क्रमांक प्रादुविअ/नाशिक/सह/क/अंतरीम आदेश/शिवशक्ती शे.मे.पा. संघ/४८३/१५००/२०२३.----महाराष्ट्र सहकारी संस्था अधिनियमाचे कलम १०२(१)(क)(चार) व १०२(२) व १०३ मधील तरतूद विचारात घेऊन मी, चंद्रशेखर बारी, विभागीय उप निबंधक, सहकारी संस्था (दुग्ध) नाशिक विभाग, नाशिक या आदेशान्वये शिवशक्ती धुळे जिल्हा, शेळी-मेंढी उत्पादन व प्रक्रिया सहकारी संघ मर्यादित, शहादा, संघ अवसायनात घेणेसाठी दिनांक ९ नोव्हेंबर २०२३ रोजी पारीत केलेले अंतरिम आदेश या आदेशान्वये अंतिम करीत आहे. तसेच कलम १०३ मधील तरतुदीप्रमाणे श्री. वाय. व्ही. राजपूत, लेखापरिक्षक, श्रेणी-१, सहकारी संस्था उडते पथक (पदुम), धुळे, यांची अवसायक म्हणून केलेली नेमणूक कायम करीत आहे. सदरचा अंतिम आदेश माझ्या सही व शिक्क्यासह दिला असे.

क्रमांक प्रादुविअ/नाशिक/सह/क/नोंदणी रद्द/साक्री ता.दु. संघ, साक्री/४४३/१३९४/२०२३.----महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०९ मधील तरतुदीनुसार साक्री तालुका, दुग्ध उत्पादक व कृषिपूरक उद्योग सहकारी संघ मर्यादित, साक्री, जिल्हा धुळे या दुग्ध संघाचे अवसायक कामकाज समाप्त झाल्याचे जाहीर करीत आहे व सदर संघाची महाराष्ट्र सहकारी संस्था अधिनियम अन्वये केलेली नोंदणी कलम २१ मधील तरतुदीनुसार रद्द करीत आहे. तसेच कलम ११० मधील तरतुदीनुसार नोंदणी रद्द दुग्ध संघाच्या नावे अधिशेष मालमत्ता आढळून आल्यास ती निबंधकाकडे विहित होईल व अशा अधिशेषमत्तेचा निबंधकाच्या पूर्वमंजुरीने विनियोग करण्यासाठी शासकीय परीक्षक म्हणून श्री. शेखर साळी, सहाय्यक निबंधक सहकारी संस्था (दुग्ध) यांची नियुक्ती करीत आहे. या आदेशापासून सदर संस्था निगम निकाय असल्याचे बंद होईल.

सदरचा आदेश आज रोजी माझ्या सही व शिक्यासह दिला असे.

अधिसूचना

आदेश क्रमांक कार्यासन ७/गृह-१/आर.आर/२३८०/२३.----- मी, जिल्हाधिकारी तथा जिल्हादंडाधिकारी, कोल्हापूर या शासन निर्णयाद्वारे सोबत जोडलेल्या नावाच्या अनुसूचीमध्ये विर्िननिष्ट केलेल्या व्यक्तींची कोल्हापूर जिल्ह्यचे विशेष कार्यकारी अधिकारी म्हणून नियुक्ती करीत आहे. ही नियुक्ती सामान्यत: हा निर्णय निर्गमित केल्यापासून पुरस्कार प्राप्त व्यक्तीचे वयाच्या ७० वषार्ंपयर्ंत अस्तित्वात राहील. तसेच राज्य शासन विशेष कार्यकारी अधिकारी यांची ही नियुक्ती वरील कालावधी पूर्ण होण्यापूर्वी केव्हाही, कोणतीही कारणे न देता संपुष्टात आणण्याचा अधिकार मला राहील.

(१) विशेष कार्यकारी अधिकारी पुढे उल्लेख केलेली कर्तव्ये पार पाडण्यासाठी सक्षम राहतील :-----

(एक) या शासन निर्णयाद्वारे केलेल्या विशेष कार्यकारी अधिकारी यांच्या नियुक्त्या "" मानसेवी "" असून त्यांना सोपविण्यात आलेल्या वरील कामांबाबत कोणतेही मानधन, वेतन किंवा भत्ते अनुज्ञेय राहणार नाही.

(दोन) साक्षांकनाचे काम : विशेष कार्यकारी अधिकारी यांना केवळ कागदपत्रांच्या साक्षांकनाचे अधिकार राहतील व त्यांनी मूळ कागदपत्रे प्रत्यक्ष पाहिल्याशिवाय साक्षांकन करू नये. साक्षांकन करताना विहित रबरी शिक्क्यासह सही करून सही खाली दिनांक नमूद करावा. मूळ कागदपत्रापेक्षा वेगळी माहिती नमूद असलेल्या कागदपत्रावर विशेष कार्यकारी अधिकारी यांनी साक्षांकन करू नये. वेगळी माहिती असलेल्या कागदपत्रावर जर सत्यप्रत म्हणून साक्षांकन केल्यास त्यामुळे होणाया सर्व प्रकारच्या परिणामांकरिता विशेष कार्यकारी अधिकारी म्हणून साक्षांकन करणारी व्यक्ती जबाबदार राहील. अशी घटना उघडकीस आल्यास त्या व्यक्तीची विशेष कार्यकारी अधिकारी म्हणून करण्यात आलेली नियुक्ती रद्द करण्यात येईल व तो/ती विशेष कार्यकारी अधिकारी म्हणून पुर्ननियुक्तीस अपात्र असेल.

