महाराष्ट्र वन्ये प्ाण्येांमुळे झालेली हानी, इजा किंकंवा नुकसान येांकररता नुकसानभरपाई प्दान करणे अकिंधकिंनयेम, २०२३.

क्रमंांका डब्ल्यूएलपी ०२.२३/प्र.क्र.५२(भाग-२)/फ-१.— मंहुाराष्ट्र वान्य प्राण्यांमंुळे झालेली हुानांी, इजा दिकांवा नांुकासानां यांकारिरता नांुकासानां भारपीाई प्रदानां कारणे अदिदिनांयमं, २०२३ (२०२३ चा मंहुा. ३७) याच्या कालमं ८ च्या पीोट-कालमं (१) द्वारे प्रदानां काेलेल्या अदिकारांचा वापीर कारूनां, मंहुाराष्ट्र शासानां, याद्वारे, पीुढील दिनांयमं कारीता आहुे :–

१. संकिंप्त नाव.– या दिनांयमंांसा, मंहुाराष्ट्र वान्य प्राण्यांमंुळे झालेली हुानांी, इजा दिकांवा नांुकासानां यांकारिरता नांुकासानांभारपीाई प्रदानां कारणे अदिदिनांयमं, २०२३, असाे म्हुणेावाे.

२. व्येाख्येा.– (१)– या दिनांयमंांता, सांदाभागनांुसार दाुसारा अर्थग आवाश्यका नांसाेल तार,–

(का) "अदिदिनांयमं" याचा अर्थग, मंहुाराष्ट्र वान्य प्राण्यांमंुळे झालेली हुानांी, इजा दिकांवा नांुकासानां यांकारिरता नांुकासानांभारपीाई प्रदानां कारणे अदिदिनांयमं, २०२३ (२०२३ चा मंहुा. ३७), असा आहुे;

(ख) "काुटं ब" याचा अर्थग, बळेी पीडलेल्या व्यक्ताीचाी पीत्नांी, पीताी, मंुले, आई दिकांवा वाडील, असा आहुे;

(ग) "नांमंुनांा" याचा अर्थग, या दिनांयमंांसा जोडलेला नांमंुनांा, असा आहुे.

(२) या दिनांयमंाता वापीरलेले, पीरंताु व्याख्या नां काेलेले शाब्दा वा शाब्दाप्रयोग यांनांा, या अदिदिनांयमंान्वाये अनांुक्रमंे जो अर्थग नांेमंूनां दिदालेला आहुे ताोचा अर्थग असाेल.

(१)

भाग चार-अ-२०–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, फेब्रुवारी १, २०२४/माघ १२, शके १९४५ ३. इतर प्कारच्येा इजा किंकंवा नुकसान.– अदिदिनांयमंाच्या कालमं ३ च्या पीोट-कालमं (२) मंध्ये तारताूदा काेलेल्या वान्य प्राण्यांच्या हुल्ल्यामंुळे झालेल्या इजांच्या दिकांवा नांुकासानांीच्या प्रकारांदिशावाय, राज्य शासानां, उक्ता अदिदिनांयमंान्वाये, वान्य प्राण्यांच्या हुल्ल्यामंुळे मंानांवाला झालेल्या दिकारकाोळे इजांसाठी दाेखील नांुकासानांभारपीाई प्रदानां कारील.

४. मंजुरी देणारा प्ाकिंधकारी.– ज्या क्षेत्रामंध्ये वान्य प्राण्यांच्या हुल्ल्याचाी घटनांा घडली आहुे त्या क्षेत्रावार अदिकारिरता असाणेारा साहुायका वानांसांरक्षेका हुा, या अदिदिनांयमंाच्या प्रयोजनांांसाठी मंजुरी दाेणेारा प्रादिकारी असाेल.

