PUBLIC NOTICE UNDER SECTION 32 (2) OF MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961 No. S.C.-Present-4-MIDC-Arvi-WS-154-2024.–
Whereas, by the Government Notification, Industries and Labour Department No, IDC 2023- (P.No.689)-Ind-14, dated 4th September, 2023 issued under sub-section (3) of Section 1 of the Maharashtra Industrial Development Act. 1961 (Mah. III of 1962 (hereinafter referred as to "the said Act" ) and published in the Maharashtra Government Gazette, Part 4-B, dated 30th August, 2023 on page No. 1 to 4 in Marathi & Page No. 01 to 11 in English the Govt. of Maharashtra has directed that the provision of Chapter VI of the said Act, shall take effect from the 4th September, 2023 in the area specified in the schedule to that notification;
And, Whereas, the land mentioned in the schedule here to are situated in, area where the provisions of Chapter VI of the said Act, have been taken effect as aforesaid;
And, Whereas, under Section 32 of the said Act, the State Government is empowered to acquire lands in the area to which chapter VI of the said Act has been made applicable and are required for the purpose of the development by the Maharashtra Industrial Development Corporation (hereinafter referred as "the Corporation " ) or for any other purpose in furtherance of the object of the said Act;
द्धन्रु]क्ष् रू न् +रून् ॅ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र १५, २०२४/द्ध २६, ॅ १९४५ ५And, Whereas, Government Notification dated 30th August, 2023 issued under Section 2 clause (c) of the said Act, Department of Industries, Energy and Labor No. I.D.C. 2023-P. No. 689-U-14. The State Government hereby declares that the works entrusted to the Collector under Rule 28 of the Maharashtra Industrial Development Rules, 1962 under Section 32(2), Section 33(2), 36 and 38 of the said Act. The Sub-Divisional Officer, Arvi is specially appointed to carry out;
And Whereas, the Sub-Divisional Officer/Land Acquisition Officer, Arvi is of the opinion that the Lands described in the schedule hereto are required by the Corporation for developments Industrial Area.
Now, therefore, in exercise of the powers of the State Government under sub-section (2) of the Section 32 of the said Act. delegated as aforesaid, the Sub-Divisional Officer/Land Acquisition Officer, Arvi hereby give notice calling upon all the persons having interest and rights in the lands described in the schedule hereto, to show cause in writing to the undersigned before one month from individual notice received under Section 32 (2) as to why the lands described in the schedule should not be acquired for the said purpose.
Any contacts for the disposal of the said lands by sale, lease, mortgage, assignment, exchange or otherwise, or any outlay or improvements made therein without the sanction of the Collector after the date of this notice will, under sub-section (5) of Section 33 of the said Act, read with Section 26 to 30 Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 be disregarded by the Officer assessing compensation for such parts of the said lands as may be finally acquired.
Any person who desire to be heard in person may, after previous appointment appear before the undersigned in person or through his legal constituted attorney between 11.00 a.m. and 1.00 p.m. on any working day within one month from the date of this notice.
