नोटीस

ज्याअर्थी, महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (१९६२ चा महा. ३ रा) यांच्या कलम १, पोट-कलम (३) अन्वये काढण्यात आलेली व महाराष्ट्र शासन राजपत्र भाग चार-ब, दिनांक २७ ऑक्टोबर, २०२३ पृष्ठ क्रमांक १ ते ३ मराठी व पृष्ठ क्रमांक ४ ते ५ इंग्रजी वर प्रसिध्द करण्यात आलेली आहे. सदरील दिनांक २७ ऑक्टोबर, २०२३ ची शासकीय अधिसूचना उद्योग, उर्जा व कामगार विभाग, क्रमांक आयडीसी २०२३-प्र.क्र.९३२- उ-१४, दिनांक ३१ ऑक्टोबर २०२३ अन्वये प्रकरण सहाचे उपबंध हे या अधिसूचनेच्या अनुसूचित र्िनदिष्ट करण्यात आलेल्या क्षेत्रात सन २०२३ चे नोव्हेंबर महिन्याच्या २७ व्या दिवसापासून अंमलात येतील असे महाराष्ट्र शासनाने निर्देश दिला आहे;
आणि, ज्याअर्थी, सोबतच्या अनुसूचित वर्णन केलेली/केलेल्या जमीनी/जमिनी उक्त प्रकरण सहाचे उपबंध ज्या क्षेत्रात अंमलात आले आहेत त्या क्षेत्रात आहे/आहेत आणि परिणामी त्या-त्या क्षेत्रात लागू होतात.
आणि, ज्याअर्थी, महाराष्ट्र औद्योगिक विकास महामंडळामार्फत (यात या नंतर ज्याचा "उक्त महामंडळ" असा निर्देश करण्यात आला आहे) विकासाच्या प्रयोजनार्थ किंवा उक्त अधिनियमाच्या उद्दिष्टांच्या पुष्टयर्थ असे, अशा इतर कोणत्याही प्रयोजनार्थ ती/त्या आवश्यक असणारी/असणाया जमीन/जमिनी असल्यामुळे उक्त अधिनियमाच्या कलम ३२ अन्वये अशा क्षेत्रातील जमिनी संपादन करण्याची शक्ती राज्य शासनास प्रदान करण्यात आली आहे ;

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक नागपूर विभागीय पुरवणी, डिसेंबर ११, २०२३/अग्रहायण २०, शके १९४५ आणि, ज्याअर्थी, उक्त अधिनियमाचे कलम २. खंड (क) अन्वये काढण्यात आलेली दिनांक ११ जून, १९९३ ची शासकीय अधिसूचना उद्योग व कामगार विभाग क्रमांक आयडीसी-१८९२/(१७४४१)/उद्योग-१४ ही व्दारे राज्य शासनाने, महाराष्ट्र औद्योगिक विकास नियम, १९६२ याच्या नियम २८ अन्वये जिल्हाधिकायाकडे जी कामे सोपविण्यात आली आहेत अशी उक्त अधिनियमाचे कलम ३२, ३३, ३६ व ३८ खालील जिल्हाधिकायांची कामे पार पाडण्यासाठी शासन उद्योग व कामगार विभाग यांचे पत्र क्रमांक कार्या-८-अ.का-भूसं-कावि-१७०४-२०२३ दिनांक २१ नोव्हेंबर, २०२३ अन्वये उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, चामोर्शी यांना अधिकार प्रदान करुन भूसंपादन कार्यवाही पूर्ण करण्यासाठी प्राधिकृत केले आहे तसेच उक्त अधिनियमाचे कलम ३३ (३) च्या तरतुदीनुसार नुकसान भरपाई निश्चित करण्याचे अधिकारी ही उप विभागीय अधिकारी तथा भूसंपादन अधिकारी, चामोर्शी यांना देण्यात आले आहेत.
आणि, ज्याअर्थी, औद्योगिक क्षेत्र म्हणून/औद्योगिक वसाहत म्हणून विकसित करण्यासाठी किंवा दोन्ही करिता म्हणून सोबतच्या अनुसूचित वर्णन केलेल्या जमिनी महामंडळास आवश्यक आहेत असे उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, चामोर्शी यांचे मत झाले आहे.
त्याअर्थी, आता उक्त अधिनियमाचे कलम ३२, पोट-कलम (२) व उक्त अधिसूचना व खालील राज्य शासनाच्या शक्तीचा वापर करून मी, उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, चामोर्शी याद्वारे या सोबतच्या अनुसूचित वर्णन केलेल्या जमिनी उक्त प्रयोजनार्थ का संपादन करण्यात येऊ नयेत. या संबंधी ही नोटीस मिळाल्यापासून एका महिन्यात लेखी स्वरूपात कारण दर्शविण्याबद्दल आपणास फर्मावित आहे.
या नोटीशीच्या तारखेनंतर, जिल्हाधिकायांच्या मंजुरी शिवाय, विक्री करून, पट्टयाने देऊन, गहाण ठेवून, अभिहस्तांतरण करून, अदलाबदल करून किंवा अन्य रितीने, विल्हेवाटीसाठी केलेला कोणताही करार किंवा तीवर/त्यांवर केलेला, कोणताही खर्च किंवा तीमध्ये/त्यामध्ये केलेल्या सुधारणा या उक्त जमिनीच्या/जमिनीच्या अंतिमत: संपादन करण्यात येतील अशा भागासंबंधी भरपाई निर्धारित करण्याया अधिकायांकडून उक्त अधिनियमाचे कलम ३३, पोट-कलम (५) व भूसंपादनातील योग्य नुकसान भरपाईचा अधिकार व स्थानांतरण, पुन:स्थापना आणि पुनर्वसन अधिनियम, २०१३ अन्वये, विचारात घेतल्या जाणार नाहीत.
जिची व्यक्तिगत सुनावणी करण्याची इच्छा असेल अशा कोणत्याही व्यक्तीस या नोटीशीच्या तारखेपासून एक महिन्याच्या आत, भेटीची वेळ ठरवून कोणत्याही कामाच्या दिवशी, सकाळी ११ ते १ वाजेपयर्ंत खाली सही करणायापुढे जातीने किंवा आपल्या कायदेशीर मुखत्यारामार्फत हजर राहता येईल.

