NOTICE

Whereas the Regional Plan of Amravati Region (hereafter referred to as the "Said Regional Plan") has been sanctioned by Government Urban Development Department under section 15(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS-2887-CR-196-UD-13, dated the 29th May, 1993 and has come into force with effect from the 15th August, 1993;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्यरूदन्क्ष् २१-२७, २०२३ / + ३०-रु ६, ॅ १९४५And whereas, in the said Regional Plan, the land admeasuring 1.21 Ha. bearing Survey No. 12/3b area 1.21 H.R of Mouje Kathora Bu. Tal., Dist. Amaravati, as shown on the Part Plan (hereinafter referred to as the"said land ")is included in Agricultural Zone;
And whereas, Government has constituted Zone Change Committee (hereinafter referred to as " said committee") vide Notification No. TPS-1815-C.R. 49-15-UD-13, date 06th May, 2015 for zone change proposals of sanctioned Regional Plan up to the Limit of 10.00 Ha. to 25.00 HA. of land.
And whereas, the land owner have submitted a zone change proposal of the said land as per Govern- ment Zone Change, policy with all required document to the Member Secretary of the Zone Change committee, Amravati on Dated 13th January, 2022.
And whereas, said the area of the land in the instant proposal is 1.21 Ha. which is less than 10.00 HA. And whereas as per recommendation by the Zone Change Committee Government vide letter No. TPS-2822-575-CR-112-2022-UD-30, dated 4th July, 2023 has accorded sanction for necessary action be taken for change of zone of the said land by the said Zone Change Committee;
And whereas, said committee's meeting was held on 26th October, 2023; and after consulting the committee members " said committee " is of the opinion, that the said land in accordance with the provisions of sub-section (2) of section 20 of the said Act, should be deleted from Agricultural Zone and include in Residential zone, subject to following condition. (herein- after referred to as the " Proposal Modification ")
Condition No. 1: While preparing the layout in respect of the said land under modification, apart from the compulsory 10% open space,10% space shall be kept for public amenities. (This amenity space can be developed by the Land owner/ Developer for the same purpose)
Condition No.2: It shall be the responsibility of the concerned Land Owner/ Developer to provide all basic infrastructure i.e. Acess Roads, Water Supply Power Supply, etc. in the said land under modification.
Condition No. 3: It shall be the responsibility of the Land Owner/Developer to pay Premium as decided by the Government vide order No. TPS-1815-C.R.49-15-UD-13, dated 6th May, 2015 and dated 11th June, 2015 Also, it is necessary to Pay Premium on the entire land under this proposal.
Condition No.4: If the said lands under modification are proposed to be developed by way of plotted layout, then sale of plots shall be monitored by the Collector, in relation to development of civic amenities as per the stages given below.
(i) After final approval of layout. Sale of 25% of total Plots shall be permissible.
(ii) After completion of 40% of Civic Amenities. Sale of 50% of total Plots shall be permissible.
(iii) After completion of 60% of Civic Amenities. Sale of 75% of total Plots shall be permissible.
(iv) After completion of 80% of Civic Amenities. Sale of 90% of total Plots shall be permissible.
(v) After completion of 100% of Civic Amenities. Sale of 100% of total Plots shall be permissible.
Also if Group Housing Scheme is proposed in the layout, then the occcupancy certificate shall not given unless civic amenities specified by the Collector are fully developed.
Condition No. 5: Considering the category of the watershed area, ground water abstraction should be done for public drinking purpose only.
Condition No. 6: Maharashtra ground water (Development and Management) Act, 2009 should be followed strictly.
Condition No. 7: It is necessary to check chemical quality of gound water.
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्यरूदन्क्ष् २१-२७, २०२३ / + ३०-रु ६, ॅ १९४५ ५Condition No. 8: Availability of ground water depends of Rain.
Condition No. 9: Artificial recharge of rain Water, Groundwater Recharge Measures (Rain water Collection) will be binding near the source of groundwater abstraction for drinking water.
Condition No. 10: As per Government of Maharashtra, Ministry of Urban Development Resolution No. TPS- 1819-A.-36-19-UD-13, Dt. 5th August, 2019 Amended instructions have been received under Section 154 of Maharashtra Regional and Town Planning Act 1966. Pursuant to the provisions given in paragraph 1 of the instructions for the future urban and industrial areas and rural areas the maximum distances of building line and the con trol line will remain binding. Also to comply the instructions given in the Government Resolution will be binding.
