आशिणे ज्य ाअथाी, महाराष्ट्र ासंनाच्या नगराशिवकासं शिवभागाकडील अशिसंूचना क्रमांक शिपुीबी-४३१७/६२९/संीआरा- ११८(III)/२०१७/नशिव-११, शिदोनांक १२ नोव्हांबीरा २०१८ राोजीच्या ुशिपुत्राकान्वये बीृहान्मु ंबीई महानगरापुाशिलका शिवकासं शिनयंत्राणे व प्राोत्संाहान शिनयमावली मंजूरा झोालेली असंून ती शिदोनांक १३ नोव्हांबीरा २०१८ पुासंून अंमलात आलेली आहाे. (यापुढे ज्याचा उल्लेख " उक्त शिनयमावली " या प्रामाणे कराण्यात आला आहाे) ;
आशिणे ज्याअथाी, महाराष्ट्र् ासंनाच्या गृहाशिनमागणे व शिवेष संहाय्य शिवभागाने १६ शिडीसंबीरा १९९५ च्या अशिसंूचना क्रमांक झोपुयो १०९५/प्रा.क्र-३७/गृहाशिनमागणे संेल, अन्वये महाराष्ट्र झोपुडीपुट्टी (संुाराणेा, शिनमू गलन व पुनशिवगकासं) अशिशिनयम, १९७१ मील कलम ३(अ) मील तरातुदोीच्या अशिन राहाून " झोपुडीपुट्टी पुनवगसंन प्राशिकराणेाची " शिनयुक्ती केली आहाे. (यापुढे ज्याचा उल्लेख "उक्त प्राशिकराणे" या प्रामाणे कराण्यात आला आहाे) ;
आशिणे ज्याअथाी, उक्त अशिशिनयमातील कलम २(१९)(बी) नुसंारा उक्त प्राशिकराणेासं बीृहान्मु ंबीई क्षेत्रात झोपुडीपुट्टी पुनवगसंन योजना राबीशिवण्याकरिराता संदोरा अशिशिनयमात अशिभाप्राेत असंणेारा शिनयोजन प्राशिकराणेाचा दोजाग शिदोलेला असंून त्यानुसंारा उक्त अशिशिनयमातील कलम ३७(१-बी) अन्वये मंजूरा शिवकासं योजनेमध्ये फेराबीदोल प्रास्ताशिवत कराण्यासंबींीचा प्रास्ताव तयारा करून ासंनासं संादोरा कराण्याचा उक्त प्राशिकराणेासं अशिकारा प्राप्त झोाला आहाे ;

आशिणे ज्याअथाी, झोपुडीपुट्टी पुनवगसंन योजने अंतगगत / झोपुडीपुट्टी पुनवगसंन क्षेत्रांतगगत/ घोशिषत झोपुडीपुट्टी क्षेत्रात / झोपुडीपुट्टी पुनवगसंन प्राशिकराणेाच्या कायगक्षेत्रात, महाराष्ट्र प्रादोेशिक व नगराराचना अशिशिनयम, १९६६ चे कलम ३७(१-बी) व इतरा योग्य त्या कलमाखाली मु ंबीई शिवकासं आराखड्यात आवश्यकतेनुसंारा फेराबीदोल, संुाराणेा इत्यादोी कराण्याचे प्रास्ताव मांडीण्याचे झोपुडीपुट्टी पुनवगसंन प्राशिकराणेाचे अशिकारा, मुख्य कायगकाराी अशिकाराी, झोपुडीपुट्टी पुनवगसंन प्राशिकराणे यांना प्राशिकराणेाच्या शिदोनांक ७ जून २००४ राोजीच्या बीैठकीत बीाबी शिप्पुणेी क्र.१२.६ अन्वये प्रादोान कराण्यात आलेले आहाेत ;
आशिणे ज्याअथाी, बीृहान्मु ंबीई महानगरापुाशिलका क्षेत्रातील," जी/दोशिक्षेणे " शिवभाग, येथाील मौजे-वराळी शिवभाग, ता-मु ंबीई हारा, येथाील न.भाू.क्र.२२५(भाग) (यापुढे ज्याचा उल्लेख " उक्त जमीन " या प्रामाणे कराण्यात आला आहाे) हाी झोपुडीपुट्टी वसंाहात असंून ती " शिहारा ेठ पुाराेखवाडी एसं. आरा. ए. संहा. गृहा. संस्था (शिनयो)" या नावाने ओळीखली जाते (यापुढे ज्याचा उल्लेख " उक्त झोपुडीपुट्टी संोसंायी " या प्रामाणे कराण्यात आला आहाे) व संदोरा शिमळीकतीवरा महाराष्ट्र अशिशिनयम क्रमांक २८ महाराष्ट्र झोपुडीपुट्टी (संुाराणेा, शिनमू गलन आशिणे पुनशिवगकासं) अशिशिनयम, १९७१ मील कलम ४(१) अन्वये " झोपुडीपुट्टी क्षेत्रा (Slum Area)" घोशिषत कराण्यात आले आहाे ;
