क्रमांका सीएचाए-२०१४/६४१/प्र.क्र.११६/कायाग-१.—भारताच्या सींदिवाधानांाच्या अनांुच्छेदा ३०९ च्या परंताुकान्वाये प्रदानां काेलेल्या अदिधाकारांचा वापर कारूनां, माहुाराष्ट्राचाे राज्यपाल, याद्वारे, माहुाराष्ट्रा शासीनांाच्या दिवादिधा वा न्याय दिवाभागाच्या अंतागगता असीलेल्या धामागदाय सींघटनांेच्या आस्थापनांेवारील प्रशासीकाीय अदिधाकारी,गट-"ब" (राजपदित्राता) या पदाच्या सीेवाप्रवाेशाचाे दिवादिनांयमानां कारण्यासीाठी पुढील दिनांयमा कारीता आहुेता :—

१. या दिनांयमांनांा "धामागदाय सींघटनांेच्या कायागलयाताील प्रशासीकाीय अदिधाकारी,गट-ब(राजपदित्राता), (सीेवाप्रवाेशा) दिनांयमा, २०२४" असीे सींबोधाण्याता यावाे.

२. या दिनांयमांता, सींदाभागनांुसीार दाुसीरा अथाग अपेदिता नांसीेल तार,—

(का) दिनांयुक्ताी प्रादिधाकारी याचा अथाग शासीकाीय सीेवाेताील प्रशासीकाीय अदिधाकारी या पदावार उमाेदावाराला दिनांयुक्ता कारण्यासीाठी सीमा असीलेला दिवाभागाचा प्रभारी मांत्राी, असीा आहुे ;

(ख) "धामागदाय सींघटनांा" याचा अथाग, माहुाराष्ट्रा सीावागजदिनांका दिवाश्वास्ता व्यवास्था अदिधादिनांयमा (१९५० चा २९) याच्या तारताुदाीच्या प्रयोजनांाथाग, धामागदाय आयुक्ता यांचाे कायागलय वा त्यांच्या अदिधापत्याखाली माहुाराष्ट्रा राज्याता कायगरता असीलेल्या त्यांच्या प्रादाेदिशाका कायागलयांसीहु इतार कायागलये, असीा आहुे ;

(ग) "आयोग" याचा अथाग, माहुाराष्ट्रा लोकासीेवा आयोग, असीा आहुे ;

(घ) "पदावाी" याचा अथाग, सीांदिवादिधाका दिवाद्यापीठीाच्या काोणत्याहुी दिवाद्याशाखेचाी पदावाी दिकांवा दिताच्या सीमाताुल्य शासीनांानांे घोदिता काेलेली इतार काोणताीहुी अहुगता, असीा आहुे ;

(१)

भाग चार-अ-१–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जानेवारी ३, २०२४/पौर्ष १३, शके १९४५ (ङ) "दिवाभाग" याचा अथाग, शासीनांाचा दिवादिधा वा न्याय दिवाभाग, असीा आहुे ;

(चा) "पदाोन्नांताीकारिरता पात्राता" याचा अथाग, शासीनांाच्या सीामान्य प्रशासीनां दिवाभागानांे वाेळोवाेळोी दिनांगगदिमाता काेलेल्या दिनांयमा, शासीनां दिनांणगयांमाध्ये दिकांवा काढीलेल्या आदाेशांमाध्ये पदाोन्नांताीकारिरता दिवादिनांदिदागष्ट काेलेल्या अटी वा शाताीनांुसीार पात्राता असीा आहुे ;

(छे) "शासीनां" याचा अथाग, माहुाराष्ट्रा शासीनां, असीा आहुे.