५. मानवी जीकिंवतहानी व मानवास इजा झाल्येास, नुकसानभरपाई प्दान करण्येाची कायेषपद्धती :–

(१) मंानांवाी जीदिवाताहुानांी झाल्यासा,–

(का) वान्य प्राण्यांच्या हुल्ल्यामंुळे मंानांवाी जीदिवाताहुानांी झाल्याबद्दलचाी साूचानांा, काोणेत्याहुी व्यक्ताीद्वारे, तात्काळे जवाळेच्या वानांरक्षेकाला लेखी स्वारूपीाता दाेण्याता येईल. अशाी साूचानांा दिमंळेाल्यानांतार, वानांरक्षेका, अशाी घटनांा घडली आहुे दिकांवा कासाे याचाी खात्राी कारील आदिणे घटनांेचाी मंादिहुताी गोळेा कारील आदिणे वास्ताुस्थिस्र्थताी सांबंदिता वानांपीालासा आदिणे वानांक्षेत्रापीालासा तात्काळे काळेवाील.

(ख) अशा प्रकारणेी, अदिदिनांयमंान्वाये प्रदाेय असालेल्या नांुकासानांभारपीाईसाठी, मंृता व्यक्ताीच्या कायदाेशाीर वारसांद्वारे, अशा घटनांेपीासाूनां अठ्ठेचाळेीसा तासांच्या आता, सांबंदिता वानां क्षेत्रापीालाकाडे नांमंुनांा - एकामंध्ये अजग कारण्याता येईल.

(ग) वानांक्षेत्रापीाल, खंड (ख) खालील असा अजग प्राप्ता झाल्यावार, घटनांास्र्थळेासा भाेट दाेईल आदिणे असा अजग दिमंळेाल्याच्या दिदानांांकापीासाूनां ताीनां दिदावासांच्या आता, आवाश्यका ताी चाौकाशाी कारील. वानांक्षेत्रापीाल, अशा चाौकाशाीनांतार, पींचानांामंा कारील.

(घ) अशा प्रकारणे ी, वाैद्यकाीय अदिकाऱ्याद्वारे शावादिवाच्छेदानां कारण्याता येईल. वाैद्यकाीय अदिकारी, शावादिवाच्छेदानांानांतार, शावादिवाच्छेदानां अहुवाल सांबंदिता अदिकाऱ्याकाडे पीाठीवाताील.

(२) मंानांवासा कायमंस्वारूपी दिदाव्यांगत्वा आल्यासा, मंोठी दिकांवा दिकारकाोळे इजा झाल्यासा,–

(का) वान्य प्राण्यांच्या हुल्ल्यामंुळे मंानांवाला कायमंस्वारूपी दिदाव्यांगत्वा आल्यासा, मंोठी दिकांवा दिकारकाोळे इजा झाल्यासा, अदिदिनांयमंान्वाये प्रदाेय असालेल्या नांुकासानांभारपीाईसाठी, जखमंी व्यक्ताीद्वारे स्वाता: दिकांवा दिताच्या काुटं बाताील इतार काोणेत्याहुी व्यक्ताीद्वारे, अशा घटनांेपीासाूनां अठ्ठेचाळेीसा तासांच्या आता, ज्या क्षेत्राता असा हुल्ला झाला आहुे त्या क्षेत्रावार अदिकारिरता असाणेाऱ्या वानांक्षेत्रापीालकाडे, नांमंुनांा - एकामंध्ये अजग कारण्याता येईल. अजगदार, अशा अजागसाोबता वाैद्यकाीय अदिकाऱ्यानांे तापीासाणेी काेलेल्या बळेी पीडलेल्या व्यक्ताीच्या तापीासाणेीचाे वाैद्यकाीय प्रमंाणेपीत्रादाेखील सादार कारील.

(ख) वानांक्षेत्रापीाल, खंड (का) खालील अजग प्राप्ता झाल्यावार, घटनांास्र्थळेासा भाेट दाेण्यासाठी आदिणे असा अजग दिमंळेाल्याच्या दिदानांांकापीासाूनां ताीनां दिदावासांच्या आता, आवाश्यका चाौकाशाी कारण्यासाठी वानांपीालासा दिनांदाेशा दाेईल. वानांपीाल, अशा चाौकाशाीनांतार, पींचानांामंा कारील. वानांपीाल, त्याचा अहुवाल पींचानांाम्यासाहु वानांक्षेत्रापीालासा सादार कारील.

