महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६.
ज्याअर्थी, ठाणे शहराची सुधारीत विकास योजना शासनाने महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ चे कलम ३१ (१) नुसार (यापुढे याचा उल्लेख " उक्त अधिनियम " असा केला आहे.) शासन निर्णय क्रमांक टिपीएस-१२९७/१३१९/सीआर-१४८/९७/नवि-१२, दिनांक ४ ऑक्टोबर, १९९९ अन्वये मंजूर केली असून, ती दिनांक २२ नोव्हेंबर १९९९ पासून अंमलात आहे. तसेच सुधारीत विकास योजनेतील वगळलेल्या क्षेत्राची (Excluded Portion) विकास योजना शासन निर्णय क्रमांक टिपीएस-१२०१/२७४/सीआर-२८/२००१/नवि-१२, दिनांक ३ एप्रिल २००३ अन्वये शासनाने उक्त अधिनियमानुसार मंजूर केली असून ती दिनांक १४ मे, २००३ पासून अंमलात आहे. (यापुढे " उक्त मंजूर विकास योजना " असा उल्लेख केला आहे.) ;
आणि ज्याअर्थी, ठाणे महानगरपालिका प्रारुप विकास नियंत्रण नियमावलीत काही बदल करून शासनाने निर्णय क्रमांक टिपीएस-१२९४/ १२५९/सीआर-२२२/९४/नवि-१२, दिनांक २८ एप्रिल १९९५ अन्वये उक्त अधिनियमाचे कलम ३१(१) अन्वये विकास नियंत्रण नियमावली मंजुर केली होती व सदर नियमावली दिनांक १ जून १९९५ पासून अंमलात आली होती ;
आणि ज्याअर्थी, तत्कालीन मंजुर विकास नियंत्रण नियमावलीतील तरतुदीनुसार ठाणे महानगरपालिका हद्दीमध्ये ४४ नागरी पुनरुत्थान आराखडे (यु.आर.पी.) अधिसूचित करून दिनांक ५ मे २०१८ रोजीच्या शासन राजपत्रामध्ये प्रसिद्ध करण्यात आले आहेत ;
आणि ज्याअर्थी, शासन निर्णय क्रमांक टिपीएस-१८१८/प्र. क्र. २३६/१८/कलम ३७ (१कक) (ग) व कलम २०(४)/नवि-१३, दिनांक २ डिसेंबर २०२० अन्वये शासनाने एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावली, मंजुर केली आहे आणि उक्त विकास नियंत्रण नियमावली दिनांक ३ डिसेंबर २०२० पासून अंमलात आली असून सदर नियमावली ठाणे महानगरपालिकेस लागू आहे. (यापुढे " उक्त नियमावली " असा उल्लेख केला आहे) ;
आणि ज्याअर्थी, एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावलीतील विनियम क्र. १४.८.१ च्या खंड १४.८.१ (ii) (b) मध्ये सुधारणा करणेबाबत महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ चे कलम ३७(१कक)(ग) अन्वये शासनाच्या नगरविकास विभागाने शासन निर्णय क्रमांक टिपीएस-१२२२/१०८९/प्र.क्र.७०/२२/नवि-१२, दिनांक २० फेब्रुवारी २०२४ अन्वये फेरबदल मंजूर केला आहे ;

भाग दोन-------२९-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मार्च १५, २०२४/फाल्गुन २५, शके १९४५ आणि ज्याअर्थी, उक्त मंजुर फेरबदलानुसार झोपडपट्टी पुनर्वसन प्राधिकरणाकडील दिनांक २७ जून २०२२ पुर्वीचे विचाराधीन प्रस्तावांचा अधिसुचित नागरी पुनरुत्थान आराखडा/योजनेमध्ये समावेश होत असल्यास उच्चाधिकार समितीच्या संमतीने सदर प्रस्ताव नियमावलीतील विनियम क्र. १४.७ अन्वये विकसित करणे शक्य आहे ;