आशिणे ज्याअथाी, उक्त झोपुडीपुट्टी संोसंायीने उक्त जशिमनीवराील प्रास्ताव शिवकशिसंत कराण्यासंाठी "मे.नॉथाग रिराअल्ी शिबील्डीसंग प्रा. शिल." या शिवकासंकाची शिनयुक्ती केलेली आहाे. (यापुढे ज्याचा उल्लेख " उक्त शिवकासंक " या प्रामाणे कराण्यात आला आहाे) ;
आशिणे ज्याअथाी, उक्त जशिमनीचा शिवकासं झोपुडीपुट्टी पुनवगसंन योजने अंतगगत उक्त शिनयमावलीच्या शिवशिनयम क्र. ३३(१०) च्या तरातुदोीनुसंारा कराण्याचे प्रास्ताशिवत केले असंून, उक्त प्राशिकराणेाने उक्त जशिमनीवराील उक्त झोपुडीपुट्टी संोसंायीचा झोपुडीपुट्टी पुनशिवगकासं योजनेचा प्रास्ताव स्विस्वकृत केला आहाे ;
आशिणे ज्याअथाी, उक्त जमीन उक्त शिवकासं योजनेमध्ये भाग: " RMS ६.१ (Storm water Pumping Station)" या आराक्षेणेाने (यापुढे ज्याचा उल्लेख " उक्त आराक्षेणे " या प्रामाणे कराण्यात आला आहाे) व भाग: " EMS६.१+EMS४.३ (Storm Water Pumping Station+ Sewage Pumping Station)" या अस्विस्त्वातील वापुराने (यापुढे ज्याचा उल्लेख " उक्त अस्विस्त्वातील वापुरा " या प्रामाणे कराण्यात आला आहाे) बीाशित हाोत आहाे ;
आशिणे ज्याअथाी, उक्त जशिमनीवराील उक्त शिवकासं योजनेमील उक्त आराक्षेणेाने बीाशित हाोणेाराे अंदोाशिजत क्षेत्रा ४१०.७८ चौ.मी. व उक्त अस्विस्त्वातील वापुराने बीाशित हाोणेाराे अंदोाशिजत क्षेत्रा १२५.१२ चौ.मी. बीदोलून त्याऐवजी " Rehabilitation and Resettlement(RR २.१)" हाे आराक्षेणे प्रास्ताशिवत कराण्यासंाठी उक्त शिवकासंकाने शिवनंती केली आहाे;
आशिणे ज्याअथाी, उक्त जशिमनीवराील झोपुडीपुट्टी पुनवगसंन योजनेची अंमलबीजावणेी हाोणेच्या दोृष्ीने केलेली शिवनंती शिवचारात घोेतल्यानंतरा उक्त जमीनीवराील उक्त आराक्षेणेाचा व उक्त अस्विस्त्वातील वापुराचा वापुरा बीदोलून " Rehabilitation and Resettlement(RR २.१)" हाे आराक्षेणे कराणे या फेराबीदोलाकरिराता उक्त अशिशिनयमातील कलम ३७ (१बी) प्रामाणेची कायगवाहाी कराणे आवश्यक आहाे, असंे उक्त प्राशिकराणेाचे मत झोाले आहाे (यापुढे ज्याचा उल्लेख " उक्त फेराबीदोल " असंा कराण्यात आला आहाे.).
आशिणे त्याअथाी, आता उक्त अशिशिनयमातील कलम ३७ मील उपु कलम (१बी) अनुसंारा उक्त प्राशिकराणे खालील अनुसंूचीमध्ये शिवश्लेशिषत केल्यानुसंाराच्या प्रास्ताशिवत फेराबीदोला संदोभागत आम नागरिराकांकडीून संूचना आशिणे/शिकंवा हाराकती मागशिवण्याची संूचना प्राशिसं कराीत आहाे. संदोराची संूचना शासन राजपत्रात प्राशिसं झोाल्याच्या शिदोनांकापुासंून १ (एक) मशिहान्यात संूचना आशिणे/शिकंवा हाराकती मुख्य कायगकाराी अशिकाराी, झोपुडीपुट्टी पुनवगसंन प्राशिकराणे, शितसंरा मजला, प्रासंकीय इमारात, प्राो. अनंत काणेकरा मागग, वांद्रे(पुूवग),महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, फेब्रुवारी २७, २०२४/फेाल्गुन ८, शके १९४५ ३ मु ंबीई ४०००५१ यांचेकडीे दोाखल कराण्य ात याव्यात. शिवशिहात मुदोतीत प्राप्त हाोणेाऱ्या संूचना आशिणे/शिक ंवा हाराकती झोपुडीपुट्टी पुनवगसंन प्राशिकराणेाकडीून शिवचारात घोेण्यात येतील ;

No. SRA/DDTP/Modification/ Hirasheth Parikhwadi SRA CHS (Prop)./ Worli division/Mumbai City/CTS No.225 (pt)/2024/88.
