क्रमांक टिपीएस-१२२४/१२/प्र.क्र.२/२४/नवि-१२.----- आणि ज्याअर्थी, शासनाचे सार्वजनिक बांधकाम विभागाचे दिनांक ९ जुलै १९९६ रोजीच्या शासन निर्णयाद्वारे महाराष्ट्र राज्य रस्ते विकास महामंडळाची (यापुढे ज्याचा उल्लेख " एम.एस.आर.डी.सी. " असा करण्यात आला आहे) स्थापना करण्यात आली आहे ;
ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे) च्या कलम ४० मधील तरतुदीनुसार महाराष्ट्र शासनाने दिनांक ४ मार्च २०२४ रोजीची अधिसूचना क्रमांक टिपीएस-१२२४/१२/प्र.क्र.२/२४/ नवि-१२, (यापुढे ज्याचा उल्लेख " उक्त अधिसूचना " असा करण्यात आला आहे) अन्वये कोकण विभागातील पालघर, रायगड, रत्नागिरी आणि सिंधुदुर्ग या जिल्ह्यतील महानगरपालिका, नगरपरिषदा व नगरपंचायती तसेच विशेष नियोजन प्राधिकरणे, विकास प्राधिकरणे या प्राधिकरणांची कार्यक्षेत्रे व गावठाण क्षेत्र वगळता, उर्वरीत क्षेत्राकरिता (यापुढे ज्याचा उल्लेख " उक्त अधिसूचित क्षेत्र " असा करण्यात आला आहे) शहर आणि औद्योगिक विकास महामंडळ (महाराष्ट्र) मर्यादित (सिडको) ची (यापुढे ज्याचा उल्लेख " उक्त महामंडळ " असा करण्यात आला आहे) विशेष नियोजन प्राधिकरण (यापुढे ज्याचा उल्लेख " उक्त विशेष नियोजन प्राधिकरण " असा करण्यात आला आहे) म्हणून नेमणूक केली आहे ;
आणि ज्याअर्थी, उपाध्यक्ष आणि व्यवस्थापकीय संचालक, महाराष्ट्र राज्य रस्ते विकास महामंडळ यांनी कोकण विभागातील पालघर, रायगड, रत्नागिरी आणि सिंधुदुर्ग या जिल्ह्यतील कोकण द्रुतगती महामार्ग (Konkan Expressway)/ कोकण किनार पट्टी महामार्ग इंटरचेंेज/लगत एकूण १३ नव नगरे / ग्रोथ सेंटरच्या एकूण ४४९.८३ चौ. कि.मी. क्षेत्राकरिता महाराष्ट्र राज्य रस्ते विकास महामंडळाची विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्याची विनंती शासनास दिनांक १२ मार्च २०२४ रोजीच्या पत्रान्वये केली आहे, ज्यामध्ये उक्त अधिसूचित क्षेत्रामधील १०५ महसुली गावाचा समावेश आहे (यापुढे ज्याचा उल्लेख " उक्त क्षेत्र " असा करण्यात आला आहे.) ;

भाग एक (को.वि.पु.)--५२-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, मार्च १६, २०२४/फाल्गुन २६, शके १९४५ आणि ज्याअर्थी, आवश्यक ती चौकशी केल्यानंतर उक्त क्षेत्र उक्त महामंडळाच्या उक्त अधिसूचित क्षेत्रामधून वगळणे तसेच उक्त क्षेत्राकरिता उक्त महामंडळाची विशेष नियोजन प्राधिकरण म्हणून असलेली नियुक्ती रद्द करणे व महाराष्ट्र राज्य रस्ते विकास महामंडळाची उक्त क्षेत्राकरिता विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्याचे प्रस्तावित करणे उचित होईल, असे शासनाचे मत झाले आहे.
आणि त्याअर्थी, आता शासन याद्वारे,------
(i) उक्त अधिनियमाच्या कलम १६० मधील तरतुदीनुसार शासनास प्राप्त असलेल्या व इतर सर्व अधिकारांचा वापर करून शहर व औद्योगिक विकास महामंडळाची (सिडको) या अधिसूचनेसाबत जोडलेल्या परिशिष्टामध्ये नमूद केल्यानुसारच्या १३ ग्रोथ सेंटर साठीची विशेष नियोजन प्राधिकरण म्हणून असलेली नेमणूक याद्वारे मागे घेण्यात येत आहे.
(ii) उक्त अधिनियमाच्या कलम ४०(१) मधील तरतुदीनुसार शासनास प्राप्त असलेल्या व इतर सर्व अधिकारांचा वापर करून महाराष्ट्र राज्य रस्ते विकास महामंडळाची या अधिसूचनेसोबत जोडलेल्या परिशिष्टामध्ये नमूद केल्यानुसारच्या १३ ग्रोथ सेंटर साठीची विशेष नियोजन प्राधिकरण म्हणून नेमणूक याद्वारे करीत आहे.
(iii) शासनाने उक्त अधिनियमाचे कलम १५४ अन्वयेे दिलेले निदेश क्र.टिपीएस-१२२४/१२/प्र.क्र.२/२४/नवि-१२, दिनांक १२ मार्च २०२४ यापुढे देखील लागू राहतील.
(iv) उक्त क्षेत्राची विकास योजना तयार करणे तसेच नगररचना विषयक कामकाजाकरिता नगररचना व मुल्यनिर्धारण विभागातील अधिकारी/कर्मचारी यांची एकूण ४१ पदे एम.एस.आर.डी.सी. मध्ये प्रतिनियुक्तीने भरण्यास शासनाने मान्यता दिली असून, त्यानुसार अंमलबजावणी करण्यात यावी.