(तीन) ओळखपरेड : विशेष कार्यकारी अधिकारी म्हणून नियुक्त झालेली व्यक्तींनी ओळख परेड तसेच मृत्युपूर्व जबानी यासाठी उपस्थित राहू नये.

(चार) उत्पन्न प्रमाणपत्र देणे : विशेष कार्यकारी अधिकारी यांनी उत्पन्न प्रमाणपत्र देऊ नये.

(२) विशेष कार्यकारी अधिकारी म्हणून नियुक्त झालेल्या व्यक्तींनी त्यांच्या घरावर/दुकानावर/कार्यालयावर स्वत:च्या नावांसह विशेष कार्यकारी अधिकारी असा फलक लावावा. तथापि त्यांनी कुठल्याही वाहनावर विशेष कार्यकारी अधिकारी असा उल्लेख करू नये. तसेच त्यांच्या नियुक्तीचा कालावधी संपुष्टात आल्यावर लागलीच फलक काढावेत.

(३) नियुक्ती करण्यात आलेल्या विशेष कार्यकारी अधिकायांना मोहोर उमटविण्यासाठी शिक्का नजिकच्या पोलीस स्टेशनकडून उपलब्ध करून घ्यावा. तसेच साक्षांकित केलेल्याची माहिती एका नोंदवहीत न चुकता नमूद करावी व ज्या वेळेस या नोंदवहीची अवलोकनासाठी संबंधित पोलीस आयुक्त/अधीक्षक/जिल्हाधिकारी यांचेकडून मागणी केली जाईल, त्यावेळी ती तात्काळ उपलब्ध करून देण्यात यावी.

(४) या शासन निर्णयान्वये नेमण्यात आलेल्या विशेष कार्यकारी अधिकायांची, शांतता प्रस्तावित करण्यासाठी आवश्यकतेनुसार त्या क्षेत्रातील मोहल्ला समिती/शांतता समितीवर पोलीस आयुक्त, जिल्हा पोलीस अधीक्षक यांनी नियुक्ती करावी.

भाग एक (म.उ.वि.)---१अ४ महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, फेब्रुवारी ८-१४, २०२४/माघ १९-२५, शके १९४५ (५) नियुक्तीचा कालावधी संपुष्टात आल्यानंतर विशेष कार्यकारी अधिकारी यांनी साक्षांकनाचे काम करू नये व सर्व साहित्य जिल्हाधिकारी यांचेकडे तात्काळ जमा करावे. अन्यथा ते पुर्ननियुक्तीस अपात्र ठरतील. नियुक्ती कालावधी संपुष्टात आल्यानंतर विशेष कार्यकारी अधिकारी यांनी साक्षांकन केल्याचे निष्पन्न झाल्यास त्यांचेविरुद्ध फसवणुकीचा गुन्हा नोंदविण्यात येईल.

क्रमांक जिउनि-यवत/वि-२/औषध वि. पत यवत/कलम १५६/५०११/२०२३.----महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, नानासाहेब चव्हाण, जिल्हा उप निबंधक, सहकारी संस्था, यवतमाळ या आदेशान्वये यवतमाळ जिल्हा औषध विक्रेता नागरी सहकारी पतसंस्था मर्यादित, यवतमाळ, तालुका-जिल्हा यवतमाळ, र.न. ११८ या संस्थेच्या संचालक मंडळ यांची सभा २१ सप्टेंबर २०२३ रोजीचे ठरावामध्ये नमूद कर्मचारी/अधिकारी यांना त्यांच्या नावासमोर दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) नियम १०७ नुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०२४ या कालावधीकरिता प्रदान करीत आहे :-----

वरीलप्रमाणे वाचा क्रमांक ३ नुसार संस्थेच्या वसुली अधिकायांना याबाबत सूचित करण्यात येते की, त्यांनी जप्त केलेल्या मालमत्तेचा कर्जदाराकडील ताबा, जोपयर्ंत अशी मालमत्ता सार्वजनिक लिलावात विकली जाणार नाही तोपयर्ंत घेऊ नये.

वरीलप्रमाणे अधिकार खाली नमूद केलेल्या अटी व शर्तीस अधीन राहून प्रदान करण्यात आलेले आहेत :-----

(१) वसुली अधिकारी यांना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१, ९८ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांना दरमहा सोबत जोडलेल्या विहित नमुन्यात ""अ-३"", ""अ-४"" व ""ब"" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे. त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज, त्यांच्या शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी. त्याबाबत नमुना ""अ १"" ""अ २"" व ""अ ४"" सोबत जोडलेला आहे.

(६) मा. उच्च न्यायालय, मुंबई यांनी रीट याचिका क्रमांक १९४२/२०१३, दि बेसन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोेजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०५/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्यांच्या नावापुढे कोठेही "" महाराष्ट्र शासन नियुक्त "" आणि किंवा ""सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे कलम १०७ अन्वये)"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी............... सहकारी बँक/ पतसंस्था........................"" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदारांच्या/जामिनदारांच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनावरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) सहकार आयुक्त कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्रमांक ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकायांनी करावयाची कार्यवाही यामधील मार्गदर्शक सुचनांचे पालन करावे. बँकेचे/पतसंस्थेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायाचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाचमध्ये नमूद केल्याप्रमाणे घ्यावा.

(१४) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.
