िमरा-भा(cid:666)दर महानगरपािलका शहराची (cid:332)ा(cid:544)प सुधा(cid:555)रत िवकास योजना अिधिनयमाचे कलम २६ अ(cid:261)वये िदनांक २८ ऑ(cid:242)टोबर २०२२ रोजी (cid:332)िस(cid:460) झाली असून ती कलम ३० अ(cid:261)वये शासनास मंजुरीसाठी िदनांक २५ ऑ(cid:242)टोबर २०२३ रोजी सादर झाली आहे. (cid:257)याम(cid:260)ये महानगरपािलक(cid:577)स (cid:332)ा(cid:262)त झालेले "सुिवधा (cid:550)े(cid:327)" तसेच (cid:274)थलांतरण कर(cid:256)यात आले(cid:269)या बगीचाचे आर(cid:550)ण व इतर जिमनीवर "आ.(cid:312). २२६ (cid:266)युिनिसपल पप(cid:593)ज " ( (cid:550)े(cid:327) १२४९०.०० चौ. मी.) आर(cid:550)ण (cid:332)(cid:274)तािवत कर(cid:256)यात आले आहे.

आिण (cid:257)याअथ(cid:559), उपरो(cid:242)त नमूद "उ(cid:242)त फ(cid:577)रबदलाबाबत" (cid:249)या नागरीकांना हरकती िक(cid:573)वा सूचना (cid:464)ावया(cid:247)या अस(cid:269)यास (cid:257)यांनी हरकती / सूचना लेखी (cid:274)व(cid:543)पात सदरची अिधसूचना शासन राजप(cid:327)ात (cid:332)िस(cid:460) झाले(cid:269)या िदनांकापासून ३० िदवसां(cid:247)या मुदतीपय(cid:597)त सादर करा(cid:271)यात, (cid:266)हणजे सदर फ(cid:577)रबदला(cid:247)या (cid:332)(cid:274)तावास अंितम (cid:274)व(cid:543)प दे(cid:256)यापूव(cid:559) उ(cid:242)त सूचना / हरकत(cid:558)चा िवचार करता येऊ शक(cid:577)ल.

(Amendment under section 37 of the Maharashtra Regional and

Town Planning Act, 1966.)

Whereas, the Revised Development Plan of the city of Mira-Bhayander (hereinafter referred to as "the said Development Plan") has been sanctioned by the Government in Urban Development Department, under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") vide Notification No.TPS-1296/847/CR-162/96/UD-12, dated the 14th May, 1997 (hereinafter referred to as "the said Notification") and has come into force with effect from 15th July, 1997 and the Excluded Part of the said Development plan has been sanctioned by the Government in Urban Development Department vide Notification No. TPS- 1298/941/CR-89/98/UD-12, dated the 25th August, 2000 which came into force with effect from the 15th October, 2000;

And Whereas in the said Development Plan, The Layout of M/s. J.P. Infra Approved by Municipal Corporation in the land bearing Survey No.20/4B, 8Pt., 21/2A,Pt., 21/2B,Pt., 22/1B, 1C,2,3,5,24/3, 25/1, 26/5,8(Pt.),9, 110/1Pt., 2Pt., 112/2Pt., 113/1,2, 114/1,3,4,6, 116/1,2A(Pt.),3,4,5,7,8,9, 117/1,3, 4,5,6, 118/2,3, 4,5,7,8, 124/2,3, 125/1,2,3,4,5,6,7, 126/1 to 6, 127/1,2,3,4,5, 128/5a, 5bPt., 132/3, 133/1,2,3,4, 5, 6,7,8; 134/2,3,5a,8, 135/3, 148/1,2; at Village Ghodbunder the urban "Amenity Open Space" area admeasuring 3150.37 sq.m. has been handed over to the Municipal Corporation and the land bearing at, S.No.127/4Pt., 5Pt., 133/1Pt., 2, 3Pt., 4Pt., 5Pt., 6Pt., 7Pt., 8Pt., 134/2, 134/3Pt., 135/3Pt., 148/1Pt., 2 Pt., of village Ghodbundar in the said development plan has been a reserved for Reservation No. 325 "Garden" (area 6000 sq.m.) as per the actual measurement plan reservation area is 6050 sq.m. out of the area of the said reservation 1048.00 sq. mtr. handed over to Municipal Corporation in the form of Transferable Development Rights.