३. धामागदाय सींघटनांेताील प्रशासीकाीय अदिधाकारी, गट ब (राजपदित्राता) या पदावारील दिनांयुक्ताी एकातार.—

(का) अधाीका दिकांवा दिवादिधा सीहुायका, गट ब (अराजपदित्राता) हुे पदा धारण कारणाऱ्या वा त्या पदांवार ताीनां वापेा कामाी नांसीेल इताकाी दिनांयदिमाता वा अखंदिता सीेवा असीणाऱ्या आदिण सीेवाप्रवाेशाोत्तर परीा उत्तीणग हुोण्यापासीूनां सीूट दिदालेली नांसीेल तार उक्ता परीा उत्तीणग झालेल्या व्यक्तांमाधाूनां, सीेवाज्येष्ठीताेच्या आधारे, पदाोन्नांताीकारिरता पात्रा असीणाऱ्या योग्य व्यक्ताीचाी पदाोन्नांताीद्वारे कारण्याता येईल, दिकांवा

(ख) जे उमाेदावार, पुढील दिनांयमांचाी पूतागता कारताता अशा, त्यासीाठी घेतालेल्या स्पधागत्माका परीेच्या दिनांकालाच्या आधारे, आयोगानांे दिशाफारसी काेलेल्या उमाेदावारांमाधाूनां नांामादिनांदाेशानांाद्वारे कारण्याता येईल :—

(एका) वायोमायागदा.—

(का) दिकामानां वायोमायागदा.—त्या पदाच्या भारताीच्या जादिहुराताीनांुसीार अजग स्वाीकाृताीच्या अंदितामा दिदानांांकासी अठीरा वाे पूणग काेलेले.

(ख) कामाल वायोमायागदा.—त्या पदाच्या भारताीच्या जादिहुराताीनांुसीार अजग स्वाीकाृताीच्या अंदितामा दिदानांांकासी राखीवा प्रवागागताील नांसीलेल्या व्यक्ताीसीाठी अताीसी वाे पूणग काेलेले आदिण राखीवा प्रवागागताील असीलेल्या व्यक्तांसीाठी त्राेचाळोीसी वाे पूणग काेलेले.

(दाोनां) दिकामानां शाैदिणका अहुगता.—धारण काेलेली पदावाी.

४. प्रशासीकाीय अदिधाकारी, गट ब (राजपदित्राता) पदावारील दिनांयुक्ताी, पदाोन्नांताीद्वारे वा नांामादिनांदाेशानांाद्वारे ५०:५० या प्रमाणाता कारण्याता येईल.

५. दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेल्या व्यक्ताीनांे, जर सीेवाप्रवाेशाोत्तर परीा उत्तीणग हुोण्यापासीूनां दिताला सीूट दाेण्याता आलेली नांसीेल तार त्याबाबताीता काेलेल्या दिनांयमांनांुसीार दिवादिहुता माुदाताीता ताी परीा उत्तीणग हुोणे आवाश्यका असीेल. जी व्यक्ताी, उक्ता परीा उत्तीणग हुोण्याता अपयशाी ठीरेल ताी व्यक्ताी, त्याबाबताीता काेलेल्या दिनांयमानांुसीार योग्य ताी कारवाई काेली जाण्यासी पात्रा असीेल.

६. नांामादिनांदाेशानांाद्वारे प्रशासीकाीय अदिधाकारी, गट ब (राजपदित्राता) पदावार दिनांयुक्ता काेलेली व्यक्ताी, दाोनां वागच्या कालावाधाीकारिरता परिरवाीाधाीनां कालावाधाीवार असीेल. परिरवाीाधाीनां कालावाधाी हुा, दिनांयुक्ताी प्रादिधाकाऱ्याच्या स्वाेच्छेादिनांणगयानांुसीार कामाल एका वागपयता वाढीदिवाता येईल. शासीनांाच्या परिरवाीा धाोरणानांुसीार परिरवाीाधाीनां कालावाधाी वाढीवा कालावाधाीसीहु सीमाधानांकारकारीत्या पूणग कारणे अदिनांवायग आहुे. शासीनांाच्या परिरवाीा धाोरणानांुसीार परिरवाीाधाीनां कालावाधाी (वाढीवा कालावाधाीसीहु) सीमाधानांकारकारीत्या पूणग कारण्यासी अपयशाी ठीरल्यासी, अशा प्रसींगी, दिताचाी सीेवा सीमाप्ता काेली जाण्यासी पात्रा असीेल.

