BY DIRECTOR OF TOWN PLANNING

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT. 1966.—

ORDER

No.D.T.P.-D. P. Ballarpur-Sec-127(2)-Order-TPV-II-553-2024:—

Whereas, the Development Plan of Ballarpur Municipal Council has been partly sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government. in Urban Development Department vide Notification No. TPS-2202-CR-2(B)-2004-UD-9. dated 18th August, 2005 (hereinafter referred to as "the said Notification") & has come into force with effect from dt.1st October, 2005. (hereinafter referred to as "the said Sanctioned Development Plan") and the Excluded Plan has been sanctioned by Government in Urban Development Department vide Notification No. TPS-2202-260-CR-2-2004-UD-9, dated18th June, 2008 & has come into force with effect from dt.17th July2008.;

And whereas, in the said Sanctioned Development Plan, out of the area admeasuring approximately 1.62 Ha. of the land bearing S.No. 31/42 of Mouza Ballarpur is partly affected by the Reservation Site No. 45, "Stadium" (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the acquisition and development of the said Reservation is Municipal Council, Ballarpur (hereinafter referred to as "the said Appropriate Authority");

And whereas, the land affected by the said Reservation have not been acquired by the said Appropri- ate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force;

And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S.No. 31/42 admeasuring area approximately 1.62 Ha. which is partly affected by the said Reservation (hereinafter referred to as "the said Land") had served a notice as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 17th January, 2019;

And whereas, the said land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127 (1) of the said Act have been taken by the Appropriate Authority within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of Section 127 of the said Act;

And whereas, the Hon'ble High Court. Mumbai, Nagpur Bench in the order dt. 26th October, 2023 in Writ Petition No. 8257/2022 (hereinafter referred to as "the said Writ Petition") has passed an order that, the said Reservation on the said Land have lapsed as per the provisions of Section 127 of the said Act:

And whereas, Municipal Council. Ballarpur vide Marathi letter No. ह्यम् 3307/2023, dated 12th December, 2023 has communicated that Since, out of the total land under Reservation No. 45 'Stadium' (5.58Ha.), the land admeasuring 2.02 Ha. was transferred to District Sports Officer by the order४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र १-७, २०२४/द्ध १२-१८, ॅ १९४५ of Collector. Chandrapur, as per the decision of General Body vide Resolution dt. 30th June, 2018 to acquire the remaining land through private negotiation. Then as per the letter of consent given by the land owners, when the request was made to the Collector, Chandrapur on 3rd May, 2019 regarding making the said land available for the stadium, it could not be completed as there was no correspondence from the Collector Office. In the intervening period, Shri. Patel and others issued a notice under Section 127 of the said Act on Municipal Council regarding S. No. 31/42 Area 1.62 Ha. on 17th January, 2019. Then after the approval of General Body Resolution No. 04, dt. 18th February, 2020 to initiate the land acquisition proceedings, this office submitted the land acquisition proposal to Collector. Chandrapur on 26th June, 2020. Meanwhile, the Sub Divisional Officer, Ballarpur informed this office on 21st April 2022 about the querries in the proposal about 2 years after receiving the purchase notice. This office informed applicant Shri. Patel about the querries. However, Shri. Patel filed Writ Petition No. 8257/2022 in the Hon'ble High Court Mumbai, Bench Nagpur. In the said Writ Petition, the Hon'ble High Court passed an order on 26th October, 2023 and has directed the Government to publish the Order under 127(2) of the Maharashtra Regional and Town Plan- ning Act, 1966. No revision petition has been filed by the City Council against the said order';

And whereas, the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur vide letter No. 2767, dt. 22th December, 2023 has submitted report stating that, in consideration of the order passed by the Hon'ble High Court. Mumbai, Nagpur Bench, it would be appropriate to issue an order that, the said Reservation have lapsed as per the provisions of Section 127(2) of the said Act;