Area 1048.00 sq.m., which was Transferred ot Mira-Bhaindar Municipal Corporation in the said reservation and remaining 5002.00 sq.m. out of 70% Area 3501.40 sq.mtr. in the Garden reservation as per the provision of Accommodation reservation Principle in the Unified Development Control and Promotion Regulations. Such total area of 4549.40 sq.mtr. area relocate adjacent to the amenity area as per the provision of 3.11 of the Unified Development Control and Promotion Regulations has approved Letter No.MBMC/TP/4616/2021-22, dated 31st March 2022.

The draft revised development plan of Mira-Bhaindar Municipal Corporation has been published under section 26 of the said act dated 28th October 2022 and the draft revised Development Plan has been submitted to the Government for approval under section 30 of the said act dated 25th October 2023. In the draft development plan "Amenity Area" received by the Municipal Corporation as well as the reservation of the garden which was shifted under Resolution No. 3.11 and other remaining land reserved for the purpose of "Reservation No. 226 "Municipal Purpose" (area 12490.00 sq.m.).

Accordingly, as per the revised draft development plan has not been sanctioned, according to the sanctiond development plan permission given by the Municipal Corporation on 31st March 2022 to relocate the area of "Reservation No. 325 Garden", in the said sanctioned Development Plan as well as the "Amenity Open Space" Area received by Municipal Corporation and the land under residential zone in the Sr.No.127/3Pt., 4Pt., 5, S.No. 129/5Pt. 11Pt., 12Pt.,13pt., S.No.130/1Pt., 5Pt., 6Pt. S.No. 131/3Pt., 132/1Pt.,2,3,4Pt.,5, 6Pt.,8Pt.,9Pt.,10,11Pt., 13Pt., S.No.133/1,2, 3Pt, 4Pt., 5Pt., 6Pt., 7Pt., 8Pt., S.No. 134/1Pt., 2Pt., 3Pt., S.No. 135/3Pt., and S.No.148/1,2Pt., 3Pt., 5Pt., the Municipal Corporation Administrative Resolution No. 279, case No. 279, dated 8th December 2023, it is reserved for the purpose of "Municipal Purpose" area admeasuring about 12490.00 sq. mtr. As per the draft development plan submitted to Government decided to propose modification in the भाग दोन (संकीण(cid:593))–२६ महारा(cid:273)(cid:322) शासन राजप(cid:327), भाग दोन-संकीण(cid:593) सूचना व जािहराती, गु(cid:543)वार ते बुधवार, जानेवारी ११-१७, २०२४/पौष २१-२७, शक(cid:577) १९४५ approved development plan as per Section 37(1) of the said Act. (hereinafter referred to as "the said modification".)

And in that regard, the citizens who have to give objections or suggestions regarding the above- mentioned "said modification" should submit their objections/suggestions in written form within 30 days from the date of publication of the said notification in the Government Gazette, that is, the said suggestions/objections may be considered before finalizing the said modification proposal.

A map showing the proposed modification has been placed for public inspection and information at the Municipal Corporation, Head Office and Town Planning Department during office hours.