Whereas, the Revised Development Plan 2034 Of Greater Mumbai Municipal Corporation Area (hereinafter referred to as " the said Development Plan") has been sanctioned by the State Government in the Urban Development Department, partly under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") vide Notification No.TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 and the said Development Plan came into force from 1st september 2018 ;
And whereas, the revised Development Control and Promotional Regulations for Greater Mumbai Municipal Corporation Area have been sanctioned by the State Government vide Urban Development Department's Corrigendum Notification No.TPB-4317/629/CR-118(III)/2017/UD-11, dated 12th November 2018 (hereinafter referred to as " the said DCPR ") and the said DCPR came into force with effect from 13th November 2018 ;
And whereas, the Government of Maharashtra vide Notification of Housing and Special Assistance Department No. SRD 1095/CR-37/Housing Cell, dated 16th December 1995 has appointed " Mumbai Slum Rehabilitation Authority " under the provisions of section 3 (A) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 for its jurisdiction. (hereinafter referred to as "the said Authority ") ;
And whereas, according to the provisions of section No. 2 (19) (b) of the said Act the said Authority has been declared as the Planning Authority for the purpose of implementation of Slum Rehabilitation Scheme in its jurisdiction and according to the provisions of section No. 37 (1-B) of the said Act, the said Authority has been empowered for initiating modification in the said Development Plan and submit it to Government ;
And whereas, the Chief Executive Officer of the said Authority has been empowered to initiate modification to the said Development Plan under the provisions of sub section (1-B) of section 37 of the said Act and call upon suggestions/objections from public by the resolution No. 5/6/4 dated 28th August, 1997 of the said Authority ;
And whereas, the Chief Executive Officer of the said Authority has been empowered and authorized to make modification or correction etc. in the sanctioned Development Plans in the areas of Slum Rehabilitation Scheme/Slum Rehabilitation Area/Notified Slum Area under their jurisdiction as stipulated in section 37(1-B) of the said act and to submit proposal to the state Government for sanction under the provision of section 37 of the said Act, vide their Resolution No.12.6, dated 07th June 2004 ;
And whereas, the lands bearing CTS No. 225 (pt.) of Village Worli Division, Taluka Mumbai City, Ward " G/S " (hereinafter referred to as " the said land ") are Slum Areas and this Slum is popularly Known as "Hirasheth Parikhwadi SRA CHS (Prop)." and the said land is declared as " Slum Area " under section 4(1) of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (hereinafter referred to as " the said Slum Society ");
And whereas, the said Slum Society has appointed " North Reality Builders Private Limited " for the development of their proposal on the said land (hereinafter referred to as " the said Developer ") ;
And whereas, it is proposed to develop the said land under regulation no.33(10) of the said DCPR and the said Authority has accepted Slum Rehabilitation Scheme proposal of the said Slum Society on the said Land ;
And whereas, in the said Development Plan the said land is partly shown as Reservation for " RMS 6.1 (Storm water Pumping Station) " (hereinafter referred to as " the said Reservation ") and महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, फेब्रुवारी २७, २०२४/फेाल्गुन ८, शके १९४५ ५ partly shown as existing use EMS6.1+EMS4.3 "(Storm Water Pumping Station+ Sewage Pumping Station) " (hereinafter referred to as " the said Existing Use");
And whereas, the said developer has requested to modify the said Reservation on the said land having area admeasuring approximately 410.78 sq.m. and the said Existing Use having area admeasuring approximately 125.12 sq.m. from the said Reservation and the said Existing Use to "Rehabilitation and Resettlement (RR 2.1) ";
And whereas, after considering the request of the said developer, for the planned implementation of the scheme the said Authority is of the opinion that it is necessary to initiate the procedure under section 37(1B) of the said Act to modify the purpose of the said Reservation and the said Existing Use to "Rehabilitation and Resettlement (RR 2.1)" (hereinafter referred to as " the said Modification").
Now therefore, in accordance with the provisions contained in sub-section (1B) of section 37 of the said Act, the said Authority hereby publishes this notice for inviting suggestions and/or objections in respect of the proposed modification described in the schedule herein below, from the general public within 1 (one) month from the date of publication of the notice in the Maharashtra Government Gazette. The suggestion and/or objections shall be addressed to the Chief Executive Officer, Slum Rehabilitation Authority, Third Floor, Administrative Building, Prof. Anant Kanekar Marg, Bandra (E.), Mumbai 400 051. The suggestions and/or objections received within the aforesaid stipulated period shall only be considered by the said Authority ;

" The lands bearing CTS No. 225 (part) of Village-Worli Division, Taluka- Mumbai City, Ward "G/S", slum encroached land by Hirasheth Parikhwadi SRA CHS (Prop) Society, which has a reservation for " RMS 6.1 (Storm water Pumping Station) " having an area admeasuring approximately 410.78 sq.m. and the exiting use for " EMS6.1+EMS4.3 (Storm Water Pumping Station+ Sewage Pumping Station) " having an area admeasuring approximately 125.12 sq.m. in the said Development Plan is proposed to be modified as " Rehabilitation and Resettlement (RR 2.1) "
2. A copy of the part plan showing proposed modification shall be kept open for inspection by the general public in the following offices for the period of one month :–