And whereas, after considering the above facts in respect of the land bearing S. No. 31/42 admeasur- ing 1.18 Ha area under the said Reservation out of total 1.62 Ha. area in the said Sanctioned Development Plan, the Di.rector of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reserva- tion on the area admeasuring 1.18 Ha. of the said land;

And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR- 508-UD-13, dt. 1st December, 2016, has delegated the powers exercisable by it as per the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority. to the Director of Town Planning, Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as speci- fied in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of area admea- suring 1.18 Ha. of the said land as per the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:—

2. Whereas, the Development Plan of Ballarpur Municipal Council has been partly sanctioned as per the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government. in Urban Development Department vide Notification No. TPS-2202-CR-2(B)-2004-UD-9. dated 18th August 2005 (hereinafter referred to as "the said Notification") & has come into force with effect from dt.1st October 2005. (hereinafter referred to as "the said Sanctioned Development Plan") and the Excluded Plan has been sanctioned by Government in Urban Development Department vide Notification No. TPS-2202-260-CR-2-2004-UD-9, dated18th June 2008 & has come into force with effect from dt.17th July 2008.;

And whereas, in the said Sanctioned Development Plan, area admeasuring approximately 0.81 HA.

of the land bearing S.No. 31/43 of Mouza Ballarpur is partly affected by the Reservation Site No. 45, "Stadium" (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the acquisi- tion and development of the said Reservqtion is Municipal Council, Ballarpur (hereinafter referred to as "the said Appropriate Authority");

And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S.No. 31/43 admeasuring area approximately 0.81 HA. which is partly affected by the said Reservation (hereinafter referred to as "the said Land") had served a notice as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 5th March 2016 and 13th April 2018;

And whereas, the Hon'ble High Court. Mumbai, Nagpur Bench in the order dt. 26th October 2023 in Writ Petition No. 8256/2022 (hereinafter referred to as "the said Writ Petition") has passed an order that, the said Reservation on the said Land have lapsed as per the provisions of Section 127 of the said Act:

And whereas, Municipal Council. Ballarpur vide Marathi letter No. ह्यम्-3305/2023, dated 12th December 2023 has communicated that, Since, out of the total land under Reservation No. 45 'Stadium' (5.58HA.), the land admeasuring 2.02 HA. was transferred to District Sports Officer by the order of Collector. Chandrapur, Pursuant to the said land owner's Notice dated 5th March 2016, as per the decision of General Body vide Resolution No. 2 dt. 10th August 2017, it was requested through Municipal Council to Hon. Collector Chandrapur to make available Shri Akhade's land free of cost in case of breach of conditions. Also report was called for regarding the allotment of the said land from Tahsldar. After that,८ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र १-७, २०२४/द्ध १२-१८, ॅ १९४५ Mr. Akhade and others re-issued the Notice dt. 13th April 2016 under Section 127 of the said Act on Munici- pal Council After approval of General Body Resolution No. 13, dt. 30th June 2018 regarding the request for funds for land acquisition of the said land. Mr. Akhade and other land holders affected by reservation were called to the Nagar Parishad to discuss allotment of land through private negotiation. After the said dis- cussion Mr. Akhade gave the consent letter to the Municipal Council regarding land acquisition through private negotiation. After that, the District Sports Officer, Chandrapur was requested by the Municipal Council to acquire the said land However, in the meantime, Shri Akhade and others filed Writ Petition No. 8256/2022 in the Hon'ble High Court Mumbai, Bench Nagpur. In accordance with the said Petition, the Hon'ble High Court passed an order on 26th October 2023 directed the Government to publish the Order under 127(2) of the Maharashtra Regional and Urban Planning Act, 1966. No revision petition has been filed by the Municipal Council against the said order';