Condition No. 11: A per Government of Maharashtra, Ministry of Urban Development Department Mantralaya Mumbai Vide Resolution No. TPS-1819-A.-36-19-UD-13, Dt. 5th August, 2019 in case of a request from the Planning Authority to the public work department for permiting construction of a service road, and if at least 30 meters of space is available within the boundry of the state government road, then permission for construction of service road of 7.5 meters width will be allowed from the road boundry. But it will be manadatory to construct service road under the leadership of the zonal officer. But in the new limits of the local bodies provision for service road should be made in the development plan and the construction fo service road should be completed at their own expense.
Condition No. 12: If for public purpose Road widening has to be done (Major State Roads/States Roads/ Major District Roads/Other District Roads/Village Roads) then the right to acquire the land adjacent to Road will be vested with Public Works Department/Z.P. construction department.
Condition No. 13: As per Public Works Department Govt. Resolution No. RBD-2020-CR-32-Roads-7, dated. 13th October, 2021 the procedure to follow for access road from various grades of Roads is published in The Maharashtra PWD Guideline for issuing of NOC for Acess permission to Fuel Stations and Private properties/Other Establishment (other than fuel station) along State Roads, 2021. As per these guideline the land owner has to take permis sion before starting residential construction from Competent officer of Public Works Department/ Competent Officer of Rural Development Department for construc tion of access road and to get to the main Road (Major State Road/State Road/Major District Road/Other District Road/Village Road)
Condition No. 14: It is mandatory to take action as per Govt. Rules for Flood Zone, Yellow Zone, Green Zone.
Condition No.15: All relevant rules of the Govt. issued from time to time shall be binding on the applicant.
Condition No. 16: Considering the tree planting policy of the government, it is mandatory to fulfill the objectives of tree planting.
In case of non-compliance, layout Approval and Non-Agriculture permission shall be laible to be cancelled.
And whereas, Government by order No. TPS-1815-C.R.49-15-UD-13, dated 11th June, 2015 has delegated power to the Joint Director of Town Planning of respective Division and Member Secretary of Zone Change Committee to notify under sub-section (3) of Section 20 of said act;
६ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ह्यरूदन्क्ष् २१-२७, २०२३ / + ३०-रु ६, ॅ १९४५Now, therefore, in exercise of the power confered under sub-section (3) of section 20 of the said act, the Joint Director of Town Planning, Amravati Division, Amravati declares its intention to initiate the " Proposed Modification" and invites in writing objections and suggestion with reasons from the general public within 30 days from the date of publication of this notice in the Maharashtra Government Official Gazette.
Suggestions/Objections in this regard shall be addressed to the Assistant Director of Town Planning Amravati Tatte Building, Camp, Amravati who is hereby appointed as the Officer to hear the Suggestions/Objections received within stipulated period and to submit his report on the same to Member Secretary, Zone Change Committee Amravati.

Whereas, Development plan of Washim (2nd Revised) has been sanctioned by Govt. of Maharashtra State, vide TPS No. 4115-179-CR-206 (A)-2015-UD-30 dated 12th September, 2016 and came into force with effect from 6th November, 2016 for the public interest. And Excluded plan of Washim has beeb sanctioned by Govt. of Maharashtra State. Vide TPS-411-1945-CR-167-UD-30-2017 dated 17th July, 2018
And whereas, The Municipal Council, Washim has decided some modification in the sanctioned 2nd revised development plan Washim as follows.
In the said development plan, S.No. 409/1, 409/1A, & 422/2 (area of 5.63 H.R.) is included as Green zone & Municipal Council, Washim Vide Administrator resolutions dated 8th December, 2023 has de- cided to make Modification in development plan and proposed that the above said land of S. No. 409/1, 409/1A & 422/2 (area of 5.63 H.R.) shll deleted from Green zone and to be included in Residential Zone.
And whereas, The plan of the proposed Modification has been kept in the office of the Municipal Council, Washim for inspection of the public during office hours.
Now Therefore, any person having objection or suggestion regarding proposed modification may communicate in writing to the Municipal Council, Washim within one month from the date of publica- tion of this gazette notification. It shall be considered by the Municipal Council, Washim before submit- ting the proposal of modification to Government for sanction.
