आशि ज्याअथाी, झोपुडीपुट्टी पुनवगसंन योजनेअंतगगत / झोपुडीपुट्टी पुनवगसंन क्षेत्रांतगगत / घोशिषत झोपुडीपुट्टी क्षेत्रात / झोपुडीपुट्टी पुनवगसंन प्राशिकराच्या कायगक्षेत्रात, महाराष्ट्र प्रादोेशिक व नगराराचना अशिशिनयम, १९६६ चे कलम ३७(१-बी) व इतरा योग्य त्या कलमाखाली मु ंबीई शिवकासं आराखड्यात आवश्यकतेनुसंारा फेराबीदोल, संुारा इत्यादोी कराण्याचे प्रास्ताव मांडीण्याचे झोपुडीपुट्टी पुनवगसंन प्राशिकराचे अशिकारा, मुख्य कायगकाराी अशिकाराी, झोपुडीपुट्टी पुनवगसंन प्राशिकरा यांना प्राशिकराच्या शिदोनांक ७ जून २००४ राोजीच्या बीैठीकीत बीाबी शिटप्पुी क्र. १२.६ अन्वये प्रादोान कराण्यात आलेले आहाेत ;

आशि ज्याअथाी, उक्त जमीन बी. के. संी. च्या 'एफे' ब्लॉक मध्ये स्थिस्थात असंून संदोरा क्षेत्राचे उक्त शिनयोजन प्रास्ताव नकामध्ये "Area to be kept unreclaimed" आशि "१५M Wooded Area" या शिनयोजन प्रास्तावाखाली दोगशिवण्यात आली आहाे (यापुढे ज्याचा उल्लेख "उक्त शिनयोजन प्रास्ताव" याप्रामाे कराण्यात आला आहाे) ;

आशि ज्याअथाी, उक्त जशिमनीवराील उक्त शिनयोजन प्रास्ताव मा. संवोच्च न्यायालयातील अशिपुल क्र. १०४६३-१०४६४/२०१६ संहा अशिपुल क्र. ६०६४-६०६५/२०१७ मील आदोेाचा अवमान हाोारा नाहाी याची दोक्षेता घोेण्याच्या अटीसंापुेक्षे फेराबीदोल कराण्यासंाठी उक्त प्राशिकराने कायगवाहाी करावी असंे शिनदोे ासंन, नगराशिवकासं शिवभागाने शिदोनांक १५ माचग २०२४ राोजीच्या पुत्रान्वये शिदोलेले आहाेत ;

आशि ज्याअथाी, मा. संवोच्च न्यायालयाचे आदोेानुसंारा शिमठीनदोी संदोभागत शिनयूक्त तज्ज्ञा संशिमतीच्या शिफेाराी व त्यानुषंगाने बीृहान्मु ंबीई महानगरापुाशिलका आशि एमएमआराडीए यांनी मा. संवोच्च न्यायालयासं संादोरा केलेला पुूतगता अहावाल शिवचारात घोेता उक्त जशिमनीवराील उक्त शिनयोजन प्रास्ताव बीदोलून नकात दोगशिवल्याप्रामाे "वाकोला नाल्यालगत ९.०० मी. रूंदो रास्ता दोगशिवण्यासंहा संदोरा संपुूग जमीन राशिहावासं शिवभागात" संमाशिवष्ट कराेबीाबीत उक्त अशिशिनयमाच्या कलम ३७ (१ - बी) प्रामाे कायगवाहाी कराे आवश्यक आहाे, असंे उक्त प्राशिकराचे मत झोाले आहाे (यापुढे ज्याचा उल्लेख "उक्त फेराबीदोल" याप्रामाे कराण्यात आला आहाे).

आशि त्याअथाी, आता, उक्त अशिशिनयमातील कलम ३७ मील उपुकलम (१बी) अनुसंारा उक्त प्राशिकरा खालील अनुसंूचीमध्ये शिवश्लेशिषत केल्यानुसंाराच्या प्रास्ताशिवत फेराबीदोला संदोभागत आम नागरिराकांकडीून संूचना आशि / शिकंवा हाराकती मागशिवण्याची संूचना प्राशिसंध्दो कराीत आहाे. संदोराची संूचना शासन राजपत्रात प्राशिसंद्ध झोाल्याच्या शिदोनांकापुासंून १ (एक) मशिहान्यात संूचना आशि/शिकंवा हाराकती मुख्य कायगकाराी अशिकाराी, झोपुडीपुट्टी पुनवगसंन प्राशिकरा, शितसंरा मजला, प्रासंकीय इमारात, प्राो. अनंत काेकरा मागग, वांद्रे (पुूवग), मु ंबीई ४०० ०५१ यांचेकडीे दोाखल कराण्यात याव्यात. शिवशिहात मुदोतीत प्राप्त हाोाऱ्या संूचना आशि / शिकंवा हाराकती झोपुडीपुट्टी पुनवगसंन प्राशिकराकडीून शिवचारात घोेण्यात येतील.

[ Under section 37(1-B) of the Maharashtra Regional and Town Planning Act, 1966].