(३) वानांक्षेत्रापीाल, वानांपीालाचा अहुवाल प्राप्ता झाल्यानांतार, त्याच्या दिवादिशाष्ट दिशाफारशाीसाहु अजग, सावाग बाबताीता पीरिरपीूणेग असालेल्या अजग प्राप्ता झाल्यापीासाूनां वाीसा दिदावासांच्या आता, साहुायका वानांसांरक्षेकाकाडे पीाठीवाील.

(४) जर सांबंदिता व्यक्ताी, वान्यजीवा (सांरक्षेणे) अदिदिनांयमं, १९७२ (१९७२ चा ५३) याच्या काोणेत्याहुी तारताुदांचाे दिकांवा त्याखालील काेलेल्या काोणेत्याहुी दिनांयमंांचाे उल्लंघनां कारीता असातानांा, वान्य प्राण्यांच्या हुल्ल्याचाी घटनांा घडली असाेल तार, जखमंी झालेली दिकांवा मंृता व्यक्ताी, काोणेत्याहुी नांुकासानांभारपीाईसाठी पीात्रा असाणेार नांाहुी.

६. मानवी जीकिंवतहानी झाल्येास नुकसानभरपाईचे प्दान करणे.–

(१) मंृता व्यक्ताी प्रौढी असाल्यासा, नांुकासानांभारपीाईचाी रक्कामं पीुढीलप्रमंाणे असाेल :–

(का) जर मंृता व्यक्ताीचाी पीत्नांी/ पीताी दिजवांता असाेल तार, पीत्नांी/ पीताी वा मंुले यांनांा सामंानां दिहुस्सा दाेण्याता येईल;

(ख) जर पीत्नांी/ पीताी दिजवांता नांसाेल तार,–

(एका) जर सावाग मंुले साज्ञानां, असाताील तार, मंागे हुयाता असालेल्या सावाग मंुलांमंध्ये, नांुकासानांभारपीाईचाे सामंसामंानां दिवाभाजनां कारण्याता येईल;

(दाोनां) जर मंूल अज्ञानां असाेल तार, नांुकासानांभारपीाईच्या रकामंेताील त्याचा दिहुस्सा, असाे अज्ञानां मंूल वा सांबंदिता उपीदिजल्हुादिकारी यांच्या सांयुक्ता नांावानांे उघडलेल्या खात्याता जमंा कारण्याता येईल. जमंा काेलेली अशाी नांुकासानांभारपीाईचाी रक्कामं, अशा अज्ञानां मंुलाचाे वाय अठीरा वार्षे पीूणेग झाल्यानांतार, त्याला प्रदानां कारण्याता येईल.

(ग) जर मंृता व्यक्ताीचाी पीत्नांी/ पीताी आदिणे मंुले दिजवांता नांसाताील तार, नांुकासानांभारपीाईचाी रक्कामं, मंृता व्यक्ताीच्या आई-वादिडलांनांा प्रदानां कारण्याता येईल.

(२) मंृता व्यक्ताी अज्ञानां असाल्यासा, नांुकासानांभारपीाईचाी रक्कामं, पीुढीलप्रमंाणे असाेल :–

(का) नांुकासानांभारपीाईचाी रक्कामं, मंृता व्यक्ताीच्या आई - वादिडलांनांा प्रदानां कारण्याता येईल;

(ख) जर आई-वाडील दिजवांता नांसाताील तार, मंृता व्यक्ताीच्या भावांडांनांा सामंानां रक्कामं दाेण्याता येईल. जर भावांडे अल्पीवायीनां असाताील तार, पीोट-दिनांयमं (१) च्या खंड (ख) च्या उपी-खंड (२) च्या तारताुदाी, योग्य त्या फेरफारांसाहु, लागू हुोताील.

(३) जर मंृता व्यक्ताीच्या कायदाेशाीर वारसांच्या बाबताीता, काोणेताहुी वादा उद्भावाला तार, उत्तरादिकार प्रमंाणेपीत्रा सादार काेल्यानांतारचा काेवाळे नांुकासानांभारपीाईचाी रक्कामं प्रदानां कारण्याता येईल.