७. (१) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार पदाोन्नांताीद्वारे दिनांयुक्ता कारावायाचाी व्यक्ताी, जर ताी अगोदारचा दिहुंदाी भा वा माराठी भा परीा उत्तीणग नांसीेल दिकांवा उक्ता पदावार पदाोन्नांताी दिमाळोण्यापूवाी त्या परीा उत्तीणग हुोण्यापासीूनां दिताला सीूट दाेण्याता आलेली नांसीेल तार, ताी, त्याबाबताीता, शासीनांानांे, वाेळोवाेळोी काेलेल्या दिनांयमांनांुसीार, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता, दिहुंदाी वा माराठी भा परीा उत्तीणग कारील.

(२) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, जर ताी अगोदारचा दिहुंदाी भा वा माराठी भा परीा उत्तीणग नांसीेल दिकांवा त्या परीा उत्तीणग हुोण्यापासीूनां दिताला सीूट दाेण्याता आलेली नांसीेल तार, ताी, त्याबाबताीता, शासीनांानांे वाेळोवाेळोी काेलेल्या दिनांयमांनांुसीार, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता, दिहुंदाी वा माराठी भा परीा उत्तीणग कारील. ताी व्यक्ताी, या परीा उत्तीणग हुोईपयता, वादिगका वाेतानांवाढीसीाठी दिकांवा पुढील पदाोन्नांताीच्या पदावारील पदाोन्नांताीसीाठी पात्रा असीणार नांाहुी.

८. (१) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार पदाोन्नांताीद्वारे दिनांयुक्ता कारावायाचाी व्यक्ताी, उक्ता पदावार पदाोन्नांताी दिमाळोण्यापूवाी, जर दिताला सींगणका हुाताळोणी प्रमाणपत्रा धारण कारण्यापासीूनां सीूट दाेण्याता आली नांसीेल तार, त्याबाबताीता, शासीनांानांे, वाेळोवाेळोी काेलेल्या दिनांयमांद्वारे दिकांवा काढीलेल्या आदाेशांद्वारे दिवादिहुता काेलेले सींगणका हुाताळोणी प्रमाणपत्रा धारण कारील.

(२) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, जर दिताला सींगणका हुाताळोणी प्रमाणपत्रा धारण कारण्यापासीूनां सीूट दाेण्याता आली नांसीेल तार, ताी, याबाबताीता, शासीनांानांे, वाेळोवाेळोी दिवादिहुता काेलेले सींगणका हुाताळोणी प्रमाणपत्रा, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता धारण कारील, अन्यथा ताी व्यक्ताी, ताे प्रमाणपत्रा धारण कारीपयता, वादिगका वाेतानांवाढीसीाठी दिकांवा पुढील पदाोन्नांताीच्या पदावारील पदाोन्नांताीसीाठी पात्रा असीणार नांाहुी.

९. (१) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ताीसीाठी दिशाफारसी काेलेली व्यक्ताी, माहुाराष्ट्रा नांागरी बाचाे प्रदिताज्ञापनां) दिनांयमा, २००५ दिकांवा याबाबताीता, शासीनांानांे, वाेळोवाेळोी दिनांगगदिमाता काेलेले अन्य काोणताेहुी दिनांयमा, सीेवा (लहुानां काुटं आदाेशा दिकांवा काोणताेहुी सींलेख यांच्या तारताुदाीनांुसीार लहुानां काुटं बाचाे प्रदिताज्ञापनां सीादार कारील.

बाचाे प्रदिताज्ञापनां सीादार कारण्याच्या दिदानांांकासी दाोनांपेा अदिधाका अपत्ये असीणारी व्यक्ताी, शासीकाीय सीेवाेताील (२) लहुानां काुटं दिनांयुक्ताीसीाठी अपात्रा असीेल.

