ज्याअर्थी, नागपूर शहराची दुसरी सुधारित विकास योजना महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ (१९६६ चा महा. ३७ वा) (यापुढे " उक्त अधिनियम " असे संबोधले आहे) चे कलम ३१ चे उप-कलम (१) नुसार अधिसूचना, नगर विकास विभाग क्र. टिपीएस-२४९६- २६४३-प्र.क्र.३००(अ)-१९९७-नवि-९, दि. ०७ जानेवारी, २००० अन्वये मंजूर केली असून ती दि. ०१ मार्च, २००० पासून अंमलात आली आहे (यापुढे " उक्त विकास योजना" असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेत, मौजा नारी येथील खसरा क्र. ११३/१, ११३/३, न.भू.क्र. ५९ व ६०, क्षेत्र ६२२४.२६६ चौ.मी. आणि खसरा क्र. ९६/४, न. भू.क्र. ८५, क्षेत्र १६७०० चौ. मी. या जागा सार्वजनिक निम-सार्वजनिक विभागामध्ये समाविष्ट आहेत. (यापुढे " उक्त जमिनी " असे संबोधले आहे);
आणि ज्याअर्थी, मुख्य कार्यकारी अधिकारी झोपडपट्टी पुनर्वसन प्राधिकरण, नागपूर यांनी उक्त जमिनीवर पुनर्वसन प्राधिकरणामार्फत प्रधानमंत्री आवास योजना राबविण्याकरीता समकक्ष " सार्वजनिक गृहनिर्माण " साठी आरक्षित करणेच्या दृष्टीने फेरबदल करण्याबाबत शासनास विनंती केलेली आहे (यापुढे " उक्त प्रस्ताव " असे संबांधले आहे);
आणि, ज्याअर्थी, सार्वजनिक हिताच्या दृष्टीने उक्त जमिनी सार्वजनिक गृहनिर्माणासाठी आरक्षित करुन समुचित प्राधिकरण हे झोपडपट्टी पुनर्वसन प्राधिकरण, नागपूर यांना करणे (यापुढे " उक्त फेरबदल " असे संबोधले आहे) आवश्यक आहे, असे राज्य शासनाचे मत झाले आहे;
आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३७ (१कक) (क) अन्वये प्रदत्त असलेल्या अधिकारानुसार शासन, खाली जोडलेल्या अनुसुचित नमूद उक्त फेरबदलाच्या अनुषंगाने जनतेकडून सूचना / हरकती मागविण्यासाठी प्रस्तुतची सूचना राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसाच्या २ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर २१-२७, २०२३/अग्रहायण ३०-पौष ६, शके १९४५ आत सहसंचालक, नगररचना, नागपूर विभाग, नागपूर " जूने सचिवालय, कक्ष क्र.१०८/१०९, पहिला माळा, सिव्हिल लाईन्स, नागपूर- १ " या पयावर लेखी स्वरुपात पाठवाव्यात. प्राप्त होणाया सूचना / हरकतीवर सूनावणी देण्यासाठी सहसंचालक नगर रचना, नागपूर विभाग, नागपूर यांची उक्त अधिनियमाचे कलम १६२(१) अन्वये अधिकारी म्हणून नियुक्ती करण्यात येत असून त्यांनी त्यांचा अहवाल शासनास उपरोक्त मुदत संपल्यानंतर ३० दिवसात सादर करावा;

उक्त फेरबदल दर्शविणारी प्रस्तूत सूचना / भाग नकाशा जनतेच्या अवलोकनार्थ खालील कार्यालयात कामकाजाच्या दिवशी कार्यालयात उपलब्ध राहिल.

NOTICE
No. TPS-2420-1380-C.R.30-2021-UD-9:.—
Whereas, the Government has sanctioned the Second Revised Development Plan of Nagpur Mu- nicipal Corporation (hereinafter referred to as "the said Development Plan") vide Urban Development Departments Notification No.TPS- 2496-2643-CR-300(A)/97-UD-9, dated 7th January, 2000 under sub- section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") which has come into force with effect from 1st March, 2000;

No. 59 & 60 admeasuring area 6224.266 Sq. Mt. & Khasara No. 96/4, C.T.S. No.85 admeasuring area 16,700 Sq. Mt. of Mouja Nari is included in Public & Semi Public Zone (hereinafter referred to as "the said Lands");
And whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Nagpur has requested to Government to make modification on the said lands to reserve for Public Housing to implement " Pradhan Mantri Awas Yojana " through Slum Rehabilitation Authority (hereinafter referred to as " the said Proposals ");
And whereas, the State Government is of opinion that, in the public interest, it is necessary to reserve said lands for " Public Housing " and for that purpose appropriate authority as Nagpur Municipal Corporation / Slum Rehabilitation Authority, Nagpur (hereinafter referred to as " the said Modification ");
Now therefore, in exercise of the powers vested under Section 37 (1AA) (a) of the said Act. The Government hereby publishes this Notice for inviting Suggestion / Objection from the general public in respect of the said Modification, as specified in the Schedule, within a period of one month from the date of publication of this notice on the Official Gazette. Any Suggestion / Objection in respect of the said Modification should be forwarded to the Joint Director of Town Planning, Nagpur Division, Nagpur, hav- ing his office at " Old Secretariat, Room No.108/109, First Floor, Civil Lines, Nagpur-1 " who has been appointed as the Officer under Section 162(1) of the said Act, to hear suggestions / objection and submit his report to Government, within 30 days after the expiry of the above mentioned period.

