BY DIRECTOR OF TOWN PLANNING

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

ORDER

No.-D.T.P.-D.P.Mul-Sec.-127(2)-Order-TPV-II-684-2024.—

Whereas, the Development Plan of Mul (Partly) Municipal Council has been sanctioned under the provisions of section 31 (1) of Maharashtra Regional & Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") by Government in Urban Development Department vide Notification No. TPS-2298-CR- 102-98-443-2005-UD-9, dt. 25th October 2001 (hereinafter referred to as " the said Notification ") & has come into force with effect from 15th December 2001, (hereinafter referred to as " the said Sanctioned Development Plan ") ;

And whereas, in the said Sanctioned Development Plan, area admeasuring approximately 0.91 Ha. of the land bearing S. No. 84 of Mouza Mul is affected by the Reservation Site No. 19, " Garden " (hereinafter referred to as " the said Reservation ") and the Planning and the Appropriate Authority for the acquisition and development of the said Reservastion is Municipal Council, Mul (hereinafter referred to as " the said Planning Authority ") ;

And whereas, the Land affected by the said Reservation have not been acquired by the said Planning Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force ;

And whereas, the concerned land owner Shri Vilas Gajanan Karkade (hereinafter referred to as " the said Land Owner ") of the Land bearing S. No. 84 admeasuring area approximately 0.91 Ha. which is affected by the said Reservation (hereinafter referred to as " the said Land ") after serving a notice as per the provisions of section 127(1) of the said Act, (hereinafter referred to as " the said Notice ") on the said Planning Authority on 11th November 2012, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of section 127(1) of the said Act have been taken by the Planning Authority within the stipulated period ;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the order dt. 26th October 2023, in Writ Petition No. 5865/2022. (hereinafter referred to as " the said Writ Petition ") has passed an order that, the said Reservation on the said Land has lapsed as per the provisions of section 127 of the said Act ;

And whereas, in the order passed by Hon'ble High Court, taking into consideration the letter from the then Chief Officer dt. 24th June 2016, assuming that the Land owner have served notice on the said Planning Authority and Noting the incontrovertible position that land acquisition has not been done so far, the Hon'ble High Court has declared the said Reservation on the said Land as lapsed ;

And whereas, Municipal Council, Mul vide Marathi letter No. द्धा-ह्य..ह्यम्.-२७९, dtd. 21st September 2023 has communicated that, ' The Hon'ble High Court, Mumbai, Nagpur Bench vide judgement dated 26th July 2023 has passed an order that, the Reservation No. 19 " Garden " on S. No. 84, Area 9100 sq.m. has lapsed under section 127 of the Said Act and directed to publish the notice of lapsing in the Gazette. Municipal Council has no objection to publish the said notice ' ;

And whereas, Assistant Director of Town Planning, Chandrapur Branch vide letter No. 2067, dt. 25th September 2023 and 194, dt. 19th January 2024 has also submitted report stating therein that, in consideration of the order passed by the Hon'ble High Court, Mumbai, Nagpur Bench, it would be appropriate to issue an order that, the said Reservation have lapsed as per the provisions of Section 127(2) of the said Act ;

And whereas, with reference to the proposal submitted vide letter dt. 15th December 2023 by Directorate of Town Planning, in regard to the fact raised by the Chief Officer, Municipal Council, Mul, the State Government has directed to issue the order under Section 127(2) of the said Act, as the government Pleader has opined it being not necessary to file the Review Petition in the said case ;

And whereas, after considering orders passed by Hon'ble High Court and the aforesaid instructions from Government, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127(2) of the said Act ;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dt. 1st December 2016, has delegated the powers exercisable by it as per the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/ Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said Land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows :—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :—

No. D.T.P.-D.P.Hinganghat-Sec.-127(2)-Order-TPV-II-897-2024.—

Whereas, the Development Plan of Hinganghat Municipal Council (Revised + AA) has been sanctioned under the provisions of section 31 (1) of Maharashtra Regional & Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") by Government in Urban Development Department vide Notification No. TPS- 2905-3248-CR-121(A)-2005-UD-9, dated 26th April 2006 (hereinafter referred to as " the said Notification ") & has come into force with effect from 15th June 2006, (hereinafter referred to as " the said Sanctioned Development Plan ") ;