(४) नांुकासानांभारपीाईचाी चाळेीसा टक्काे रक्कामं, मंजुरी दाेणेाऱ्या प्रादिकाऱ्यानांे, ताी ज्या व्यक्ताीला मंजूर काेलेली आहुे त्या व्यक्ताीच्या खात्याता जमंा कारण्याता येईल आदिणे नांुकासानांभारपीाईचाी साठी टक्काे रक्कामं, अशा व्यक्ताीच्या मंादिसाका व्याज दिमंळेणेाऱ्या मंुदाता ठीेवा खात्याता दाहुा वार्षेासाठी जमंा कारण्याता येईल. दाहुा वार्षेानांतार, मंुदाता ठीेवाीचाी मंुदाता सामंाप्ता झाल्यावार, अशा खात्याताील रक्कामं त्या व्यक्ताीला प्रदानां कारण्याता येईल.

(५) बळेी पीडलेल्या काुटं बाताील सादास्याचा गंभाीर आजार, शाैक्षेदिणेका प्रयोजनां वा दिवावाहु यासाठी, मंजुरी दाेणेाऱ्या प्रादिकाऱ्याच्या पीूवाग पीरवानांगीनांे, मंुदाता ठीेवाीताील रक्कामं, काढीता येऊ शाकाेल.

७. पशु जीवांची हानी किंकंवा पशु

ंना इजा पोहचल्येास, नुकसानभरपाई प्दान करण्येाची कायेषपध्दती.–

(१) पीशाु जीवांचाी हुानांी झाल्यासा दिकांवा पीशाु ंनांा इजा पीोहुचाल्यासा, पीशाु ंचा मंालका, नांुकासानांभारपीाईचा दावा कारण्यासाठी त्या क्षेत्रावार अदिकारिरता असाणेाऱ्या सांबंदिता वानांक्षेत्रापीालाकाडे, अठ्ठेचाळेीसा तासांच्या आता, नांमंुनांा- दाोनांमंध्ये अजग कारील.

(२) पीशाु ंचा मंालका, ताो दिकांवा काोणेताीहुी व्यक्ताी, वानांपीालाकाडूनां दिनांरीक्षेणे कारण्याता येईपीयता, अशा पीशाुचाे शावा घटनांास्र्थळेावारूनां हुलदिवाले जाणेार नांाहुी याचाी काळेजी घेईल, अन्यर्था, ताो नांुकासानांभारपीाईसाठी पीात्रा असाणेार नांाहुी.

(३) वानांक्षेत्रापीाल, खंड (का) खालील अजग प्राप्ता झाल्यावार, घटनांास्र्थळेासा भाेट दाेण्यासाठी आदिणे असा अजग प्राप्ता झाल्याच्या दिदानांांकापीासाूनां ताीनां दिदावासांच्या आता, आवाश्यका ताी चाौकाशाी कारण्यासाठी सांबंदिता वानांपीालासा दिनांदाेशा दाेईल. वानांपीाल, अशा चाौकाशाीनांतार, पींचानांामंा कारील.

(४) वानांपीाल मंृता झालेल्या दिकांवा जखमंी झालेल्या पीशाुचाी, शासाकाीय पीशाुवाैद्यकाीय अदिकाऱ्याकाडूनां तापीासाणेी कारूनां घेईल. शासाकाीय पीशाुवाैद्यकाीय अदिकारी, मंृता झालेल्या दिकांवा जखमंी झालेल्या पीशाुचाी तापीासाणेी काेल्यानांतार, पीशाुचा मंृत्यू दिकांवा इजा, वान्य प्राण्यामंुळे झाली आहुे दिकांवा नांाहुी याचाी दिवादिशाष्ट दिनांरीक्षेणे नांदादिवाल्यावार, वानांपीालाला वाैद्यकाीय प्रमंाणेपीत्रा दाेईल. वानांपीाल, पींचानांाम्यासाहु त्याचा अहुवाल आदिणे असाे वाैद्यकाीय प्रमंाणेपीत्रा वानांक्षेत्रापीालासा सादार कारील.

(५) वानांक्षेत्रापीाल, वानांपीालाचा अहुवाल प्राप्ता झाल्यानांतार, पीशाुच्या बाजार मंूल्याचाे मंूल्यादिनांागरणे कारील. वानांक्षेत्रापीाल, असा अजग वा त्याच्या दिवादिशाष्ट दिशाफारशांसाहु आवाश्यका असालेले सावाग दास्ताऐवाज, सावाग बाबताीता पीरिरपीूणेग असालेला अजग प्राप्ता झाल्यापीासाूनां वाीसा दिदावासांच्या आता, साहुायका वानांसांरक्षेकासा पीाठीवावाीता.

