क्रमांक टिपीएस-१२२१/७१/प्र.क्र.१४१/२३/नवि-१२.-----ज्याअर्थी, मिरा-भाइर्ंदर शहराची सुधारित विकास योजना (यापुढे जिचा उल्लेख उक्त " विकास योजना " असा करण्यात आला आहे) महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे) च्या कलम ३१(१) अन्वये शासन नगरविकास विभागाची अधिसुचना क्रमांक टिपीएस-१२९६/८४७/ प्र.क्र.१६२/९६/नवि-१२, दिनांक १४ मे १९९७ अन्वये मंजूर झाली असून, ती दिनांक १५ जुलै, १९९७ पासून अंमलात आली आहे आणि उक्त विकास योजनेच्या वगळलेल्या भागाची विकास योजना शासन नगरविकास विभागाची अधिसुचना क्रमांक टिपीएस-१२९८/९४१/प्र.क्र.८९/९८/ नवि-१२, दिनांक २५ ऑगस्ट २००० अन्वये मंजूर झाली असून, ती दिनांक १५ ऑक्टोबर २००० पासून अंमलात आली आहे (यापुढे ज्याचा एकत्रितपणे उल्लेख " उक्त अधिसूचना " असा करण्यात आला आहे) ;
आणि ज्याअर्थी, उक्त विकास योजनेमध्ये आ.क्र. ९१-स्टेडीयम, ना-विकास विभाग, इलेक्ट्रॉनिक पार्क झोन, ४५ मी. रुंद विकास योजना रस्ता, इत्यादी प्रस्ताव (यापुढे ज्याचा उल्लेख " उक्त विकास योजना " असा करण्यात आला आहे) दर्शविण्यात आले असून काही क्षेत्र सिआरझेडने बाधित होत आहे ;
आणि ज्याअर्थी, मिरा-भाइर्ंदर महानगरपालिकेने (यापुढे ज्याचा उल्लेख " उक्त महानगरपालिका " असा करण्यात आला आहे) उक्त अधिनियमातील कलम ३७ (१) अन्वयेची सर्व वैधानिक कार्यवाही पुर्ण करून, दिनांक १९ जून २०२० रोजी प्रसिध्द केलेल्या सुचनेसोबत जोडलेल्या भाग नकाशामध्ये दर्शविल्याप्रमाणे भाइर्ंदर (पश्चिम) परिसरातील वसई खाडी ते मिरा-रोड (पश्चिम) येथील बृृहन्मुंबई महानगरपालिका हद्दीपयर्ंत ६०.०० मी. रुंद विकास योजना रस्ता उक्त विकास योजनेमध्ये दर्शविण्याचा फेरबदल प्रस्ताव, दिनांक २२ जानेवारी २०२१ च्या पत्रान्वये शासनाच्या मंजूरीकरिता सादर केला आहे. (यापुढे ज्याचा उल्लेख " प्रस्तावित फेरबदल " असा करण्यात आला आहे) ;
आणि ज्याअर्थी, आवश्यक ती चौकशी केल्यानंतर व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर प्रस्तावित फेरबदल अटीसापेक्ष मंजूर करणे आवश्यक आहे, असे शासनाचे मत झाले आहे.
त्याअर्थी, आता उक्त अधिनियमाच्या कलम ३७ चे पोट-कलम (२) अन्वये व त्याअनुषंगाने शासनास प्राप्त असलेल्या इतर अधिकाराचा वापर करून शासन उक्त विकास योजनेमधील प्रस्तावित फेरबदल अटीसापेक्ष मंजूर करीत आहे आणि त्यासाठी उक्त विकास योजना मंजुरीच्या अधिसूचनेमधील फेरबादलाच्या अनुसुचिमध्ये शेवटच्या नोंदीनंतर पुढील नवीन नोंद समाविष्ट करण्यात येत आहे ;

" विकास योजना भाग नकाशात दर्शविल्याप्रमाणे भाइर्ंदर (पश्चिम) परिसरातील वसई खाडी ते मिरा-रोड (पश्चिम) येथील बृृहन्मुंबई महानगरपालिका हद्दीपयर्ंत ६०.०० मी. रुंद विकास योजना रस्त्याची आखणी मिरा-भाइर्ंदर शहराच्या मंजूर विकास योजना मध्ये खालील अटीसापेक्ष दर्शविण्यात येत आहे.