PUBLIC NOTICE U/S. 32 (2) OF MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961
No.2023-LNQ-Chamorshi-IND-CR-1704-2023.–
Whereas, by the Government Notification, Industries and Labour Department No, IDC 2023-(C.R.932)- Ind-27, dated 27rd October, 2023 issued under sub-section (3) of Section 1 of the Maharashtra Industrial Development Act. 1961 (Mah. III of 1962) (hereinafter referred as to " the said Act" ) and published in the Maharashtra Government Gazette, Part 4-B, dated 27th October, 2023 on page No. 1 to 3 in Marathi & Page No. 4 to 5 in English the Govt. of Maharashtra has directed that the provision of Chapter VI of the said Act, shall take effect from the 31st October, 2023 in the area specified in the schedule to that notification;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक नागपूर विभागीय पुरवणी, डिसेंबर ११, २०२३/अग्रहायण २०, शके १९४५And, Whereas, the land mentioned in the schedule here to are situated in, the area where in the provisions of Chapter VI of the said Act, have been taken effect as aforesaid;
And, Whereas, under Section 32 of the said Act, the State Government is empowered to acquire lands in the area to which chapter VI of the said Act has been made applicable and are required for the purpose of the development by the Maharashtra Industrial Development Corporation (hereinafter referred as "the Corporation " ) or for any other purpose in furtherance of the object of the said Act; And, Whereas, by Government Notification in Industries, Energy and Labour Department No. IDC-1892 (17441) Industries-14, dated 11th June 1993 issued under clause (c) of the Section 2 of said Act, and the Govt. letter in Industries & Labour Deptt. No. IDC-8 CR-1704-2023 Industrial- 14, Dated 21st November 2023, the Sub-Divisional Officer and Land Acquisition officer, Aurangabad has been specially appointed by the State Government to perform the functions of a Collector, under Section 32, 36 and 38 of the said Act delegated to him by rule 28 of the Maharashtra Industrial Development Rules, 1962;
And Whereas, the Sub-Divisional Officer/Land Acquisition officer, Aurangabad is of the opinion that the Lands described in the schedule hereto are required by the Corporation for developments Industrial Area.
Now, therefore, in exercise of the powers of the State Government under sub-section (2) of the Section 32 of the said Act. delegated as aforesaid, the Sub-Divisional Officer/Land Acquisition Officer, Aurangabad here by give notice calling upon all the person having interest and rights in the lands described in the schedule hereto, to show cause in writing to the undersigned before one month from individual notice received under Section 32 (2) as to why the lands described in the schedule should not be acquired for the said purpose.
Any contacts for the disposal of the said lands by sale, lease, mortgage, assignment, exchange or otherwise, or any outlay or improvements made therein without the sanction of the Collector after the date of this notice will, under sub-section (5) of Section 33 of the said Act, read with Section 26 to 30 Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 be disregarded by the Officer assessing compensation for such parts of the said lands as may be finally acquired.
Any person who desire to be heard in person may, after previous appointment appear before the undersigned in person or through his legal constituted attorney between 11.00 a.m. and 1.00 p.m. on any working day within one month from the date of this notice.