(६) जेर्थे पीशाु ंनांा प्रवाेशा कारण्यासा प्रदिताबं आहुे अशा राष्ट्रीय उद्यानांाच्या दिकांवा अभायारण्याच्या काोणेत्याहुी क्षेत्राता अशा भाग चार-अ-२०–१अ४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, फेब्रुवारी १, २०२४/माघ १२, शके १९४५ पीशाुनांे प्रवाेशा काेला असाेल आदिणे अशा क्षेत्राताील वान्य प्राण्यानांे पीशाुला ठीार मंारले असाेल तार, अजगदार, या अदिदिनांयमंाखालील नांुकासानांभारपीाईसाठी पीात्रा असाणेार नांाहुी.

(७) जर, काोणेत्याहुी वान्य प्राण्याचा, घटनांेच्या दिठीकाणेापीासाूनां दाहुा दिकालोमंीटरच्या पीरिरघाता, दिवार्षेबाेमंुळे साहुा दिदावासांच्या आता मंृत्यू झालाअसाेल तार, अशा पीशाुचा मंालका, या अदिदिनांयमंान्वाये नांुकासानांभारपीाई दिमंळेण्यासा पीात्रा असाणेार नांाहुी.

८. किंपकांचे व फेळेझाडांांचे नुकसान झाल्येास किंकंवा मालमत्तेचे नुकसान झाल्येास नुकसानभरपाईचे प्दान

करण्येाची कायेषपध्दती.–

(१) दिपीकांचाे दिकांवा फळेझाडांचाे नांुकासानां झाल्यासा, मंालका, या अदिदिनांयमंान्वाये प्रदाेय असालेली नांुकासानांभारपीाई दिमंळेण्यासाठी, जेर्थे असा हुल्ला झाला असाेल त्या क्षेत्रावार अदिकारिरता असाणेाऱ्या सांबंदिता वानांक्षेत्रापीालाकाडे, बहुात्तर तासांच्या आता, नांमंुनांा - ताीनांमंध्ये अजग कारील.

(२) दिपीकांचाे दिकांवा फळेझाडांचाे नांुकासानां झाल्यासा, त्या क्षेत्राचा वानांरक्षेका, काृर्षेी साहुायका वा तालाठी यांचा सामंावाेशा असालेली सादिमंताी, सांयुक्तापीणे शाेताचाी पीाहुणेी कारील आदिणे वान्य प्राण्यामंुळे झालेल्या नांुकासानांीचाे मंूल्यदिनांागरणे कारील आदिणे अहुवाल तायार कारील आदिणे अजग दिमंळेाल्याच्या तारखेपीासाूनां दाहुा दिदावासांच्या आता, अहुवाल, वानांक्षेत्रापीालासा सादार कारील.

(३) जंगली हुत्तीमंुळे मंालमंत्तेचाे नांुकासानां झाल्यासा, मंालका, या अदिदिनांयमंान्वाये प्रदाेय असालेली नांुकासानांभारपीाई दिमंळेण्यासाठी, जेर्थे असा हुल्ला झाला असाेल त्या क्षेत्रावार अदिकारिरता असाणेाऱ्या सांबंदिता वानांक्षेत्रापीालाकाडे, बहुात्तर तासांच्या आता, नांमंुनांा- ताीनांमंध्ये अजग कारील.

(४) जंगली हुत्तीमंुळे मंालमंत्तेचाे नांुकासानां झाल्यासा, त्या क्षेत्राचा वानांक्षेत्रापीाल, सावागजदिनांका बांकामं दिवाभागाचा कादिनांष्ठी अदिभायंता वा तालाठी दिकांवा ग्रामंसाेवाका यांचा सामंावाेशा असालेली सादिमंताी, नांुकासानांीचाी पीाहुणेी कारील वा मंूल्यदिनांागरणे कारील आदिणे अजग दिमंळेाल्याच्या तारखेपीासाूनां दाहुा दिदावासांच्या आता, पींचानांामंा कारील. अशा घटनांेता, सादिमंताीकाडूनां पींचानांामंा वा नांुकासानांीचाे मंूल्यदिनांागरणे पीूणेग हुोईपीयता, अजगदार, काोणेताीहुी गोष्ट हुलदिवाणेार दिकांवा घटनांास्र्थळेाचाे दिचात्रा बदालणेार नांाहुी दिकांवा दाुरुस्ताीचाे काोणेताेहुी कामं कारणेार नांाहुी .