Whereas, as per the powers conferred by sub section (1) of Section 31 of the MR & TP Act, 1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/CR- 118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as ("the said Notification") alongwith the Development Control and Promotion Regulations 2034 for Greater Mumbai ;

And whereas, the land bearing C.T.S. No. 50 of village Vikhroli is affected by existing amenities of EOS 2.6 (Recreation Ground)( part of larger existing amenities) and ET 1.6 (Public Parking Lot). The land is affected by 15.25 mtr wide proposed D.P. Road and is situated in Residential Zone (R) and the land bearing C.T.S. No. 194A/7 of village Ghatkopar is affected by the reservation of ROS 1.5 (Garden/Park), RH1.2(Hospital) (part of larger reservation), RE 1.1 (Municipal School), RE 1.2 (Primary/Secondary School), ROS 1.4 (Play Ground) (Part of larger reservation) and existing amenity of RE 1.2 (Police Staff Quarters) and EOS 1.4 (Play Ground). The land is affected by 12.2mtr (2 nos), 24 mtr, 18.30 mtr (2 nos) and 9.15 mtr wide DP Roads and road widening of 18.30 mtr. The same is situated in Residential Zone ;

And whereas, while sanctioning DP 2034, vide Notification U/No.TPB-4320/CR- 135/2020/UD- 11, dated 8th May 2018, the reservations/designations on land bearing CTS No. 194A/7 of village Ghatkopar were in EP-N59, EP N44. From Sanctioned EP-N59 it can be seen that, the land under reference i.e CTS No. 194A/7 (pt) is affected by the reservation of R.H. 1.3+(Maternity Home and Municipal Housing) and some part of CTS No. 193B of village Ghatkopar is also affected with reservation of R.H. 1.3+(Maternity Home and Municipal Housing). Also, the land bearing F.P. No. 46, T.P.S.-II Ghatkopar is partly affected by the reservation of R.H. 1.2 (Hospital) and partly affected by the reservation of RT 1.4 (Best Bus Facilities). The land is affected by proposed road widening of 9.15 mtr and the land is situated in Residential Zone;

And whereas, it is proposed to delete the existing amenity of EOS 2.6 (Recreation Ground) on land bearing C.T.S. No. 50B of village Vikhroli and to propose reservation of RSA 4.8 (Cemetery) on part land admeasuring aprox. 4293.5 sq.mtr. and RH 1.2 (Hospital) on remaining part of land admeasuring aprox. 4300 sq.mtr. and to delete the reservation of RH 1.3+ (Maternity Home and Municipal Housing) on land bearing C.T.S. No. 194A/7(pt) and CTS. No. 193B(pt) of village Ghatkopar having ownership in the name of Maharashtra State Police Housing and Welfare Corporation as per online PRC admeasuring aprox 5300 sq.mtr. and reservation of R.H. 1.2 (Hospital) on F.P. No. 46(pt), T.P.S.-II Ghatkopar village Ghatkopar Kirol, having ownership in the name of Government of India as per Form B, admeasuring aprox. 3500 Sq.mtr. and to propose the reservation of ROS 1.5 (Garden/ Park) on said land ;

Whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "MR & TP Act, 1966"), the Planning Authority may, or when so directed by the State Government shall within one month from date of such directions publish a notice inviting suggestions/ objections from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction ;

And whereas, as per circular U/No. BMC/ADMN/3 dated 7th April 2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act, 1888') all the powers of the Corporation are now vested with the Administrator;

And whereas, Administrator (Improvement Committee) vide Resolution No 52 of dated 14th December 2023 and Administrator (Corporation) vide Resolution No. 958 dated 21st December 2023 has accorded sanction to initiate the modification proposal, to invite suggestions/objections from भाग दोन (संकीण(cid:593))–३अ१० महारा(cid:273)(cid:322) शासन राजप(cid:327), भाग दोन-संकीण(cid:593) सूचना व जािहराती, गु(cid:543)वार ते बुधवार, जानेवारी ११-१७, २०२४/पौष २१-२७, शक(cid:577) १९४५ general public under section 37(1) of MR & TP Act, 1966 and to make correspondence with State Govt. in Urban Development Dept. for final sanction under section 37(2) of MR & TP Act, 1966 for the proposed modification in Sanctioned DP 2034.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub section (1) of Section 37 of the MR & TP Act, 1966 ; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby.
