MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
NOTIFICATION
No. TPS-2724-39-CR-08-2024-UD-30.—
Whereas, the Development Plan of Parbhani City (Revised+Additional Area) Dist. Parbhani has been sanctioned by the Government under Section 31 of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Urban Development Department's Notification No. TPS-2718-1837-CR- 167-2018-Part Sanction-UD-30, dated 2nd December, 2021 and has come into force with effect from the 05th May, 2022 (hereinafter referred to as "the said Development Plan") ;
And whereas, in the said Development Plan, the area admeasuring 4.71 Hect. out of total area admeasuring 4.93 Hect. bearing Survey No. 6/4 (3.23 Hect.) and Survey No. 7/1/1 (1.70 Hect.) of Mauje Arni (Rehabilitation), Taluka Arni (hereinafter referred to as "the said Land") is included in Agriculture Zone and the remaining area is affected by 30 Mtr.
wide Development Plan road;
And whereas, as per the provisions of Section 37(1) of the said Act, the Administrator/Chief Officer, Arni Municipal Council, Dist. Yavatmal vide his Resolution No. 02, dated the 31st August, 2023, has resolved to make modification in the said Development Plan, so as to delete the said Land from Agriculture Zone and to include the same in Residential Zone (hereinafter referred to as "the said Proposed Modification") and accordingly submitted the proposal to the Government for sanction vide its Marathi letter No. +-१७१३-२०२२-२३, dated the 12th December 2023;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that, the said Proposed Modification should be sanctioned with some changes and certain conditions;
And whereas, the land owner of the said Land, has deposited 50% the Government share of 5% premium amount of Rs.98,910, for 4.71 Hect. area which is included in Agriculture Zone, as per the rate of said Land as prescribed in the Annual statement of Rates (ASR) for the year 2023-24, in the Government Treasury vide challan, dated the 22nd February, 2024 through the Assistant Director of Town Planning, Yavatmal Branch, Yavatmal and the remaining 50% of the 5% premium amount of Rs.98,910 has been deposited with the Chief Officer, Arni Municipal Council, Dist. Yavatmal, dated the 21st February, 2024;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the said Proposed Modification with some changes and certain conditions, for 4.71 Hect. land bearing Survey No. 6/4 (3.01 Hect.) and Survey No. 7/1/1 (1.70 Hect.) of Mauje Arni (Rehabilitation), Taluka Arni, as shown on plan and for that purpose amends the above said Notification dated the 02nd December, 2021 as follows :-
" In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry.":-
ENTRY
" The land admeasuring 4.71 Hect. bearing Survey No. 6/4 (3.01 Hect.) and Survey No. 7/1/1 (1.70 Hect.) of Mauje Arni (Rehabilitation), Taluka Arni, is deleted from Agriculture Zone and the land so released is included in Residential Zone as shown on plan, subject to following conditions-
Condition No. 1 - While developing the land under modification, in addition to 10% open space, it is mandatory to provide additional 10% amenity space.
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्धक्ष् १४-२०, २०२४/त्र्ॅा २४-३०, ॅ १९४५Condition No. 2 - The abovesaid amenity space shall be developed as per the provision of the Sanctioned Unified Development Control and Promotion Regulations.
Condition No. 3 - It is mandatory for the Land owner/Developer to develop infrastructure amenities, at his own cost.
Condition No. 4 - If the abovesaid infrastructure amenities are proposed to be developed by stages, then sale of plots shall be monitored by the Chief Officer, Arni Municipal Council, Dist. Yavatmal, in relation to expected development of civic amenities as per the stages given below.—
A. After final approval of layout
- sale of 25% of total plots shall be permissible.
B. After completion of 40% of civic Amenities - sale of 50% of total plots shall be permissible.
C. After completion of 60% of civic Amenities - sale of 75% of total plots shall be permissible.
D. After completion of 80% of civic Amenities - sale of 90% of total plots shall be permissible.
E. After completion of 100% of civic Amenities - sale of 100% of total plots shall be permissible.
In case of violation of the above, the layout and non-agriculture permission will be eligible for revocation.
If group housing is to be developed in the layout, occupation certificate should not be issued unless all the infrastructure facilities are developed."
A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Arni Municipal Council, Dist. Yavatmal during office hours on all working days for inspection of public for a period of one month.
This Notification shall also be published on the Government website www.maharashtra.gov.in./Acts & Rules.
