THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. TPS-3022-1043-C.R.62-2023-UD-30:.—
Whereas, the Revised Development Plan of Amravati Municipal Corporation has been partly sanctioned by the Government under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS-2892- 1180-CR-90-92(B)-UD- 13, dated the 04th December, 1992 has come into force with effect from dated the 25th February,1993 (hereinafter referred to as "the said Development plan");
And whereas, in the said Development Plan, the land admeasuring 603.03 Sq.Mt. bearing Plot No. 56 and 57 of sanctioned layout of bearing Survey No. 10/2 of Mouje Akoli, Pragane-Badnera Taluka and Dist-Amravati (hereinafter referred to as "the said Land"), is reserved as "18.00 Mt. wide Development Road" (Partly) (hereinafter referred to as "the said Road");
And whereas "Amravati Municipal Corporation" is the Appropriate Authority for the said Road.
(hereinafter referred to as "the said Appropriate Authority");
And whereas, the said Land, affected by the said Road, has not been acquired by the said Appropri- ate Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the land owner of the said Land admeasuring 603.03 Sq.Mt. has served a notice dated the 07 October, 2013, under Section 127(1) of the said Act, to the said Appropriate Authority (hereinafter referred to as "the said Notice");
And whereas, even after service of the said Notice under Section 127(1) of the said Act by the land owners as aforesaid, the said Land has neither been acquired within prescribed time period, nor the Notification of land acquisition as required under Section 126 (4) of the said Act, read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Appropriate Authority, within prescribed time period from the date of the service of said Notice under sub-section (1) of Section 127 of the said Act;
And whereas, the Hon'ble High Court of Judicature at Nagpur Bench in Writ Petition No. 8031/2018 filed by the owner of the said Land, vide its order dated the 15th September, 2022 (hereinafter referred to as "the said Decision"), held that, the said Road on the said Land, to the extent of the said Land, stands lapsed, under Section 127 of the said Act and accordingly the Hon'ble High Court vide the said Order directed that, the State Government shall issue a notification about the Road having lapsed. (hereinaf- ter referred to as "the said Decision");
And whereas, after considering the report of the Director, Town Planning, Pune and the said Deci- sion, it is observed that, the said Land affected by the said Road, has neither been acquired within the prescribed time limit from the date of service of Notice, nor Notification of land acquisition required under Section 126 (4) of the said Act, read with Section 19 of the Right to Fair Compensation of Trans- parency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within the pre- scribed time limit by the said Appropriate Authority. And, in consequence thereof, the Government of Maharashtra is of opinion that, the said Road on the said Land bearing bearing Survey No. 10/2 of Mouje Akoli, Pragane-Badnera, Taluka and Dist-Amravati stands lapsed to the extent of area 603.03 Sq.Mt., as per the provisions of Section 127 (1) of the said Act;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the annexure below, hereby notifies that, the said Road i.e. "18.00 Mt. wide Development Road" (Partly) on the said Land bearing Plot Nos. 56 and 57 of sanctioned Layout of Survey No. 10/2 of Mouje Akoli, Pragane-Badnera, Taluka and Dist-Amravati, stands lapsed to the extent of area 603.03 Sq.Mt. as shown on plan, and the land so released will be available to the Owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

A copy of the Part Plan, showing the area of the said Road which has been lapsed vide this Order, is available in the office of the Commissioner, Amravati Municipal Corporation, Amravati during office hours on all working days for inspection of public for the period of one month.