अट :------ " सदर ६०.०० मी. रुंद विकास योजना रस्त्याच्या आखणीखालील रस्त्याचे काम सुरू करण्यापूर्वी MCZMA ची पर्यायाने पर्यावरण विभागाची ना-हरकत / मान्यता मिरा-भाइर्ंदर महानगरपालिकेने घेणे बंंधनकारक राहील ."
२. सदरचा मंजूर फेरबदल ही अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनाकांपासून अंमलात येईल.
३. उक्त मंजूर फेरबदलाची अधिसूचना व मंजूर फेरबदल दर्शविणारा भाग नकाशा नागरिकांच्या अवलोकनार्थ कार्यालयीन वेळेमध्ये कामकाजाच्या दिवशी खालील नमूद कार्यालयामध्ये एक महिन्याच्या कालावधीकरिता उपलब्ध राहील.
(१) आयुक्त, मिरा-भाइर्ंदर महानगरपालिका, भाइर्ंदर.
(२) सहसंचालक, नगररचना, कोकण विभाग, कोकण भवन, नवी-मुंबई.
(३) सहाय्यक संचालक नगररचना, ठाणे शाखा, जि. ठाणे.
४. सदर अधिसूचना ही महाराष्ट्र शासनाच्या www.maharashtra.gov.in वेबसाईटवर प्रसिद्ध करण्यात आली आहे.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-1221/71/CR-141/23/UD-12.—Whereas, the Revised Development Plan of the city of Mira-Bhayander (hereinafter referred to as " the said Development Plan ") has been sanctioned by the Government in Urban Development Department, under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") vide Notification No. TPS-1296/847/CR-162/96/UD-12, dated the 14th May 1997 (hereinafter referred to as " the said Notification ") and has come into force with effect from 15th July, 1997 and the Excluded Part of the said Development plan has been sanctioned by the Government in Urban Development Department vide Notification No. TPS-1298/941/CR-89/98/UD-12, dated the 25th August, 2000 which came into foce with effect from the 15th October 2000 ;
And whereas, Site No. 91-Stadium, No Development Zone, Electronic Park Zone, 45.00 mt.
Devlopment Plan Road, etc. proposals are shown in the said Development Plan (hereinafter referred to as ' the said Development Plan Proposals ') and some area is affected by the Coastal Regulation Zone ;
And whereas, Mira-Bhayander Municipal Corporation (hereinafter referred to as " the said Municipal Corporation "), after following the legal procedure under sub-section (1) of section 37 of the said Act, has submitted a proposal for modification in the said Development Plan so as to shown the alignment of 60.00 mt. wide Development Plan Road in the said Development Plan from the Vasai Creek of Bhayander (West) area to the Mira Road (West) upto the Brihanmumbai Municipal Corporation boundary as shown on the part plan published with the notice dated 19th June 2020 by the said Municipal Corporation, to the Government for sanction vide letter dated 22nd January 2021 (hereinafter referred to as " the Proposed Modification ") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that it is necessary to sanction the Proposed Modification with condition.
Now therefore, in exercise of the powers conferred under sub-section (2) of Section 37 of the said Act and all other powers enabling it in that behalf, the State Government hereby sanctions the Proposed Modification with condition and for that purpose in the Schedule of modifications appended with the said Notification, after the last entry, the following new entry shall be inserted viz. :—
ENTRY
" the alignment of 60.00 mt. wide Development Plan Road from the Vasai Creek of Bhayander
(West) area to the Mira Road (West) upto the Brihanmumbai Municipal Corporation boundary is
shown in the Development Plan of Mira Bhayander as shown on the part plan of the Development
Plan subject to following condition.

the MCZMA i.e. Enviornment Department before starting the construction of this 60.00 mt. wide
Development Plan Road."
2. The date of publication of this Notification in the Maharashtra Government Gazette is fixed as the date of coming into force of this sanctioned modification.
3. The Part Plan of aforesaid sanctioned modification shall be made available for inspection by the general public during office hours on all working days at the following offices for a period of one month :—
(i) The Commissioner, Mira-Bhayander Corporation, Bhayander.
(ii) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.
(iii) The Assistant Director of Town Planning, Thane Branch, Thane.