(३) शासीकाीय सीेवाेता व्यक्ताीचाी दिनांयुक्ताी झाल्यानांतार, जर दिताला दिनांयुक्ताीच्या वाेळोी दिकांवा त्यानांतार दाोनांपेा अदिधाका अपत्ये असील्याचाे दिसीद्ध झाले तार, ताी व्यक्ताी, शासीकाीय सीेवाेताील उक्ता पदावार कायमा राहुण्यासीाठी अपात्रा असीेल.

१०. दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार दिनांयुक्ता काेलेली व्यक्ताी, माहुाराष्ट्रा राज्याताील काोणत्याहुी दिठीकाणी बदालीसीाठी पात्रा असीेल.

११. काोणत्याहुी शासीकाीय कामागचाऱ्याच्या दिनांयुक्ताीनांतार, शासीनांानांे वाेळोवाेळोी दिनांगगदिमाता काेलेले काोणताेहुी दिनांयमा, आदाेशा दिकांवा शासीनां दिनांणगय यांमाध्ये शासीनांानांे दिवादिनांदिदागष्ट काेलेल्या अटी वा शाताी, दाेखील अशा शासीकाीय कामागचाऱ्यासी लागू असीताील.

Constitution of india.

No. CHA-2014/641/C.R.116/Desk-1.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Administrative Officer, Group "B" (Gazetted), in the office of the Charity Organisation under the Law and Judiciary Department of the Government of Maharashtra, namely :—

1. These rules may be called the "Administrative Officer, Group "B" (Gazetted) in the Office of the Charity Organisation (Recruitment) Rules, 2024".

2. In these rules, unless the context requires otherwise,—

(a) "Appointing Authority" means the Minister-in-charge of the Department, who is competent to appoint a candidate on the post of Administrative Officer in the Government Service;

(b) "Charity Organization" means the Office of the Charity Commissioner and other offices working under it in the State of Maharashtra including its regional offices for the purposes of the provisions of the Maharashtra Public Trusts Act (XXIX of 1950) ;

(c) "Commission" means the Maharashtra Public Service Commission ;

(d) "Degree" means a degree of any discipline of a statutory university or any other qualification declared by the Government to be equivalent thereto ;

(e) "Department" means the Law and Judiciary Department of the Government ;

(f) "Eligibility for Promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department of the Government, from time to time ;

(g) "Government" means the Government of Maharashtra.

3. Appointment to the post of Administrative Officer, Group-B (Gazetted) in the Charity Organisation shall be made either,-

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Superintendent or Legal Assistant, Group-B (Non-gazetted) and having not less than three years regular and continuous service on those posts and have passed post recruitment examination unless exempted from passing of the said examination;

(b) by nomination from amongst the candidates recommended by the Commission on the basis of result of Competitive Examination conducted therefor, who fulfills the following criteria, namely :—

(I) Age limit.—

(A) Lower Age Limit.- Eighteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit.- Thirty-eight years of age completed for the persons not belonging to reserved categories and forty three years completed for the personsमहाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जानेवारी ३, २०२४/पौर्ष १३, शके १९४५ ५ belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(II) Minimum Educational Qualification.—Possesses a degree.

4. Appointment to the post of Administrative Officer, Group-B (Gazetted) shall be made by promotion and nomination in the ratio of 50:50.

5. A person appointed to the post mentioned in rule 3 by nomination shall be required to pass the prescribed Post Recruitment Examination for the post, according to the rules made in that behalf unless he has been exempted from passing that examination. A person, who fails to pass the said Examination, shall be liable to the action to be taken as per the rules made in that behalf.