(v) सदरची अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येईल.
३. सदरची अधिसूचना आणि उक्त १३ ग्रोथ सेंटरच्या अधिसूचित क्षेत्राची हद्द दर्शविणारा नकाशा नागरिकांच्या अवलोकनार्थ खालील कार्यालयामध्ये कार्यालयीन वेळेमध्ये कामकाजाच्या दिवशी एक महिन्याच्या कालावधीकरिता उपलब्ध राहील.
(१) व्यवस्थापकीय संचालक, महाराष्ट्र राज्य रस्ते विकास महामंडळ, नेपियन्सी रोड, मुंबई.
(२) व्यवस्थापकीय संचालक, सिडको, सिडको भवन, सीबीडी बेेलापूर, नवी मुंबई.
(३) जिल्हाधिकारी, पालघर/रायगड/रत्नागिरी/सिंधुदुर्ग.
(४) सह संचालक, नगररचना, कोकण विभाग, कोकण भवन, नवी मुंबई.
(५) सहायक संचालक, नगररचना, पालघर शाखा, जि. पालघर, रायगड शाखा, जि. रायगड, रत्नागिरी शाखा, जि. रत्नागिरी, सिंधुदुर्ग शाखा, जि. सिंधुदुर्ग.
४. सदरची अधिसूचना ही महाराष्ट्र शासनाच्या www.maharashtra.gov.in वेबसाईटवर (कायदे/नियम) प्रसिद्ध करण्यात आली आहे.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No.TPS. 1224/12/CR. 2/24/UD-12.—And whereas, the Maharashtra State Road Development Corporation (MSRDC) (hereinafter referred to as " the MSRDC ") has been established by the Government in Public Works Department vide Government Resolution dated 9th July 1996 ;
Whereas, the Government of Maharashtra has appointed the City and Industrial Development Corporation (CIDCO) (hereinafter referred to as " the said Corporation ") as a Special Planning Authority under the provisions of section 40 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act ") vide Notification No. TPS-1224/12/CR-2/24/ UD-12, dated 4th March 2024 for the areas in the Districts of Palghar, Raigad, Ratnagiri and Sindhudurg excluding the area under Municipal Corporations, Municipal Councils and Nagar Panchayats as well as Special Planning Authorities, Development Authorities and areas under Authorities and Gaothan areas as Special Planning Authority (hereinafter referred to as " the said Notified Area ") ;
And whereas, the Vice Chairman and Managing Director, Maharashtra State Road Development Corporation has requested Government in Urban Development Department vide letter dated 12th March 2024 to appoint the said Corporation as a Special Planning Authority for the 13 New Towns/ Growth Centers, total admeasuring 449.83 Sq. km, of total 105 revenue villages along the Konkan Expressway/ Coastal Highway Interchange/ adjoining, in the Palghar, Raigad, Ratnagiri and Sindhudurg districts in said Notified Area, (hereinafter referred to as " the said Area ") ;
And whereas, after making necessary enquiries, Government is of the opinion that the said Area shall be excluded from the said Notified Area of the said Corporation and the appointment of the CIDCO as a Special Planning Authority shall be withdrawn for the said Area and Government is also of the opinion that for the area so withdrawn from the said Notified Area, MSRDC shall be appointed as a Special Planning Authority.
Now, therefore, Government hereby,—
(i) In exercise of the powers conferred under section 160 of the said Act and all other powers enabling it in this behalf, withdraws the appointment of the City and Industrial Development Corporation (CIDCO) as the Special Planning Authority for the said area under 13 Growth Centers more specifically mentioned in Schedule appended hereto.
(ii) In exercise of the powers conferred under section 40(1) of the said Act and all other powers enabling it in this behalf, appoints the Maharashtra State Road Development Corporation as a Special Planning Authority for the said area under 13 Growth Centers more specifically mentioned in Schedule appended hereto.
भाग एक (को.वि.पु.)--५२-२अ८ महाराष्ट्र शासन राजपत्र असाधारण भाग एक---कोकण विभागीय पुरवणी, मार्च १६, २०२४/फाल्गुन २६, शके १९४५ (iii) Directives under section 154 of the said act given vide Government in U.D.D. letter No. TPS-1224/12/C.R.-2/24/UD-12, dated 12th March 2024 are continued.
(iv) For the preparation of Development Plan and for Town Planning related work etc. Government has sanctioned the proposal to appoint total 41 officers/staff from Town Planning and Valuation Department on deputation basis in MSRDC, accordingly same to be implemented.
(v) Fixes the date of publication of this Notification in the Government Gazette as the date of coming into force of this Notification.
2. Copy of the Notification and plan showing the boundaries of the aforesaid 13 Growth Centers shall be available for inspection for the general public during office hours on all working days at the following offices for a period of one month :—
(i) The Managing Director, Maharashtra State Road Development Corporation Ltd., Nepeance Road, Mumbai.
(ii) The Managing Director, City and Industrial Development Corporation, CIDCO Bhavan, CBD Belapur, Navi Mumbai 400 614.
(iii) The Collector, Palghar, Raigad, Ratnagiri, Sindhudurg District.
(iv) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.
(v) The Assistant Director of Town Planning, Palghar Branch, Raigad Branch, Ratnagiri Branch, Sindhudurg Branch.