And whereas, in the said Sanctioned Development Plan, land bearing S. No. 87 and 96 of Mouza Shahalangadi is affected by the Reservation Site No. 87, " Play Ground " (Total area 0.6 Ha.) (hereinafter referred to as " the said Reservation ") and the Planning and the Appropriate Authority for the acquisition and development of the said Reservastion is Municipal Council, Hinganghat (hereinafter referred to as " the said Planning Authority ") ;

And whereas, the Land affected by the said Reservation have not been acquired by the said Planning Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force ;

And whereas, the concerned land owner Shri Kishor Suryabhanji Naukarkar (hereinafter referred to as " the said Land Owner ") of the Land bearing S. No. 96/4 admeasuring area 1.03 Ha. which is affected by the said Reservation (hereinafter referred to as " the said Land ") had serving a notice as per the provisions of section 127(1) of the said Act, (hereinafter referred to as " the said Notice ") on the said Planning Authority on 26th September 2018.

And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127(1) of the said Act have been taken by the Planning Authority, within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of Section 127 of the said Act ;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the order dated 13th October, 2023 in Writ Petition No. 767/2022 (hereinafter referred to as " the said Writ Petition ") has passed an order that, the said Reservation on the said Land have lapsed as per the provisions of Section 127 of the said Act ;

And whereas, Municipal Council, Hinganghat vide Marathi letter No. -दह.ह्यम्-ॅह्यम्-३६०-२३, dated. 22nd Novem- ber, 2023 has communicated that, ' The Notice under of Section 127 of the Maharashtra Regional and Town Planing Act, 1966 issued by the applicant has been received by the office of Municipal Council, Hinganghat on 26th Spetember, 2018. After receiving the said notice, the necessary action has not been taken by the authority within the prescribed period i. e. 24 months. Pursuant to the said notice, the Writ Petition No. 767/2022 has been filed in the Hon'ble High Court and Hon'ble High Court vide court order dated 13th October, 2023 has accepted the demand of petitioner to declare the subject reservation as lapsed ;

And whereas, Joint Director of Town Planning, Nagpur Division, Nagpur vide letter No. 68, dated. 11th January 2024 has submitted report stating therein that, in consideration of the order passed by the Hon'ble High Court, Mumbai, Nagpur Bench, it would be Planning to take a proper decision. In the report also mentions that, out of the said land approximately 3263.0 sq. m. area is affected by the said Reservation ;

And whereas, as per the said Sanctioned Development Plan, the Layout Plan for the said Land has been recom- mended for demarcation by the Assistant Director of Town Planning, Wardha Branch office on dated 7th July, 2010 and in the Layout Plan, the area of reservation for " Primary School " is mentioned as 3263.0 Sq. m.. As per the sanctioned Layout Plan of the said Land, the part of said Reservation is shown as plot No. 20 and as per sub division of said Land, area as per 7/12 extract of this land is approximately 3263.0 sq. m. ;

And whereas, after considering the above facts in respect of the said reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue an order as per the provisions of Section 127 (2) of the said Act regarding the lapsing of the said reservation on an area of approximately 3263.0 sq. m. of the said land ;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated. 1st December 2016, has delegated the powers exercisable by it as per the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation on the said Land as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows :—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :—

Whereas, the Development Plan of Umred Municipal Council has been Partly sanctioned as per the provisions of Section 31 (1) of Maharashtra Regional & Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as " the said Act ") by Government in Urban Development Department vide Notification१० द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र २२-२८, २०२४/त्र्ॅा ३-९, ॅ १९४५ No. TPS-2498-287-CR-25-98-UD-9, dated 8th July, 2003 (hereinafter referred to as " the said Notification ") & has come into force with effect from 25th August, 2003, (hereinafter referred to as " the said Sanctioned Development Plan ") ; and the Excluded Plan has been sanctioned by the Government in Urban Development Department vide Notification No. TPS-2498-287-CR-25-98-UD-9, dated 19th July 2005 & has come into force with effect from dated 05th September 2005 ;