6. A person appointed to the post of Administrative Officer, Group-B (Gazetted) by nomination shall be on probation for a period of two years. The probation period may be extended maximum upto one year at the discretion of the Appointing Authority. Completion of the probation period (including extended period) satisfactorily as per the probation policy of the Government, is mandatory. In the event of failing to complete the probation period (including extended period) satisfactorily as per the probation policy of the Government, his services shall be liable to be terminated.

7. (1) A person to be appointed to the post mentioned in rule 3 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3 by nomination shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

8. (1) A person to be appointed to the post mentioned in rule 3 by promotion shall possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A person appointed to the post mentioned in rule 3 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

9. (1) A person recommended for appointment by nomination to the post mentioned in rule 3 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government Service.

10. A person appointed to the post mentioned in rule 3 shall be liable for transfer anywhere in the State of Maharashtra.

The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government Servant.

(का) "दिनांयुक्ताी प्रादिधाकारी" याचा अथाग, धामागदाय आयुक्ता, माहुाराष्ट्रा राज्य, असीा आहुे ;

(ख) "धामागदाय सींघटनांा" याचा अथाग, माहुाराष्ट्रा सीावागजदिनांका दिवाश्वास्ता व्यवास्था अदिधादिनांयमा, १९५० (१९५० चा माु ंबई क्रमांका २९) यांच्या तारताुदांच्या प्रयोजनांाथाग, धामागदाय आयुक्ता यांचाे कायागलय वा त्यांचाी प्रादाेदिशाका कायागलये यांसीहु, माहुाराष्ट्रा राज्याताील त्यांच्या अंतागगता कायगरता असीलेली इतार कायागलये, असीा आहुे ;

३. दिवादिधा सीहुायका,गट-ब (अराजपदित्राता) या पदावारील दिनांयुक्ताी हुी, जे उमाेदावार, पुढील दिनांकांचाी पूतागता कारताता अशा, त्यासीाठी घेतालेल्या स्पधागत्माका परीेच्या दिनांकालाच्या आधारे, दिनांवा सीदिमाताीनांे दिशाफारसी काेलेल्या उमाेदावारांमाधाूनां नांामादिनांदाेशानांाद्वारे कारण्याता येईल :—

(एक) वयेोमयेाषदा—

(का) दिकामानां वायोमायागदा.—त्या पदाच्या भारताीच्या जादिहुराताीनांुसीार अजग स्वाीकाृताीच्या अंदितामा दिदानांांकासी एकाोणीसी वाे पूणग काेलेली.

(ख) कामाल वायोमायागदा.—त्या पदाच्या भारताीच्या जादिहुराताीनांुसीार अजग स्वाीकाृताीच्या अंदितामा दिदानांांकासी अराखीवा प्रवागागताील व्यक्तांसीाठी अताीसी वाे पूणग काेलेले वा राखीवा प्रवागागताील व्यक्तांसीाठी त्राेचाळोीसी वाे पूणग काेलेली.

(दोन) किंकमान शैक्षकिंणक अहषता.—ज्यांनांी सीांदिवादिधाका दिवाद्यापीठीाचाी दिवादिधा माधाील पदावाी दिकांवा दिताच्याशाी सीमाताुल्य असील्याचाे शासीनांानांे घोदिता काेलेली इतार काोणताीहुी अहुगता धारण काेलेले :

परंताु, धामागदाय सींघटनांेच्या राज्यस्तारिरय दिनांवा सीदिमाताीनांे पात्रा ठीरदिवालेल्या उमाेदावारांनांा सीमानां गुण प्राप्ता झाले असीताील त्याबाबताीता, पुढील उमाेदावारांनांा प्राधान्य दाेण्याता येईल,—

(एका) सीांदिवादिधाका दिवाद्यापीठीाचाी दिवादिधामाधाील पदाव्युत्तर पदावाी दिकांवा दिताच्याशाी सीमाताुल्य असील्याचाे शासीनांानांे घोदिता काेलेली इतार काोणताीहुी अहुगता धारण कारणारा उमाेदावार ; दिकांवा८ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जानेवारी ३, २०२४/पौर्ष १३, शके १९४५ (दाोनां) खाजगी दिकांवा शासीकाीय कायागलयांमाधाील धामागदाय सींघटनांेशाी सींबंदिधाता कामा कारण्याचा ताीनां वाचा अनांुभावा असीणारा उमाेदावार.

४. दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, अगोदारचा सीेवाप्रवाेशाोत्तर परीा उत्तीणग नांसीेल दिकांवा ताी परीा उत्तीणग हुोण्यापासीूनां दिताला सीूट दाेण्याता आलेली नांसीेल तार, ताी, त्याबाबताीता शासीनांानांे, वाेळोवाेळोी काेलेल्या दिनांयमांनांुसीार, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता सीेवाप्रवाेशाोत्तर परीा उत्तीणग कारील. ताी व्यक्ताी, हुी परीा उत्तीणग हुोईपयता, वादिगका वाेतानां वाढीसीाठी दिकांवा पुढील पदाोन्नांताीच्या पदांवारील पदाोन्नांताीसीाठी पात्रा असीणार नांाहुी.

५. दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, अगोदारचा दिहुंदाी भा वा माराठी भा परीा उत्तीणग नांसीेल दिकांवा त्या परीा उत्तीणग हुोण्यापासीूनां दिताला सीूट दाेण्याता आलेली नांसीेल तार, ताी, त्याबाबताीता, शासीनांानांे, वाेळोवाेळोी काेलेल्या दिनांयमांनांुसीार, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता, दिहुंदाी वा माराठी भा परीा उत्तीणग कारील. ताी व्यक्ताी, या परीा उत्तीणग हुोईपयता, वादिगका वाेतानां वाढीसीाठी दिकांवा पुढील पदाोन्नांताीच्या पदांवारील पदाोन्नांताीसीाठी पात्रा असीणार नांाहुी.

६. दिनांयमा ३ येथाील पदावार नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, दिताला सींगणका हुाताळोणी प्रमाणपत्रा धारण कारण्यापासीूनां सीूट दाेण्याता आली नांसीेल तार, ताी, याबाबताीता शासीनांानांे, वाेळोवाेळोी दिवादिहुता काेलेले सींगणका हुाताळोणी प्रमाणपत्रा, दिनांयुक्ताीनांतार दिवादिहुता माुदाताीता धारण कारील, अन्यथा ताी व्यक्ताी, ताे प्रमाणपत्रा धारण कारीपयता, वादिगका वाेतानां वाढीसीाठी दिकांवा पुढील पदाोन्नांताीच्या पदांवारील पदाोन्नांताीसीाठी पात्रा असीणार नांाहुी.

७. (१) दिनांयमा ३ माध्ये नांमाूदा काेलेल्या पदावार नांामादिनांदाेशानांाद्वारे दिशाफारसी काेलेली व्यक्ताी, माहुाराष्ट्रा नांागरी सीेवा (लहुानां बाचाे प्रदिताज्ञापनां) दिनांयमा, २००५ दिकांवा याबाबताीता, शासीनांानांे, वाेळोवाेळोी दिनांगगदिमाता काेलेले अन्य काोणताेहुी दिनांयमा, आदाेशा दिकांवा काुटं काोणताेहुी सींलेख यांच्या तारताुदांनांुसीार लहुानां काुटं बाचाे प्रदिताज्ञापनां सीादार कारील.

बाचाे प्रदिताज्ञापनां सीादार कारण्याच्या दिदानांांकाला दाोनां पेा अदिधाका अपत्ये असीणारी व्यक्ताी, शासीकाीय सीेवाेताील (२) लहुानां काुटं दिनांयुक्ताीसीाठी अपात्रा असीेल.

(३) एखाद्या व्यक्ताीचाी शासीकाीय सीेवाेता दिनांयुक्ताी झाल्यानांतार, दिताला दिनांयुक्ताीच्या वाेळोी दिकांवा त्यानांतार दाोनांपेा अदिधाका अपत्ये असील्याचाे दिसीध्दा झाले तार, ताी व्यक्ताी, शासीकाीय सीेवाेताील उक्ता पदावार राहुण्यासीाठी अपात्रा असीेल.