And whereas, the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur vide letter No. 2768, dated 22th December 2023 has submitted report stating there in that, in consideration of the order passed by the Hon'ble High Court. Mumbai, Nagpur Bench, it would be appropriate to issue an order that, the said Reservation have lapsed as per the provisions of Section 127(2) of the said Act; And whereas, after considering the above facts in respect of the land bearing S. No. 31/43 admeasur- ing 0.762 HA. area under the said Reservation out of total 0.81 HA. area in the said Sanctioned Develop- ment Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation on the area admeasuring 0.762 HA. of the said land;

And whereas, the Government in Urban Development Department as per the provisions of Section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR-508-UD13, dated 1st December 2016, has delegated the powers exercisable by it as per the provisions of Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority. to the Director of Town Planning, Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as speci- fied in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of area admea- suring 0.762 Ha. of the said land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—

NOTIFICATION

No. TPS-2423-281-CR-88-2023-UD-9.—

Whereas, Development Plan of Kalmeshwar City (Revised + Additional area) has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide Notification TPV- 2/4287, dated the 21st July, 1992 (hereinafter referred to as " the said Development Plan ") under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") and has come into force with effect from the 1st October, 1992 ;

And whereas, in the said Development Plan, the land bearing Survey No. 924/1 area admeasuring 3.94 Hector of Mouje Kalmeshwar (hereinafter referred to as " the said Land "), is included in Agricultural Zone (hereinafter referred to as " the said Use ") ;

And whereas, the Kalmeshwar Municipal Council being the Planning Authority (hereinafter referred to as " the said Planning Authority"), vide its Resolution No. 08, dated the 24th June, 2008, has resolved to change the allocation of the said land from the said use and include the same in Residential Zone and after following the procedure laid down under sub section (1) of section 37 of the said Act, submitted a proposal to the Government, for its sanction, vide its letter date 4th February, 2020. (hereinafter referred to as " the said Proposed Modification.") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that land admeasuring 2.74 Ha. out of 3.94 Ha. as per updated 7/12 of the said proposed Modification, should be sanctioned with some conditions ;

And whereas, the Land Owner of the said lands have deposited Rs. 8,69,950/- towards the 50% Government share of 5% premium amount as per the value of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 8th September 2023 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 8,69,950/- payable to the Planning Authority has been deposited with the Chief Officer, Municipal Council, Kalmeshwar on 08-09-2023 ;

Now therefore, in exercise of the powers conferred on it under sub section (2) of section 37 of the said Act, the Government hereby, sanctions the Proposed Modification subject to conditions, and for the purpose amends the aforesaid Notification dated 21st July, 1992 as follows ;

In the Schedule of Modifications appended to the Notification dated 21 July, 1992 sanctioning the said Develop- ment Plan, the following new entry shall be added after the last entry :—

ENTRY

Land bearing Survey number 924/1 area admeasuring 2.74 Hector of Mouje Kalmeshwar is deleted from Agriculture Zone and land thus released is included in Residential Zone as shown on the plan, subject to the conditions mentioned specified below—

Condition No. 1 :–In the layout of the said Land, in addition to 10% compulsory open space as per the prevailing Development control Regulation for Kalameshwar City, it will be compulsory to provide an additional 10% amenity space.

Condition No. 2 :–It is necessary to construct compound wall around the open space.

Condition No. 3 :–It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage & drainage etc.

Condition No. 4 :–If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer, Kalameshwar Municipal Council in relation to development of basic amenities as per the stages given below. :—

(A) After final approval of layout

. . Sale of 25% of the total Plots shall be permissible (B) After completion of 40% of Civic Amenities . . Sale of 50% of the total Plots shall be permissible (C) After completion of 60% of Civic Amenities . . Sale of 75% of the total Plots shall be permissible (D) After completion of 80% of Civic Amenities . . Sale of 90% of the total Plots shall be permissible (E) After completion of 100% of Civic Amenities . . Sale of 100% of the total Plots shall be permissible In the case of violation of the above, the layout and non-agriculture permission will be eligible for revocation.

If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given unless all the basic amenities are fully developed.

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Kalameshwar Municipal Council during office hours on all working days for a period of one month.