आणि ज्याअर्थी, मुंबई महानगर प्रदेश झोपडपट्टी पुनर्वसन प्राधिकरण यांनी ठाणे शहराच्या मंजूर नगररचना योजना क्र.१ मधील अंतिम भूखंड क्र. ४२३, ४२४अ, ४२७ पांचपाखाडी, या भूखंडांकरीता झोपडपट्टी पुनर्वसन क्षेत्र घोषित करणेची कार्यवाही दिनांक १८ मार्च २०२० रोजी म्हणजेच उपरोक्त नमुद दिनांक २७ जून २०२२ पुर्वी झालेली असल्याचे कळवून नागरी पुनरुत्थान आराखडा क्र. ९ (सिध्देश्वर) च्या अधिसूचित हद्दीतुन अंतिम भूखंड क्र. ४२३, ४२४अ, ४२७ पांचपाखाडी, या भूखंडांखालील ५.६१ हे. क्षेत्र वगळणेबाबत विनंती केली आहे (यापुढे " प्रस्तावाधिन क्षेत्र " असा उल्लेख केला आहे.) ;
आणि ज्याअर्थी, ठाणे शहराच्या मंजूर नगररचना योजना क्र. १ मधील अंतिम भूखंड क्र. ४२३, ४२४अ, ४२७ पांचपाखाडी, या भूखंडाखालील ५.६१ हे. क्षेत्र यु.आर.पी. क्र. ९ सिध्देश्वरच्या अधिसूचित हद्दीतुन वगळणेस उच्चाधिकार समितीने काही अटींच्या अधिन राहून, दिनांक १४ मार्च २०२४ रोजीच्या बैठकीत संमती दिली आहे ;
आणि ज्याअर्थी, यु.आर.पी. क्र. ९ सिध्देश्वरच्या पुर्वअधिसूचित हद्दीतुन प्रस्तावाधिन क्षेत्र वगळल्यानंतर त्याप्रमाणे यु.आर.पी. क्र. ९ सिध्देश्वरची सुधारीत हद्द व सुधारीत २३.६५ हे. क्षेत्र अधिसूचित करणेचे प्रस्तावित आहे ;
आणि ज्याअर्थी, उक्त नियमावलीतील विनियम क्र. १४.८.१.(ii) (b) च्या तरतुदीनुसार नागरी पुनरुत्थान आराखडा तयार करण्याचे अधिसुचित करण्याचे आणि जेव्हा आवश्यक असेल तेव्हा सुधारीत करण्याचे अधिकार आयुक्त यांना असल्याचे नमूद आहे.
आणि त्याअर्थी, उक्त नियमावलीतील विनियम क्र. १४.८.१ (ii) (b) अन्वये मला प्रदान अधिकारान्वये, ठाणे शहराच्या हद्दीतील यु.आर.पी.क्र.९ सिध्देश्वरच्या यापुर्वीच्या अधिसूचित हद्दीमधुन प्रस्तावाधिन क्षेत्र वगळुन सुधारीत हद्दीचा आराखडा यु.आर.पी.क्र.९ सिध्देश्वर (सुधारीत क्षेत्र अंदाजे २३.६५ हे.) म्हणून अधिसूचित करीत आहे.
सदर अधिसूचित आराखडयाची सुधारीत हद्द दर्शविणारा नकाशा जनतेच्या अवलोकनार्थ खालील ठिकाणी, पुढील तीस दिवसांकरिता ठेवण्यात येत आहे.
(१) उपसंचालक नगररचना, क्लस्टर सेल, ठाणे महानगरपालिका, ठाणे यांचे कार्यालय, चौथा मजला, धर्मवीर आनंद दिघे प्रशासकीय इमारत, कशिश पार्क, ठाणे.
(२) शहर विकास विभाग, चौथा मजला, ठाणे महानगरपालिका, ठाणे.
(३) उथळसर प्रभाग समिती कार्यालय.
ही अधिसूचना व अधिसूचित नकाशा www.tmetp.thanecity.gov.in या संकेत स्थळावर सुद्धा उपलब्ध आहे.