महाराष्ट्र शासन नगर विकास विभाग, शासन निर्णय क्रमांक टीपीएस-२२९९-१००१-प्र.क्र.१११-नवि-९, मुंबई दिनांक २८ जून, २००२ अन्वये विकास योजना ब्रम्हपुरी भागश: मंजुर असून, ती दिनांक २६ ऑगस्ट, २००२ पासून अंमलात आलेली आहे. तसेच वगळलेल्या भागाची विकास योजना शासन निर्णय क्रमांक टीपीएस-२२९९-१००१-प्र.क्र. १११-- भाग-२-नवि-९, दिनांक १३ जुलै, २००५ अन्वये मंजुर झालेली आहे. महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे कलम २१ (२) (कलम ३८ सह) अन्वये नगरपरिषद क्षेत्राचा नियोजनबध्द विकास होण्यासाठी त्या क्षेत्राची विकास योजना तयार करणे आवश्यक आहे.
सबब, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे कलम २१ (२) च्या अनुषंगाने कलम २३ (१) (कलम ३८ सह ) अन्वये ब्रम्हपुरी नगर परिषदने विकास योजना तयार करण्याचा इरादा जाहीर करण्यासाठी सर्वसाधारण सभेचा ठराव क्र ०५, दि. ०३ ऑक्टोबर, २०२३ अन्वये मान्यता दिली आहे. त्यानुसार सदरची सूचना प्रसिध्द करण्यात येत आहे.
महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे कलम २१ (२) (कलम ३८ सह) नुसार ब्रम्हपुरी नगर परिषदेच्या विकास योजने मध्ये समाविष्ट असलेल्या क्षेत्राची हद्द दर्शविणारा नकाशा नगरपरिषदेच्या कार्यालयात, कार्यालयीन कामकाजाच्या दिवशी, कार्यालयीन वेळेत नागरिकांच्या अवलोकनासाठी ठेवण्यात आलेला आहे.
ज्या नागरिकांच्या याबाबत काही सूचना / हरकती असतील त्यांनी ही सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिध्द होईल त्या तारखे पासून ६० (साठ) दिवसाच्या आत मुख्याधिकारी, ब्रम्हपुरी नगरपरिषद यांचेकडे लेखी स्वरूपात द्याव्यात. विकास योजना तयार करताना त्या सूचना / हरकतींचा योग्य तो विचार करण्यात येईल.

Declaration of Intention to prepare Development Plan of Bramhapuri Municipal Council as per Section 23(1) (with Section 38) read with Section 21(2) of Maharashtra Regional and Town Planning Act, 1966.

Government of Maharashtra in Urban Development Department, vide it's Notification No. TPS-2299-1001-111-UD-9-part-1, Dated 28th June, 2002, sanctioned Part of the Draft Development plan of Bramhapuri has came into force dated 26th August, 2002 and Excluded parts of the said Development plan sanctioned vide Government Notification No. TPS-2299-1001-111-UD-9, Part 2, Dated 13th July, 2005. It is necessary to prepare the Development Plan for the area of Municipal council as per section 21(2) (with section 38) of Maharashtra Regional and Town Planning Act, 1966 for planned development of the said area.
महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, डिसेंबर २१-२७, २०२३/अग्रहायण ३०-पौष ६, शके १९४५ ५Hence, the Bramhapuri Municipal Council by its resolution No. 05, dated 03th October, 2023 has given consent to declare its intention to prepare Development Plan, as per provision of Section 23(1), (with section 38) read with Section 21(2) of the Maharashtra Regional and Town Planning Act, 1966. Accordingly, this notice is being published.
The plan showing boundary of the area included in Development Plan of Bramhapuri Municipal Council is kept open for inspection by the public on office working days, during office hours at the office of the Municipal Council, as required under Section 21(2) (with section 38) of the Maharashtra Regional & Town Planning Act, 1966.
Any suggestion / objection of the public in this regard, may be forwarded in writing to the Chief Officer, Bramhapuri Municipal Council within a period of 60(Sixty) days from the date of publication of this notice in Maharashtra Government Gazette. The suggestion/objection shall be duly considered while preparing the Development Plan.