८. दिनांयमा ३ अन्वाये सीदार पदावार दिनांयुक्ता काेलेली व्यक्ताी, माहुाराष्ट्रा राज्याताील काोणत्याहुी दिठीकाणी बदालीसीाठी पात्रा असीेल.

९. शासीकाीय कामागचाऱ्यांच्या दिनांयुक्ताीनांतार, शासीनांानांे वाेळोवाेळोी दिनांगगदिमाता काेलेले काोणताेहुी दिनांयमा, आदाेशा दिकांवा शासीनां दिनांणगय यांमाध्ये शासीनांानांे दिवादिनांदिदागष्ट काेलेल्या अटी वा शाताी दाेखील अशा शासीकाीय कामागचाऱ्यासी लागू असीताील.

No. CHA-2014/641/Case No.116(Part-2)/D-1.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Legal Assistant, Group-B (Non-Gazetted) on the establishment of the Charity Organization under the Law and Judiciary Department of Government of Maharashtra, as follows, namely :—

1. These rules may be called the Legal Assistant, Group-B (Non-Gazetted) on the establishment of the Charity Organization, under the Law and Judiciary Department (Recruitment) Rules, 2024.

2. In these rules, unless the context require otherwise,—

(a) "Appointing Authority" means Charity Commissioner, Maharashtra State ;

(b) "Charity Organization" means the Office of the Charity Commissioner and other offices working thereunder in the State of Maharashtra including its regional offices for the purposes of provisions of the Maharashtra Public Trusts Act (Bom.XXIX of 1950) ;

(c) "Degree in Law" means the three years or five years degree course in law of a Statutory University ;

(d) "Department" means Law and Judiciary Department of Government of Maharashtra ;

(e) "Government" means the Government of Maharashtra ;

(f) "Selection Committee" means a State Level Selection Committee constituted, from time to time, by the Government for the purpose of selection of candidates for direct recruitment to the post of Group 'B' (Non-Gazetted) and Group 'C', in the Charity Organization.

3. Appointment on the post of Legal Assistant, Group 'B' (Non-Gazetted) shall be made by nomination from amongst the candidates recommended by the Selection Committee on the basis of result of Competitive Examination conducted therefor, who fulfills following criteria, namely :—

(i) Age limit.—

(A) Lower Age Limit—Nineteen years completed as on the last date of receipt of applications as per advertisement for recruitment to the post.

(B) Upper Age Limit—Thirty-eight years completed for the persons not belonging to reserved categories and forty three years completed for the persons belonging to reserved categories as on the last date of receipt of applications as per advertisement for recruitment to the post.

(ii) Minimum Educational Qualification.—who posses a Degree in Law of a statutory University or any other qualification declared by Government to be equivalent thereto :

Provided that, in case the candidates held eligible by the Selection Committee secure equal marks preference will be given to the,—

qualification declared by Government to be equivalent thereto ; or

(ii) candidate having three years experience in handling work related to Charity Organisation in private or Government offices.

4. A person appointed to the post mentioned in rule 3 by nomination shall pass the Post Recruitment Examination as per rules made in behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes the examinations.

5. A person appointed to the post mentioned in rule 3 by nomination shall pass the Marathi and Hindi languages examinations as per rules made in behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

6. A person appointed to the post mentioned in rule 3 by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from passing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

7. (1) A person recommended for appointment by nomination to the post mentioned in rule 3 shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government Service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in Government Service.

8. A person appointed to the post under rule 3 shall be liable for transfer anywhere in the State of Maharashtra.

9. The terms and conditions specified by the Government, subsequent to the appointment of Government Servant in any rules, orders or resolutions issued by the Government, form time to time, shall also be applicable to the Government Servant.
