त्याअथाी, याद्वाराे अशाी नोटीस देण्यात येते की, राील देर्े असलेल्या राकमाेचाी फेड कराण्यासाठी उक्त मालमात्तेा प्त कराण्यात आली आहाे. आविर् प्रमार्पत्रा देण्यात आल्यानंतरा केलेले उक्त मालमात्तेचाे केलेले कोर्तेहाी खागी हास्तांतरार् विकंा स्ाीन करार्े विकंा वितच्याबीराोबीरा विनमा्णर् केलेला कोर्ताहाी भारा विकंा बीोा हा पूोक्त अ्णदारा नकोच्या विरुद्ध राद्दबीातल हाोईल.

मालीमत्तेचे वर्णन

आर्खाी असे अविसूविचात कराण्यात येत आहाे की, देय असलेले राक्कमा व्या आविर् खाचा्ण यांसहा विदनांक १२ ानेाराी २०२४ राोी विकंा त्यापुी देण्यात आली नाहाी तरा, रा उल्लेखा केलेली मालमात्तेा विक्रीस काढीण्यात येईल.

ज्याअथाी, माहाराष्ट्र प्रादेविशाक नगराराचाना अविविनयमा, १९६६ (यापुढीे ज्याचा उल्लेखा "उक्त अविविनयमा" असा करार्ेत आलेला ंबीई माहानगरापाविलका त्यांचाे अविकारा क्षेत्राकरिराता (यापुढीे ज्याचा उल्लेखा "उक्त माहानगरापाविलका" असा आहाे.) च्या तरातुदंनुसारा बीृहान्माु करार्ेत आलेला आहाे.) विनयोन प्राविकरार् आहाे ;

आविर् ज्याअथाी, उक्त अविविनयमा चाे कलमा ३१, पोट-कलमा (१) अन्ये प्राप्त अविकारांचा ापरा करून राज्य शासनाने अविसूचाना क्र.विटपीबी ४३१७/६२९/प्र.क्र.११८/२०१७/वि.यो./नवि-११, विदनांक ८ माे २०१८ (यापुढीे "उक्त अविसूचाना" असा उल्लेखा करार्ेत आलेला आहाे) द्वाराे बीृहान्माु ंबीई प्रारुप विकास योना - २०३४ ( यापुढीे "उक्त विकास योना" असा उल्लेखा करार्ेत आलेला आहाे) सहा विकास विनयंत्रार् प्रोत्साहान विनयमाली - २०३४ ला मांुराी विदली आहाे ;

अविसूचाना प्रकाविशात झाल्याच्या ताराखाेपासून एक माविहाना संपण्यापूी लेखाी स्रूपात, खालील काया्णलयाकडे पाठीविल्या ाऊ शाकतात.

प्रस्तावित फेराबीदल दशा्णविर्ारा क्र. प्र.अ./१५३८६/वि.विन./प.उप. अन्येचा नकाशा खालील काया्णलयांमाध्ये काया्णलयीन ेळेत शाविनारा, राविारा सा्णविनक सुट्टी व्यवितरिराक्त सामान्य नतेच्या अलोकनासाठी खाुला ठीेण्यात आला आहाे :—

NOTIFICATION

Whereas, the Brihanmumbai Municipal Corporation is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'MR & TP' Act, 1966).

And whereas, as per the powers conferred by sub-section (1) of section 31 of the MR & TP Act, 1966, State Government has accorded sanction to the Draft Development Plan 2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11, Dt. 08 May 2018 (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai ;

And whereas, as per Sanctioned Development Plan 2034 of 'R/N' Ward, the land bearing C.T.S No. 319F(part) is affected by existing amenities of EOS2.6 (Recreation Ground) (part of larger existing amenities). For proposed Agari-Koli Bhavan, there is a proposal for change of designation of land bearing C.T.S. No. 319F(part) of village Dahisar from EOS2.6 (Recreation Ground) to RSA2.1 (Multipurpose Community Center) and other corrections ;

And whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of the 'MR & TP' Act, 1966, the Planning Authority may, or when so directed by the State Government shall within Ninety days from date of such directions publish a notice inviting objections and suggestions from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction ;

And whereas, as per circular u/no. BMC/ADMN/3 dated 7th April 2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act, 1888') all the powers of the Corporation are now vested with the Administrator ;

And whereas, Administrator (Corporation) has accorded sanction vide resolution u/no. 837 dated 22.11.2023, to take further action 1) to initiate the modification to Sanctioned DP -2034 of R/N ward under section 37(1) of Maharashtra Regional & Town Planning Act, 1966 for Change of designation of land bearing C.T.S. No. 319F (part) of village Dahisar having approximate area admeasuring 1500 sq.mtrs. from EOS2.6 (Recreation Ground) to RSA2.1 (Multipurpose Community Center) and (2) to show of existing road on west & north side of land bearing CTS No. 319F of R/N Ward & to change reservation shown on east part of land bearing CTS No. 319F as ROS1.4 (Play Ground) to EOS2.6 (Recreation Ground) ;

And whereas, Administrator, Corporation has empowered the Municipal Commissioner of Brihanmumbai Municipal Corporation to take further action under section 37(1) of the Maharashtra Regional & Town Planning Act, 1966 and also empowered to approach UDD, GoM for seeking the final sanction of State Government u/s 37(2) of Maharashtra Regional & Town Planning Act, 1966 for proposed modification in Sanctioned Development Plan 2034 of 'R/N' Ward.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of section 37 of the MR & TP Act, 1966 ; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification as required by section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any suggestions and /or objections in respect of the proposed modification mentioned above may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of.