(५) वानांक्षेत्रापीाल, पीोट -दिनांयमं (३), वा यर्थास्थिस्र्थदिता, पीोट-दिनांयमं (४) मंध्ये दिनांदिदागष्ट काेलेल्या सादिमंताीचा अहुवाल प्राप्ता झाल्यानांतार, अजग वा अशा सादिमंताीचा अहुवाल त्याच्या दिवादिशाष्ट दिशाफारशांसाहु, तात्काळे, साहुायका वानांसांरक्षेकांकाडे पीाठीवाील.

(६) पीुढील प्रकारणेी नांुकासानांभारपीाई प्रदाेय असाणेार नांाहुी :–

(का) जर लागवाडीखालील जमंीनां हुी, वानां जदिमंनांीवारील दिनांयदिमंता नां काेलेले अदिताक्रमंणे असाेल तार;

(ख) जदिमंनांीच्या मंालकानांे दिकांवा लागवाडदारानांे, घटनांेच्या दिदानांांकापीासाूनां गेल्या ताीनां वार्षेामंध्ये भारताीय वानां अदिदिनांयमं, १९२७ (१९२७ चा १६) दिकांवा वान्य जीवा (सांरक्षेणे) अदिदिनांयमं, १९७२ (१९७२ चा ५३) या खालील काोणेताहुी अपीरा काेलेला असाेल तार.

९. व्येाज दर.– जर नांुकासानांभारपीाईचाे प्रदानां कारण्यासा, वानांक्षेत्रापीालासा, सावाग बाबताीता पीरिरपीूणेग असालेला अजग दिमंळेाल्याच्या दिदानांांकापीासाूनां ताीसा दिदावासांपीेक्षेा अदिका दिवालंब झाला असाेल तार, नांुकासानांभारपीाईच्या रक्कामंेसाहु, नांुकासानांभारपीाईच्या रकामंेवार दार साल साहुा टक्काे दारानांे व्याज प्रदाेय असाेल.

(2) In case of permanent disability, major or minor injury to humans.–

(a) In case of permanent disability, major or minor injury to humans caused due to attack of wild animal, an application for the compensation payable under the Act shall be made in Form I, by the injured person himself or any other person from his family to the Range Forest Officer having jurisdiction over the area where such attack has occurred, within forty-eight hours of such incident. The applicant shall also submit alongwith such application a medical certificate of examination of the victim conducted by the Medical Officer.

(b) The Range Forest Officer shall, on receipt of an application under clause (a), direct the Forester to visit the spot and conduct necessary inquiry within three days from the date of receipt of such application. The Forester shall draw a Panchnama after such inquiry. The Forester shall submit his report alongwith a Panchnama to the Range Forest Officer.

(3) The Range Forest Officer shall, after receipt of the report of the Forester, forward the application alongwith his specific recommendation to the Assistant Conservator of Forest within twenty days of the receipt of application complete in all respects.

(4) The injured or deceased person shall not be eligible for receipt of any compensation if the incident of attack by wild animal has taken place while the concerned person is contravening any of the provisions of the Wild Life (Protection) Act 1972 (53 of 1972) or any rules made thereunder.

6. Payment of compensation in case of loss of human life.–

(1) In case the deceased is an adult, the payment of compensation shall be as follows, namely :–

(a) If the spouse of the deceased is alive, the spouse and children shall be given equal share.

(b) If the spouse is not alive,–

(i) the compensation shall be equally divided amongst all the surviving children if all are major;

(ii) if the child is minor, then his share of the amount of compensation shall be deposited into an account opened in the joint name of such minor and the concerned Deputy Collector. Such deposited amount of compensation shall be paid to such minor child after he attains the age of eighteen years.

(c) If the spouse and children of the deceased are not alive, the amount of compensation shall be paid to the parents of the deceased.