NOTIFICATION

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
Whereas, the Revised Development Plan of the Thane City has been sanctioned by the Government under section 31(1) of the Maharashtra Regional and Town Planning Act 1966, (hereinafter referred to as " the said Act ") vide Notification No.TPS-1297/1319/CR-148/97/UD-12, dated 4th October 1999 which has come into force with effect from 22nd November 1999 and the Excluded Part (EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No.TPS/1201/274/CR-28/2001/UD-12, dated 3rd April 2003 which has come into force with effect from the 14th May 2003 ; (hereinafter referred to as "the said sanctioned Development Plan") ;
And whereas, the Development Control Regulations of Thane Municipal Corporation has been sanctioned by the Government after making some modifications in draft Development Control Regulations of Thane City vide Urban Development Department, vide Notification No. TPS-1294/ 1259/CR-222/94/UD-12, date 28th April 1995 under section 31(1) of the said act which had come into force with effect from the 1st June 1995 ;
And whereas, in pursuant to the provisions of erstwhile sanctioned Development Control Regulations, 44 Urban Renewal Plans (hereinafter referred to as " URP ") are notified in Government Gazette dated 5th May 2018 within the limits of Thane Municipal Corporation ;
And whereas, the Government has sanctioned Unified Development Control and Promotion Regulations vide resolution No.TPS-1818/CR236/18/DP&RP/sec.37 (1AA) (c) & Sec. 20(4)/UD-13, dated 2nd December 2020 (hereinafter referred to as " the said Regulations ") and the said Regulations came into force from dated 3rd December 2020 and are applicable to Thane Municipal Corporation ;
And whereas, Government has sanctioned modification in clause 14.8.1(iii)(g) of the said regulation as per section 37 (1AA)(c) of the said Act vide Notification No.TPS-1222/1089/CR.70/ 22/UD-12, dated 20th February 2024 ;
And whereas, as per the said modification, Slum Redevelopment proposals under consideration with Slum Rehabilitation Authorities before 27th June 2022 on land parcels situated in the notified URP/URS boundary may be allowed to develop under regulation No.14.7 with the consent of High Power Committee (HPC) constituted under regulation No.14.8.8 (ii) ;
And whereas, Mumbai Metropolitan Region Slum Rehabilitation Authority (SRA) has requested to exclude Final Plot No.423, 424A, 427, Panchpakhadi of Sanctioned Town Planning Scheme No.1 admeasuring 5.61 Ha., from the notified boundary of URP No. 9 Siddheshwar as areas under these plots have been notified by SRA dated 18th March 2022 which is before 27th June 2022 (hereinafter referred to as " the said area ") ;
And whereas, High Power Committee, subject to certain conditions, has given its consent to exclude Final Plot No.423, 424A, 427, Panchpakhadi of Sanctioned Town Planning Scheme No.1 from the notified boundary of URP No.9 Siddheshwar in High Power Committee meeting on 15th March 2024 ;
And whereas, after excluding the said area from the earlier notified boundary of URP No. 9, it is proposed to notify the revised area of URP No.9 as 23.65 Ha. and revised boundary of URP No.9 Siddheshwar;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मार्च १५, २०२४/फाल्गुन २५, शके १९४५And whereas, as mentioned in the Regulation No.14.8.1 (ii)(b) of the said Regulations, that Urban Renewal Plan, URS may be for the concerned area, prepared and notified by the Commissioner, who may revise the same, as and when required.
Now, therefore, as per powers conferred upon me vide Regulation no.14.8.1 (ii)(b) of the said Regulations, the revised boundary of URP No.9 Siddheshwar (Revised area approximately 23.65 Ha.) is hereby notified.
The plan showing boundaries of revised Urban Renewal Plan No.9 is kept for inspection by general public at following places for next thirty days :—
(1) Office of the Deputy Director of Town Planning, Cluster Cell, Thane Municipal Corporation, Thane, 4th floor, Dharmveer Anand Dighe Administrative Building, Kashish Park, Thane.
(2) Town Development Department, 4th floor, Thane Municipal Corporation, Thane (3) Uthalsar Ward office.
This notification along with notified plan is also available on website www.tmctp.thanecity. gov.in. Thane, dated 15th March 2024.
