुविधा वर केलेल्या ताळेबंदाला देय / दायित्व दर्शविलेली रक्कम व मालमत्ता त्या त्या संस्थेचे धारण क्षेत्राचे प्रमाणात विभागण्यात येईल व त्या त्या संस्थेचे ताळेबंदाला नमुद करण्यात येईल.

वरीलप्रमाणे कार्यवाही करुन त्याबाबतचा अहवाल व माहिती या आदेशाचे दिनांकापासून दोन महिन्याचे आंत या कार्यालयात सादर करावी.

(७) सामाईक सुविधांची मालकी व व्यवस्थापन :---- सदर मुळ न्यू पंचगंगा को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक या संस्थेच्या आजमितीस असलेल्या सामाईक सुविधांची मालकी व व्यवस्थापन तीनही संस्थांची त्यांच्या सदनिकाच्या व क्षेत्रफळाच्या प्रमाणात राहील. बांधीव इमारत वगळता शिल्लक मोकळ्या जागेचा वापर तीनही संस्थांच्या व्यवस्थापन समितीच्या निर्देशानुसार करण्यात येईल.

विद्युतमिटर व पाणीमिटर :---- विद्युत मिटर व पाणी मिटर हे मुळ संस्था व विभाजनानंतर अस्तित्वात येणारी नविन संस्था यांचे विंग-निहाय वेगवेगळे असल्याने ज्या त्या संस्थेकडून त्यांच्या विद्युत मिटर व पाणी मिटर वर हक्क राहील. तसेच त्या त्या संस्थेच्या समितीकडून त्यांचे व्यवस्थापन व देखभाल करण्यात येईल.

(८) कागदपत्रे व दस्ताऐवज :---- मुळ न्यू पंचगंगा को - ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक या संस्थेचे सर्व हिशोब कागदपत्रे व दस्तऐवज विभाजन तारखेपयर्ंतची येणी-देणी नविन / विभाजीत व मुळ / कायम संस्थांमध्ये वर्ग झाल्यांनतर हिशोबाचे लेखापरीक्षण अद्यावत करण्यात येईल व लेखापरीक्षण अहवाल त्या त्या संस्थेचे व्यवस्थापन समितीकडे हस्तांतरीत करण्यात येतील. जी कागदपत्रे ज्या ज्या संस्थेशी संबंधीत असतील ती ती कागदपत्रे त्या त्या संस्थेने आप-आपले स्तरावर स्वतंत्ररित्या ठेवावीत व जी कागदपत्रे सामाईक आहेत त्यांची मुळ प्रत आपसमजुतीने कोणत्याही एका संस्थेच्या ताब्यात राहतील तसेच सदर मुळ प्रती आवश्यकतेनुसार ती संस्था दुसया संस्थेला अवलोकनार्थ उपलब्ध करुन देतील. उपविधी नुसार निवडून आलेल्या व्यवस्थापन समिती कागदपत्रे व दस्ताऐवजांची मालकी स्विकारतील व त्यानंतर भविष्यात सदर संस्था स्वतंत्ररित्या कागदपत्रे व हिशोबाची पुस्तके ठेवतील हे त्या त्या संस्थेच्या व्यवस्थापन समितीचे कर्तव्य व जबाबदारी राहील. तसेच आजपावेतोचे प्रोसीडींग व ऑडीट रिपोर्ट व अनुषंगीक कागदपत्रे यांची साक्षांकीत प्रत मुळ संस्थेकडून नविन अस्तित्वात येणायांना दोन्ही संस्थांना देण्यात येईल.

(९) मालमत्ता व हस्तांतरण :---- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १८ (क) (३) नुसार मुळ संस्थेचे विभाजन करुन नवीन संस्थेची नोंदणी केल्यामुळे मत्ता व दायित्व त्या त्या संस्थेचे नांवे होण्याकरीता संपत्ती हस्तांतरण अधिनियम, १८८२ व भारतीय नोंदणी अधिनियम, १९०८ अन्वये स्वंतत्र हस्तांतरणपत्र करण्याची आवश्यकता राहणार नाही.

(१०) अधिकार अभिलेखातील नोंदी :--- नवीन / विभाजनानंतर अस्तित्वात येणाया ज्ञानपीठ को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक (बी-विंग) आणि न्यु स्वप्नपूर्ती को-ऑपरेटिव्ह हौसिंग सोसायटी लि., नाशिक (ई-विंग) या संस्थांच्या नांवाची नोंद मौजे पाथर्डी शिवारातील गट नं. ३०९/४अ, ३०९/४ब, ३०९/४क यासी एकत्रित क्षेत्र ७३३२.०० चौ.मि. या क्षेत्राच्या ७/१२ उतायावर, सिटी सव्र्हे उतारा, नाशिक महानगरपालिका, महावितरण कंपनी व इतर अभिलेखामध्ये करण्यात येईल.

(११) न्यायिक कार्यवाही :---- मुळ संस्थेची विभागणी केल्यामुळे विभागणी केल्यामुळे संस्थेचे कोणतेही हक्क किंवा बंधने यावर परिणाम होणार नाही, जी न्यायीक कार्यवाही चालु ठेवण्यात किंवा सुरु करण्यात आली असेल अशी कोणतीही न्यायिक कार्यवाही सदोष ठरणार नाही.

(१२) वाद :--- विभाजनाचे आदेशाचे अंमलबजावणीसंबंधी काही वाद निर्माण झाल्या त्यासाठी या कार्यालयाकडे निर्णयासाठी येईल व त्या संबंधीचा या कार्यालयाचा निर्णय अंतिम राहील व तो सवार्ंना बंंधनकारक राहील.

प्रस्तुतचा मसुदा आदेश आज दिनांक ६ मार्च २०२३ रोजी माझे सही व कार्यालयीन मुद्रेसह दिला असे.

सदर तात्पुरती पदोन्नती ही मा. सर्वाेच्च न्यायालयातील विशेष अनुमती याचिका क्रमांक २८३०६/२०१७ तसेच मा. उच्च न्यायालय, मुंबई येथील प्रलंबित असलेल्या रिट पिटीशन स्टॅम्प नं. १०८७६/२०२१ व रिट पिटीशन स्टॅम्प नं. १०८७८/२०२१ मध्ये होणाया अंतिम निर्णयाच्या अधीन राहून देण्यात येत आहे.

विधि व न्याय विभाग