(2) In case the deceased is a minor, the payment of compensation shall be as follows, namely :–

(a) the amount of compensation shall be paid to the parents of the deceased.

(b) if the parents are not alive, the siblings of the deceased shall be given equal amount. If the siblings are minor, then the provisions of sub-clause (ii) of clause (b) of sub-rule (1) shall, mutatis mutandis apply.

(3) If any dispute arises in respect of the legal heirs of the deceased, the amount of compensation shall be paid only after submitting the succession certificate.

(4) The forty per cent. of the compensation amount shall be deposited in the account of the person to whom it is awarded by the Sanctioning Authority and sixty per cent. of the compensation amount shall be deposited in monthly interest bearing fixed deposit account of such person for ten years. After ten years on maturity of fixed deposit, the amount in such account shall be paid to such person.

(5) The amount in the fixed deposit may be withdrawn with prior approval of the Sanctioning Authority for critical illness, educational purposes and marriage of member of the family of the victim.

7. Procedure for payment of compensation in case of loss of cattle life or injury to cattle.–

(1) In case of loss of cattle life or injury to cattle, the owner of the cattle shall make an application within forty-eight hours in Form II for claiming compensation to the concerned Range Forest Officer having jurisdiction over the area.

(2) The owner of the cattle shall take care that he or any person shall not move the carcass of the cattle from the spot of the incident till inspection is carried out by Forester, otherwise he shall not be eligible for compensation.

(3) The Range Forest Officer shall, on receipt of an application under clause (a), direct the concerned Forester to visit the spot and conduct necessary inquiry within three days from the date of receipt of such application. The Forester shall draw a Panchnama after such inquiry.

(4) The Forester shall get the deceased or injured cattle examined by the Government Veterinary Officer. The Government Veterinary Officer shall, after examination of the deceased or injured cattle, give Medical Certificate to the Forester after recording specific observations whether death or injury of cattle is caused by wild animal or not. The Forester shall submit his report alongwith a Panchnama and such Medical Certificate to the Range Forest Officer.

(5) The Range Forest Officer shall, after receipt of report of the Forester, assess the market value of the cattle. The Range Forest Officer shall forward the application and all necessary documents alongwith his specific recommendations to the Assistant Conservator of Forests within twenty days of receipt of application complete in all respects.

(6) If the cattle has entered any area of the National Park or Sanctuary where entry of such cattle is prohibited and is killed by wild animal in such area, then the applicant shall not be eligible for compensation under the Act.

(7) If any wild animal dies due to poisoning within six days from the date of incident in the radius of ten kilometers from the place of incident, then the cattle owner of such animal shall not be eligible for receipt of the compensation under the Act.

8. Procedure for payment of compensation in case of damage to crops and fruit plants or damage

to property.–

(1) In case of damage to the crops or fruit plants, the owner shall make an application within seventy-two hours in Form III for compensation payable under the Act to the concerned Range Forest Officer having jurisdiction over the area where such attack has occurred.

(2) In case of damage to crops or fruit plants, the Committee comprising of Forest Guard, Agriculture Assistant and Talathi of the area shall jointly inspect the farm and assess the quantum of damage due to wild animal and prepare a report and submit it to the Range Forest Officer within ten days from the date of receipt of an application.

(3)In case of damage to the property by wild elephant, the owner shall make an application within seventy-two hours in Form III for compensation payable under the Act to the concerned Range Forest Officer having jurisdiction over the area where such attack has occurred.

(4) In case of damage to property by wild elephant, the Committee comprising of the Range Forest Officer, Junior Engineer of Public Works Department and Talathi or Gramsevak of that area shall inspect and assess the damage and draw a Panchnama within ten days from the date of receipt of an application. In such incident, the applicant shall not remove anything or modify the scene of incident or carry out any work of repair till the Panchnama and assessment of damage is completed by the Committee.

(⁶) The compensation shall not be payable in respect of the following cases, namely :– (a) if the cultivation land is an un-regularized encroachment on forest land;

(b) if the owner of the land or cultivator has committed any offence under the Indian Forest Act, 1927 (16 of 1927) or the Wild Life (Protection) Act, 1972 (53 of 1972) within last three years from the date of incident.
