Whereas, the Slum Rehabilitation Authority has formed Slum Rehabilitation Scheme under the provision of section 3B (3) of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 and published in Gazette on 9th April 1998 ;

Whereas, in view of the provision of section 3C (1) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 the Chief Executive Officer, Slum Rehabilitation Authority is empowered to declare any area as "Slum Rehabilitation Area".

Therefore, in view of the said provision of section 3C (1) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971. I, undersigned is hereby declare the area shown in schedule as "Slum Rehabilitation Area". Now, the said area is open to submit scheme of slum rehabilitation as per regulation 33 (10) of Development Control and Promotion Regulation, 2034 for Greater Mumbai.

No. SRA/CA-8/SlumDeclaration/Chavan Chawl/2024.—Wheras the Competent Authority - 8, SRA, Mumbai has been appointed as, under section 3 of the Maharashtra Slum Areas (Improvement, Clearance, Redevelopment) Act, 1971 in respect of all lands having any type of tenure and ownership (except Central Government lands) in Mulund, Bhandup, Kanjur, Hariyali, Vikroli and Ghatkopar revenue villages within Kurla Taluka ;

And Wheras on the basis of the information about the slum areas available, the Competent Authority is satisfied that the areas specified in the Schedule hereto (hereinafter referred to as the said areas) are source of danger to the health, safety or convenience of the public of that area and of its neighbourhood by reason of it being overcrowded and lacking in basic amenities, has been rendered insanitary, squalid, and /or otherwise.

Now, therefore, in exercise of the powers conferred on me under section 4 (1) of the Maharashtra Slum Areas (Improvement, Clearance, Redevelopment) Act, 1971, I, Competent Authority - 8, SRA, Mumbai, declare the said areas to be the Slum Areas.

Whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'MR & TP Act, 1966'), the Planning Authority may, or when so directed by the State Government shall within one month from date of such directions publish a notice inviting suggestions/objections from any person, as mentioned therein and after giving hearing, submit the proposed modification to the State Government and the State Government subject to such condition as it may deem fit sanction the modification or refuse to accord sanction.

And whereas, as per circular u/no. BMC/ADMN/3, dated 7th April 2022, under section 6C (1) of Mumbai Municipal Corporation Act, 1888 (hereinafter referred as 'MMC Act, 1888') all the powers of the Corporation are now vested with the Administrator.

And whereas, Administrator (Improvement Committee) accorded sanction u/n 71, dated 7th February 2024 & Administrator (Corporation) has accorded sanction to the said proposal vide resolution u/no. 1256, dated 8th February 2024, to Change in designation of plot bearing CTS No. 1406/A/16/E, Survey No. 504(pt.) of village Malad South of Goregaon Sports Club from Existing Amenity of Recreation Ground (EOS 2.6) to Existing Amenity of Club/Gymkhana (EOS 2.1) and Reservation of Sports Complex/ Stadium (ROS 2.5) in DP 2034 & to invite suggestions/objections from general public u/s. 37(1) of MRTP Act, 1966 and to approach State Govt. in Urban Development Dept. for final sanction u/s. 37(2) of MRTP Act, 1966 for the proposed modification in Sanctioned DP 2034.

And whereas, as per the powers conferred by sub-section (1) of Section 31 of the MR & TP Act, 1966, State Government has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai.

And whereas, As per Sanctioned DP 2034, the land bearing CTS No.1406/A/16/E of village Malad South is affected by the existing amenity of Recreation Ground (ROS 2.6) and Existing Road namely Link Road. The plot is situated in Commercial Zone (C).

And whereas, the proposal for above modification is approved by Administrator (Improvement) vide No. 71, dated 7th February 2024 and further approved by Administrator (Corporation) vide resolution No. 1256, dated 8th February 2024.

And whereas, Administrator (Corporation) has proposed to change the designation of existing amenity on the land bearing CTS No. 1406/A/16/E of village Malad South, admeasuring 41740.00 Sq.m. from Recreation Ground (EOS 2.6) to designation of Club/Gymkhana (EOS 2.1) and reservation of Sports Complex/ Stadium (ROS 2.5) in sanctioned DP 2034 as shown in plan u/no. ChE/DP/10931/ WS, dated 17th January 2024.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed modification, as required by Section 37(1) of the said Act, for information of all persons likely to be affected thereby. BMC is further pleased to inform that any objections/suggestions in respect of the proposed modification mentioned above may be forwarded, in writing before the expiry of one month from the date of publication of this notification, to the office of