NO. SRA/DDTP/Modification/Sant Dnyaneshwar Nagar and others/Bandra/Tal-Andheri / S.No. 341, CTS No. 629 (Part)/2024/139

Whereas, State Government vide Urban Development and Public Health Department's Notification No. BKR 1177/262-UD-5, dated 7th March 1977 has appointed Mumbai Metropolitan Region Development Authority (hereinafter referred to as "MMRDA") formed under the provisions of Mumbai Metropolitan Region Development Authority Act, 1974 as Special Planning Authority for Bandra-Kurla Complex Notified Area (hereinafter referred to as "B.K.C.") under section 40(1)(c) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") ;

And whereas, the plan of Planning Proposals for the area included in B.K.C. (hereinafter referred to as "the said Planning Proposal Plan") along with Development Control Regulations have been sanctioned by State Government vide Urban Development and Public Health Department's Notification No. BKR 1177/262-UD-5, dated 9th April 1979 under section 40(3)(d) of the said Act ;

And whereas, the Government of Maharashtra vide Notification of Housing and Special Assistance Department No. SRD 1095/CR-37/Housing Cell, dated 16th December 1995 has appointed "Slum Rehabilitation Authority" under the provisions of section 3(A) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971) for its jurisdiction (hereinafter referred to as "the said Authority") ;

And whereas, according to the provisions of section No. 2(19) (b) of the said Act the said Authority has been declared as the Planning Authority for the purpose of implementation of Slum Rehabilitation Scheme in its jurisdiction and according to the provisions of section No. 37 (1-B) of the said Act, the said Authority has been empowered for initiating modification in the said Development Plan and submit it to Government ;

And whereas, the Chief Executive Officer of the said Authority has been empowered to initiate modification to the said Development Plan under the provisions of sub section (1-B) of section 37 of the said Act and call upon suggestions/objections from public by the resolution No. 5/6/4, dated 28th August 1997 of the said Authority ;

And whereas, the Chief Executive Officer of the said Authority has been empowered and authorized to make modification or correction etc., in the sanctioned Development Plans in the areas of Slum Rehabilitation Scheme/Slum Rehabilitation Area/Notified Slum Area under their jurisdiction as stipulated in section 37(1-B) of the said act and to submit proposal to the state Government for sanction under the provision of section 37 of the said Act vide their Resolution No. 12.6, dated 7th June 2004 ;

And whereas, the lands bearing S.No. 341, CTS No. 629 (pt.) of Village Bandra, Taluka-Andheri, Ward "H/E" (hereinafter referred to as "the said land") having approximate area of 66483 sq.m, as shown on plan are Slum Areas and this Slum is popularly Known as "Proposed Sant Dnyaneshwar Nagar SRA CHS and other SRA CHS" (hereinafter referred to as "the said Slum Society") and the slum on the said land is Censused Slum ;

And whereas, the said land is located in 'F' block of B.K.C. and shown as "Area to be kept unreclaimed" and "15 M Wooded Area" (hereinafter referred to as "the said Planning Proposal") in the said Planning Proposal Plan ;

And whereas, State Government vide Urban Development Department's letter dated 15th March 2024 has directed the Said Authority to initiate the modification proposal on the said land for modifying the said Planning Proposal subject to condition that there shall ,not be any contempt of Hon'ble Supreme Court Order in Appeal No. 10463-40464/2016 and Appeal No. 6064-6065/2017 ;

And whereas, considering the recommendations submitted by Technical Committee related to Mithi River and the report based on it submitted by the Brihanmumbai Municipal Corporation and MMRDA in the Hon. Supreme Court, for the planned implementation of the scheme the said Authority is of the opinion that it is necessary to initiate the procedure under section 37(1B) of the said Act to modify the said Planning Proposal to "Residential Zone along with 9 mtr. road adjacent to Vakola Nalla'' (hereinafter referred to as " the said Modification") as shown on plan.

Now therefore, in accordance with the provisions contained in sub-section (1B) of section 37 of the said Act, the said Authority hereby publishes this notice for inviting suggestions and/or objections in respect of the proposed, modification described in the schedule herein below, from the general public within 1 (one) month from the date of publication of the notice in the Maharashtra Government Gazette. The suggestion and/or objections shall be addressed to the Chief Executive Officer, Slum Rehabilitation Authority, Third Floor, Administrative Building, Prof. Anant Kanekar Marg, Bandra (E.), Mumbai 400 051. The suggestions and/or objections received within the aforesaid stipulated period shall only be considered by the said Authority ;

SCHEDULE

" The lands bearing S.No. 341, CTS No. 629 (pt.) of Village Bandra, Taluka Andheri Ward 'H/E' in Mumbai Suburban having approximate area of 66483 sq.m occupied by Censused slum of 'Proposed Sant Dnyaneshwar Nagar SRA CHS and other SRA CHS' situated in F Block of Bandra Kurla Complex which is shown as 'Area to be kept unreclaimed' and '15 M Wooded Area' in the planning proposal is proposed to be deleted and included in 'Residential Zone along with 9 mtr. road adjacent to Vakola Nalla'

2. A copy of the part plan showing proposed modification shall be kept open for inspection by the general public in the following offices for the period of one month :—
