THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
NOTIFICATION
No. TPS-2322-651-C.R.54-2022-UD-9.—
Whereas, the Government in Urban Development Department vide Notification No. TPS-2311-2186- CR-249(B)-2011-UD-9, dated 04th April 2012 has partly sanctioned the second development plan for the Gondia City which came into force with effect from the 15th May 2012 and excluded part of the Revised Development Plan has been sanctioned by the Government vide Urban Development Department'sद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र ८-१४, २०२४/द्ध १९-२५, ॅ १९४५ ३ Notification No. TPS-2313-378-CR-160-2013-UD-9, dated the 30th August 2013 (hereinafter referred to as "the said Development Plan") under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing No. 692/1, 692/2 & 693/2 are included in Residential Zone & 18.0 mt. wide Proposed Development Plan road (partly) & Survey No. 717, 721 & 722 are included in Residential Zone of Mouje Kudwa (hereinafter referred to as "the said land");
And whereas, the Gondia Municipal Council, Gondia (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution Dated 22nd February 2023 has resolved to delete 18.00 Mt. wide proposed development plan road from D. B. Science Chowk (Survey No. 692/1, 692/2 & 693/2 of Mouje Kudwa & decide to propose a new 12.00 Mt. wide development plan road in Survey No. 717, 721 & 722, as per the provisions of sub section (1) of section 37 of the said Act, after following the legal proce- dure laid down under the said Act, (hereinafter referred to as "the Proposed Modification") the Planning Authority has submitted the said proposal of Modification to the Government for sanction vide its letter dated 12th May 2023;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra state, Pune, the Government is of opinion that the proposed modification, should be sanc- tioned with some conditions;
And whereas, the Land Owner of the said land have deposited Rs. 2,95,000/- towards the 50% Government share of 5% premium amount as per the value of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2022-2023 in the Government Treasury on 30th November 2023 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 2,95,000/- payable to the Planning Authority has been deposited with the Chief Officer, Gondiya Municipal Council, Gondiya on 30th November 2023;
Now therefore, in exercise of the powers conferred on it under Sub-section (2) of section 37 of the said Act, the Government hereby, sanctions the said Modification proposal and for that purpose amends the said Development Plan Notification as follows.
" In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry -
ENTRY
" 18.00 Mt. wide Development Plan road in Survey No. 692/1, 692/2 & 693/2 of Mouje Kudwa, 18.00 Mt. wide development plan road from western boundary of Survey No. 692 to the eastern boundary i.e. up to nallah, also from the eastern boundary of Survey No. 692 to the southern triangular area affected by the 18.00 Mt. wide road owned by the applicant is deleted and included in residential zone & 12.00 Mt. wide new development plan road is proposed in Survey No. 717, 721 & 722 of Mouje Kudwa, as shown on the Plan, subject to the conditions mentioned specified below -
Condition No. 1.—It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenties in- cluded as road, water supply, sewerage & drainage etc.
Condition No. 2.—It the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer Gondiya Municipal Council, Gondiya in relation to development of basic amenities as per the stages given below.
(a) After final approval of layout Sale of 25% of the total plots shall be permissible.
(b) After completion of 40% basic Amenities. Sale of 50% of the total plots shall be permissible.
(c) After completion of 60% basic Amenities. Sale of 75% of the total plots shall be permissible.
(d) After completion of 80% basic Amenities. Sale of 90% of the total plots shall be permissible.
(e) After completion of 100% basic Amenities. Sale of 100% of the total plots shall be permissible.
A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspec- tion in the office of the Chief Officer, Gondia Municipal Council, Gondia during office hours on all work- ing days for a period of one month.