And whereas, in the said Sanctioned Development Plan, areas admeasuring approximate 4200 sq. mt. and 4000 sq. mt. of land bearing S. No. 2 of Mouza Belgaon are affected by the Reservation Site No. 39, " Shopping Center & Vegetable Market " and Reservation Site No. 40, " Primary School ", (hereinafter referred to as " the said Reservation ") and the Appropriate and Planning Authority for the acquisition and development of the said Reservastion is Municipal Council, Umred (hereinafter referred to as " the said Appropriate Authority ") ;

And whereas, the Land affected by the said Reservation has not been acquired by the said Appropritate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force ;

And whereas, the concerned land owner (hereinafter referred to as " the said Land Owner ") of the Land bearing S. No. 2 which is affected by the said Reservation (hereinafter referred to as " the said Land ") had served a notice as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as " the said Notice ") on the said Appropriate Authority on 10th July, 2020.

And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of Section 127(1) of the said Act have been taken by the Appropriate Authority, within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of Section 127 of the said Act ;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the order dated 27th June, 2023 in Writ Petition No. 5508/2022 (hereinafter referred to as " the said Writ Petition ") has passed an order that, the said Reservation on the said Land have lapsed as per the provisions of Section 127 of the said Act ;

And whereas, Municipal Council, Umred vide letter No. 608/2023 dated 6th September, 2023 has communicated that, ' the Municipal Council informed the applicant vide letter dated 25th February 2021 and 30th June 2021 to attend a discussion with the officer of the Municipal Council and the Chief Officer for granting transferable development rights. But since the applicant was absent both times, assuming that the applicant was not willing to take the transferable development right, the Municipal Council vide letter No. 362 dated 27th July, 2021 has submitted Land acquisition proposal to Land Acquisition Officer. Thereafter, The Collector, Nagpur appointed Sub Divisional Officer alis Special Land Acquistion Officer, Umred for the said land acquisition. The Sub Divisional Officer alis Land Acquisition Officer, Umred vide letter No. 140, dated 9th March, 2022, has informed for joint measurment. Thereafter, paying the required fee for measurement, Deputy Superintendent, Bhumi Abhilek, Umred vide letter No. 2891, dated 15th September, 2022, has been reported that, the area to be acquired could not be demarcated as it was unable to determine the boundaries of the area to be acquired at the time of actual measurment, therefore report has been submitted that it would be necessary to take a action as per the order of the High Court ;

And whereas, Assistant Director of Town Planning, Nagpur Branch, Nagpur vide letter No. 2496, dated. 18th October 2023 has submitted report stating therein that, in consideration of the order passed by the Hon'ble High Court, Mumbai, Nagpur Bench, it would be Appropriate to issue an order that, the said Reservation have lapsed as per the provisions of Section 127(2) of the said Act ;

And whereas, after considering the above facts in respect of the said reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of Section 127 (2) of the said Act, regarding the lapsing of reservation Site No. 39 " Shopping Center & Vegetable Market " and Reservation Site No. 40, " Primary School " on land bearing S. No. 2 of Mouza Belgaon, admeasuring areas Appropriate 4200 sq. mt. and 4000 sq. mt. respectively ;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated. 1st December 2016, has delegated the powers exercisable by it as per the provisions of Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said Land bearing S. No. 2 as per the provisions of Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follws :—

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :—

Note :—(1) The said Land so released from the said Reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent Land under the said sanctioned Development Plan.

(2) A copy of the part plan of the said sanctioned Development Plan showing the areas of the said Land which are lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Umred, District Nagpur during office hours on all working days for inspection to public upto one month.

(3) This Order shall also be published on the Directorate's official website. www.dtp.maharashtra.gov.in.
